The "Constitutionality" of Obama's power grabs will be ultimately scritinized by the Supreme Court. That Supreme Court will be overstocked with leftists when Obama fills the vacancies that open in his second term. Obama will get what he wants, if not through Congress than absolutely through the Supreme Court. Fundamentally transforming America will be made that much more easy with a lapdog Supreme Court in the tank for Obama and other leftists to follow.

There must be justiciable action and standing to sue. A president grabbing power is not in the hands of the Court. Rather, it would be up to Congress to stymie the overreach of a president. And, as well as we know dingy Harry, that ain't gonna happen. In Harry's Senate, Obama could declare himself dictator for life and the Senate would approve.

The Republicans offered a plan -- in writing -- to avoid the "fiscal cliff." It includes $800 billion in revenue increases, which demonstrates the GOP's reluctant assent to increasing the tax burdens on Americans.  The White House has rejected the proposal out of hand.

The sheer audacity of the President's last proposal shows that Obama sees this as the opening salvos of 2014.  Republicans need to do a better job explaining their position in a way that will allow them to make a strong case for themselves (and for electing more of them) in 2014.
