If she had been approached by an American lawyer she would be suing in American court. But the case hinges upon Brazilian law which is contrary to ours. If he loses, all he has to do is refuse to pay (and never go back to Brazil).

The real reason for this suit is that his comments have made people realize that the Brazilian air system is poor. And Brazil doesn't want that broadcast as it might cut tourism to the country. After all, do YOU want to risk your life by going there because their system is so bad? In the most recent assault, a Brazilian widow is suing an American reporter in a Brazilian court for allegedly defaming the entire nation of Brazil. She claims Joseph M. Sharkey, a New Jersey - based freelance travel columnist for the New York Times, offended the "dignity" of Brazil by criticizing its incompetent air-traffic control on his blog. Moreover, she claims that under Brazilian law, an "insult" to Brazil is also a personal insult to her as a Brazilian citizen.
