Back when I was on the receiving end of racial discrimination, it was to me not simply a personal misfortune, or even the misfortune of a race, it was a moral outrage. But not everyone who went through such an experience sees it that way.

When it comes to subjecting other people to the same treatment in a later era, some have no real problem with that. They see it as pay-back.

One of the many problems of the pay-back approach is that many of the people who most deserve retribution are no longer alive. You can take symbolic revenge on people who look like them but this removes the whole moral element. If it is all right to discriminate today against individuals who have done you no harm, then why was it wrong to discriminate against you in the past?

These are not just abstract questions. These are serious, real world questions, especially when considering someone to be given a lifetime appointment to the Supreme Court of the United States.

Some judicial nominees have had racial bias attributed to them, despite their years of unwavering support of civil rights for all-- Judge Robert Bork and Judge Charles Pickering being striking examples. But the current Supreme Court nominee is the first in decades to explicitly introduce racial differences in their own words, along with the claim that their own racial or ethnic background makes them better qualified.

Attempts to claim that Judge Sonia Sotomayor's words were isolated remarks-- a slip of the tongue "taken out of context"-- have now been discredited by further information showing that she has repeatedly expressed the same ideas, in virtually the same words, at other times and in other contexts.

Moreover, her deeds-- including years of participation in group identity politics-- are perfectly consistent with her words. So too was her vote on the 2nd Circuit Court of Appeals to summarily dismiss the appeal of white firefighters who did not get the promotions they had earned by passing a required test, because not enough minority firefighters passed to provide racial "diversity."

The Supreme Court of the United States found that appeal worth hearing, even if Judge Sotomayor did not.

The warm and genial image of Sonia Sotomayor presented on television, during President Obama's introduction and afterwards, is in sharp contrast with what attorneys who have appeared before her in court have said.

A poll of such attorneys showed them rating her worse than other judges in her treatment of those who appeared before her. A tape of Judge Sotomayor's abusive behavior in court backed up the attorneys' picture. It is also consistent with someone in pay-back mode.

A confirmation decision on a Supreme Court nominee is not like deciding whether someone is innocent or guilty of a crime. It is right in criminal cases that the burden of proof is on those making an accusation, and that the accusation be proved "beyond a reasonable doubt."

Judge Sotomayor is not in jeopardy of either criminal or civil penalties. So there is no reason why either the criminal standard or proof "beyond a reasonable doubt" or the civil standard of "the preponderance of evidence" is required for determining whether she is the right person to be given a lifetime appointment to the highest court of the land.

It is hundreds of millions of Americans-- current and future-- whose fundamental rights are at stake whenever any nominee is being considered for the Supreme Court of the United States. It is the American people as a whole who are entitled to the benefit of the doubt.

One of those fundamental rights was taken away just four years ago, when a 5 to 4 decision by the Supreme Court gave local politicians the right to seize your home or business and turn the property over to some other private party that they favor. Just one vote on the Supreme Court can make a huge difference.

We have been told endlessly about Sonia Sotomayor's biography and her symbolism as a Hispanic woman. Is that enough to risk millions of other Americans' fundamental rights?

Dr. Sowell once more reduces what some people see as a murky issue to a couple of basic elements that need to be the focus. A person with a revenge mentality, based on wrongs done in the past by people often no longer alive, is hardly one who can dispassionately apply the Constitution in any legal dispute.

I quote Gandhi only rarely, but in this case, I think it's appropriate: "An eye for an eye makes the whole world blind." And blindness, in the matter of the Supreme Court, is of two kinds. It's right to be blind to persons and groups; it's wrong to be blind to the Constitution. Regardless of all the rhetoric obscuring the real nature of this appointment, I think this appointment is a mistake because the candidate appears more than ready to interpret the law through a lens of identity politics while blinding herself to the Constitution.

As usual. Sowell rarely, if ever, disappoints. Wish he were President.

Superb as usual. Although I would like to add one point in regards to your “payback” comments. It’s usually worse than you even stated...not only are the regular “targets” of the so-called payback completely innocent, but those performing the “payback” are normally not even a “victim” of the initial offense.

Liberal "Victim": “I think it’s somewhat possible that someone who looks like you may have at one time or another done something wrong to someone who possibly looked like me, therefore I am now entitled to harm you in any way I feel appropriate...and as often as I like.”

Not mentioned often enough
The city that administered the test, didn't just create the test on their own. They didn't want there to be any racial questions about that test, so they contacted the U.S. Justice dept for help. And the Justice Dept, told them about companies that could design such a non-racial test. So they got a test that wasn't racially biased. And that wasn't good enough for soto. It looks like she doesn't care what anyone's qualifications are, just what color their skin is.

Dr. Sowell Is Right, As Usual
What you have written is very true. All too often, we address our grievances by striking out at the wrong people. My ancestors owned slaves, but that was a century and a half ago. I was raised that all men and women were born equal, and my parents made sure I understood that from the very beginning. Never once did I ever hear one of my parents make a racist remark. In the first place, having been born naked, without black robes on, I never considered it my right to "judge" anyone. The Liberal faction of my Party, has changed my outlook, however, for I find myself passing judgement on their motives, their actions and their statements. They are so filled with hate and venom that they are turning our nation into warring camps and I am tired of it, aren't you? Notice how they harp on right wing fanatics? Talk about the pot calling the skillet black. David Letterman is a classic example of pushing the line too far in condemnation of your fellow man. Having been a registered Democrat for fifty-four years, but always a Conservative, I will say what I please about my "fellow" Democrats! I didn't make the rules but I will use them just the way the Liberals do. All's fair in love and war and eight years of Bush bashing was over the top. We are supposed to support our President. Now, we are supposed to support a mystery person and know little or nothing about him. I will support him when he proves he has earned that support, legally and professionally. At least President Bush met all of the legal requirements and we all knew where he was born, and to whom. Are you ready, Liberals, attack me for a change and leave Dr. Sowell alone. If anyone is inferior, it is because they show themselves to be that way in the stupid things they say and do.

The history of the world is on of wars, conquering, enslaving:
Romans, Gauls, Mongols, Moors, Vikings, Saxons, Normans, Germans, French, Spanish - that doesn't even begin to cover the damage done by humans to each other. Nor does any river outlast the tears of the vanquished.

In the sixteenth and seventeenth century, Europeans fled to this New World in the hope of a just country. Our constitution is their map, their dream of free men for a free country.

As humans have done from the beginning of time, they managed to mess things up with slavery, but whether you want to or not, one has to judge them from the standards of their time. Today, we would be much more culpable because our conscience and moral knowledge is more advanced.

That is not to say they were not wrong, but perhaps in moral weight, the more recent mistreatment is worse.

But we have looked at the damage and we try to
make a more civilized, better world.

Injured people can always clasp the injuries close, but the hatred eats the hater as much as the hated.

Revenge makes more revenge - look at the Near East, Northern Ireland.

Our constitution is the greatest gift made yet to a suffering world. We must not let it be
torn apart to please someone who feels to be an underdog and wants to be top dog.

As history shows - top dogs can stand on flimsy
pedestals.

Our constitution is precious. It contains the seed of a better world, just as it has until now, produced the best country, even if it is not perfect.

I would like to offer my condolences to you for the abuse that is heaped upon you by the likes of Miles, Reply #6. This is typical of the vileness that the Left seems to think is acceptable when speaking to, or about us. It permeates their side and has reached the point of mob mentality blood lust, a form of hysteria that can never end well. Give it to her. Let her see what it's like to be a white man accused of racism and sexism, which is precisely what would have happened to a white man who said what she said.

And to the "out of context" crowd, please tell me in what context, aside from quoting someone else to prove they are an idiot, is the following statement good?

"Justice O'Connor has often been cited as saying that a wise old man and wise old woman will reach the same conclusion in deciding cases. … I am … not so sure that I agree with the statement. … I would hope that a wise [Insert race of speaker here] [insert sex of speaker here] with the richness of [his/her] experiences would more often than not reach a better conclusion than a [insert any other race here] [insert the opposite sex here] who hasn't lived that life."

For effect, you can even insert things like Christian, gay, straight, muslim, jewish, Catholic, protestant, Mormon, atheist, theist, secularist, religionist, liberal, conservative, Darwinist, Creationist, etc. instead of or in addition to race and sex. None of it improves the statement.

We must fight for our Constitution against those who want to change it. This is very good example of what we must fight to save the future of our country. Have felt for many years, the racial division in this country is more of political manufacture than a systemic problem. If politicians and "community leaders" can reinforce victimhood and grievance, they cement their power base... promising to fight the alleged oppressor, and crush the aggressor, if the victims just vote for them, or join their "movement" and either volunteer or DONATE.

Darnit! I'm a 60 year old Texan! I saw the REAL discrimination when I was a kid. Separate accomodations, segregated schools, etc. Sweeping change for the better has occurred! Speaks volumes about the fundamental goodness.... no, greatness of this country.

Somewhere along the line, the noble goal of equal opportunity transitioned into equal outcome. Not at all what Dr. King had in mind. He believed in the ability of each individual to accomplish whatever goal his abilities and initiative could earn. To realize "the dream", regardless of ethnicity.

Identity politics disrespects individuals... If a "leader" can persuede an individual to buy into a "label"... convince them walk in lock step, the leader derives power to implement his own agenda... it is manipulation and exploitation... more subtle, but equally as sinister as the unconscionable racism of the past.

History is what it is. Critically important to study the past, learn from it... equally important to pay attention to the present, and listen carefully and critically to the words and actions of those who hold, or aspire to, positions of power. Look carefully at the agenda, and make informed decisions.

What's required of a Supreme Court Justice is OBJECTIVITY, and adherence to the Constitution. Am not convinced that Judge Sotomeyer can "check" her personal biases at the door, and base her decisions on law, not "empathy", ethnicity, or gender.

We conquered the institutional racism of the past and are now substituting the exact same thing in reverse with the nomination of sotomayor. The woman has no place on any court no less the Supreme Court.

If the words of DR King were followed and we were all judged by the "content of our character" rather than allowing these pols and race hustlers to hold sway, this country would be a damnsight better off. It IS a better place simply by virtue of having men like Dr Sowell to listen to and emulate.

I still can't figure out what a racially-biased test is. Knowledge is knowledge isnt' it? Did the SAT, ACT, MCAT, etc. all get reconfigured for purposes of bias???

And if a group goes the extra mile to ensure that a test is not "racially biased", then how is the result thrown out??? What more could they have done???

What if we take the same logic that S.S. uses and apply that to ALL facets of modern society....

Sorry, no minorities in Kentucky scored 1200 or better on the SAT, therefore all KY SAT scores will be thrown out.

Sowell's Experience
A couple of Sundays ago there was a long article in the New York Times comparing how Sowell and Sotomayor reacted to being the object of prejudice. Both came from a humble background, both were smart, and both got into good schools on Affirmative Action preferences. Both then were assumed (for example, by prospective employers) to be stupid because of that history. Sowell's reaction was narcissistic wound, and he has spent the rest of his life vengefully trying to destroy the program that helped him get where he is today.

Your explanation of duties is what was INTENDED by the Constitution and Bill of Rights -- protecting the Rights of the People from 'government'. However, when Congress did not step in and correct the potential for black-robed tyranny or despotism that were apparent in the 1803 Marbury v. Madison decsion, it was expected that sooner or later there would be a politicizing of the Federal Court system and especially, the Supreme Court. Thomas Jefferson warned of this in 1816 or earlier, and others have warned us since.

The most obvious warning should have been the Supreme Court 'packing' proposal by FDR in 1938. The potential for 'packing' exists today greater than at any time in our Nation's history.

Dr. Sowell and others have numerous good reasons to speak out against this nominee, and especially be fearful of this Congress Mr. Obama.

Unless you are fluently bilingual and have wide knowledge of Hispanic culture, you appear to have assumed that the word "raza" has the same meaning in Spanish and English. It doesn't mean just "race" as black or white does in English, but has a wider meaning, referring also to simply "being Hispanic". It's the name of a Spanish-language newspaper in Chicago that is mostly advertising but has a few articles of use to the Hispanic community, like about avoiding poorly-qualified dentists who rip people off for large sums of money.

I heard of a man who, staying in a hotel in Mexico, went to take a shower and found he had no soap in his bathroom. So, assuming that English words and Spanish words aren't all that different, he called the desk and ordered "sopa". A waiter soon brought him a tureen of soup. Don't make assumptions in language.

Judge Sotomayor is not fit...
to be a Supreme Court Justice. Her racial predjudice is as obvious as the nose on her face. She claims being a hispanic female makes her a better judge. That is racial and sexual bias. A judge calls balls and stikes, but does not decide the size of the strike zone. A boxing referee decides if a blow during a fight is illegal or not according to the rules, not what he "thinks" ought to be legal. A court judge rules based on what the law says, not what they think it ought to say. Sotomayor rules by what she feels, not by rule of law. She will even rule based on racial make-up, sexual orientation or financial status. That is not unbiased "blind" justice. Her bias is wrong, and cannot be tolerated in the highest court of the land.

The problem with yoour story is that "raza" DOES mean race. Your criticism is at least as invalid as someone who criticizes a person saying "Grin and bear it" by saying "a bear is a large woodland creature" and really more so. Because your further definition only supports the criticism. The person was pointing out that the group she joined was a Hispanic supremacist group that called itself "THE race" Then you say, Oh well, that is referring to being hispanic, which only supports the OP's point.

Affirmative action started in 1972
with Title IX of the Civil Rights Act, although some sources claim AC started with Lincoln and freeing the slaves, the first actual words in law start in 1972.

Ergo, people entering society in education and employment prior to 1972 were not directly affected or covered by affirmative action.

Dr. Sowell is my generation and never had any of his activities influenced by AF, unlike Sonya Sotomayor who has admitted publicly that her grades and experience were always inferior to her performance and her *success* is virtually entirely based on the idiot assumption that she makes about anyone from a different category of race/ethnicity is somehow morally elevated over others of white European descent,

even though with *Spanish blood,* she is MERELY another white European by way o f Puerto Rico.

The fact that "La Raza" doesn't mean "just" the race doesn't deny the fact that it means race. Your definition of it as "hispanic" doesn't make it any better. The group La Raza is no different than the NAACP or the KKK. They are all organizations designed to promote their own race at the expense of others. Also your criticism of Dr. Sowell's stance on affirmative action is weak. Somebody might have benefited from his parents owning slaves, but they could still be opposed to it. I find it interesting when minorities excel because of their hard work, then insist that everyone else from a similar background need special entitlements to succeed.
Asians seem to succeed when they come to our country, even though many have nothing when they arrive here. Haven't you ever considered that it is the need to struggle that causes people to succeed. If I'm receiving just enough to get by what motivation is there to exert any more effort.

I'm a 62 year old white woman and have been morally upright in my treatment of non-whites all my life. I thought it was OK to raise my children in a mostly Latino neighborhood, but the progressive city council accused me of being a racist when I asked for protection from the foreign outlaw gang selling heroin on the streets of my neighborhood. It turns out the progressives wanted to threaten eminent domain for a landgrab for the big business that has them in his pocket and their trade-off of housing projects and non-profits for "ex" gangsters from Mexico in the US illegally.

Afirmative Action is FUN!

An American Treaure
Dr. Sowell is an American Treasure who clearly articulates the truth about the great issues of the day. Unfortunately, the vile comments of Miles reflect what the Liberal Left really thinks about people of color who have the testicular fortitude to state the truth. They want to keep the Black & Hispanics on the plantation and dependent on the government for nearly every need. Successful and intelligent minoroties are a threat to the Liberal Left and so must be belittled and atacked at every opportunity.

LaRaza ruined my High School
Corky Gonzales, leader of Crusade for Justice, (a faction of LaRaza) ruined West High School in Denver during the 60's and 70's by instigating violent protests and demonstrations by the Hispanic students and non-students. The result of their actions, which were touted as promoting improvements to graduation rates and reducing dropout rates among hispanics which were relatively low at the time, wreaked nothing but degradation to the entire student population. Today, teen pregnancy among hispanics is soaring, the drop out rate is skyrocketing and the graduation rate is among the lowest in the city of Denver. Test performance is always abysmal and declining, but their prescriptions for so-called improvements remain the same as back in the 70's. They promote their culture and encourage social promotions, but they don't promote "education" by encouraging more homework and more parental involvement. They continue to blame it on whitey and a lack of adequate funding. My white nephew earned a scholarship and graded extremely high on the SAT'S by working very hard for it, so the teaching is there to be taken advantage of. And, yes some hispanics perform exceptionally as well, but they are too few and too far between. The results of the actions of LaRaza are nothing short of criminal.

For all its flaws
the opinion in the Ricci case did hold--albeit without much, if any, discussion or citation to any controlling legal authority--that the circumstances at issue did not give rise to a Title VII violation. Ultimately, the SCOTUS may rule to the contrary, but until it does, it's really not fair to point to the case as an example of judicial bigotry on the part of Judge Sotomayor. In fact, she may have been doing nothing more than applying the law as currently written and interpreted.

The real problem with the case though, as Dr. Sowell points out, is that the Second Circuit should have conducted its own analysis instead of adopting wholesale the reasoning of the District Court. Had it done so, the opinion could be fairly scrutinized for its substance and correctness. In time though, the SCOTUS will enlighten us all.

The "any resonable person" clause in determining sexual harassment cases doesn't really take "gender" perspective into consideration, as much as it does morals. For example: a woman who slept her way to the top would probably be far more accepting of sexual harrassment than a religious man who was faithful to his wife (and no I'm not saying that's how Judge Sotomayor got to her current postion).
Judge Sotomayor's own history of denying opportunities to others based solely on race is reason enough to reject her as a supreme court justice regardless of any affiliation with a racist organization.

Unfortunately, the plan does not address the millions of people, who will lose their health insurance when their companies discontinue its healthcare benefits.

Same problem, but with a $1tn+ price tag.

I have enjoyed Dr. Sowell's works for years, primarily in the books that he has written. His works are not for the faint of heart liberal. His works are for those who wish to learn.

I first learned of Thomas Sowell through a column by Dr. Walter E. Williams many years ago (The 'E' may be important if you do a web search). I proudly display upon my wall a certificate of "Amnesty and Pardon" granted by Dr. Williams for my white, male, european sins against people that I did not know at a time when I was not alive. Somehow I know it must have been my fault.

One of the great things about Townhall is that I get to read the liberal viewpoint so eloquently expressed. Some have become my favorites though I shall not name them since that may suggest an excellence of eloquence in incoherent thought. Nice post! To your recommendations that liberals not read things that might upset the delicate balancing act they have to do, I would add C.S. Lewis's recommendation that young ATHEISTS cannot be too careful about their reading. If they venture too far into the exhilarating, dangerous waters of literature, philosophy, science, history, etc., they may find themselves having disturbing thoughts. So he recommends the daily papers as preventive medicine.

Books in general, unless they are best-selling romance novels, should be left alone. Even liberal books. Even atheist books. Remember, no one hates another person because of their race, color, creed, dress, shape, or job, etc. Those features are the identifiers, and once they are identified in one or more of those categories, the observer now remembers what they have read, or heard, or experienced from some one with that feature, and now if they love or hate, it is determined by what the observer remembers.

The biggest problem with SCOTUS
isn't the judges----- it is their ASSUMPTION of powers not granted to them. Show me where in the constitution the court can decide what is and is not Constitutional! Wake up Americans! You, in the petit and grand jury, have the RIGHT and the POWER to decide on the constitutionality of the law as well as the facts of the case. When a jury finds a law to be improper they have the right to jury nullification. Although this is done(rarely)today by unanamous "not guilty" verdicts it is the only way they can get it past a judge who will not advise them of this anciaent and cherished right. You owe it to your fellow citizens to be aware of this right as it is the only way, besides the voting booth, to tell lawmakers "hell no!"

Professor Sowell has now written a total of eight columns against the Sotomayor nomination, to near unanimous approval on this site. As one of the few dissenters here, I'm curious about what the Professor and most of you think you can accomplish.

Whatever happens to this nominee, the President will never choose anyone that Professor Sowell likes. Is there a possible nominee that he and you dislike less? Who is it, why do you consider him or her better, and why would the President go along?

Or do you hope that Republicans, aided by moderate Democrats, will block all of the President's nominees for as long as it takes to reclaim the presidency? Do you think your Senate allies could hold out that long?

What burns me so, is the constant wailing about "discrimination".

Someone needs to ask Sotomayor, why it is that in her parents' native land of Puerto Rico, that they discriminate so against the Blacks there. In fact, you could ask any of those in the Caribbean, Central and South America as to why it is that Black folks are not included in their mainstream societies.

The End Game
Mike. I think that the end game is to be on record as strenuously opposing the nomination of such a blatant judicial activist to such an important post. I have no doubt that this harpy will be confirmed. However, if there is enough of a stink raised about judges of her ilk, then the victory will be a Pyrrhic one, as they will, more than likely, not be able to nominate someone with her views again.

It also makes for good campaign fodder. Given time, the buyer's remorse with Obama & his minions will grow. Issues such as the appointment of this radical, along with the massive spending & the weakening of our economy DUE to said spending, will all make for countless rounds of ammo in the upcoming 2010 elections & the 2012 ones following them. We have a local election in my county today.It is called SPLOST...Special Purpose Local Option Sales Tax. It is to see if the one cent sales tax will continue another year. Our sales tax is seven percent.

When the South actually was more racist in the past, it is the churches that took the lead in promoting social change that would create more social justice. The slavery fight was chiefly a religious fight. Secular science of the time was thoroughly racist. Darwin wanted the Black races to be exterminated, for example.

However dark and difficult the age, if you saw a glimmer of light, it always was found in the church, not apart from it.

Republicans Can Stop Her
It is almost impossible to prevent her being seated on the court if the process gets to a vote a the full floor of the Senate.

However, according to Senate Rules, to get out of the Judiciary Committee, the nominee must receive at least one vote from the opposing party. If, and I know it is a huge if, Republicans are united and no one on the committee votes to allow her out of committee, she will not be seated.

Were they to show some guts and principle (for the first time in many years) they would be savaged by the media. It is most doubtful they are up to this kind of challenge.

The South is "most prejudiced" due to the simple fact that slavery got a foothold down there. Institutionalized racism against whites

It's perfectly politically correct to discriminate against white people these days.

I have been told that I can not even apply for certain jobs as they are "for minorities only". If I was to try and get some legal help in addressing this I would be laughed at and told to just apply somewhere else. This is the USA in 2009 and I don't see it getting any better under 0bama or under Sotomayor either. The new racists are in the driver's seat.

Racism against blacks was wrong. Racism against any other race is just as wrong.
