Lest you forget it takes Congress to remove that barrier. And the Senate in June 2001 went to the Dems when Jim Jeffords (VT) switched parties. And guess what? The Senate filibustered dozens of high level appointments Bush made in DOJ, FBI, and DOD. Most of those high level appointments didn't even take their places until July 2001 or later. Please, either learn current history (ie who ran the Senate) or find your bottle of Night Train and return to your mom's basement.
