In some jurisdictions, the woman could face arrest because she shot without first warning the invader. Further, she and her family could be sued by the invader. In Massahcusetts, for example, criminals who were shot have successfully sued their victims into financial ruin even if the victims were not charged with a criminal offense. Move to Texas, people.

Most states have a castle doctrine or even a castle LAW to shield the homeowner from criminal and civil liability if the threat turns out to be real.

In my state if someone breaks into your house you do not have to retreat. It irks me to think that some people think yiou should give the poor intruder the benefit of doubt. In the first place you cant read his mind, so you dont know whether he is after your possesions or your life. I stand between my family and danger armed and ready to dispatch any intruder and then go back to bed and get a good nights sleep knowing that I did what I was supposed to and protected my family.

It should be considered implied if someone uses enough force to break into the house then they have the capacity to harm a person - ergo - equal force can be used.
