Will the Dems' health care Christmas Present to America be an improvement or detriment to our health care system?


They've been shackled in chains and held in solitary confinement, their defense attorneys have been denied access to key evidence of the case and now their right to request a waiver of a pre-trial hearing — known as an article 32 — has also been denied. Such has been the treatment of the men known as the Pendleton 8 in their quest to receive a fair, impartial hearing with a true presumption of innocence.

The Pendleton 8 are seven Marines and a naval corpsman being held in a brig at Camp Pendleton while waiting trial on charges of kidnapping and murder. On April 26, they were on an ambush mission in Hamdania, Iraq, designed to snare known local insurgents. The men are charged with allegedly taking an Iraqi villager, 52-year-old Hashim Ibrahim Awad, from his home, kidnapping him, placing him in a hole, shooting him repeatedly and staging the scene to make it appear he was an insurgent planting a bomb. The defendants deny the charges and claim they followed the rules of engagement. The federal government thus far has denied their defense attorneys access to evidence of the crime scene. Allegations are based upon witness accounts of Mr. Awad's neighbors. This case is separate from Haditha, Iraq, case.

"The Article 32 hearing is a sham," said defense attorney Jane Siegal, who represents PFC. John Jodka III. "Because the government has denied our opportunity to waive the 32, it is costing the Jodka family tens of thousands of additional dollars in legal fees. All this so the government can parade its coerced statements in front of the media. Coerced statements paraded in front of the media which will potentially pollute the jury pool."

Ms. Siegal's strategy to waive the article 32 hearing and go directly to trial was based upon her belief that the case is certain to go to trial anyway, so why waste time and money with a pre-trial.

As to the allegation of coerced statements, Pfc. Jodka's father, John Jr., described to me the psychological torture he believes his 20-year-old son has endured:

"Immediately after my son was removed from the war zone, literally moments after his rifle was removed from his hands, he was placed in a room for 7 to 7.5 hours — no food, no water, no sleep — and he was told that he was a murderer. They hammered away at him to give statements of what it was they wanted to hear."

Mr. Jodka visits his son every Saturday at the Camp Pendleton brig while balancing his career and family obligations. "JJ has looked me straight in the eye and told me his 100 percent innocent. He continues to maintain his faith in the system and believes the truth will eventually come out."

Said Ms. Seigel of the Naval Criminal Investigative Service: "NCIS was on a mission to place blame and not find the truth. They wanted to make sure that Hamdania did not mimic Haditha. America needs to know that 'there are all kinds of rubber hoses' in the offices at NCIS, and that statements can be extracted from prisoners by using intimidation tactics other than physical force. Ask NCIS why they keep rubber hoses in their offices, and why they think it's funny?"

I did. I called NCIS and asked if rubber hoses were located in their offices and if so, why? NCIS at Camp Pendleton referred me to NCIS headquarters in Washington. NCIS headquarters in Washington told me I would receive an e-mail statement over the weekend. I have yet to receive it. Meanwhile, Ms. Siegal will enter in to evidence a photograph taken at NCIS-Camp Pendleton of a rubber hose on a white board, with the words "my psychological friend" written underneath.

Public perception has been another problem for the imprisoned Marines. First off, with the busy lives we live these days how many people know a Haditha from a Hamdania? Secondly, there is the steady rhetoric of Rep. John Murtha, Pennsylvania Democrat, and the New York Times along with the absolute deafening silence of Republican members of Congress. If it weren't for conservative radio talk-show host Michael Savage and journalist Michelle Malkin there would be no other high-profile voices to counter Mr. Murtha and the NYT.

The government has just completed the construction of a brand new $800k media center at Camp Pendleton. Will this be the scene of a fair, impartial hearing with a true presumption of innocence? Or will this be the scene of a government bent on proving to the world it has the ability to police its own internal affairs? A lot is at stake here. The lives of eight young men are at stake.

Possibly too is the morale of our military. As former marine Leo Chapinsky wrote in this e-mail to me: They recruit you. They train you. They teach you to kill. You kill the enemy and you get treated like the Pendleton 8? Is it any wonder the Marine Corps needs to call up reservists to active duty?

Another example
During an internet radio interview on W.A.R. Wednesday night, John Jodka Sr. shared this example of the antics that went on during the investigation:

“The NCIS took my son out to the Hamdaniya area and made him pick up his brass, made him pick up his shell casings, which were not 2 feet away from, you know, where Mister Awad was, but a hundred meters away, plus. And my son kept telling them that in the NCIS investigation, in the interrogations, which lasted 7 and a half hours plus per session, no food, no water, things like that, and, finally at the end my son got upset, and said, ‘You know, I think you failed Metric School, because 2 feet does not equal 100 plus meters!’ This is the kind of thing they’re dealing with in the lack of rigor in the investigation...”

Of course this isn’t proof, but it does give us all an idea of the kinds of things that were going on behind the scenes, and the kinds of opportunities available to the investigators to frame these guys for murder. If this truly happened this way, this NCIS investigator committed a crime by falsifying evidence, and needs to be prosecuted to the fullest extent of the law.

It would be interesting to ask the Prosecution for the Crime Scene Photographs of the Shell Casings…

During the Hearing, Prosecution revealed they are unable to contact the key Iraqi "eye-witnesses," the accusers in this case. Apparently they don't mind violating the 6th Amendment, which compels accusing witnesses to testify so that the accused can face their accuser.

Any military personnel
How does the UCMJ differ from the way civilian law functions? Do military personnel have a presumption of innocence or a right against self-incrimination?

I am just wondering so that I can get a better understanding of what is happening in this case and others like it.

Military does not give up any of their rights or protections, though the military justice system, appropriately, does function differently, and USUALLY treats the accused with great respect... http://www.INNOCENTMARINE.com has some good summaries and points about the particular violations of the rights and UCMJ being violated in this particular case. Where's pres Bush in all this?
All his military advisors and legal advisors HAVE to be telling him the same thing: This is a railroad job. WHY DOESN'T HE SPEAK OUT? And all the congressPEOPLE who represent these soldiers. Why don't they speak out?

I would like to see our military to a man and woman lay down their arms and tell the politicians, liberals, Pentagon, UN and foreign countries we're defending and supporting to defend their own sorry traitorous asses for a change.

Our finest citizens are honoring their country by sacrificing literally life and limbs with bravery, heroism and courage few of us could find in ourselves.

The Marine Corps Brass in charge at the time, General Hagee and General Sattler, have both moved on (retired, been promoted respectively) from the positions they held at the time, leaving the mess for others to clean up... There have been multiple writing and call-in campaigns, but the silence from the White House and Congress is deafening. Not surprising, though -- Pres. Bush practically ordered this when he sat in the Oval Office and proclaimed that "if the accused are guilty, they'll be punished." Not, "there's an investigation going on, until I know otherwise they have my full support." And when Murtha started shooting his mouth off, did the House of Representatives move to censure him? NO! They are culpable in this travesty. And the members of the Senate and House Armed Services Committees? Remember, they were going to hold public hearings to see how these "atrocities" could happen -- but now when we're finding out that it is the NCIS and prosecutors that are committing atrocities -- well, they don't want to touch that with a ten-foot-pole. Doesn't sound like supporting the troops to me...

This is the result of liberalism
Thank you, American Left, for your insidious and polluting effect on our society! Now we can railroad soldiers who were doing their duty, on spurious charges, provided by dubious witnesses who may themselves be our enemies, and sacrifice those soldiers at your pacifist, defeatist, leftist altar.

Once the United States ceases to seek the truth and provide justice, it cannot sell democracy to anyone.

The bigger problem is not that potentially innocent Marines may have rough, unfair treatment; it is that instigators of falsehoods that generate the mistreatment, even Senators, get a free pass to do their dirty deeds.

I'm disgusted
In this country I used to think that we trid to look at the facts before deciding guilt or innocence. USED is the key word.

Thank you for your measured comments. Unfortunately, because you are not familiar with this case, they do not apply in the least. It's like trying to diagnose a disease without examining the patient. So may I suggest you research this particular situation before prescribing a solution.

As for letting things go forward, in Great Britain in 2005, ~$18 million dollars was spent on a military investigation and murder trial that went on for 29 months. As soon as the Iraqi witnesses took the stand they confessed to lying and making up the charges, and the judge dismissed all charges against the accused before the defense even presented it's case, acknowledging THAT THE CASE NEVER SHOULD HAVE GOTTEN THAT FAR. We are raising issues now cuz we don't want to repeat the Brits mistakes. In this case, the Prosecution has lost contact with the accusing “eye-witnesses,” which deprives these men of their 6th Amendment rights, as well as numerous other breaches described in detail elsewhere.

Corrupt investigations: the guys were shackled and placed in maximum solitary confinement BEFORE THEY WERE CHARGED, then charged before the investigation was complete, the defense has been denied access to the crime scene, the body, and the accusing "witnesses," forensic evidence, and numerous standard evidence that should have been available immediately upon someone being charged with this level of crime. Compare to Haditha -- how long and how many pages of documents have been produced to make sure it is accurate and will stand up to the scrutiny of the public? Here prosecution turns over 40 documents at the Article32 -- the prosecution wants us to look at the damaging statements, the defense says where's the evidence? the prosecutions says look at the statements, the defense says, where are the witnesses? the prosecution says look at the statements, the defense says what is the motivation? When all the prosecution has is one item, not supported by witnesses or evidence, the whole investigation is suspect.

Objectively, we know that COL Navarre responded to complaints made by defense lawyers by talking to the guys in the brig -- through their lawyers and to Navarre apparently they claimed they had been told by the interrogators that 1) if they asked for a lawyer it would be the biggest mistake of their lives, 2) if they didn't sign the statement they would never go home (back to the US -- this was in Camp Fallujah, Iraq, fresh off the front lines, which violates Marine Corps policy respecting mental health regs), and 3) if they didn't sign they would get the death penalty. If an interrogator actually said any of these they violated the UCMJ and will be charged with felonies. The LOG BOOKS corroborate the guys claims that their interrogations were lengthy, 7-8 hours, without food, water or bathroom breaks, which violates the UCMJ, or should have at least raised red flags that since this claim was true, proof that errors were made, the other allegations should have been looked into.

Your 'wise lawyer' is an idiot. If you see a crime being committed -- which is what this is -- these men are being DENIED justice -- you do something about it, you don't wait until after it's been committed. And time is NOT on their side, as these innocent men sit in solitary confinement 22 out of 24 hours a day while their children miss their daddies, wives their husbands, parents, their sons, and they sit with the death penalty hanging over their heads, knowing their families are working multiple jobs, cashing out their life savings, selling their belongings and moving to CA to be near their falsely imprisoned loved ones, knowing they are at the mercy of an untrustworthy justice system.

And this case is ALL ABOUT PUBLIC OPINION -- unfortunately, it's for the sake of IRAQI PUBLIC OPIONION!

John Karr confessed to killing JonBenet Ramsey, was charged with her murder and extradited to Colorado. DNA evidence exonerated him, and the charges were dropped. The Prosecutor is now being criticized for bringing charges in the first place.

Are you saying instead that she should be criticized for not letting the justice system grind through the entire process?

Clearly you have not familiarized yourself with THIS case. Please do so, with what you have just written in mind, and tell me if what you see happening to these accused matches your description of the military justice system in any way. In case you also haven't read the article above and the other entries, start there. Then proceed as directed above to visit Innocentmarine.com, where one of the first entries details an example of NCIS willful and criminal corruption of the case. There WILL be a test --

Dispassionate justice is better? Heck, ANY kind of justice would be better than what is going on here. Which is why those who are defending these guys are so passionate, and will not be silenced by those who don't know what is going on in the case.

And if you were one of the Pendleton guys, you would be as grateful as they and their families are for those who are standing up for and with them against the injustices they are experiencing from the military and the indifference they are experiencing from the uninformed.
