No newly enacted law goes before SCOTUS to be vetted before it becomes active law,a test case has to come up through the appeals courts,from a person having legal "standing".(the arrestee)
Cite me ONE law enacted by Congress that was nullified by SCOTUS -BEFORE- it went into effect.
