On the Perry v. Schwarzenegger ruling, I hate to break this to most of you, but the odds of a 5-4 upholding the decision are high. The last time the Court decided a gay rights case, Romer v. Evans, Kennedy wrote the decision striking down an amendment to the Colorado Constitution that prevented protected status under the law for homosexuals or bisexuals because it was not rationally related to a legitimate state interest.

We live in a world of imperfect and costly information, and people seek to economize on information costs in a variety of ways. If we don't take that fact into account, we risk misidentifying and confusing one type of human behavior with another. Let's look at it.
