Globalists Plan to Give Away U.S. Patents

In extraordinary coordination, the judiciary committees of both the U.S. Senate and House of Representatives in the same week approved a bill, which, if it becomes law, will spell the end of America's world leadership in innovation.

Called the Patent Reform Act, it is a direct attack on the unique and successful patent system created by the U.S. Constitution.

Before 1999, the U.S. Patent Office was required to keep secret the contents of a patent application until a patent was granted, and to return the application in secret to the inventor if a patent was denied. That protected the legal rights of the inventor, who could then go back to the drawing board to perfect his invention and try again.

A mischievous congressional "reform" in 1999 authorized the U.S. Patent Office to shift to the Japanese and European practice of publishing patent applications 18 months after filing whether or not a decision is yet made on granting a patent. Congress allowed a patent application, under certain conditions, to be exempt from the publication requirement, but the default procedure is to publish.

The 2007 Patent bill would delete this exemption and require publication of all patent applications 18 months after filing regardless of whether a decision has been made on granting a patent.

By 2006, the U.S. Patent Office had placed 1,271,000 patent applications on the Internet, giving access to anyone anywhere in the world. This foolish practice created a gold mine for China to steal U.S. innovations and get to market quickly.

Chinese pirates don't roam the high seas looking for booty but sit at their computers, roam the Internet, and steal the details of U.S. inventions that the U.S. Patent Office loads online. This practice became China's research and development program, and it is even more efficient than China's network of industrial and military spies.

U.S. policy has always been to grant a patent to the first one who actually invents something. But the new patent bill would change to the foreign system, which grants patents to the first one to file papers.

First-to-file would be a windfall to megacorporations and a big disadvantage to the small-entity inventor. First-to-file would invite an avalanche of applications from the big companies that have the resources to grind out multiple filings, and the small inventor would be lost in the shuffle. The new patent bill offers yet another way for patent pirates to steal U.S. technology. It's called post-grant review: a plan to make it easier to challenge patents during the entire life of the patent.

Another provision of the new patent bill would shift decision-making about damages for patent infringement from market valuations to judgments by judges and juries. This would increase litigation and limit the ability of independent inventors and small companies to enforce their rights or to win just compensation from those who infringe their rights.

The new bill would also transfer unprecedented rule-making authority to the Patent office. That's an abdication of congressional responsibility.

Add it all up, and it is clear that the new patent bill is a big attack on the constitutional property rights of individual inventors and small enterprises, the very kind of entrepreneurs who give us our most important innovations. About a third of all patent applications are filed by individual inventors, small companies, universities, and nonprofit groups.

The common thread in the changes to be made by the new patent bill is that they favor big companies like Microsoft and hurt individual and small-entity inventors.

Microsoft has thousands of patents, and recently argued that the free GNU/Linux operating system infringes over 200 of them. Microsoft wants to be able to use its huge patent portfolio to intimidate potential competitors, and at the same time it wants it to be easier to knock out individual patents.

If Congress wants to do something constructive for our patent system, Congress should reinstate the rule that the Patent Office may not publish a patent application until a patent is granted, and if it is denied the application must be returned to the inventor with his secrets intact.

Congress should also give back to the Patent Office the flow of fees paid by inventors, which Congress took away in 1999 to spend on other projects. Then the Patent Office can hire more examiners and reduce its backlog of 800,000 applications.

The U.S. patent system is the vital factor in the technological lead that gives the United States an edge over competitors and enemies. Globalists cannot be allowed to destroy it.

Why am I not surprised?
This is an even bigger attack on what makes America great than the amnesty/open-borders bill. Who benefits from eliminating patent protection? The big global firms who have the resources to overcome the truncated time frame hurdle for qualifying for protection. Might as well go back to parking your car in that garage. Your ideas will now be stolen by those who have the deep pockets to pay the lawyers.

It's all part of the plan
to bring America into line with the rest of the world by slowly eviscerating our rights. This nonsense will continue until we stop electing these same elites over and over again.

I don't believe in patents either like some other posters, but at least you mention the existence of GLOBALISTS. People think this is some kind of conspiracy theory, but it is very well documented. The Globalists call themselves Globalists. I would invite anyone to read Zbigniew Brzezinski's new book, Second Chance:

"The first of these two world-organizing visions can best be described by the word most closely associated with its substance: globalization. The second is named for its donctrinal source: neoconservatism. Both ideas claimed to express the inner meaning of history."

To Brzezinski, those are the only two that exist, only two that matter. These guys write about this stuff all the time. Brzezinski was the first to fund the Afghan "Al Qaeda" or freedom fighters, as they were called, against the Soviets under Carter. He gave Bush Sr the highest grade of the last three Presidents in his book on Foreign Policy, W got an F.

Please explain to me why that if a person invents something by putting years of research and dollars into the idea, he shouldn't be able to own the idea for at least a number of years to recoup some of the blood, sweat and tears he has put into it?

The American Political system is beyond repair. Fat cats are growing wealthier by the hour and the as the country is slowly decaying right before our eyes.

When we sleep, Congress opens the Gates
Does anyone ever think how easy it is to bribe a congressman if you are a sovereign power? A sovereign power can set up a bank account in its own country or in Switzerland. In neither case can a bribe be proven. These bank accounts are beyond subpoena. The politician can enjoy his illegal fortune outside of the U.S. A net worth alarm will never go off. Over time the funds can be leaked back into his estate.

We don't even stop to think that President Reagan received two million dollars for two weeks of speaking engagements in Japan after he retired. (Japan paid him a much bigger retirement than this Country did). Bush senior may have made $100 million or more from the Saudis while his son is President. Are we so dumb that we don't have disclosure laws on this? George Jr. is and heir to George Sr. The Demos "hate" Bush but going after Sr doesn't occur to them? Are they all paid by the same master?

Does anyone ever consider how easy it would be to black mail politicians like Clinton, or Condit, or Foley? How easy it would be to entrap them? How easy it is to identify their sexual preferences, the bars they frequent and so on? How easy to have the hotel room all lined up and wired for media?

How can we not believe that this happens? Clinton is a near certainty. He would have been easily suckered into stardom. And as a State Attorney General he was the most inviting kind of target for organized crime. Attorney Generals can dismiss cases against drug dealers etc. Once you have the pictures you can sell them. When Clinton became President wouldn't a likely bidder have been China?

We have a Congress that is clearly anti- American. Shouldn't we start to look for sensible explanations?

One thing people don't generally realize is that when a politician is compromised by a sovereign power, he actually becomes more powerful. The sovereign power tends to protect its property. I remember reading that over one hundred people close to Clinton were victims of homicide (most of them were suicides).

At the same time Congressman Condit's mistress seemed to turn against him, she was murdered. In cases like this you can assume the Congressman will have an iron clad alibi. You can assume the Congressman has no idea that the murder is going to occur.

Compromised politicians just start getting unexplainably lucky like Mr. McGoo the cartoon hero.

I wonder if it is already too late to stop the globalist agenda? I see end times events lining up.

All the top tier candidates are bought and paid for, but that is not true with second tier candidates. Globalists control all the media and continue to brain wash people that only the top tier can supposedly win. IT isn't true.

I fear nothing but repentance and revival may save our nation. If any of the top tier candidates win, I expect we will see the destruction of our country during the next term.

States because they had been furnishing Russia with Technology which would help keep up with the
West. Because Reagan had as his main goal and focus the downfall of Communism he was astute to
such going ons.

Years later the leaders of the former Soviet Union would confront Reagan and say that they had now understand that Reagan defeated Communism because he was instrumental in helping to make sure that their access to modern technology was greatly limited. They also claimed Reagan's strategy had worked and that by the time they figured it out it was already too late because they had fallen so far behind and could not keep up.

Unfortunately, those who would have made fun of and mocked Reagan and former Senator Jesse Helms are now in the drivers seat and have no reservations about showering Communist China with the best of Western Technology. There you have the Communist Elites who are in league with Western Industrialists. Some call them traitors while others call them heroes?

America is slowly becoming a third world country.
The American Government is being used as a cash cow to fund Utopian ideologies and World Socialism as I write this. Already our country is over nine (9) trillion dollars in debt and the Wars in different parts of the world is costing American taxpayers billions of dollars each week.

A couple of days ago he met with President Bush on Airforce one to discuss the prospect of yet another vote and all of a sudden Senator Harry Reid changed his vote on the funding of the extra three (3) billion dollars for beefed up security along the fence. I always said that I thought Specter was a fruit cake from time to time, but this time he is becoming a loose cannon!

Internet publication of patents
My husband and I are inventors and have patented a new concept. We requested it remain secret as it would be best for America if it did. So what happened? The Patent office published it on the internet! Congressional leaders who do not realize the need to keep some ideas secret are traitors to Americans.

So, instead of working on the 13 federal appropriations bills w hich are required by law to have been passed and signed by the president in two months time, the Democrats are busy holding sham hearings on nonscandals, debating huge tax increases for all of us, and changing the rules on patents to give our advantages away to our competitors.

Give Away
First of all you are working on the wrong assumption, you seem to believe that what benefits America should remain under American control. Why do benefits that help America. I believe they should be global after all every country wants what’s good for it's citizens and America has no political enemies, unless of course you include Russia, Iran, some radical small fridge groups, the US congress and a few others who would destroy our way of life for their own political gain.

What is wrong if I have an idea and I mortgage my home ,tap out my credit cards and family and friends believe in me and do likewise. What is wrong if a Chinese political prison administrator gets the patent and starts manufacturing the item with slave labor. So what if I lose my home and go bankrupt I least I have benefited a foreign power. Now that’s true patriotism.

Of course give away is the wrong term, people in power give away nothing it is always a trade off that benefits them and hopefully diminishes the power of others, mainly the voters, read campaign finance reform which overrides free speech.

Who understands the importance?
How many people outside of TH will know of this?
How many will understand how it discourages innovation?
How many understand how innovation governs progress that determines their future lifestyle?

Future generations will not enjoy the frequent new luxuries we do today because most of the people who are capable of designing new inventions will be discouraged from going to the trouble.

Corporations don't invent anything.
Some pay people to invent, some steal inventions but most valuable inventions arise from some individual searching for a solution to a problem Corporate executives never encounter and don't even know it need exists.

Patents are bad for economic growth
As an economics student I was exposed to two differing ideas about IP. One that government enforced property rights through patents would encourage innovation and the other that a lack of patents, which are a government granted monopoly on a piece of technology, stifles innovation and leads to less efficient allocations of resources. For the longest time I though patents were necessary until the economic arguments of Doron Ben-Atar, in his book TRADE SECRETS, explained how US industry and economic growth began because of our government's insistence that foreign designs and techniques should be pirated and copied here, in clear violation of patents. The cotton gin is another example. Eli Whitney made some money on the invention, but it was copied throughout all of America and Whitney wasted his small fortune on law suits. If the US had enforced patent laws at its beginning, this would be a much poorer nation with a much impeded economic growth.

Also, modern fashion industries don't operate with patents and they are among the most innovative and profitable industries in the world. They are able to keep secrets in their firms. It's very difficult to reverse engineer medicine(they don't even know all of the secret ingredients in Coke), electronics, or any other type of technology. Imposing a patent, which is a monopoly, for an idea for a long period of time creates an unreasonable monopoly which impedes economic growth. Trade secrets are of course necessary, but those can be handled by entrepreneurs and businessmen, they should not be handled by the government.

While it's true that nobody knows the formula of coke, just a couple years ago there was an article in the paper about somebody trying to sell the formula that held no rights to it.
To belie your train of thought, coke has had ownership of that formula for what, about a hundred years and it hasn't stopped others from economic groth in that field. Lets see theres pepsi, r.c. cola, all kinds of generic colas, not to mention all kinds of diet and flavored colas. Gee, just think if the market hadn't been stiffeled by the patent and trade mark?

I believe the campaign bribes ...er... I mean ... contributions by the Chi Comms that convinced Slick Willie to let Loral sell missile technology to them occured during Clinton's re-election campaign of 1996.

The patents on this technology theoretically would have belonged to Loral, since Loral developed the technology, except that (1) this technology was developed under a government-funded agreement to do the research which undoubtedly had a clause that reserved all patent rights back to the government and (2)the technology had national security implications, which would have given the government cause to block the sale even if it the technology had been developed entirey in private.

What patents? If these inventions really were deveoped in foreign countries then there was no US patent in force. Foreign patents would not apply within our borders unless by specific mention in a formal treaty (not "patent laws" that were "clear[ly]" being violated).

Further, it is not illegal for the Chinese, for example, to use technology patented in the US to make products and sell these products in China. It is none of our government's business what the ChiComms allow their businesses to sell in their own country. This is known as 'lack of standing'. Such patents only become enforceable when/if the producer tries to sell his product in the US.

BTW - I'm sure we would still be technologically backward if we hadn't stolen all those great inventions from other countries. You know, the steam engine, the car, the airplane, the telephone, the radio, the phonograph, the electric light, air conditioning, the internet ... wait a minute. Those are all American inventions. Never mind.

Yes, "they" do. The original formula for Coca Cola used cocaine. This ingredient had to be changed to (mostly) caffeine after the government decided cocaine was addictive and couldn't legally be distributed in any form in the US.

Pepsi got its hands on Coke's formula after the patent expired and offered a virtually identical product that had a little more sugar in it and thus ate significantly into Coke's share of the market.

Coke has in fact changed its formula a number of times in the last 25 years (Ever hear of "Coca Cola Classic? That's what they called the product they made from the 'original' caffeine-based formula after they changed the formula of their main line product to counter Pepsi's extra sweet version of cola). They have also offered variations including Cherry Coke, Vanilla Coke, and a number caffeine-free and/or sugar-free versions. The idea that Coca Cola's formula has remained 'secret' all these years is incorrect.

Difficult? Not impossible? "Difficult" is merely a speed bump to an enterprising company trying to make a large fortune. How "difficult" was it to come up with "Levitra" after "Viagra" was invented?

Why is it that drug companies say they only have the 5 or 6 years that are left on their patents after FDA approval to recover the enormous costs of research if their inventions cannot be easily copied? The idea that the difficulty of "reverse-engineering" is prohibitive is counter-intuitive to the very concept of patents and counter to the realities we have experienced in the market; especially with medicine.

Patent office salesmen
In 1984 I had developed a telecom switch similar to the technology used today by Cisco and NTelecom, for laser signal transmissions. This circuitry was so advanced though, that there wasn't even a process for producing them at the time, although that also would have come with the prototyping of the switch. But both held an expensive price tag to develop, but once done, the circuit would have cost a dime a dozen to produce. This was one product that would have helped revolutionize telecom transmissions, gbit I/O, and using only the power of a watch battery per circuit.

I say 'would have', because I tossed the designs a few years ago. Had I published this design we would today have the ability to have holographic computer displays, for everything from a tv watch to our telephones. I could not agree with the disclosure contracts I was asked to sign, from places like AT&T or Motorola or N. Telecom. In essence they would allow the company the opportunity to show and talk to anyone they chose regarding the designs, to 'determine the validity and compliance to their products already produced'. Nice choice of words for saying that, whether they agreed to fund the R&D or not, forget about any chances to compete with them. They could say no to me, develope a slightly altered version, and beat me to the market with it. Does this sound like a good agreement to sign?

This is exactly what I found with the patent office. If I could not patent all 200 similar structures of the patent at the same time, the free for all of competing products would have kept a start up completely out of the market, without so much as a nod of 'thank you'. So, we'll stick with the $45.00 a month 'broadband', high electric use of our computers and leave it up to the rich companies to steal thier next product to sell to us. It's my invention, can make billions for a company, and I won't recieve even a % of it? Sorry. I see what they came up with as their product to compete with the features I would have offered, but still, they missed the mark.

I don't care about it, I'll never really know if it works, but I'm sure it does. I'd say that there is no good thing about the USPTO, it has always been a clearinghouse of honest people trusting a corrupt program from the start, a place where MIT students can apply thier papers for thier phds.

Edison said that the only security in a patent wasn't in the protection of applying for it, rather in the constant innovation and improvements you made with it. You will always be competing with your own inventions no matter what you do. Just have the best product on the market, and you'll always remain on top. He thought competition was actually good advertising for his products.

It is another method by which the 'good people' in congress are blatantly selling it's citizens down the river. Such a shame for this country to come to this.

Motivation key to invention
When the globalist loons in government fail to protect our patents and actually give away our inventive ideas on the Internet, they are, in effect, destroying all incentive to invent better things for the benefit of all people around the world. Their unjust policies evidence a total lack of the most basic knowledge of human nature, one shared with liberals, fascists, socialists and communists worldwide.

Human beings in real life don’t do much without some sort of financial motivation. The auto mechanic will not fix your car without monetary motivation for his expertise and labor. The cleaning lady will not vacuum your rugs and dust your furniture without the motivation of a paycheck. You and I have to be financially remunerated for our labors because our modern society requires that we have the resources to pay in dollars for the many things necessary to sustain life as we know it today.

The same applies to inventors. They must have effective patent protection for their work if they are to have the ability to profit from it. Without the profit, they correctly will not produce inventions, and humanity is much the poorer for it. When mindless government policy and actions destroy their ability to justly live by their inventions, it effectively destroys their creative lives. This harms not only them, but also all people on earth because all of us are thereby denied the often great benefit of their inventive genius. As it turns out, then, the globalists are ultimately doing that which is of the greatest harm rather than greatest benefit for everyone on our amazing little spinning globe.

People don't know what is coming. Much is already in effect. It is not a conspiracy. It is all out there to read. By 2010 the people "will have figured out it is already too late. The patent giveaway is but another step in the "submergence" of the U.S. sovereignty.
Globalization is presented as good for business and the economy. The formula is marriage of governments, open borders, common currency and control by a single world government. When I got married 40 years ago, guess what I gave up?
Globalization is the effect money, power and control has in steering nations to come under the control of the few.
Unless a viable substitute can be presented that is equally good or better for the business and the economy.....we're sunk.

Well, we have sent all our manufacturing jobs there. Then it was outsourcing other jobs to India. Then we allowed illegal aliens into the country to lower our wages. Now we do this.
