the right of the citizens to keep and bear arms shall not be infringed. the constitution does not qualify that statement. do not forget, it is NOT A MILITIA if a duly constituted government orders it. militias by their very nature cannot exist under the control of a duly constituted government. militias by their very nature must be directly controlled by citizens who do not officially represent a duly constituted government.

The militia is defined in the U.S. Code, Title 10, Section 311. It's pretty much everybody.

government (FEDGOV) organizes,arms and equips ARMIES(the Regular military),but cities,towns,and states cannot have armies,so they organize militias.
Militias belong to the state until they are Federalized and then they act as a reserve component of the Regular military.
some militias are armed by the State,but some must supply their own arms.
the Second Amendment exists to protect the citizenry's ability to form militias,since one cannot form a militia without arms. the 2nd restricts government from disarming people.

Last week I gave you a look at Senator Diane Feinstein's semi-automatic weapon ban legislation, which includings new restrictions on semi-automatic rifles, handguns and shotguns. The legislation is expected to be introduced today when the 113th Congress begins.

“On the first day of the new Congress, I intend to introduce a bill stopping the sale, transfer, importation and manufacturing of assault weapons as well as large ammunition magazines, strips and drums that hold more than 10 rounds.”
