Justice Sonia Sotomayor’s commitment to her own personal interpretation of the Constitution could have devastating consequences on everyday Americans, and here’s why:

It was Good Friday when the knock came on the door at the home of Pastor David Jones and his wife, Mary. San Diego County officials were hot on the trail of reportedly suspicious activities taking place inside the couple’s home each and every week.

Mrs. Jones, the co-conspirator, was interrogated vigorously. “Do you sing? Do you say ‘Praise the Lord?’ Do you say ‘amen?’” San Diegans can be relieved their county officials are in hot pursuit of major trouble makers. Especially on Good Friday. How could authorities possibly sit by and allow homes to be the centers of meal sharing and Bible Study in the midst of unsuspecting, at-risk neighbors?

The Joneses were warned that if they did not pay for an expensive Major Use Permit, normally used for the city to conduct studies on environmental impact, traffic patterns, etc., their weekly gatherings of 15 would have to stop. And if they did not stop, there would be escalating fines and “then it will get ugly.” Seems like it already has.

Meanwhile, down in Louisiana, a man was reportedly stopped by police and held for questioning and a background check for displaying the notoriously offensive “Don’t Tread on Me” bumper sticker. Christopher Gadsen, a Revolutionary War era general designed “Don’t Tread on Me” for a flag representing the need to defend America’s rights from tyranny. Ben Franklin loved the symbolism Gadsen used of the rattlesnake and the rebellion. Good thing Franklin wasn’t traveling in Louisiana, bearing that flag on his carriage, when those police were out to catch “right wing extremists.” Imagine … Homeland Security urging the nation’s law enforcement to protect the homeland from those who want to protect the homeland. Is there a category for that?

Or for that matter, for this: Debbie McLucas is a hospital supervisor at Kindred Hospital in Mansfield, Texas. Her husband and sons have all served in the military. Her daughter is currently stationed in Iraq as a combat medic. In honor of Memorial Day, Debbie did the unthinkable: She hung a three-by-five foot American flag in an office she shares with three other supervisors. One was quite offended. So offended, she took down the flag all by herself. Take that, Debbie McLucas. The hospital refused to support the display, claiming other patients and visitors were also offended.

It would be hard to fault the offended supervisor. She has only been in the country for 14 years, during which time she has risen to a high level of achievement, made a good salary and, as with a number among the new wave of immigrants, never had or felt a need to show loyalty to the country for her great fortune. It isn’t her country … this USA … some nation in Africa is … and the honoring of the shedding of American blood abroad to protect it was apparently of little consequence to her.

These three stories currently in the news represent the types of issues that may very well end up in the United States Supreme Court.

Enter Judge Sonia Sotomayor and the living, breathing, constitution philosophy she and Justice Ruth Bader Ginsburg and President Barack Obama embrace. Under the original interpretation of our rights, pastor and Mrs. Jones would have had the right to hold a Bible Study in their home, but the newly-found interpretation of the “right to privacy” which more enlightened judicial minds most recently found to protect abortion and homosexual relations may in the future not protect Bible Study, which by the way, is the source of objection for both.

While the ever-evolving interpretation of the First Amendment right to free religious expression currently extends to Muslims with prayer rugs in public school and prisons, future justices with an agenda may no longer see it extending to Christians in their homes.

Homeland Security’s new concern over “right-wing extremists,” including those who are pro-life, those who believe in a strict interpretation of the Bible, others who oppose illegal immigration and, horror of horrors, embrace state control rather than federal, has given us yet another interpretation of the First Amendment. The right to free speech, primarily guaranteed for the purpose of political dissent may soon not include political dissenters who display politically incorrect concerns with unpopular slogans on bumper stickers.

The Constitution is said to protect the burning of the American flag, but its guarantees haven’t devolved yet so that the display of it is criminal. Don’t think that couldn’t change. Our current president thought it inappropriate to wear the flag on his lapel while campaigning. While other American leaders have proudly worn it in the past, he called it a “false patriotism.” And his friends on the left agree. Newfound rights not to be “offended” together with immigration laws that have made it too tempting for some immigrants to reap the benefits of this country while disdaining and undermining it have made the flag unacceptable in many quarters. While their rights to claim offense may be protected by the new understanding of the law, our right to display the flag could well be threatened.

What’s at stake with the nomination of a judge like Sonja Sottomayor are real-life consequences for ordinary American citizens. What we don’t need is a justice taking the bench with the notion that somehow the Constitution doesn’t mean what it has always meant, who proceeds to twist it to reflect his or her own viewpoint—a justice like Sonia Sotomayor, the older, wiser Latina female, who in her own words “would more often than not reach a better conclusion than a white male…” judge.

The dangers of her attitude are exactly why the Constitution isn’t “living.” Its principles were established to endure for generations so that such men and women, persuaded by their times, could not recklessly adjudicate while claiming “new wisdom.” Methods change, circumstances change, but principles and carefully-crafted law based on those principles stand like a rock for all time.

A wise Latina woman and a wise white man will more often than not reach the same conclusion: One reflective of enduring wisdom and not the folly of our times.

Conservatives should protest these three situations most vigorously. This left-wing hypocritical concept of "freedom" needs to be challenged.

I keep reading stories like this and keep shaking my head. How did we reach this point in our country? How can leftist be so mislead that they think a Code Pink march in front of a military recruiting station is a great thing, but "tea parties" protesting wasteful spending and excessive taxation are unpatriotic?
Let me tell you a few things. #1) The U.S. Constitution GUARANTEES me the right to practice my religion as I see fit. PERIOD. "... nor prohibit the free exercise thereof." You are screwed up in the head if you think it is ok to accomodate every religion in the world and not make them feel persecuted, but then persecute and interfere with Christians. It was Christian principles that provided the foundation for the United States and it is what made us the greatest nation on earth.

If you are offended by the American flag, get the @#%*& out of the United States! You don't deserve its protections or benefits if you feel that way. If you came from another country for the freedom and opportunity to have a better life, and have been successful in making that better life, then you should be kissing our feet and show some gratitude for that opportunity. If you are not grateful and appreciative of our freedoms, then I welcome you to take your thankless butt back to your homeland and admire that flag and country. Oh, and you can leave the wealth you made here since you think the other place is so much better.

Justice is supposed to be blind. Race, sex, social status, religious affiliation if any or national origin should have no bearing on the outcome of any legal issue. Judge Sottomayor has had 60% of her rulings overturned by higher courts (according to another article I read a little while ago) because they were not based on rule of law or legal basis, but were based on her empathy for one side or the other. That is dangerous and wrong. Do you actually think that if a judge said that white men made better decisions that there would not be calls for their removal? Do you think it is fair to rule in favor of of someone because they were blond haired and blue eyed, or because they were shorter, or older, or better looking, or had endured more than the opponent? That appears to be how she judges and is in total violation of what jurisprudence is all about. If you think empathy and bias are acceptable in court, then you are totally mislead of full of it! You may be on the wrong side of that bias one day.

If the pin fits, wear it.
Our current president is inappropriate. And I do not doubt that wearing a flag for him is false patriotism. I've never been more ashamed of my country as Michelle has finally became proud of it.

There are many facts available for you to use in support of this 'real' president, and this 'real' appointee. So please feel free to support your simple comments with facts. I realize that facts are the natural enemy of the liberal, for they often are in direct opposition to dreamy idealism.

However, you are in a place where facts are welcome...and who knows, with much research, thoughtful organization and passionate delivery you may actually persuade someone. And if not, you will at least be taken more seriously than those who just spout.

Typical TH columnist story. No specifics contained in the “stories” as to what possible reasons there could be for the outrageous occurrences. No other side of the story. Just enough out of context info to back the tripe and drivel the columnist uses to pay the bills. Don’t perform research on both national and conservative web sites. Report that research in a way to back up your OPINION, and don’t let FACTS get in the way. Of course that amount and level of BS can lead to losing your gig at The National Review but hey, lift the skirt a couple of inches more. Because anyone who knows anything about Neighborhood Associations knows that planting the wrong bush, holding a Scout meeting (WITHOUT PERMISSION!!) or displaying a US flag that is the wrong dimensions, is subject to fines and censure. This story is all about stepping on someone’s turf and not bowing to the jerk in charge.
The bible study meeting? If they violate local ordinances or homeowner associations rules, for whatever reasons (none are stated in this “story”), the city can and will step in. Bible study or devil worship.
The bumper sticker story? Who knows, no info included. The flag, again, only outrage, no usable info. How does this apply to the nominee? It only applies if you are selling a story or looking for outrage that backs up your current supply of it. So scream. Scream louder. Scream so I can hear you in Texas. We’re still trying to get over having one of our own being shot in the face by a guy whose popularity has soared to 37%.

One has to wonder what will be said and what will be allowed to be said about whites once they are no longer in the majority in the US. I can't help but think that it could get pretty ugly for the race that founded the United States of America, but then such is the fate of the lazy and the overly charitable.

Last time I checked, going to the park was free. That's why parks and related services are the first things to go when city budgets get tight. We can afford $150,000 patrol cars to idle on our streets 24 hours per day... Maybe it is time to open a cash basis church.

I'd say the author did pretty well with her couple hundred word allotment. The point is still hanging there waiting for a reasoned, articulate response: is it a good idea to give a lifetime appointment to someone who does not value the foundational priciples that made her rise to power and affluence possible?

With a constructionist, you know what you're going to get--and it's worked out pretty well for a couple hundred years. Problems, sure. But we've fixed a bunch of them, too. But the system has worked well enough to put Obama in the WH, and Sotomayer on a high court bench. Why do we want to mess with that success? We can (and HAVE) elected extreme radicals to the other branches of government. Wouldn't it be more WISE to be more conservative in our judicial appointments?

Judge Sonia Sotomayor is unfit to serve on the Supreme Court of the United States because she sees herself as a political activist first and a jurist second.

In a speech in California in 2001 she disparaged white male judges, saying, "I would hope that a wise Latino woman with the richness of her experiences would more often than not reach a better conclusion (as a judge) than a white male who hasn't lived that life."

In a current case from the New Haven, Connecticut, fire department, Sotomayor has ruled from the appellant court that job applicants' loss of promotion after succeeding on a test designed to be race neutral was "thorough, thoughtful, and well reasoned," because no black applicant had achieved an acceptable score.

That seventeen (17) "white" test takers had succeeded, including ONE HISPANIC, the test was thrown out by the officials in New Haven and no promotions granted to anyone. Such activism shows Sotomayor is less interest in minority success than enforcing that success by any means FROM THE BENCH.

On the Second Amendment, Sotomayor is anti-gun as revealed in "the right to possess a gun is clearly not a fundamental right" (US v Sanchez-Villar, 2004). This opinion is exactly opposite of the recent US Court ruling supporting an earlier verdict in Washington,, DC, that affirmed the right to bear arms as fundamental as any rights enumerated in any other amendment in the Bill of Rights.

Sotomayor was only following her own philosophy that appellant courts are where "policy is made", which she claimed at Duke University in 2005.

This Obama nominee, as with many others, is out of step with Main Street America, out of step with Supreme Court rulings, and not qualified on her legal history or personal beliefs to be a Supreme Court justice. That she is of Puerto Rican descent and struggled to make her position in life is immaterial.

Have you ever read the First Amendment? The parts about the government not being able to prohibit free exercise of religion or abridging the right of the people to peaceably assemble? As far as I am concerned San Diego's statute requiring churches to spend thousands of dollars to get a "permit" is an unconstitutional prohibition of the free exercise of religion.

And Tim from Texas, like the environmentalists justify everything including painting roofs white as science, liberals justify everything by citing laws and ordinances.
This regulation mentality gave us toilets that save water so that you have to flush twice for the same result and ladders so full of stickers with danger warnings you are afraid to climb on the thing. New Government Motor cars will be so tiny that you won't be able to even get your groceries home in one trip. Car pooling will be replaced by convoys of Smart Cars carrying one or two people max. Equipment gets there on its own.

Tim you do sound a bit angry, and not much like the picture I have of Texans; maybe that answers why you sound so frustrated. Lighten up.

These examples given in the article are a result of socialist liberal democrat teachings that have permeated our schools and colleges and governments. Debate and articles are only gonna get ya so far ultimately. I agree that Sotomayor is not fit for the High Court or any other for that matter. But socialism will not stop at this debate. It has to be dealt a desicive blow everywhere it exists. There may be only one way to rid the country of it. It will probably eventually come to that. Maybe that is Revelations in reality.

Joel, it is THE PEOPLE who decide what laws are unconstitutional! The SCOTUS doesn't have that power and the states cannot be a referee in their own case!

In a democratic Republic We the People are the sovereigns. Think of the three POWERS in SELF government: the Fed, the States, and The People. Constitionally there is the voice of the People in the House, the voice of the States in the Senate, and the whole of the fed in the Supreme Court and Executive. The People (as a whole)and the States make the laws in the House and Senate; the SCOTUS and President are charged with enforcing the laws (police powers).

Notice how the INDIVIDUAL citizen's voice doesn't have a place here? The people have the most POWER: We have the right to vote for our state and national Reps (and now Senators). Then comes THE JURY! Juries, at the time of our founding, sat on Petit and Grand juries. They heard evidence, given under oath or affirmation, could summon one to answer for charges which THEY decided were merited. A common jury then ruled on the LAW as well as the facts of the case. If they found the law UNCONSTITUTIONAL or the charge improperly applied it was their right to "nullify"--not the verdict but the law, by refusing to render a verdict or by a "not guilty". The modern citizen has no idea of the power they have in the jury; they have been railroaded by judges for decades as the judge will not tell the jury of their rights. In fact, modern judges will toss you if you deny that you will obey only his instructions.

You do not have to hunt their page. You can simply alphabetize their names to keep track. Point at the email bar under the name. Email form comes up. Enter your name and address info. That's the time consuming part. Copy and paste your letter and send.

Follow up with a phone call. Make sure you've written down what you are going to say. Confirm they have received your letter. Make sure you send it to all Dems and Rep Senators. Have someone help you with the calls.

I'm taking the position she's enacted her own recusal. I'm posting a sample in several parts to give you the general idea.

Are you in a position to help avoid Judge Sotomayor’s confirmation?

I believe that President Obama's candidate has exercised her own recusal from her Supreme Court Confirmation! That's a new one for me.

She has proudly stated her prejudices, how they add value to her judiciary skills and behavior, and the benefits of bringing these qualities to The Court.
Senator, this is virtually reality TV. How can we confirm someone who publicly makes these statements to the media and our citizens in advance of their confirmation?

Some Examples (Reminders) of Judge Sotomayor’s statements:

• “Personal experiences affect the facts that judges choose to see.”

• “Our experiences as women and people of color affect our decisions.”

• “I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white man who hasn’t lived that life.

She is being labeled a bigot and a racist for this and for many other statements and actions preceding her nomination.

How does she discount the efforts of firefighters, one Hispanic and one disabled, who studied to pass their tests? Oddly enough this seems a contradiction.

Singular Power of the Supreme Court
Is to decide a single case at a time.

To determine if a Grievance has merit to be corrected or rejected.

The Supreme Court has no jurisdiction over any legislation, just in how it applies on a case by case trier of fact.

The Court has assumed greater powers than the entire Federal Government was given, the powers of a dictator or a king to decree a law according to their own judgment.

The ones on the Court who think this this would be impeached if the Rule of Law was still King in America and is not.

No man knows what the law will be from day to day if this court is in session.

This Court has undermined the Rule of Law with contempt for the Rule of Law.

I wonder: when the poor Sotomayor family lived in the housing project in the Bronx, NY - who paid subsidy rent and utilities? I believe it was white male, the tax payer.

And who paid for little Sonia medical expenses when was diagnosed with diabetes? The same white male.

Who paid hundred thousand dollars for the poor Latina woman education in two! Ivy League universities, just like the Obamas. I'm sure it was the white male.

So, even as a small token of appreciation, why not say: "I, Sonia Sotomayor, got where I am today not only because of my talents but also because the white people of the United States provided me with the opportunity and financial support"? That would be much more decent than claim her Latino superiority.

Please not in regards to establishing religion, CONGRESS is prohibited, not state legislatures. Massachusetts and Connecticut both had state established religions, other states had language in their constitutions concerning the need to promote virtue, or christian charity. Some had provisions that elected officials had to swear to a believe in God the Father, Jesus the Son, and the Holy Spirit.
The federal government was created for the benefit of the states, thus it's only natural it would be prohibited from establishing a religion that would be imposed on different states. Also for the ignorant and misguided, NO! the B of R was not incorporated into the 14th. No language saying so, and nothing other than a few obscure references during the 39th congress.
It's not constitutional rights, it's unalienable, God given, natural rights, acknowledged in the US constitution and specifically stated in most state constitutions. Federalism, not nationalism.

The idea it took the 14th A. to incorporate the Bill of Rights is as bizzare as it is absurd.

The very language of the Amendments speak of "the people".

Who are those people if not the citizens.

The 14th was added for one reason, and one only.

Reconstruction of the Southern States or any State that did not recognize blacks as citizens with equal rights.

Even so, some States ignored this and instituted Jim Crow Laws, done by the "legal" system itself.

This woman Sotomayor is just one more person that belongs tot he family of crows the legal system provides a nest for every so often.

Please note here that specific modes of COMMUNICATION are mentioned, NOT expression. Also note, again this applies to congress, not states, thus states are free to determine whether or not they want to allow the display of vulgarity or what have you. Congress cannot say otherwise. Most states had laws concerning "expression",and they did not allow speech that was considered vulgar, and they had public morality laws.
Freedom of expression is a modern invention that cannot be found in the proceedings of the federal convention, nor state ratification debates, and certainly not in the making of state constitutions.
An example from NY's..XXXVIII. Note that licentiousness was not allowed. Most other states had similar laws. Clearly the modern day expression cannot be understood as being protected under the US constitution.

Tim from Texas, this will probably be difficult for you, but note that the questions asked were concerning their right to practice religion, not concerning anything else, not number of people in residence, or parking on the lawn, or any such thing. Facts and Context, Please
The story about the person in Louisiana supposedly questioned about his "Don't Tread on Me" bumper sticker is so vague that my immediate instinct is to run to the "urban legends' websites. If Ms. Rios is going to run it, she needs to do her homework and provide links so we can do ours. (And I mean to REAL news sites---not the sorry likes of WorldNetDaily.)

And what is the context for the San Diego story? The questions supposedly directed to the pastor and his wife by the police suggest that the prayer group in question may have been creating a noise disturbance. Furthermore, one story I did find in a quick check said there had been a complaint about attendees using too many parking spaces in the vicinity. Again, Ms. Rios needs to provide some context before I conclude that this story represents a legitimate example of religious persecution.

And finally, did the woman who occupies an office with three others have the common courtesy to ask her office mates if they minded her placement of a rather large flag in their shared space? Again Ms. Rios seems intent on portraying the offended party as anti-American rather than in providing the kind of context needed to assess the situation described.

Does Sotomayor support La Raza?
I don't know but there is some noise on the internet that she does support La Raza. Evidence of her support would disqualify her in the mind of any patriotic American.

How is it possible
For anyone to doubt Sotomayor is very much a part of La Raza.
