If Supreme Court Justices were nominated and confirmed solely on the basis of interpreting the Constitution as written instead of promoting an ideology of any stripe, this would not be a problem. It might not comport with any President’s view of a particular piece of legislation, but it would be in line with the intent of the Founding Fathers. At present, four of the sitting Justices seem to believe in personal interpretation of the Constitution and if there was one more, Obama would have no problem with their rulings on what Congress has the power to do. Secondarily, Congress could have prevented this entire issue had they not passed legislation without knowing what was in it, but perhaps, that was their intent.
