Only about a decade before this awful amendment, the Supreme Court had ruled that taxes on income violated the "just compensation" clause of the 5th Amendment. That was never overturned, nor did any judge publish an injunction against this law.based on the court ruling. And, no, this is not an example of "judicial activism" ( a la Roe v. Wade, Lawrence vs. Texas, etc.) as the Supreme court cited an actual clause, and one which LIMITS government power.

Today is the 100th birthday of the income tax. On February 3, 1913 the 16th amendment was ratified, which enabled the establishment of the federal income tax. This is ever in our mind as tax season is now upon us.
