Terrorists are NOT entitled to be afforded the rights under the Geneva Convention. The Geneva Convention applies ONLY to military personnel who wear the uniform and operate under the military rules and regulations of a nation. Terrorists' activities also cannot be classified as a "crime". Their activities are acts of war and they should be prosecuted under a Military Tribunal, as they were during WW2. However, the Obama Administration, with Eric Holder as the prime banner waver, continues to insist that the terrorists should be tried in criminal court.
