Specter Demands Sanity Check on Obama's Hypocrisy

The Democrats begrudge the 2000 Bush-Gore Florida recount. They blithely complain when Republicans seek valid measures preventing voter fraud. Why then, are the Democrats suddenly blind, deaf, and dumb when Senator Barack Obama and the Democratic National Committee openly avow to disenfranchise voters 1,749,920 in Florida and 594,398 in Michigan? Not only are Obama and the DNC perpetrating a "hi-tech" lynching, but it is blatantly unconstitutional and may even be criminal.

The Democrats allege Florida and Michigan violated the DNC Rule 11.A prohibiting a caucus or primary before Iowa, Nevada and New Hampshire. DNC Rule 20.C.1 specifies the punitive measures that both states lose 50% of their vote: Florida 210 delegates, Michigan 156 delegates. The DNC Rules Committee will be meeting this coming Saturday, May 31 to hear Obama’s utterly bizarre plan allowing only the superdelegates (ironically the votes he desperately needs to capture the nomination) to be seated, while delegates elected by popular suffrage are repudiated by being half-counted, oddly reminiscent of a colonial enumeration of freed "Black Men and Indians."

By why is there even a debate? Constitutional law is unequivocal. Every vote cast must be counted. This constitutional principle, pronounced by the United States Supreme Court since Ex parte Yarborough (1884) and reiterated as recently as Gray v. Sanders (1963), is simply beyond reproach. This rock-bottom constitutional demand applies to primaries as well as general elections. United States v. Classic (1941). Deliberately refusing to count votes cast may, under certain fact scenarios, constitute a Federal crime, United States v. Classic, citing now Section 241 of the Federal Crimes Code. Reiterating black letter law stated in Harper v. Virginia Board of Elections (1966), the high court reasserted in Bush v. Gore (2000) that "once granted the right to vote on equal terms, the State may not, by later arbitrary and disparate treatment, value one person's vote over that of another."

Sen. Arlen Specter (R-PA), now the Senate Judiciary’s ranking minority member, asserted to us in an exclusive interview, that although as a learned attorney he remains obliged to see "how it plays out," that "it may well be worthwhile" to hold Congressional hearings on the Democrats’ refusal to seat Florida and Michigan at the Democratic National Convention. "It’s certainly something I want to consider," said Specter, ruefully hinting things might be different if he was still the Judiciary Chairman. "The essence of democracy is the right to vote," asserted Specter, the Democrat’s contemplation of not seating Florida and Michigan may constitute a fundamental violation of democratic principles. He believes that the Congress must act "very promptly."

Specter emphasized while Republicans are striking bold initiatives such as GOP onDemand™ to promote full voter inclusiveness, the Democrats’ direction in the opposite direction is more than paradoxical, it is "hypocrisy." "They are preaching one thing and practicing another" angrily complained the former prosecutor, who long fought the legendary Philadelphia Democratic machine’s ghost voting and other voter frauds.

While observing there is "great frustration and anger" among his Senate colleagues, Specter’s own disbelief over Obama’s disingenuous media manipulations was self-evident as we heard him literally swearing as he was hanging up the phone. I have observed Specter for 33 years. His strenuous objections are not political positioning for TV cameras, but are at heart of his — and any civic minded citizen’s — core beliefs of what is America. To anyone who has served his country, it is incongruous to even think such an alien idea.

Specter reminds Obama that it is fully within the Congress’ prerogative to investigate the Democrats’ machinations; the presumption that political parties as private entities are immune from oversight or court intervention has long been judicially discredited. Specter also suggested that Florida’s Governor Charlie Crist or Attorney General Bill McCollum and Michigan’s Attorney General Michael Cox or Secretary of State Terri Land Lynn contemplate what would be required to be prepared on June 2 to go into Federal court paren patriae to see emergency injunctive relief under "Section 1983," the legal parlance for the Civil Rights "Anti-Ku Klux Klan" Act of 1871, if the DNC May 31 hearings fail to adhere to the fundamental one-man, one-vote constitutional rule.

And while the GOP concedes Florida’s early calendaring of the Presidential primary caused consternation, at least the "Republicans counted Florida, in stark contrast to the Democrats who didn’t count Florida," according to RNC’s Alex Conant. Highly reliable sources inform me that Senator John McCain is absolute in insisting on fully seating both Florida and Michigan delegations without any penalties, and as one source put it "what the nominee wants, he likely gets."

Michigan State Republican Chairman Saul Anuzi, one of the most conscientious and public-spirited leaders in either party, reiterated the bipartisan efforts throughout Michigan to seat fellow Wolverines at the Democratic convention, as it is beyond reproach that "every vote deserves to be counted." Anuzi, remains as baffled as everyone as to the Obama’s "apologists" spin-doctoring Michigan’s ostracization, warning voter anger from Obama’s boycott of Michigan is not "going away" by a "perfunctory photo-op."

Florida’ National Republican Committeeman Paul Senft pointed to the hypocrisy of Obama "using Florida as an ATM" while agreeing in writing, to refuse to "talk to voters." Senft’s courtly manner couldn’t disguise his own frustration of the irony of liberals resurrecting the "ghosts of 2000" in the recent HBO movie while openly disenfranchising the very same Floridian voters.

Several prominent civil rights attorneys, obviously speaking off the record being mindful they’re outsiders, nonetheless told us that the without question, Democrats must fully seat the Florida and Michigan delegations. (Their response was as if we were asking a "no-brainer" akin to whether kids be eating their vegetables). The universal consensus that the possibility of embroiling the Democratic presidential nominee in criminal proceedings in the midst of a campaign unquestionably should not be a risk worth entertaining.

They also routinely disbelieve Obama’s contention Florida and Michigan must be punished for violating party rules, which although viscerally appealing, is utterly fallacious as a matter of law. If Obama was purportedly "upset" at Florida and Michigan primary dates, he was required by law to act before the primary vote, not afterwards. It is fundamental law that Equity hears not the Sloth coming into court.

Democratic response to Specter is deafening by their utterly stolid silence. DNC press secretary Stacy Paxton did not respond to our phone calls to her office and cell.

Liberal entities such as the Center for American Progress failed to respond. MoveOn (which we, the Trustees of the Republican Leadership Trust are the newly established GOP counterpart) avoids direct press contact by hiding behind a digital wall that requires the Fourth Estate to be vetted through an Orwellian email screening process.

Obama’s response is his website promoting a "National Voter Protection Center" urging us that "in this year's election we have a historic opportunity to bring more people than ever back to the political process and an essential part of that is ensuring every vote counts."

Obama reputes that he was a prominent civil rights attorney, litigating hundreds of voting rights cases. In his September 28, 2007 Howard University speech, Obama implores: "The [students] who left their homes to march in the streets of Birmingham and Montgomery; the mothers who walked instead of taking the bus after a long day of doing somebody else's laundry — they didn't brave fire hoses and Billy clubs so that their grandchildren and their great-grandchildren would still wonder at the beginning of the 21st century whether their vote would be counted . . ." Come again?

Even the ACLU, the "stalwart" Constitutional guardian, prolifically "promising" to get back, failed to produce a single person to justify Obama. And this is despite pleading, as I was once, an ACLU board member for several years, albeit a lone conservative Republican in a sea of liberal, Democratic activists.

If this is so black and white, so basic Constitutional jurisprudence, why isn’t the press demanding someone’s head on a platter? Why are the liberal activists, who defend Mumia Adu-Jamal without blinking an eye, suddenly blind as two million Americans lose their right to vote? Is the Pelosi-Reid Political Correct Doublespeak so powerful as to usurp the very essence of our democracy? No matter where one hails on the political spectrum, as my fellow co-Trustee, Fred Hess, who also serves as an advisor to the son of the legendary Frank Rizzo, observed "there is never an excuse, under any circumstances, to defy the right to vote."

I had the same question. What the heck does the Constitution have to do with the primary selection process of a political party (which is a private organization)? They could nominate Mickey Mouse (and this year, they could do a lot worse); the primary votes are not legally binding on the delegates, and the delegates are the ones who pick the nominee.

In his defense, although he possesses no legal training (and apparently did not even graduate from college), Ol' Pete WAS the youngest Notary Public in Pennsylvania history.

Surely verifying signatures is ample preparation for making bold pronouncements on the finer points of Constitutional Law!

Wirs does not let ignorance get in the way of reality. That alone makes him the perfect RINO.

FYI, "Dreadnaught" went on record last time as being a sock puppet for Wirs (end of the last thread--check it out)--slip of the keyboard, I guess. (I'm not sure he knows what "sock puppet" means, though, so it might have been a false confession.) I also wouldn't be surprised if Wobbie turned out to be Wirs in drag. Who knows?

well. another conservative who up until now had successfully hid her prejudice against a black man running for president has shown her true colors. of course the word"lynching", has nothing to so with the history of Blacks and Whiters in this country. If i remember right ther were about 1600 that we know if and perhaps anothe 100 whose picked over bones are still strung up in the bayous. Yes, But.........
Wirs had an exclusive interview with Specter, the noted staunch Republican who can reach just as far across the aisle as Sidney McShame. But don't you like to hear Specter talk? He puts cotton balls in each cheek in order to make himself sound different. Why didn't his second grade teacher show him how to talk correctly? I understand that Specter and the other brave Repubs are waiting for the opportunity to pounce on the Democrats' abuse of voters and it will come at the opportune time -- right after the a Demo is elected prez.

Count The Votes!!!!
The way I see it is that some people matters, and some don't!!! If Obama was loosing his people would scream to high havens for them to count the votes but because he his "winning" he is at a standstill.

All Parliamentary proceedings, require a "Second".This was made apart of English common law,so as to avoid acts of insanity becoming law.If Mr.Obama is so fortunate,as to become the Nominee of his party.I would consider that a "Second".I won't mention the millions of people who voted for him.Somehow, they always come in last.Now do you see, how childish your approach appears?

Just the Facts, Madam
Whoa, where does this guy come from? At least he got the state names right.
1) The parties get to set up their own rules for the primaries, not a constitutional issue.
2) The Republican party also penalized Florida for scheduling an early primary. Allotting only half the normal delegates should also constitute voter disenfranchisement.
3) This is a DNC issue not something Obama came up with after the vote. All of the Democratic Party candidates including Hillary and Obama signed a statement last August agreeing to the penalty for breaking the early primary rules.
4) Obama has not tried to stop a revote in either state. Many voters choose not to vote since they had known for months that the votes would not count. The only way to properly count the votes would be to conduct a valid primary. Kind of weird to call the Michigan primary valid with only one candidate on the ballot.
This article is as phony as Hillary’s new found shock at the penalty statement she signed and her party hacks wrote back last summer.

I find it ironic that Arlen Specter is furious with perceived injustice in the Democratic primary process, while in his own last election, he pulled every string, called in every favor, to get the GOP establishment to denounce, disparage, and disown his Republican opponent, Pat Toomey, who had a very strong support among conservatives in Pennsylvania.

Despite absolutely not getting a single penny from Republican coffers, Toomey lost by 2 percentage points (51-49%).

I can't think of a high-ranking RINO that conservatives loathe more than Snarlin' Arlen.

This Florida and Michigan voter fraud issue is typical of our "politically correct" agenda that is crippling this country and it's institutions. These are the problems that started with Affirmative Action and Quotas. Instead of welcoming blacks, women and other "so-called victims" of discrimination to compete on a level playing field, the Social Engineers, in all their infinite wisdom, decided to force institutions and businesses to take unqualified people based on color, race, gener, etc. Look at the mess we are in now. Do you want a Quota Neurosurgeon operating on your brain? I don't think so. Do you want an Affirmative Action Quota President? I don't think so. This Florida and Michigan voter fraud case is typical. The minority candidate did not get what he wanted, so cry foul. It happens all the time. A person applies for a job and the more quaified person gets the job. Then, the minority applicant cries Foul and Racism and will not accept that he or she was not as qualified to get the job. This sort of practice has done a great disservice to the country and those who did strive and learn and became qualified and it has done a great disservice to minorities, as well. Now, we have millions of people who believe they should be granted positions based on color or gender without the requisite qualifications. Seat the Florida and Michigan delegates for Clinton, or everybody ought to boycott all future elections. The DNC, who are responsible for this outrageous Affirmative Action to begin with are now at it again.

Specter Demands Sanity Check on Obama's
I lay the blame for this confusion on the so called Chairman of the Democrat party. This man should be sweeping floors rather than manage a political party.

There was no reason on earth why Mich and Fla couln't move their primaries as they wanted.

If the Democrats do not count to votes in Mich and Fla, I think it will be destructive to that party in those two states. It may turn out to be a GOP landslide, which would suit me just fine.

I am not an attorney, but I am less certain that the votes in MI & FLA are subject to election law. Those votes are only to decide who will represent a political party, whose rules for the process vary from state to state. Some states allow an open primary while others only allow those who are registered as Democrats to cast a vote. Some do not even have a primary but rather have a caucus.

If you are not a registered Democrat and are prohibited in some states for voting for a Democrat presidential candidate in the primary process are you somehow disenfranchised ?

If Barack Obama is the great candidate that he is made out to be then how is it that he has not been able to put Hillary Clinton away thus far?

Either way you look at it you have two minority status liberals that border on socialism one of which will be the nominee of the Democrat party and about half of Americans believe that socialism is the solution.

Columns like this one and several others today reveal what everybody who is out in the real world already knows - that conservatism is dying. The fact that the only candidate that cons could find this year was the least conservative icon in their stable, and the fact that they are still using terms like "elitist, values, patriotic, defense of family, mainstream, etc., etc., prove that they are devoid of issues anybody really cares about. This fact has been discussed openly by Pat Buchanan, David Brooks, Sean Wilentz, Ed Rollins, William F. Buckley (before he died) and many other. The fact that well-paid columnists like this one can only think up an attack on a candidates wife reveals how bankrupt of ideas and new thinking the cons really are.
These posts also reflect it, they are also mostly written by the over 50 crowd who do not realize their time has passed, resentment and rage are no longer the mood du jour.

The Conservative movement started with genuinley sophisticated and multi-layered books like Kirk's "The Conservative Mind: from Burke to Eliot" (1953) has now devolved into "How to Talk to a Liberal - If you Must".

This is that movement that Goldwater started, Nixon put into power, Reagan popularized, Gingrich radicalised, Tom DeLay criminalized, and Bush allowed to break into pieces.

the silly columns like this one and angry, vindictive posts like the ones on TH are little more than the spasms of nerve endings in an organism that's clinically dead. The young conservatives I know say it is just a whine-fest by old retired people who are recycling old ideas and lonely housewives who get their greivances from Ann Coulter.

Odd, is it not, that Mr. Wirs even thinks of Specter as a "conservative"? The whole Toomey thing had me upset; I pretty much decided to write off the PA GOP after they stabbed Santorum in the back. They convinced him to back Specter then threw him under the bus when it was his turn. I suppose that that is what he gets for playing the game. Our Commonwealth pretty much stinks when it comes to politics, eh?

Specter Calls Obama Down
Arlen Specter, whose legislative agenda could not be more contrary to the welfare and sovereignty of this nation, calls down Obama on the matter of hypocrisy and calls for a sanity check?

I haven't got squat for Obama, but Specter has done about as much good for our nation as say Hugo Chavez would if he held his seat.

One wonders Mr. Wirs, do you and Donald Lambro wear Pachyderm Print Dr. Denton PJ's to bed at night?

Let the Democrats implode of their own accord, so Senator Specter can get back to stonewalling conservative judges, rooting for illegal alien amnesty, and keep carping about the NFL's spygate, and other such matters near and dear to his heart.

Our country crumbles and all you Kool-Aid drinking pundits and RINO's are interested in is partisan bickering.

Why would any Republican or conservative want to interfere in what appears to be the beginning of the unravelling of the Democrat Party? Yes, every vote should be counted and neither Florida nor Michigan's voting public should be "disenfranchised," but let the Dems sort it out.

We, conservatives and Republicans, need to continue to allow the Democrats to expose themselves as the hypocrites that really are. What we don't need is for elected Republicans to feel they have a duty to their opposition and rescue the Dems from themselves.

Elected Republicans need to get a clue, their first oath of allegiance is to their Republican constituents. I also have a special hesitation in believing the good intentions of someone who has admitted to being a former ACLU Board member.

Democrat Bosses Nominate...John McCain?
Specter is the treacherous grandaddy of RINO's.

Political parties are private organizations. It really is not the place of government to interfere in their nomination processes, except to the extent a breach of contract might be involved. For all I care, they could have their Politburo handpick a nominee. Same goes for the GOP (& it might have gotten us a better candidate, except I think Johnnie WAS handpicked, like a loogie, by the elite). I think this "primary election" nomenclature confuses a lot of people.

Moreover, we all know "superdelegates" are just the Dem boss' way of putting their thumb on the scales while letting the masses think they participate meaningfully in the nomination process. That way, they needn't worry their own people will swallow their own propaganda about the need to appeal to phantom "moderates," and actually nominate a supposed moderate as the Dem candidate!

Be that as it may, I believe the top-tier bosses of the Democratic Party, the elite who actually make national policy and plan strategy, are really moving to get John McCain elected. So he's nominally not a Dem? He'll enact their agenda, in the name of Republicans & (ostensibly) "mainstream" conservatives (i.e. those scared spitless by Obama or Hillary)

That's why there's this slugfest between 2 fatally flawed "identity" candidates (melanin v. ovaries, as I like to say). I suspect they actually want a lot of less fanatical Dem voters to cross over in disgust at the process & the nominee.

If that doesn't work, watch old Ralph Nader throw his hat in once again to peel off the flaming-hair bunch! There's always a way.

This One Was Better
Compared to the last Wirs column, this one was poorly written, long-winded, and factually questionable -- but readable.

Wirs wrote: "Reiterating black letter law stated in Harper v. Virginia Board of Elections (1966), the high court reasserted in Bush v. Gore (2000) that "once granted the right to vote on equal terms, the State may not, by later arbitrary and disparate treatment, value one person's vote over that of another."

-- Of course the Democratic Party is NOT "the State"; in BOTH Michigan and Florida each person's vote was correctly counted and publicly reported. As for valuing one person's vote over that of another:

In the Supreme Court case Wirs cited (United States v. Classic) the Court said that: Section 19 of the Criminal Code, making it a crime to conspire to "injure" or "oppress" any citizen "in the free exercise of any right or privilege secured to him by the Constitution," embraces a conspiracy to prevent qualified voters from exercising their constitutional right of voting, and having their votes counted, IN A PRIMARY ELECTION prerequisite to the choice of party candidates for a Congressional election.

TITLE 18 PART I CHAPTER 13 § 241 "Conspiracy against rights" reads: If two or more persons conspire to injure, oppress, threaten, or intimidate any person in any State, Territory, Commonwealth, Possession, or District in the free exercise or enjoyment of any right or privilege secured to him by the Constitution or laws of the United States, or because of his having so exercised the same ... (followed by a list of penalties)

-- That case involved a congressional election, but it can be seen how the same concept could be applied to a presidential primary.

As for why Wirs is discussing this, can it not be seen as his (maybe clumsy) attempt to aid Operation Chaos?

Unconstitutional?
Wirs seems absolutely certain that the Florida and Michigan situation is unconstitutional.
Seems to me these primaries could be declared invalid, they did not meet the criteria. Of course, this could mean they must be reheld.
The entire Constitution only mentions primaries once and that bars preventing voting on the basis of sex. Certainly, way before that, our Supreme Court may have ruled that it did. Wirs does not say if those rulings actully covered primaries (even if they did, certainly they did not cover the primary violating the established rules concerning it).

We know liberals are hypocritical on a number of issues. The problem is that we conservatives point it out THEN the dems cry foul and say that its just republican 'spin'.

So I say let dems sort this out.

Sure, the dems on the two coasts will pacify themselves and convince each other that the 'no-counts' in FL and MI are justified.

But most Americans will remember all the screeming and whining in the 2000 election. And those Americans should finally see liberals for the hypocrits they really are.
