Will the Dems' health care Christmas Present to America be an improvement or detriment to our health care system?


This could take some time, what with the pro forma hearings and all. But President Barack Obama’s nomination of Sonia Sotomayor to the Supreme Court seems doomed to failure. And it’ll be Obama’s fellow Democrats in the Senate who’ll end up voting against her.

How can we know? They’ve told us so.

Let’s backtrack a bit. Senators love to talk. Normally that’s little more than an annoyance -- background noise on C-SPAN. But in this case it gives us a valuable record to examine. Just three years ago the Senate was called upon to approve President George W. Bush’s nomination of Samuel Alito to the high court. And a steady stream of Democrats rose to explain why the nominee was unacceptable.

Oh, this wasn’t partisan, they insisted. They’d be pleased to vote for a qualified nominee who’d help knit the country together. But Alito just wasn’t that person.

But let’s take a look at Sotomayor through the lens these elected officials held up just three years ago. Back then, Democrats on the Judiciary Committee were especially concerned with some papers from Alito’s days at Princeton in the 1970s. “I think we are entitled to this information. It deals with the fundamental issues of equality and discrimination,” declared Sen. Ted Kennedy in a futile attempt to have the hearings postponed.

In the event, the papers in question -- dealing with a group called Concerned Alumni of Princeton -- didn’t mention Alito at all. But if Kennedy remains interested in matters of “equality and discrimination,” he might want to consider a speech Sotomayor gave in 2001.

“I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn’t lived that life,” she said back then. Oh? She seems to be saying a person’s ethnicity or gender (or both) would make that person better able to read the law than a person of a different ethnicity or gender. That’s a nakedly discriminatory statement.

“The Supreme Court is the guardian of our most cherished rights and freedoms. They are symbolized in the four eloquent words inscribed above the entrance to the Supreme Court: ‘Equal Justice Under Law,’” Sen. Kennedy later added. “Will the nominee be fair and open-minded, or will his judgment be tainted by rigid ideology? Is he genuinely committed to the principle of equal justice under law?” It’s difficult to read Sotomayer’s comments and believe she’s dedicated to “equal justice under law.” Guess Kennedy will be voting no.

“I wish the President was in a position to do more than claim a partisan victory,” lamented Sen. Charles Schumer of New York back then. “The Union would be better and stronger and more unified if we were confirming a different nominee, a nominee who could have united us more than divided us.” In fact, because of the pick, “millions of Americans will be at risk of losing their day in court when they suffer the yoke of discrimination.”

Americans like Frank Ricci?

He’s a dyslexic white firefighter from New Haven, Conn. who spent his own time and money studying for an exam that was supposed to determine who would be promoted. He passed the test, along with 18 other white firefighters and one Hispanic. But, since no blacks passed, the city decided to throw the test results out.

Ricci sued, claiming this violated his right to equal treatment under the law, the very thing so many senators claim to be interested in protecting. Sotomayor was part of a three-judge panel that ruled against Ricci. The panel issued a terse decision that another appellate judge, Jose Cabranes, complained about, saying it contained “no reference whatsoever to the constitutional issues at the core of this case.” The Supreme Court is now considering the case.

This should matter to Sen. John Kerry of Massachusetts as well. “We cannot put someone on the Court who makes access to justice harder and more illusive,” he said three years ago. “We cannot put someone on the Court who will fail to serve as an effective check on excessive executive power.” With the Ricci case as a yardstick, it looks as if Kerry and Schumer will be voting no.

In fact, there might be only one Democratic senator who approves Sotomayor.

“I can’t believe the President searched the country and was unable to find a qualified female nominee,” Sen. Harry Reid of Nevada said in 2006. And, “for the third time, this president has turned down the opportunity to make history by nominating the first Hispanic to the Court. How much longer must Hispanics across America wait before they see someone on the nation’s highest court who shares their ethnic heritage and their shared experiences?”

Well, Obama’s pick certainly has the “right” gender and ethnicity. Sen. Reid has made it clear that those attributes are more important to him than mere legal qualifications. He’ll certainly be a “yes” vote.

Let’s see how many other members of his caucus agree. Because if they stick to their principles -- outlined at length just three years ago -- Sotomayor doesn’t seem to stand a chance of confirmation.

What Sotomayer seems to be saying?
She "*seems* to be saying"? Good God, man. It's in English, not some code.

And in plain English, what she IS saying is not a blanket statement that *all* Latinos and/or *all* women would make a better judge than *any* white man. She's talking about "wise" Latina women who have had experiences (by virtue of being in a double minority) that what men don't have. Those experiences would serve as an asset to those who serve on the bench.

In saying that, she's in good company. Justice Alito said the same thing with respect to his heritage at his confirmation hearings.

By the way, she's not even saying it as a statement of fact. It's a statement of desire. The first three words are "I would hope...."

You and your ilk demonstrate contempt for the ability of the average American person to see racism/discrimination -- actual REAL racism/discrimination. We know the difference. This is why Republicans continue to lose credibility among the electorate -- by trying to twist plain English, which we ALL can read, into something it is not. The only people who buy into it is the far right base, an ever-dwindling demographic.

This Statement Says it All
“The Supreme Court is the guardian of our most cherished rights and freedoms."

That line of thinking is what has gotten us into this mess. The Supreme Court was never supposed to have been the "guardian..." -- we were.

The Supreme Court was to only have an "opinion" and were supposed to be little more than what you might call: Constitutional Counsel.

The Congress of the United States (the people) was supposed to be our guardians of freedom and liberty -- in as much as it pertained to the actions of the Federal Government.

But because we have bestowed the unwarranted power of defending our freedom and liberty to the Supreme Court, we have by default bestowed upon them the power to determine what our freedoms and liberties are. So you might say no, the Constitution determines that. But if you give the Supreme Court the power to "interpret" the Constitution as they see it and "See Spot Run" is interpreted by the Court to mean: "Spot rollover and go fetch a stick" -- you have effectively given NINE people the power to govern the nation.

Well, really only FIVE.

Dems can get away with anything...
It's unfortunate, but nonetheless true that the Dems can get away with just about anything with the help of the main-stream media. Despite the fact that what Sotomayor said was backed by her action of blatant discrimination against white firefighters in the Ricci case, the media will and has been focusing on the richness of her life.

Of course, why let little things like "facts" get in the way of a historical moment, a Hispanic woman, qualified or not, appointed to the Supreme Court. Sex and race is all that matters, who really cares about legal qualification and a neutral interpretation of the Constitution.

Everyone is equal, but some are more equal than others... how true?

If americans (we the people) elect a president by 52% we trust that person will nominate a well qualified judge. In a country as large and as diverse as the USA, every judge will find a cohort of people who do not like what he or she believes.

'we the people' are a melting pot of culture and ethnicity. This reality seems to be completely IGNORED by people who are uncomfortable with non-white cultures.

If you believed in 'we the people' when the USA was predominantly white, then you should also hold to that 'truth' when the demographics shift. It is unfortunate that some americans view others as 'less capable of making the right decisions'.

Sonia is well qualifed to sit in the supreme court. The only objection should be based on HER QUALIFICATIONS - not the petty issues republicans are trying to raise i.e. she hates white people, she discriminated against fire fighters......she also sided with Bush on some rulings. Funny how that is not getting much coverage on TH.

I'm sure when Obama is done with the Supreme Court in 8 years they will have found in the Constitution the right to take any and all property or money from white men to redistribute to everyone else. This will include your business being given to a random woman or person of color. this morning. You can,Judge Sonia Sotomayor is unfit to serve on the Supreme Court of the United States because she sees herself as a political activist first and a jurist second. In a speech in California in 2001 she disparaged white male judges, saying, "I would hope that a wise Latino woman with the richness of her experiences would more often than not reach a better conclusion (as a judge) than a white male who hasn't lived that life."

In a current case from the New Haven, Connecticut, fire department, Sotomayor has ruled from the appellant court that job applicants' loss of promotion after succeeding on a test designed to be race neutral was "thorough, thoughtful, and well reasoned," because no black applicant had achieved an acceptable score. That seventeen (17) "white" test takers had succeeded, including TWO (2) HISPANICS, the test was thrown out by the officials in New Haven and no promotions granted to anyone. Such activism shows Sotomayor is less interest in minority success than enforcing that success by any means FROM THE BENCH.

On the Second Amendment, Sotomayor is anti-gun as revealed in "the right to possess a gun is clearly not a fundamental right" (US v Sanchez-Villar, 2004). This opinion is exactly opposite of the recent US Court ruling supporting an earlier verdict in Washington,, DC, that affirmed the right to bear arms as fundamental as any rights enumerated in any other amendment in the Bill of Rights.

Sotomayor was only following her own philosophy that appellant courts are where "policy is made", which she claimed at Duke University in 2005.

This Obama nominee, as with many others, is out of step with Main Street America, out of step with Supreme Court rulings, and not qualified on her legal history or personal beliefs to be a Supreme Court justice. That she is of Puerto Rican descent and struggled to make her position in life is immaterial.

Saying discrimination against whites and Hispanics in New Haven doesn't count is just sophistry. Her verdicts count. In that appellant case, she was criticized by 2nd court colleagues for not basing her ruling on any cited law. It was JUST her opinion.

That she has bragged that she is out to set policy at Duke (while laughing), she admits she thinks she is a legislator and not a member of the judiciary.

Consider if you had a court case and were up against someone maybe more sympathetic--a single minority mother in a wheelchair with a disabled child who were both in a recent car accident and you were just some middle class white dude who is the defendant--would you want someone on the bench to automatically side with the single mother?

That's socialist law, not Am. Const. law.

There seem to be posters here who approve and support Obama's actions. Let's hear from some who are buying stocks, who are hiring more employees, buying new cars and other big ticket items. After all, the economy is going to turn around, all the news is great. Obama's approval rate is going up, the stimulus spending is creating jobs left and right, all you folks are putting your money where your mouth is, getting in on the ground floor of the oncoming boom while prices are low. Well, not all. The famous leftie, George Soros made a billion last year betting the American economy and dollar would crash. That 300 mil he spent getting Obama into the WH was a shrewd investment. Since my opinion was and is, Obama is a disaster, I also invested against the dollar and our economy. I didn't do as well, since i had less to invest, but my investments have at least made money over the past 8 months. My new cash is going into inflation hedges. If i take a pasting, i will be right here on TH moaning over my foolish mistakes. If i am accurate, i trust those of you who predict Obama will usher in an era of prosperity for those at the bottom of the economic ladder, will generously and ruefully admit you got suckered by a snake oil salesman selling a free and effortless lunch. Don't you know that the Italians killed millions of American Indians and enslaved millions of African slaves? Oops, that was "Hispanics." Well, don't you know that during WWII some "Hispanics" were detained in detention camps? Oops -- that was Italians. Mr. Tucker, don't you know that Hispanics were not allowed to play baseball until 1947 -- oops, that was Jackie Robinson -- plenty "Hispanics" played in the major leagues. Well at least we know that Americans hated Hispanics so much that they were never on televion except as criminals and servants. Yeah, Sotomayor had is so tough -- is this maybe even worse than Obama's "oppression" claim when he had no slave ancestors (and his dad got to attend Harvard among some of the schools he attended) and was very atypical for someone with white ancestry as Obama had multiple white slaveholding ancestors.

So then by your own admission, you are inferring that a judge's race, sex, religion, etc. comes into play when applying justice. So "some middle class white dude" might get more sympathy from a "white judge."

Or is it that minorities give preferential treatment, the white men judges are principled and make sound judicial decisions entirely unbiased?

Santomayor said what she said about her own superior ability to dispense justice due to her gender and ethnicity. Appparently, she has no idea that the Spanish killed millions of American Indians and enslaved millions of black Africans. The combined empires of the Iberian peninsula spanned the entire globe -- it is why people in the Phillipines have Spanish names, people in Angola speak Portuguese and Colorado to Antarctica Iberian place names predominate. Angola had apartheid until 1975. She is a child of a culture that imposed a religion and language on conquered peoples -- and she grew up in the U.S. during an era where she received better treatment because of her heritage. My ancestors, who were predominently Irish, did not impose their language on anybody -- nor did they have colonies. The Irish went through multiple periods of horrific suffering -- yet she believes that what she went through was difficult. Her bigotry and lack of basic understanding of history (which is sadly commonplace in Amercia) makes her a frightening choice for the Court. However, Obama -- with his heritage of white slaveholding ancestors and a father who had no connection with slavery or Jim Crow is similar. I love it when they say "you people" did this to "people of color" -- I would love to see them go through Ireland in 1847 or in Derry in 1972.

We can wish.
In this article, I find the author to be incredibly naive. As much as I would like for the stated expectations to be realized, there is reason for serious doubt.
The underlying presumption is that the Democrats will operate with consistency and on principle. The past few decades indicate otherwise.
What I expect is that the Democrats will salute The Chosen One and obediently follow the instructions given them. Further, there will be the handful of RINOs who will go along for whatever reason it is that motivates them.
Thus, if this nomination gets out of committee (which it will), it will be confirmed in short order on the Senate floor.

We who lean right may very well be reading something that is not there.Hell,I'll go as far as to say what she said is not racist.But,(you knew that was coming)for so long,you and yours,have been screaming, "RACIST RACIST",every time a White person says anything close to what she said.So now we all are programed to think that any time any one says anything remotely close to speaking well of one race over another,even when it is a fact, it is automatically assumed racist.You can't have it both ways.Well,actually in this day and time you lefties can.But don't squawk when someone from the right calls you on it.

One way to block her
Rules say that at least one member of the opposition pary must vote to discharge the nominee to the full Senate. With Specter gone, will the republican members of the judiciary committee hold the line? They might, if the nominee is painted as the radical she appears to be.

When is discrimination based on race ok?

Why all of this talk about Obama's successful presidential election means the average American has all of a sudden abandoned all of their values prior to election and are now embracing all things liberal?

They are not. At least not the people I know among my white family and friends who voted for him (including me). It was more of a rejection of the so called conservative free-market republicans that had been screwing up the country for the prior 8 years.

Liberals should be very careful about embracing someone like Sotomayor and what she stands for. Moods and voting behavior can change quickly, especially if Obama fails to restore this country's financial health quickly. Embracing discrimination when it benefits you is the kind of hypocrisy that can come back to haunt you.

Note the elaborate flowchart tying all of the aggressive socialist activists back to BHO. Just read it and ask yourself whether the dots are better connected now in your understanding as to why the Dems are engaging in behaviors that appear to be contrary to the interests of a stable and commercially vibrant America.

It was virtually impossible to find out anything regarding Obama's years at Columbia U during the campaign. Now we know why. The connection between Obama and these Columbia radicals is undeniable.

Senate Judiciary Committee Rule IV states, "...debate shall be terminated if the motion to bring the matter to a vote without further debate passes with ten votes in the affirmative, one of which must be cast by the MINORITY." If all seven Republicans vote NO, that puts an end to Sotomayor's nomination. The only question now remains, which one of them will vote YES to releasing her nomination to the full Senate? Jeff Sessions, Orrin Hatch, Charles Grassley, Jon Kyl, Lindsey Graham, John Cornyn or Tom Coburn. I cannot imagine the pressure that is being put on each of them right now and throughout the whole vettng process.

From their past record of siding with liberals, one or more will most likely vote yes. I would also bet that the ones who do approve her nomination will be from states that have a high hispanic population. And he'll vote yes out of fear of looking like he's anti-hispanic.

Maybe it's time the people put some pressure on these seven Senators, especially if they come from your state. Let's see who are the real Republicans and who are the RINOs. I wonder if they'll have the guts to show their face on the Sunday TV shows doing their usual shuck and jive to explain to us why they voted in the affirmative.

SCOTUS Qualification
As someone said this "Justice" is biased in many ways. One is concerning the firefighters test. Anyone that is fair and objective will have to conclude from her statements that she is ruling from an agenda. She wouldn't even qualify to sit on a jury for the basic trial. She would be taken off the list of a jury for reasons unrelated to her gender or race. Probably the worst example of member of the SCOTUS... Joel, it is THE PEOPLE who decide what laws are unconstitutional! The SCOTUS doesn't have that power and the states cannot be a referee in their own case!

In a democratic Republic We the People are the sovereigns. Think of the three POWERS in SELF government: the Fed, the States, and The People. Constitionally there is the voice of the People in the House, the voice of the States in the Senate, and the whole of the fed in the Supreme Court and Executive. The People (as a whole)and the States make the laws in the House and Senate; the SCOTUS and President are charged with enforcing the laws (police powers).

Notice how the INDIVIDUAL citizen's voice doesn't have a place here? The people have the most POWER: We have the right to vote for our state and national Reps (and now Senators). Then comes THE JURY! Juries, at the time of our founding, sat on Petit and Grand juries. They heard evidence, given under oath or affirmation, could summon one to answer for charges which THEY decided were merited. A common jury then ruled on the LAW as well as the facts of the case. If they found the law UNCONSTITUTIONAL or the charge improperly applied it was their right to "nullify"--not the verdict but the law, by refusing to render a verdict or by a "not guilty". The modern citizen has no idea of the power they have in the jury; they have been railroaded by judges for decades as the judge will not tell the jury of their rights. In fact, modern judges will toss you if you deny that you will obey only his instructions.


Judge Sotomayor
The gender and ethnicity of the nominee are completely irrelevant. On the other hand, her comments concerning the superiority of Latinas to white men are more disturbing as the past memberships of some former nominees in segregated clubs. There could be reasons other than prejudice for those memberships; there is no other reason for statements like hers.

She may yet prove to be fit to be on the Court, but like Lucy, she's got some 'splainin' to do.

Here we go again with that Bu!!$h!t excuse to "go along just to get along."

Everything is "perception" with this impotent gang of RINO empty suits! And heaven forbid they let their obligation to represent their concerns about the damage being done by this “popular” BLACK tyrannical president and, now, his appointment of a Latina tyrannical judge to the Supreme Court, get in the way of their concerns with being accused of a “negative” tone. We all should understand as they seem to imply, that “setting a proper and cordial tone” trumps standing on principle and honestly assessing a member of “the darker nation.”

No one is being fooled by what this “tone” sensitive strategy suggests: The underlying and not so subtle concern is one that Latinas and other “dark-skinned” members of our society, are not psychologically, intellectually, and emotionally-equipped to accept a member of their “darker nation” to be questioned with the same tone that would be used when interrogating a member of the “white privileged class” of “white” Republican Senators and Congressmen. “Oh, no! That would never do!”

Its focus is, as usual, on setting a "tone."

The only problem with this “crabbing approach” is that the entire premise, upon which it is contemplated, is RACIST TO THE CORE.

A Party that considers that there may be such a “perception” that requires that it give validity as useful and necessary, the useless and cowardly application of “biting its tongue” in such a way as to not “offend” the Latinas and “negroes,” is a Party that leaves open to questioning whether such considerations should be made by the Latinas and “negroes” when examining why it is that Republicans feel it necessary to so restrict themselves in their presence in the first place?

These Republicans’ reticence in applying the same harsh “tone” they would no doubt use on a “white man” had that been the nominee offered up for scrutiny by the equally racist Traitor-in-chief, and, in doing so, given them such an opportunity to expose the racists attitudes by their own comments and policies of this race-preferential and racially-divisive administration, speaks volumes, should they adhere to this strategy of condescension and retreat, speaks volumes for their OWN particular brand of racism; and will leave little doubt as to its validity and existence.

Yeah...just like all through the 2008 presidential campaign, the Republicans are about to have standing up and speaking out on principle, silenced, shackled, and paralyzed AGAIN with the same nonsensical, illogical, cowardly, and weak-kneed approach.

In the 2008 run-up to the presidential election, Republicans could not bring themselves to question the character of Black Liberation Theology adherent Barack Hussein "Goddamn America" Obama of the racist Trinity United Church of Satan because, "This is not the kind of tone that any of us want to set..." even though it was racist pastor Jeremiah Wright (Obama's "uncle" and "spiritual mentor") who "set the tone."

Largely as a result of Republican reluctance to apply piercing scrutiny of Obama's radical background and associations, the entire nation is now on track to total bankruptcy and radical Black Liberationist Marxist government under the disciple of Alinsky, Wright, and Frank Marshall Davis.

And the "tone" coming out of the Obama administration is, "You ain't seen nothing yet!"

Obama has made it clear, since day one, what “tone” he intends to use against the Republicans in Congress and the American people. What we are faced with in this debate is the all-too-often told same old story: Tyrannical Democrats whose “tone” is not restricted to open ridicule and derision for all that Conservatism and the Constitution stand for; and Cowardly Republicans more concerned with setting a “positive tone” than they are in standing up for the interests of the Republic.

These Republicans can hide behind their comfortable facade of "positive decorum" and gentlemanly condescending to set a "proper" and sugar-sweet "tone" donning their kid gloves in dealing with the "sensitive" issue of questioning a "Latina" woman, if they like...

...but, in doing so, they won't find any cover or gain any accolades in the Latina community or the "white" one they are so embarrassed to be associated with.

The message they will be sending of their glaring and peculiar brand of weak-kneed reverse- and underhanded- racism when dealing with matters of state, will come through, loudly and clearly, that based on their own sensitivity and unethical cowardliness, they have allowed themselves to be silenced, shackled, paralyzed, and neutered (and the nation along with them) by the vacuity of their own "racist" epiphanies.

And, by so doing, serve neither the "darker nation's" interests, nor those of the American people.

When we vote the Democrats out, we have no other choice, for the good of the nation, than to vote them out also.

Their reticence points to perhaps the most damning truth about where our nation has come to for all of this posturing: These politicians (Republican and Democrat) don’t represent any of us; they have no concept of the lives and struggles of everyday men and women.

Their every decision and machination is a reaction to which way they think the political wind is blowing at any given moment. And they are blown along in the vicissitudes of whatever the current popular trend is current to their appeasement strategy to assure their place at the table of their much-coveted and enjoyed political class entitlement.

They have been so insulated, and for so long, in their Ivory Towers and their lives of Washington political elitism and privilege, that they are indeed the ruling class; more equal than the rest of us.

There is no two Party system in America today.

They are, as Michael Savage so aptly and correctly describes them, all Republicrats and Demicans.

That, my fellow Americans, is the sad and awful truth.

And we are no more or no less than their enablers.

As I understand it there have been 240 plus black gang murders in Chicago year to date. But I guess this shouldn't elicit any sort of emotional response from the liberals. I'm sure in their minds "the white guys made them do it".

But because a white man who was threatened and robbed by black men (I'm assuming he didn't have the presence of mind to check their id's for birth dates during the atack) shot and killed the would be criminals, he is a racist.

Don't do the crime if you can't do the time.

on your points about blacks blaming ole whitey for black on black murder (a basic tenent of Obama's old church states whites are "fostering a social system that encourages them (blacks) to kill off one another.") and that if death was a real possibility for would be robbers the crime of robbery would be greatly reduced.

Why women should not be judges.
Throughout history judges have been predominately male. Why? Because women are basically emotion driven and have the unfounded and foolish notion that justice can be based on feelings. Liberals have bought into this fallacy hook, line and sinker.

Sonia Sotomayor is a prime example with her quote that as a "wise Latina" she better qualified to render justice than a white male.

When feelings and empathy trump what the law demands your legal system quickly become tyranny by a judge whose personal code is now the law of the land. Every judge is now their own fiefdom for making the law conform to their on sense of what is right.

It's time
Since the democratic party is based upon racism and baby murder, it's time they were held to their own standards.

Would that really be justice? You know, the last time I checked, lady justice had a blindfold on so she couldn't tell a person's affluence, color, sex, etc. If it comes down to two poor folks, does the poorest one win the case? The left vilified Clarence Thomas (he was seen as a heretic black because he believed in judicial restraint-- that legislatures should indeed make laws).

They led by (Teddy the Driver Kennedy) disemboweled Bork (one of the most brilliant candidates EVER) because he believed in upholding the Constitution, NOT in wanton judicial activism based on "empathy and feelings."

The ObaMessiah voted against both Alito and Roberts notwithstanding their sterling qualifications because they were NOT liberal activists trying to legislate from the bench.

Now the Left will howl if Soto is even questioned about her loaded, biased statements. Her comment about Latina judges being better than white guys was from a written, prepared text... she even admitted that it was foolish to say it publicly. She was not the least bit sorry that she said it-- but may now be a little bit sorry that it is on tape to reveal her CLEAR biases.

A fair observer might hope that opponents will NOT roll over for her... attentive Americans deserve to see her explain her biases before she moves on to the court to distort justice.

Sotomayor is a racist. That cannot be disputed. America has for many decades, though, allowed, encouraged, and condoned reverse racism in the work place, at educational institutions, and anywhere and everywhere the government exists in America, which is anywhere and everywhere.

Sotomayor's racism is being minimized. Why? Because she has a compelling life story? What does having a compelling life story have to do with her qualifications to sit as a justice of SCOTUS?

What needs to be discussed though, is the now widely known fact that not even one black fire fighter in Connecticut was smart enough, or industrious enough, to pass the promotion test, which was specially designed to make it easier for blacks and other minorities to pass. How is this possible?

The question has to be asked. Are black fire fighter's in Connecticut too stupid to pass a specially designed promotion test?

THIS IS EXACTLY WHAT I'VE BEEN THINKING. The problem is that MOST white people have been browbeaten into adaptive thinking that they should COME LAST in the world; despite all the claims that we think ourselves superior, we've accepted SELF-LOATHING. We've believed the LIES that we are EVIL. Yet I think of all the charitable giving, the time spent working to uplift other races/peoples FOR GENERATIONS, and how minuscule the gratitude, not to mention how ineffective it's mostly been... When's the last time you saw a minority helping a white person who was down? It's been so ONE-SIDED for so long, maybe that's part of the resentment (it certainly hasn't changed hearts). Look how Ward Connelly tried to get states to discontinue Affirmative Action as not helpful; he was pilloried. Bill Cosby, tried to get blacks to 'own up' for their own problems; that was massively rejected! Power, once given, is insatiable. We've created monsters. Their empowerment/our suicidal handoff started in Reconstruction after the Civil War, hit a crescendo in the Sixties, further grew since, and Now the backlash is getting overwhelming.

The whole point of having judges.....
....decide cases is that the cases don't always decide themselves. Conflicts in the law, and conflicts in the application of the law, lead to judicial rulings to resolve those conflicts. And the judges have to apply their wisdom and life experience as well as their knowledge of the law to reach a just conclusion. That's what Sandra Day O'Connor meant when she asserted that a wise woman would reach the same conclusion as a wise man, and it's what Sotomayor meant when she said that, given the right circumstatances a wise Latina woman might reach a better conclusion than a wise man lacking the relevant life experience.

If it was knowledge of the law all by itself could resolve all legal conflicts, then the supreme court could be replaced by a computer program. I doubt that anyone on either side of the political spectrum would want that.
