That is the point, there is no decision. There is a living human being that survived abortion. The Dr must render care or face negligence charges. If care is withheld because the mother does not want the child, that is murder. Her response is ludicrous.
Unless her decision is to deny care of a living child that could save the child's life. Might take a court order over her objections, but wow. This situation could be perilous for mother and Dr if no care given and child dies from neglect. But who goes to court to protect the infant?
A child under 20 weeks would not be born breathing on it's own and alive unless dates were wrong and the baby was further along. However, with the advances made every year in perinatology the survival age of babies born will decrease. The youngest I am aware of is 25 weeks gestation, but been years since I worked in high risk unit of L&D.

They are referencing babies born alive after abortion, not necessarily those 21 weeks or less. Gestational dates are a guess based on averages, and often off by 2 weeks either way. Life support leading to a viable human being should be denied, really? No one is advocating no lunches for poor children, what are you talking about?
Her mistake was in stating the mother has a choice at that point. The Dr has no choice other than to administer aid. The Dr would face charges of neglect if he/ she failed to assist an infant born alive. As you state, there are laws against infanticide. The state has every right to determine whether murder charges apply....
But it would not be up to the mother. If a child is born alive after an abortive attempt and no care is given to that child, the Dr would be subject to negligence charges and mal practice.
No. If the child is born alive after an abortive procedure, the Dr would be obligated to render care. If he/she did not it would be murder by negligence.
Perhaps it is a result of the fact that a child born alive after an attempted abortion, is just that, alive. So, are you suggesting that the mother has a choice whether or not to murder her living child?
