Congress in a Lynching Mood

The financial crisis has been widely interpreted as proof of the need for extensive government regulation of banks, insurance companies and other capitalist institutions. The antics of politicians now that they have a greater role, however, are a vivid reminder of why they can't be trusted with such power.

These days, every politician assumes that because he has a driver's license and an ATM card, he must have all the necessary skills to run an automaker and operate a bank. House Speaker Nancy Pelosi and Senate Democratic Leader Harry Reid, for example, said Detroit should use its bailout money to become "a global, competitive leader in fuel efficiency."

Never mind that if we know anything from recent automotive history, it's that the Big Three's competitive advantage is in trucks and SUVs. If they had spurned that segment during the decades of cheap gas, things would have been very different: They would have reached the brink of bankruptcy long before now. But Congress' idea of a sound business plan is to build cars that suit its grand ambitions rather than, say, the tastes of consumers.

Banks getting federal money have likewise been subjected to a frenzy of finger-wagging. Politicians were shocked when Northern Trust hosted a client event featuring the band Earth, Wind and Fire. House Banking Committee Chairman Barney Frank and 17 other Democrats demanded that it "immediately return to the federal government the equivalent of what Northern Trust frittered away on these lavish events."

But Northern Trust didn't ask for federal help -- it was conscripted into the bailout. It happens to be managing its money well enough to be making a profit and repaying the taxpayers.

And did anyone notice that after Earth, Wind and Fire did the Northern Trust gig, it performed at a White House dinner? Why is it OK for President Obama to host "lavish events" that are financed by taxpayers but outrageous for a bank to use mostly private funds to entertain valued customers?

Then there is the insurance giant American International Group, which unleashed bubbling torrents of outrage when it paid large bonuses to hundreds of employees. Angry lawmakers have no idea what these workers should be paid, except that it should be a lot less.

Of course, some taxpayers feel that members of Congress should forfeit their salaries in years when they fail to balance the budget. But our leaders' contempt for failure applies only to the private sector.

They demand that the bonuses be rescinded and, failing that, threaten to tax them away, at proposed rates as high as 100 percent. "Let the recipients of these large and unseemly bonuses be warned -- if you don't return it on your own, we'll do it for you," thundered Sen. Charles Schumer (D-N.Y.).

No one in the lynch mob wants to admit that the amount is piddling from the point of view of taxpayers. It adds up to less than 1 percent of the $170 billion the government has poured into AIG. The prevailing reaction amounts to swallowing a camel and straining at a gnat.

AIG could have refused to make the payments, but only by violating contracts it had made with employees. Officials at the Federal Reserve Bank of New York entertained this option, reports The Washington Post, only to realize that the spurned staffers would have sued and gotten not only the payments but "punitive damages that would make the ultimate cost perhaps two or three times as high as the bonuses themselves."

Refusing to pay would also have driven away any top employees with alternatives -- which would tend to be the better people, who might just be useful in restoring the company to health. Congress' approach brings to mind the sardonic workplace sign: "The floggings will continue until morale improves."

Expropriating property from people who did nothing more than accept money they were legally due sounds uncannily like a bill of attainder -- a legislative measure declaring someone guilty of a crime, and imposing punishment, without trial. This weapon was expressly forbidden by the framers of the Constitution because it is fundamentally unfair, at odds with the rule of law and driven by mass hysteria rather than dispassionate fact-finding.

Once upon a time, those were considered bad things.

Misplaced Outrage
If you add three zeros to the total amount of bonuses paid to AIG executives that have caused such outrage, the result is the approximate amount of Federal funds that have been pledged to the company. I suspect knowing the recipients of the billions of dollars of payments on Credit Default Swaps written by AIG would really bring on outrage. How many billions of taxpayer’s dollars have been paid to Goldman, the mother of so many of our government officials (like Paulson) overseeing this travesty? Will our outrage be one thousand times as great? We have been duped!

Bills of Attainder, Part 1
Bringing to light the Constitution's prohibition against Bills of Attainder once again shows us that the Congressional leaders have no intention of following the Constitution. Whether or not the Federal Courts will also ignore the Constitution is up for grabs.

I have a post at my blog about this and the fact the real outrage here is the actions Congress is preparing to take. There is a bill in the House that is due to voted on today that would allow retroactive taxation on this group of individuals to steal their money...and people are up in arms about the money! It's not the money that concern us, but the fact that members of Congress are openly flouting the Constitution and no one is giving it the proper attention because they are focused on catching Chris Dodd in a lie! Amazing!

But Chapman presumably had no problem with the violation("renegotiation")of UAW contracts back when the auto companies were receiving federal funds.

Orwell's "Animal Farm" satirically muses that all animals are equal, but that some animals(pigs)are more equal than the others.

Is Chapman suggesting that AIG "pigs", after running their company into the ground, now should be rewarded for their destructive proclivities, while UAW "pigs" are not as "equally deserving"...for presumably having a hand...er "hoof"..in running their companies into the ground?

It was not Congress, but the Federal Reserve, in conjunction with the Bush Treasury Dept., which provided AIG with $85 billion back on Sept. 16, 2008.

Congress had nothing to do with that.

And when those government funds were made available to AIG, no restrictions upon bonuses were part of any condition for receiving the government funds.

Any fair assessment of this general controversy would place some blame on both Bush and Obama administrations, Congress, and Federal Reserve.

Japanese Justice
If anything we should get from the Japanese should be justice for the victims of white collar crimes especially when the congress is involved. It would not take many times after this group is subject to justice as a whole that is every democrat, republican, and independent that voted for any bailout, stimulus project and or accepted a dollar in earmarks for his district. First all his/her assets would be surrendered including everything childern and parents name.

Also, ex post facto laws are prohibited, and as the primary function of laws passed by Congress are for purpose of revenue, and do not pertain to criminal law, which is the purview of the states, a bill targeting these or like individuals would also be a violation. Further why were only the states prohibited from impairing contracts? The reason is that the Federal government was never meant to have a role in the conduct of individuals or businesses, as this power was left to the states. The Federal government is to act on behalf of states, not individuals, which is why almost everything that the "Federal government" does is illegal, and the ones that need to be prosecuted are every living president and almost every rep or sen. Judges would be difficult as conspiracy would have to be proven. OK, I know the odds are infinitesimal, but the facts are that our money is being stolen (yes, a gun is pointed at our head) to support enterprises that have no legal/constitutional basis.

Let Congress pass a bill demanding the bonus money from the AIG execs. I'd love to see a court fight about who did what, to whom and when.

I had the misfortune of watching the public excoriation of AIG CEO Liddy by the House committee yesterday. (It should be noted that Liddy came out of retirement for $1 per year to clean up AIG's mess).

While I was initially as "outraged" as many other Americans at the bonus payouts, after carefully listening to Mr. Liddy and his reasoning, and as a business man myself, it became clear to me he acted in the best interests of AIG's future - which also means "in the taxpayers best interests".

One arrogant Massachusetts Congressman (redundant, I know) claimed to be a "contract attorney". This idiot seriously scolded Liddy for not simply ignoring AIG's contractual obligation and instead invite lawsuits. I guess it has escaped the notice of this silly Congressman that the foundation of our Constitution and the rule of law is based, among other things, upon the presumption that contracts are to be honored.

It is clear many Americans - and especially the idiot liberals on this committee - have no idea of the difference between "performance" vs. "retention" bonuses - nor the complexities of the businesses AIG is attempting to divest, for which these retained employees are necessary.

Further, so far, AIG has received $40 billion in TARP funds and a $38 billion loan from the Fed Reserve.

Finally, these is a difference between "renegotiation" of a contract and "breach" of contract. You are comparing apples and oranges.

Of course they are in a lynching mood. They have to do that to someone to get the attention away from themselves. What better way than to blame someone else for their own stupidity and greed and lynch him? Then they can insist they cleaned up the problem and hopefully the voters who watched the lynching will believe and forget who were the real criminals.

How gauling that Barney Frank and Christoper Dodd can act so innocent. Frank is mainly responsible for the mess at Fannie Mae and Freddie Mac and Dodd is a bold-faced liar. Dodd received $106,000 from AIG and our esteemed President took $100,000 from AIG. Now Fannie Mae and Freddie Mac are getting ready to hand out bonuses! Congress! It's like "the kettle calling the pot black"!

The Fed. Res. and the fed. govt. have tripled the amount of money in circulation in the last 6 months. Then, we have Scamulus, the mortgage bailout, the omnibus bill, and god help us, Mugabe's freakin $3.6T budget.

Yesterday, the Fed announced:

1) It would buy $300bn worth of treasury bonds so as to lower mortgage rates, which hasn't been done since the inflationary period of the 1960s.

2) Another $750bn to buy toxic assets, which is on top of the $500bn already spent.

3) Up to another $1T for bank stabilization.

$2T for universal healthcare.

$2T for the stupid and useless cap-n-tax.

We have a national debt over $12bn.

Unfunded obligations for social security that are between $56T and $75T.

The price of a barrel of oil is up nearly $10 in the last month and gold has skyrocketed because commodities are a hedge against the insane fiscal and monetary policies of Washington.

Please write your representatives and tell them to stop the spending immediately. The Fed is PRINTING upwards of another trillion dollars. Their goal of decreasing interest rates is not considered feasible, as evidenced by the lack of support by the markets. The Govt. is trying to finance the debt, which has NEVER succeeded.

Currently, we are in a deflationary cycle. If the Fed’s latest attempt fails, and make no mistake about it... they used every last tool they have, we are heading into a depression. They must stop the spending or we are looking at the Great Depression all over again. Spending printed Monopoly money will not correct the situation.

Dust off the wheelbarrow because Mugabe is leading us into the United Socialist States of Zimbabwe.

AIG strawman
Congress is pointing the finger because if the populist fools finally woke up they would see that Their members of Congress voted for the banking regulations that led to the crisis.

Various members of the treasury went from government to the companies which created the dirivatives which created the situation OUR government claims not to have known about.

Congress voted the CASH to AIG instead of loan gaurantees (Charlie Rose Show, Tues. evening). The government allowed AIG to pay Bear Stearns, bailed out by the government (double dipping?), CASH MONEY not at a percentage of the loss but at the full 100% of the loss.

Stupid or Evil?
I haven't decided yet if congress and the Pres are stupid or evil.

This is typical govt though. Cause a big financial mess, scramble around causing a bigger mess in the name of "doing something", than blame the whole thing on the capitalist market so they can take over the market and fix it with direct government control.

Name one economy or sector of an economy in the world that has done better with government in control rather than "selfish" individuals.

The US auto makers were very strong until Govt began regulating them in the 1980's. Since then they have struggled. Just one example.

Where we part company is in justifying the recklessness of AIG and others.

You probably disagree but I think the momentum exists for some regulation of credit default swaps and other easy-money gimmicks conjured up by shysters whose main claim to fame was in packaging and shilling of such toxic debt.

That being said, the libertarian streak in me is generally suspicious of unbridled government power and intervention.

Whom I utterly despise and hold in extreme contempt are those faux righties who have no problem with how Bush and crew subverted our constitution in this obsessive eternal war on terrorism.

Most of Congress is a joke. First they pass legislation, or coerce financial institutions into making bad loans then criticze them after doing it when they become bankrupt. What we need in this country is LESS GOVERNMENT medling in private businesses. If the businesses are smart they'll make a go of it if not they deserve to go belly up.
And while I'm at it, this bunch of wacko environmentalst are out of control. They need to be ignored. Sure, I believe man needs to watch what he is doing, but there is a God who made all of this and He is still in control and He doesn't need you to control His environment.

"How Bad Is It Really?"
The bonuses are disgusting, but there was a Keystone Kops element to the White House reaction. Its yes-we-can, no-we-can't act on canceling the payoffs was clumsy, especially when the President said he wanted the bonuses stopped. It made for good sound bites before an aide called the whole thing off, saying it was too late, legal contracts, yada, yada.

On most days, such White House fumbling would be big news, but the real outrage is that the bonuses represent a fraction of the taxpayer money consumed by AIG. Yet nobody, including Obama or the Bush administration, which started the bailout, is even talking about how to end the gravy train or what the final cost could be.
Nearly $180 billion is already gone, and there will be huge additional losses because AIG still holds a portfolio said to contain $1.6 trillion worth of lethal credit default swaps. Against that, the bonus money is chump change.

Curiously, you haven't heard much about the spent $180 billion or whether there was a better way. Maybe the pols don't have a clue.

Or maybe they figure it's safer to focus on the bonus angle because "bonus" is such a red meat word. Put a name and face on the people with the gall to demand such dough and the pols can ride the public anger like a surfer rides a wave.

But there's a third option, and that's where my money is. I bet you haven't heard much about the real cost of settling AIG's instruments of wealth destruction because Washington doesn't want you to know how bad it really is.

Care to guess which Senator put the wording into the bill to allow the bonuses? (Dodd - claiming "I didn't do it, oh, wait, I did it without knowing I did it, oh, wait, one of my secretaries did it, oh, wait, ...)

By the way, Dodd is a member of the party that came into power to clean out all the corruption in D.C.

Dodd Throws Obama Under Bus

After lying and feigning outrage, Dodd has told that it was Obama who was behind approving the AIG bonuses:

CNN -- "Senate Banking committee Chairman Christopher Dodd told CNN Wednesday that he was responsible for language added to the federal stimulus bill to make sure that already-existing contracts for bonuses at companies receiving federal bailout money were honored.


Sen. Chris Dodd, D-Connecticut, appears on CNN's "The Situation Room" on Wednesday.

Dodd acknowledged his role in the change after a Treasury Department official told CNN the administration pushed for the language.

Both Dodd and the official, who asked not to be named, said it was because administration officials were afraid the government would face numerous lawsuits without the new language.

Dodd, a Democrat, told CNN's Dana Bash and Wolf Blitzer that Obama administration officials pushed for the language to an amendment designed to limit bonuses and "golden parachutes" at those companies.

"The administration had expressed reservations," Dodd said. "They asked for modifications. The alternative was losing the amendment entirely."

On Tuesday, Dodd denied to CNN that he had anything to do with adding the language, which has been used by officials at bailed-out insurance giant AIG to justify paying millions of dollars in bonuses to executives after receiving federal money."

I say Congress should be first - Pelosi, Reid, Frank, Dodd, Schumer, Durbin, Murtha, we won't do Kennedy - that should have happened 40 years ago. None of them deserve to be retained. How do you dissolve a government? Then we can turn to the cabinet members. They're all tax cheats and liars, too. Even a couple of former Presidents should go. What Must Be Done
Our political class told us they had to have control of our commerce and finance. We the people had failed, it was time for them to assume control.

They told us to hurry, hurry, hurry, sign the law, don't look, don't wrangle, don't talk, act now.

We were told that we had to give waivers to Obama's wiz kids because we couldn't distract them with trivial matters such as paying taxes. We were told these genuises were the only people who could solve all our problems.

Now we see the folly of them and their solutions.

The tragedy is that most Americans still trust them and want to give them more power. They laugh at us who disagree. We are the stupid ones, they say.

Rational Americans will continue to suffer until they realize that hoping our rulers will change, will become wise, is a failed strategy. A new way has to be found for those who carry the load in this country. Otherwise, they will be ridden and worked to death to pay for the parasites and freeloaders. It's time to stop.

Producers have to come together and strategize on ways to disentangle themselves from the government theives and their parasitic voters. Conceptually, this will involve new business arrangements and tax planning such that they deal only with each other in such ways that their perceived incomes almost disappear and government agents are confounded trying to construct incomes.

It may also involve mass relocations to selected safe havens where only those who work, have assets, and are not criminal can live. This can be done without passing any unconstitutional laws.

Finally, these people must resolve to arm themselves and be willing to defend their estates and communities with violence.

There's nothing to fear from the seemingly awesome power of the Feds. They can be easily defeated when confronted with strong adversaries with the will to win. The VC and Al Queda proves this to be true.

AIG Tax Correction


Earlier I posted that the Congress had defeated the 90% tax measure, this was incorrect. The wire service alert I received erroneously confused the tax vote with the condemnation vote. So, Congress voted for the unconstitutional measure, but voted against the "sense of the House" condemnation of AIG. And, we wonder what the hell they are doing up there?

All that is going on is a distraction to the main and, without being pollyannaish, the most dire situation that we have seen in decades, if not in our history. As I indicated below, the Fed is printing money at an alarming rate. Understand, NEVER in the history of monetary policy has a government been able to effectively time inflationary tools to counteract deflation. NEVER. We are either looking at the most devastating recession that we have ever seen in this country or another depression AND this is only if we quit spending. If the Fed continues to print money and the government continues to spend it, not only will we have inflation and a depression, but the dollar will collapse. Most people do not believe that there can be a depression and inflation at the same time. This is simply not the case. Any cursory review of the Weimar Government or modern day Zimbabwe proves that inflation can occur in a depression.

According to sources from within the Congressional Budget Office, Obama is going to receive devastating news tomorrow on both the economy and his proposed budget. The new projections put his budget AT MORE THAN FOUR QUADRILLION DOLLARS!

China previously expressed concern over their investments and, in a way, were rewarded yesterday by the Fed's actions because they made $700bn in one day. Today, Russia has voiced grave concern about the stability of our dollar.

At the rate we are going, the poor will NEVER see parity with the "middle class", who will likewise lose their buying power. The next shoe to drop is going to be the collapse of state pension funds, which will wipe out the retirement savings of millions.

Any collapse of or significant instability in the dollar will make it nearly impossible to borrow overseas. Should this occur, Obama can say goobye to his dreams of universal healthcare, cap-n-tax, and likely card check, which will result in a replay of the effects of the 1936 Wagner Act and other workplace rules that led to the 1937 recession within the Great Depression.

This President is getting a big pass. The standard for performance has changed, the bar is always lower for a Democrat.

Heck, Obama is such trailer trash that he personally attacks private citizens and no one in the MSM seems to care. This President spends millions of our money jetting around for photo-op's and takes time to demonize citizens for their paychecks. A guy that worked in the profitable energy branch of AIG actually gave his bonus back for fear of Presidential initiated populist reprisal. Obama is scum!

He constantly cries, "It's not my fault!". What kind of a President says such childish response? Well, I guess if one is trailer trash, it is hard to be a magnanimous leader. He is all about vengence, populism and hate.

Notice how not one politician has been brought to bear on this crisis? Barney Frank and Chris Dodd have had their hands on the scales at Fannie and Freddie for more than 15 years. Fannie and Freddie are the epi-center of this crisis, yet their politically appointed CEO's Raines and Gorelick made more money than AIG paid out in bonuses.

Until Frank and Dodd are marched out in a "perp walk", I see every effort to fix this mess as so much disengenuous political window dressing.

We have a President citing private citizens as targets for for abuse! Obama and his team wrote the contracts, AIG signed them and it was commissioned. The employees got their bonuses under good faith bargaining.

Now, the jerk, for petty populist diversion from his colossal mistakes sicks his mob on them. For what? A lousy $160M. Heck, this jerk spent more than that in one day for his inaugurational party!

Because of this jerk, these citizens are getting death threats! So much for the magnaminity of the office of the President of the United States, the most powerful person on earth. Now, it is lowered to petty vengence.

Obama is the most incompetent president
We have ever had. He hasn't been in office long. But when you look at the damage already, it is shocking. He does have lavish parties and spends our money freely, while telling us that we need to sacrifice. But not him, oh no. He worries about who will win the college basketball tournaments, and spends his time partying every Wednesday with our money.

He calls AIG out, when he was the person that was to oversee this. He think being president is just one big party...for him. What do you expect from a man that spent years writing about himself. Let's do the right thing and get rid of him, before he does more damage.

You lynch a gerbil with a rope just big enough to go around its neck. It helps to hang a weight on its foot but that isn't really necessary if the gerbil is an old one like all those in Congress are.
