Yep, a very rational argument. However, it was decided by the much more traditional method of "might makes right." Before the CW, all the states thought they had the right to secede. South Carolina and Massachusetts had both threatened previously to do so. And the unfortunate by-product of the CW was that that 10th Amendment of which you speak ceased to be enforceable.

The idea of Texas seceding from the Union is a long time joke, but a secession petition on has received enough signatures to be seriously reviewed by the White House.


This isn't quite the equivalent of the Declaration of Independence, but in the digital age, you could say it's similar.
