This is not actually true. The ruling in Loving V Virginia specifically indicated that violations of human rights occur even when the violations are spread out equally. In that case, the argument that there was no discrmination becuae while black couldn't marry whites, neitehr could white marry blacks, so everyone was equal. This reasoning, i.e. your reasoning, was rejected by SCOTUS. IN general, the concept of separate but equal rights was tossed out even before Loving.
