I don't know why this is complicated. The people of Massachoochoo wanted Romneycare and it is within the realm of an individual state to request it. There is no authority for the feds to do so. It's as simple as that. Romney's approach ought to be to critics on the left that the people of Mass wanted it: go ask them or stop insinuating that they are stupid. He should get in the face of the morons in the media and ask them "are you telling the people of Massachusetts that they are stupid?" That'll fix it. Critics on the right should just shut up.
It's always been a challenge for Mitt Romney to explain the differences between Romneycare and Obamacare. The two programs share a lot of the same features -- mandate, penalties, subsidies, exchanges and others. Romney has consistently argued that those provisions are acceptable, even good, at the state level, but not acceptable, and in some cases not even constitutional, at the federal level.
