The Breyer Patch

I agree with the points in your article, of course, but thought that you missed one very important one. The second Breyer quote begins: "In my view...." Unless this is standard wording for judges, in their opinions, No judge, let alone one of the highest judges, should even mention his opinion, let alone base his legal decision on it: he is to base his decision/dissent on the law, of which the Constitution is the highest in the land. Little of the Constitution should require much interpretation, certainly not the second amendment.
