The real question is does the Supreme Court have to obey the Constitution or does the Constitution have to change every time a majority of 5 change their mind. Publius Huldah, a retired lawyer and Constitutional expert, lays out the true meaning of the Commerce clause. She documents what the founders meant when they wrote the Constitution and has several articles on the commerce clause.
