NEW YORK (AP) — An alleged New York City mobster is trying to beat a murder rap by claiming he quit the Gambino crime family — the same legal strategy as John "Junior" Gotti.Four cases against the son of notorious Gambino mob boss John Gotti ended with hung juries during the 2000s. His lawyers said he had left organized crime for good years earlier.A lawyer for John Burke said Tuesday in opening statements at Burke's federal trial that his client grew disenchanted with the Gambinos and quit in 2003.Prosecutors allege that the 51-year-old Burke was part of a racketeering conspiracy that began in 1980 and lasted until at least 2008. The conspiracy included three slayings.
