It is used so that those who follow, will know that the unalienable rights described therein are not given by man to mankind; and can not therefore be taken by man from mankind. The axiom "fruit of the poisoned tree" is apropos. That fruit is of course the requirement to particpate or suffer financial penalty, HIs honor's description of the failure to comply as a misuse of the commerce clause in that it regulates "incativity" is sound, I am confident that the Supreme Court will see it this way, and that in the interrim, the house leadership will see that no part of it is funded.
