1) Since it is now deemed a tax, it only requires a majority in both Houses of Congress to repeal it. With the prospects of Republicans taking the Senate very high this November, and it being unlikely the Republicans will lose their large majority in the House, it is clear that Congress can repeal this "tax" quite easily, if it has the will. It will require 2/3 vote of the Senate plus a majority of the House to override a Presidential veto, unlikely if 0bama is re-elected.
