Amendment: in the case of US citizenship conferred by parent, there is also a minimum time requirement for naturalised US citizens (such as myself, 2005/04/25)to have lived in US post-naturalisation to confer such citizenship to a child born outside US. As example, had I fathered a child born 2005/04/26 in Doncaster, that child would automatically have British (as mum would have most-likely been a Brit) and Canadian (through myself, as I had not yet renounced Canadian citizenship) citizenships but would NOT be triple-citizen (because US citizenship would NOT be conferred, as I had not met the minimum...

One reason he was a good choice in 2008 is that he made Mr. Obama look mature, calm and collected in contrast, which was badly needed. He's a known quantity and unlikely to need that in 2012.

Actually, for one USC parent and child born outside US, it is not quite that simple (unlike Canada since 1977 (a)), due to existence of minimum amount of time that the USC parent must have resided in the US after a certain age (b) (residence in US prior to that age is not counted).

It may help to clarify ("Let me be clear") the issue of natural-born citizenship vs. citizenship in general by referring to what the Founders wrote and what they actually meant when it was written into the Constitution. I forget the exact references, but several of them defined Natural-born to mean that both parents would have to be citizens, and this definition, this tradition, went way back to Greek and Roman times.

Don, what you say is half true. Until a change was made, just before Clinton took office, one parent being American required that the American parent had lived in the US for five (5) years between the ages of 14 and 28. This happened to me and my second son 30 year ago. Those that filled this requirement were given "natural born Americans" status. This has since been changed. I lived overseas most of my life and married a foreigner overseas, so this is first hand knowledge. Obama would have been born during that time. So, in summary, it depends on (1) if his mother filled the 5 yrs 14-28 requirement and (2) if she registered him with the U.S. Embassy in Kenya.

I not sure what the Constitutional procedures would be, either, to replace a president who it turned out was not eligible to have been president in the first place.

My own personal feeling is that the Supreme Court would treat it as effectively being the same thing as if a vacancy in the Oval Office was created by the president dying during his term - and therefore subject to the succession procedures established in the Constitution to handle such a contingency.

You may well be right about the need for a new presidential election if enough doubt arose on Obama's eligibility to be president such that his continuance as POTUS was untenable.

My belief is, even if Biden or, heaven forbid, Pelosi succeeded Obama in the Oval Office before the next REGULARLY SCHEDULED presidential election if Obama had to vacate the White House, such an administration would effectively be paralyzed. Look at how the blue-dog Democrats have shot Obama down on such issues as card-check, cap and trade, and (for now, it appears) health care. Do you think that with Biden or Pelosi in the White House under the circumstances of their accession, these blue dogs would be any more inclined to cooperate with a President...

Just one minor point, you don't have to be born on a "military base or US Embassy/Consular properties," only have to have one parent that is a US citizen. I think this is a common misunderstanding until you have to deal with it first-hand. When I took my daughter to register her birth with the embassy, her status as a "natural born citizen" was the first question I asked, and that was in 2003. My daughter was born 600 miles from the embassy in Moscow.

I confess that I was unclear in my wording about what the real eligibility issue is with Obama: after all, John McCain was born in the Panama Canal Zone, and by 2008, there was no issue about HIS eligibility to be POTUS. No one questions whether Americans born to a U.S. citizen on American military bases or U.S. embassy/consular properties outside the 50 United States meet the Constitution's POTUS eligibility requirements.

In my posts on this issue, I was basically assuming that the issue of Obama's birth/citizenship was such that he did not CLEARLY meet the Constitution's eligibility to be president on the basis of nativity or citizenship. Sorry if my posts were vague on that point.

All things considered the biggest problem with Biden is that he sometimes speaks the truth. This is his biggest failing because the truth has to be spun. Lies do not.

I am not so sure that a new election would not have to be held. I have wondered about this and my thought is that since the election would be declared a fraud, then there is no way that all of the people who came with Obama, or were subsequently appointed by him, could legally remain in office as their appointments were made by someone who obtained the office fraudulently. I am not sure that the Constitution addresses this situation, as I don't think it was ever anticipated that a fraud of such scope could be perpetrated on the American people. It may well have been. I would think that, just as would happen should the Speaker of the House be raised to the presidency as a result of a succession crises, that a new election would have...

About where Obama was born. The problem is that even if he was born outside of the US, as long as one of his parents is a US citizen, he would be considered a "natural born [US] citizen." The natural born citizen argument has to do with whether or not you aquired your citizenship through birth rather than obtaining it through application. I asked this question when I went to register my daughter's birth with the US Embassy in Moscow (she was born in Russia). The embassy personnel assured me that as long as one parent is a US citizen, the child is considered a "natural born US citizen," no matter where they are born. It even says this on the "Consular Report of Birth Abroad of a Citizen of the United States of America."

I actually did interpret your oblique reference to Ford to indicate that you also didn't believe that even if Obama's eligibility to be president was credibility impugned sufficiently to make his continuance as president untenable, that the Supreme Court would void the 2008 presidential election and order a new presidential election prior to the next scheduled one.

We're both agreed on that, that the Constitution has clear succession procedures in place that even the forced vacation of a proven-to-be-ineligible president isn't already satisfactory provided for; the vice-president simply accedes to the presidency.

I think Bill Kristol's idea that Biden may not be on Obama's ticket in 2012 (assuming there IS an Obama ticket in 2012) is actually quite realistic.

Biden right now is looking more and more like the second coming of Henry Wallace, FDR's running mate in 1940. By 1944, Wallace had managed to disingratiate himself with enough Democrats that he was dropped from the ticket. I've got to believe that privately, Obama must get getting more and more ticked off with Biden and his never-ending gaffes. I find it VERY plausible to believe that by 2012, Obama will have had all he can take of Biden - and will probably tell him privately that he wants him to step off the ticket, and if so, Biden would oblige and announce that he was stepping...

Combine the fact of there actually being a precedent for a not-validly-elected VPOTUS to succeed a POTUS unfit to continue in the office (edit: for the actual historical record of Jerry Ford, delete "validly", and also add that Nixon RESIGNED on-own before being found unfit) and with the desire (on 0bama's part) to be able to continue as POTUS due to intimidating opponents with possibility of even-worse VPOTUS succeeding (also historical precedent for this--why Senate would not confirm Clinton impeachment in 1998) and you have the reason Bidet-on-tap was chosen as VPOTUS.
