Discriminatory laws, even when democratically decided, are not authorized by the Constitution. It is why practices like miscegenation and forced circumcision are not the law in any state. That's why this will have to go to the courts now.

That is generalized nonsense least states be forced to have co-ed restrooms, people be required to equally patronize competing businesses not to mention retracting the right to base your vote on which candidate your discriminating judgement consider the best.

North Carolina voters, an important election 2012 swing state demographic, have approved a constitutional amendment that bans gay marriage and defines marriage as between one man and one woman. The amendment also bans civil unions. More from the National Journal:
