This was a horrible misuse of the federal bankruptcy code. Under laws that exist in all states, a manufacturer must show that a dealker has broken the dealer agreement before they can cancel a dealership. No justifiable cause was needed by utilizing the BK Code. If a dealer is cancelled or chooses to end the dealer relationship, under state laws, the manufacturer is obligated to buy back the inventory. This means both the new cars and the parts inventory. The cars must ve bought back at invoice and the parts at 95% of current wholesale price. By having GM and Chrysler go BK, the government was able to void these very important state laws.
