Executive orders are orders to the agencies that exist based on the laws legally passed by our bicameral Congress. Let's assume Obama writes an "order" banning private transfers. If I then sell my neighbor a pistol and am arrested by the BATFE, what LAW would I be charged under? Since no law exists, I cannot legally be arrested. Unless Obama suspends habeus corpus, of course.

Executive orders become "law" if congress does not overturn the order within 45 days from the date the order was issued.

Actually, he doesn't even have the authority to suspend habeas corpus. Congress can suspend it in time of rebellion, but the President can't. Abraham Lincoln defied the Constitution in that area.
