The truth of the matter is that Roberts is on mind altering medication to prevent seizures which he suffers from. This is a fact verified by the New York Times. The medication has obviously affected his thinking because his reasoning on the law makes no sense. Failure to purchase health coverage results in a fine. Not a tax. Just like any other leftist he has mangled our vocabulary to create new meanings of commonly understood words.

Over at HughHewitt.com I have ventured the opinion that perhaps --just perhaps-- originalists will eventually recognize Chief Justice Robert's decision and opinion yesterday as a bit of judicial genius that will be his Marbury v. Madison --the case that at first glance seemed a win for an executive whom the then Chief Justice opposed but which was in reality a huge win for the Court and the original design of the Constitution.
