First fallacy. The United States is not at war. To be at war requires a formal declaration by Congress. The nonsense spewed about our being legally at war if Congress doesn't overturn Presidential military action is just that, a total travesty. Second fallacy. Secret tribunals, star chambers, secret criteria, and secret decisions to execute are not due process. However, a grand jury that comes back with a ruling that the suspect probably has committed a triable felony of violence and is a fugitive from justice is justification for a dead or alive apprehension.

Third fallacy. That the Constitution doesn't apply to terrorists or outside the United States. The U.S. Constitution applies to everyone on U.S. soil, and applies to all U.S. Citizens interaction with our government regardless of where they are.

Any violation of the Constitution by a President should automatically result in impeachment proceedings.
