Protecting the Image

Liberals often chide that it's not socialism unless government takes ownership of the means of production and abolishes private property ... when they debate the US is not turning socialist. Back in 1938, in US vs Carolene Products, FDRs new liberal majority in the Supreme Court ruled that the federal government could legislate anything it wished, essentially repealing the 9th Amendment without any need to actually write, pass, ratify it (too much work, when you can simply interpret the constitution to mean differently than it says).
