PM Obamacare pinned its constitutionality on the Commerce Clause. No case law exists that supports the notion that the Commerce Clause can regulate INactivity. While it is true that Congress has greater leeway in its taxing powers than it does under the Commerce Clause, failure to purchase health insurance would be penalised not taxed. Such a penalty is unconstitutional. I.R.C. § 5000A – the Health Care Act penalty – is an unapportioned capitation tax, violative of U.S. Constitution Article I, Section 9. The "penalty" is – at least on its face – a tax. To be a constitutional tax, it must be an excise tax, an income tax, or a proportional capitation tax. The penalty is none of these. Glenn Beck's 8/28 rally delivered a swift kick in the rear to anyone who claims he or the conservative grassroots movement is irrelevant or idle.
