Words are not the only things that enable political rhetoric to magically transform reality. Numbers can be used just as creatively-- and many voters are even more gullible about statistics than they are about words, apparently because statistics seem more objective.

The latest Congressional crusade is to clamp down on small finance companies that provide "payday loans" and check-cashing services in many low-income neighborhoods where there are few banks.

A common practice in making small loans of a few hundred dollars for a few weeks is to charge about $15 per hundred dollars lent. Politicians, the media, community activists and miscellaneous other busybodies are able to transform these numbers into annual percentage charges of several hundred percent, thereby creating moral melodramas and demands that the government "do something" about such "abuses."

Of course, these loans are seldom borrowed for a year. They are often loans for a couple of weeks or less, to meet some difficulty of the moment by people who live from payday to payday, whether they are being paid by a job or are receiving checks from Social Security, unemployment compensation or welfare.

The alternative to getting a payday loan may be having the electricity cut off or not having money to buy some medication. It is worse to borrow from illegal loan sharks, who have their own methods of collecting.

While $15 per hundred dollars may sound like a high rate of interest, it is not all interest. The finance company incurs costs just to process a loan, and these costs are a higher proportion of the total cost for a small loan than for a large loan.

When Oregon imposed a limit of 36 percent annual interest on what a finance company could charge, that meant charging less than $1.50 for a hundred dollar loan for a couple of weeks. A dollar and a half would probably not even cover the cost of processing the loan, much less the risks of default.

Not surprisingly, most of the small finance companies making payday loans in Oregon went out of business. But there are no statistics on how many low-income people turned to loan sharks or had their electricity cut off or had to do without their medicine.

This is just one of the many ways in which self-righteous busybodies leave havoc in their wake, while going away feeling noble.

Statistics played a key role in creating the housing boom and bust that led to the current economic crisis. Back in the 1990s, politicians, the media, community activists like Jesse Jackson and others all made a lot of noise about statistical studies showing that (1) non-whites had lower rates of home-ownership than whites, (2) were turned down for mortgage loans more often than whites, and (3) resorted to more expensive subprime mortgage loans than whites.

All this led to pressures and even quotas for banks to lend to more low-income and minority applicants. That in turn led to lower mortgage lending standards, more risky mortgages, higher default rates and the collapse of financial institutions that bought these more risky mortgages or securities based on them.

We have seen and heard the same kinds of things when statistics about other racial differences have been cited in the same strident voices when other statistics showed blacks laid off more than whites during economic downturns or the children of black women having higher infant mortality rates than the children of white women.

What we have very seldom seen or heard in such parading of statistics are other statistics-- which are readily available-- showing that (1) whites are turned down for mortgage loans more often than Asian Americans, (2) whites resort to subprime loans more often than Asian Americans, (3) whites have been laid off more in a downturn than Asian Americans, and (3) the children of white mothers have higher infant mortality rates than the children of mothers of Filipino or Mexican ancestry, even though these mothers receive less prenatal care than white mothers.

In other words, numbers do not "speak for themselves." Politicians, the media and others speak for them-- very loudly, very cleverly and often very wrongly.

The Govt Should Step In
Such finance companies should be put out of business since they prey on the poor. As there is indeed a need for such services, the government should step in and take over the small finance industry. This would eliminate the greed aspect of those who seek profits for their labors, and instead convert the industry into one that provides for the needs of the less fortunate.

Currently, these loan companies demand repayment for all such loans, whereas reality dictates many of the consumers really have no means to repay the loans on time, if ever. By having the government run the industry, loans could be granted and excused based upon individual need. That way, if a poor person runs short of cash on a regular basis, they will always have a source for obtaining the funds they need to make ends meet.

Financing the project would be easy; revenue could be siphoned off from those who profit in the lending industry as a whole. Obtaining the funds from those in the finance industry would serve a dual purpose: the poor would be taken care of by those who prey upon them, and the greedy would have some of their loot taken away, thus reducing their incentive to steal from their fellow man.

Payday Loan Companies Are Swindlers
The author of this article is utterly ignorant of the fraud caused by these "legal" loan sharks. He should do more research before writing this ignorant article.

As an example of the abuse of these companies, let's say a person writes a fake check in your name OR a person tries to cash a check that was cancelled (stop payment). When that person gets money from the payday loan company, they apparently bought that check in "good faith" thinking it was valid. The uniform commercial code essentially then lets that payday company sue or go after the person whose check may have 1) been forged or 2) been cancelled. The payday company has absolutely zero requirement for validating the check was valid and they take almost zero risk. The fact they can go after the payer of a check and bypass normal stops used in the banking world make these companies just as bad as Somali pirates. I'm glad to hear they went out of business in Oregon and I hope they go out of business everywhere.

Didn't we try this with fanny and freddie, and Franklin Raines made $90 million in 6 years? That seems greedy to me.

Why didn't I think of that ... the government running payday loan shops across the U.S.A! What a great idea!

The government has certainly done this type of thing quite well in the past. In fact, the payday loan shops could be co-located in Post Offices, where you could borrow money to pay for stamps and to ship packages.

Let's take it a little further ... expand the service and sell tickets on Amtrack and open the government pawnshops at the Post Office. Next, the government health care service could also be set up in the lobby of the Post Office ... next to the government bank, the government Supermarket, the government clothes store, the government news shop (just one paper, eliminate all that competitive waste).

Hey, didn't they try all this is Russia? China? Eastern Europe? How did it work in those countries?

Notre Dame Scandal
The president of the University of Notre Dame – Father Jenkins – has invited Barack Hussein Obama to speak at the UND graduation ceremony in May.

Many Catholic, Christian, and Pro-life citizens are outraged that Fr. Jenkins would disrespect Catholic teachings against abortion and invite the O’Borter-In-Chief to speak at UND.
A petition has been circulating to protest this outrage and it now has around 300,000 signatures.

The petitioning group would like to have around 350,000 signatures before Monday April 20, 2009 when they will present the petition to Fr. Jenkins and the UND Board of Directors.
I have already signed the petition, and both written and emailed Fr. Jenkins my personal opposition to this invitation because I am pro-life and Christian.

Another great article by the esteemed Dr, Sowell. I have studied statistics and been trained in conducting statistical studies. It is so easy to structure your study to obtain the results you desire, it is ridiculous. And of course the way your statistics are presented can make all the difference in how your study is perceived. That is why the ethics and honesty of those conducting study and reporting reporting the data are so important. And also why intelligent people analyzing any statistical study want to see the raw data and want to know exactly how the study was conducted.

The poor have choices, just like the rest of us. They can choose to use a payday loan place, or they can choose to something else.

I have heard no complaints from folks getting their stimulus money! 95 percent of folks getting tax breaks. Largest middle class tax break! Rush Limbaugh and Friends will keep the GOP poll numbers in the gutter!

Here's a stat for you
It was reported on MSNBC that Gallup this week found 61 percent of Americans see their federal income taxes as being fair. Well, considering 41% pay no federal income taxes, you have to wonder what percent of the 61% polled actually pay taxes. Who knows, there may actually be some who pay nothing who think THAT'S unfair. But with poorly explained numbers, the media can make a plus look like a minus.

This is an another example of how statistics can be used to prove anything you want.

From the Army's viewpoint
While I was stationed at Fort Campbell, prior to my ETS, I worked for a bit at Army Community Services. One of the frequent problems that soldiers had was dealing with these payday check cashers. Usually the soldier had written a postdated check for $100, which got them $80 cash immediately. However, when payday came, they now were $20 deeper in the hole. So they would write another check to tide them over. This would go on until they were in over their heads.

If the soldier couldn't pay, they would contact the unit, the unit would force them to pay, and often give them an article 15, which would usually mean extra duty.

ACS was usually able to help them with a small grant, and credit counseling, but only after these troops had hit rock bottom.

These places do have a legitimate use, but they are very dangerous for people who do not know how to handle their money. They should be very closely regulated.

Pawnshops are usually a better option, since the item pawned can be redeemed or forfeited. But the debt doesn't just pile up.

Your UCC example is blatantly incorrect. The UCC was enacted in a spirit of promoting commercial efficiency, and facilitating fraud and forgery is clearly incompatible with that goal. Aside from the adequate defenses provided under the law of contracts, the UCC itself maintains that a person cannot be bound if he has not assented to such an agreement. 3-401(a) states explicitly that "A person is not liable on an instrument unless the person signed the instrument." Additionally, the victim of the forged check is also protected from his account being debited under 4-401(a) which states, "A bank may charge against the account of a customer an item that is properly payable...an item is properly payable if it is authorized by the customer and is in accordance with any agreement between the customer and the bank." In fact, Official Comment 1 to UCC 4-401 goes on to explain that "[a]n item containing a forged drawer's signature or forged indorsement [sic] is not properly payable."

Welcome Back!! We've missed you brother. There have been a few well-intentioned imitators in your absence, but no one nails quite as well as the master.

I get payday loans
every month, and I pay no interest at all. How do I swing that? I buy just about everything with a cerdit card. Then I pay off the entire balance every month, so there's no interest. A purchase during the first few dayd of a new billing cycle doesn't need to be paid for for about seven weeks.

Misuse of statistics confirmed
Another great example are the statistics on teen-agers dying from guns. This gets presented as though it is an epidemic that kids happen upon their parents' guns and one kills another. This DOES happen, but not that often. You can dissect the numbers and find that the large statistics in gun violence and teen agers are 15-19 black teen-agers dying by gunshot. Think about that and it probably builds you a much different picture on how they die, and the legality of the guns in question.

Even more dishonest are the parade of individual sob stories the left uses when it has no statistics. They go out and find one individual who fits their mold (such as Cindy Sheehan as a mother of a war death) and continually push the one example as though it is a statistic.

Dr. Sowell is right, and I congratulate him on an excellent article. I also welcome back Loyal Democrat and congratulate him on his response.

1) "Redlining" is the first club out of the bag from these people. A number of years ago, the Knasas City Star ran a huge story about insurance companies that wrote very little coverage in urban areas. "Redlining!", they shouted. It ran on the front page for days. It was weeks before a list of the offenders was provided deep in the paper. The culprits? Those that specialized in farmers' insurance. What a shock!

2) Joe. Individuals virtually never take a hit. Banks that cash the paychecks do. A number of banks have offered to make payday loans at a considerably lower fee but have uniformly been denied because the fee is construed as a rate and denied under usury laws.

3) Similarly, Leftist organizations have tried to describe NSF (not sufficient funds) fees as a rate when the institution is so evil as to (gasp) honr the check and pay the accountholders' bill. They can't make that argument if the bank doesn't disburse funds so, effectively, they are arguing that no bank should ever allow someone to go into overdraft, even if by doing so, they save the account holder the cost of a late fee to the mortggae company or prevent their car insurance from being cancelled, etc.

4) We are forever told about how the statistics show that real wages (and thus, living standards) have fallen under Republican presidents (talking point #1295). Of course, they ACTUALLY show the trend dates back to 1973 and that the reason is the greater outlay for benefits (total compnesation - including benefits - has consistently risen over the period). They also like to mention this (misleading) statistic and then comlain in addition about rising costs of living even though the term "real" means that those costs have ALREADY been factored into the data.

If liberals could actually UNDERSTAND statistics ... well, they wouldn't be liberals.

And no one challanges Frankie Boy or asks him to give money back, but we have activist and local politicians here in Connecticut who want the coach from the UCONN Men's Basketball team to give money back to the state because of the economic downturn.
Frankie Boy did run Fannie + Freddie into the ground, causing the downturn he gets to keep all his money.

Something that no one discusses
is that a fairy arge segment of the population seems to be completely ignorant when it comes to their finances.

I just learned about payday loans and check cashing places a year or two ago. There should be no need for check cashing businesses, but a large group of people in this country do not have bank accounts. Their lack of this basic necessity means they pay people to cash their paychecks, they save no extra money so they often need payday loans, and when they have to pay a bill they pay fees for money orders.

These people are clearly not taught the basics by their parents and I guess schools are two busy covering strange sexual practices and global warming to worry about it.

I generally don't support schools teaching more than basic academics, but obviously it is needed and would not be difficut to teach basic household finances before they send these people off in the world as it seems their parents aren't even doing the basics.

It makes one wonder what other basic life skills kids aren't being taught by their parents.

The first liar to figure out a way to make figures lie was a genius and is now standard operating proceedure for politicians.

Liberal Democrats don't say that the pay-day loan establishments should be put out of business by market forces, they believe that the poor should be with us always to provide fodder for the liberal agenda.

The libs don't say these businesses should be forced out of business, they merely say they should be controlled by the government, perpetuating what is perceived as a bad practice, a contradiction in logic.

If it is a bad thing for poor people to have to get pay-day loans, no amount of government interference in those businesses will stop the practice.

If anyone is truly concerned about these pay-day loan businesses, then open a business next door to them offering financial counseling to the poor ignorant people who have not been informed about the proper way of managing their money. Eliminate the bad practice of pay-day loans with the good practice of money management.

Rich libs could offer financial counseling without charging a fee and could also provide an interest-free loan to those needing the money. This would provide the market force necessary to eliminate the pay-day loan businesses.

But, of course, this idea is fanciful for two reasons: 1) Rich libs won't do it because they're greedy; 2) Libs don't really do things, they merely want other people to get things done for them.

The Internal Revenue Service charges 18% a year interest on unpaid income taxes. If that is okay, then why are banks called leaches for charging about the same on credit card balances?

I sure hope your post was written tongue-in-cheek.

I believe that, while I think the whole "payday loan" business is sleazy and is frequently a front for money-laundering, there is obviously a need for these services, and someone in this business should be able to charge whatever the market will bear. If people are too stupid or irresponsible to manage their money and live within their means, maybe this is a way to learn an expensive lesson. In fact, our current economic crisis was caused by the government forcing the banks to lend to people who don't manage their money well, and now Obama wants to bail these same people out.

As someone who has been a banker for 30 years, I resisted the movement toward an "anything goes" underwriting policy - and am pleased to see that the other banks who also resisted this pressure are the ones who are surviving and thriving.

And, by the way, the reason poor people don't have checking accounts is because THEY DON'T MANAGE THEIR MONEY WELL!!! At one time banks were forced to provide SOME form of checking account to EVERYONE - and we found that a certain segment of the population ended up overdrawn immediately. While we didn't pay the overdrafts, we did charge overdraft fees - which are set both to recoup our costs in handling returned items and also as a penalty to discourage future overdrafts. Believe me, we wrote off a LOT of those fees, and then were allowed to close the checking accounts that never should have been opened in the first place.

As to the idea expressed in some posts about government educators teaching personal finance - BAD IDEA! Government educators can't even teach basic reading and math skills. What makes you think they can teach personal finance?

Dr. Sowell is correct that the statistics upon which the government based their mortgage origination legislation (CRA) were extremely skewed. They accused bankers of "redlining" because statistically we made more loans to white people than black people. Well, if you look at the actual loan applications and reasons for denial, the white people generally had better credit histories than the black people. I remember one article I read where that was stated and Jesse Jackson (or some other race-baiting "black leader") said, "Paying bills on time is not considered a priority in the black community and should not be considered when making lending decisions." Huh???

And the reason black people are laid off more often than white people - statistically - is because there are more black people in low-paying, hourly positions, which are the most vulnerable to job loss. It's also the reason that Asian-Americans lose jobs less frequently than white people - because in the Asian culture they value education and hard work, and tend to either own their own businesses or be in higher-paying, white collar jobs that are somewhat less vulnerable to layoffs.

Bad Banks, Bad Government.
I have never gotten a payday loan. But, I do have a prepaid credit/ debt card. I don't have to wait for money to clear, monthly payments are $5, no overdraft, no hidden fee's, and I'm in control of my money. With my old bank I never could keep up with why this check was held and that one wasn't. Or, when the hidden free checking fee's were going to pop up. The only thing I have saved is my savings account. In my opinion, checking accounts and most banks are run like the government. Just a clever way to suck and control one's life through their money.

Payday Loans
We have done just fine before these Payday Loan business came to being and would be doing fine also in the future without them. They are an extension of what has created the problem we are facing now, easy credit instead of living within ones means. These guys are predatory lenders not unlike loan sharks and I would not cry seeing them go.There are many other ways to help one out of a bind in emergency and nobody shuts off the electricity because you are one month behind in payment.

You have a right not to like them, but understand no one, NO ONE, is forcing the poor or ignorant to use their services. They are not predators. Advertising is not forcing anyone.

Instead of having government regulate them, let the free market operate.

If they "take advantage of people", word will get around and smart people will beware and not use them, even if desperate.

If they take advantage of people" and you are very angry, then organize some wealthy folks who would be wiling to loan money at more reasonable rates to the "preyed upon" people.

Dave Ramsey and I part ways with his insistence that PayDay loan places be regulated or put out of business by government. (He supported Congress' last legislation of their rates.) People will not be preyed upon if they first choose not to participate. And, if one is ignorant enough, and goes through the PayDay loan process and experiences trouble, then maybe the pain of learning is the best thing to happen to them.

If the place is so evil and greedy and you were burned, by golly, you learned a good lesson and will never use them again. If not, then you are doomed to live a very unhappy life and no amount of big brother government is going to save you.

Now, the former social scientist turned social Darwinist makes his living as an intellectual panderer to angry people. He carefully chooses topics and numbers which elicit the kinds of hateful comments I often see on this page. You'll never see Professor Sowell take on any number like the disturbing explosion of hate group membership since election day.

Unless these payday firms are engaging in fraud or other illegal activities, leave them be.

The question to ask is why isn't there a bank branch there? Why aren't there other alternatives in these neighborhoods? If this is such a safe and lucrative market, why are those that find these shops despicable and worthy of shutting them down trying to open up alternative businesses?

There is a reason why there aren't big box businesses and bank branches in these neighborhoods; crime and potential profits. The fact that there has been a softness on crime in these areas actually hurts these residents. Crime is ignored and the shops have to deal with the crime with more security and/or higher prices.

We have to get beyond the stupidity that comes from the left that everything is driven by skin color and race. If so? Why do the Asian Americans fare so much better than blacks or whites?

The problem we have is "innumeracy", a term coined by Douglas R. Hofstadter in the 1980s. Like illiteracy, the inability to comprehend written language, "innumeracy" describes an inability to understand the numbers that one meets in everyday life. John Paulos, a mathematician, later authored a book using this word as its title.
The older I've gotten the more I've become convinced that "innumeracy" is rife on our society. How else can someone pledge to spend trillions of dollars that do not exist and still maintain that taxes (the sole origin of that money) will be cut? The numbers, let alone the logic, simply do not stand up under even the most cursory scrutiny. How else can this same person maintain that supply-side economics (Reaganomics) doesn't work, when it was just such an economic philosophy and the practice of slashing income tax rates that followed from it (as both Reagan and George W. Bush did) that INCREASED government revenue by freeing capital for use rather than encouraging people to hide it to avoid taxation?
Remember the old ads that said, "Three out of four doctors recommend Anacin?" That helped sell a good deal of the pain-reliever, but no one bothered to ask a) how many doctors were asked? (the sample size is vital), and b) how was the question asked? ("Would you have a problem recommending Anacin?" will yield quite a different result than the more open-ended "What do you recommend for a headache?").
All too often these days huge numbers such as hundreds of billions and even trillions are bandied about so glibly that they have lost their awe-inspiring character...not that anyone can truly imagine what a trillion looks like anyway. Politicians, like Madison Avenue advertising firms, have become quite adept at manipulating the public by using to their advantage the public's inability to fully comprehend such numbers.

First off, I don't follow weird groups that only other haters follow.

Acorn, on the other hand, is a main-stream, Federally supported, hate group that makes it into the news, quite often. Maybe, not gun toters, but very effective in spreading hate, just the same.

When Obama, a particularly hateful person, used the office of the President of the USA to call out private citizens for ridicule over their paychecks, the ACORN group dutifully got on buses to hunt them down and hound them.

Heck, these ACORN groups have never even paid taxes, yet they were up in arms over money for bail-outs! My guess is that they were jealously angry that it wasn't just given to them, instead.

You guys on the Left would be emotionally bankrupt if it were not for hate. Is there a speech that Obama has given where he did not take a moment to trash someone else to elevate his own self-aggrandizement? Nothing but hate.

Get into the money business. Nothing makes money bigger or faster than the money moving business. In the highest art form of lending out money one would need several people in the back room turning their fingers green just from counting the profits. Why mess around with trying to bake and sell pies.. Open a loan company. You'll be driving a big new car, smoking the best cigar.

While I personally find payday loan businesses repugnant, Mr. Sowell brings out a valid point. I notice that the same politicos do not have the stomach to take on credit card companies that are better little than loan sharks. Additionally, statistics without the numbers and methods used to support the findings are meaningless.

Which is more userous, those fees or Bank and ATM fees? Or cash fees -- a percentage -- on your credit card? Only the big bank titans can charge "user-ous" fees and get away with it. In some cases government regulation condones or encourages it. Don't have money for a utility bill? Fine, they'll charge you more. Don't have the mortgage payment? They accelerate your balance -- due upon reciept. Can't make the car payment, wait till you see what they're going to charge you now, plus towing, storage, damage etc.

Excellent Analysis of Payday Loan Issue
This article provides an excellent analysis of the payday loan issue. It is simply a myth, a superstition, that a loan's APR determines whether it can be a useful offering. There are situations where you could reasonably say to someone, "Buddy, lend me $20 and I'll pay you back $25 in an hour" and that could be very useful to you even though you were paying a 219,000% APR. What is important is not the APR but the actual cost of the loan versus the benefit you get from it.

In this case, the do-gooders want to eliminate loans that people depend on in emergencies, to save them from eviction or from losing their job cause they need to get their car repaired quickly - all because they don't want them to pay a high APR. This is the height of insanity.

They may be right that the average payday loan borrower requires more than one payday to pay off the loan, so those people either have to come back to the store to refinance the loan or, if that isn't permitted in their state, go to another payday loan store to take out a new loan to pay back the old one. But that is because the lenders are operating, for the most part, under a very narrow exemption to their state's so-called usury law. If a free market in loans was permitted, as it should be, then people who know they won't be able to repay the entire loan on their next payday could sign up for a loan that would be paid back over several paydays. The lenders could offer such installment payday loans at a lower APR, because they wouldn't incur the costs of processing the refinancings, and those customers would be spared a tremendous amount of unnecessary stress.

One correction to Dr. Sowell's article. Oregon's new law permits the lenders to charge a 10% fee in addition to a 36% APR - and 80% of the lenders still closed up shop. If the fee was not permitted, as it isn't under the Durbin and Speier bills now pending before Congress, then 100% of the lenders would be gone.

I was in an STATS class during the last election cycle and we did real statistical analysis on the information that some of the Media was putting out.
As Samuel C lemmings/Mark Twain is said to have once said, "there are lies, damn lies and statistics."

Small sample sizes, (less than 100 people and then extrapolated over an entire population), less than truly "simple random samples," and the tendency to have not only bad reasoning, but bad mathematics skills are the erros of the pollsters.

Mental laziness, lack of skills and unwilling to question "authority" figures, like news anchors. is OUR fault as a nation.

It is not just the "soft sciences" and literature that need conservative and center based values.
