Nebraska State Senator DiAnna Schimek’s 20-year legislative career is nearly over. She feels victimized, no doubt, by the voter-enacted term limits that make this her final year in power. Still, Senator Schimek hopes to go out with her boots on, firing one final shotgun blast to maim or kill the initiative process she has long abhorred.

You see, it was only through the voter initiative that Nebraskans passed term limits . . . three times.

Yup. It took three petition drives and three votes of the people.

Of course, term limits passed overwhelmingly each time. But a charmed third initiative was required because Nebraska’s supreme court struck down the first two citizen-sponsored measures. Those votes were tossed out (if we wish to be overly kind) because of legal technicalities or (if we wish to be more honest) because of outrageous and tyrannical court rulings.

Though term limits enjoyed sustained and overwhelming public support throughout the battle, the nation’s only unicameral never seriously entertained passing such a measure. After all, what do the voters know?

And without the initiative process, legislators-know-best would have been the rule. That’s reason enough for legislators to despise the initiative, certainly, but there are a plethora of other reasons. The fact that a cap on state spending growth made the ballot in 2006 is one more.

In fact, every initiative breaks the law-making monopoly of legislators. And every initiative is likely to be something legislators oppose, or citizens wouldn’t have to go through all the work of petitioning to place such an issue before their fellow citizens. Most significant reforms have to be enacted over the objections of those who are supposed to be representing us, but are so often representing themselves.

Schimek and her fellow know-it-all nabobs realize they can’t stop term limits at the ballot box. This reality was proven yet again in recent months by voters in California and Maine, defeating attempts by politicians to weaken their respective term limits laws. So, the politicians’ best hope appears to be to wreck the path by which such popular reforms can be instituted over their objection: the voter initiative.

That’s why Legislative Bill 39 passed by a lopsided margin of two to one. Intriguingly, more than 90 percent of those termed-out this year supported Schimek’s parting shot.

What would LB39 do? First, it outlaws paying circulators based on the number of signatures collected. So, what else would determine the pay of those circulating a petition? Paying hourly dramatically ups the cost of petition drives, which is, of course, the goal. That’s simply because it destroys any incentive to work hard, since someone standing on their feet in the hot sun asking everyone they see to sign the petition would be paid the same as his or her colleague sitting under a shade tree talking to friends on the cell phone.

LB39 would also forbid hiring professional petitioners from other states, or even allowing volunteers to cross state lines to assist.

Funny, these legislators forgot to outlaw their own use of out-of-state campaign managers, pollsters, advertising firms, etc.

Both restrictions are, at best, constitutionally questionable. They dramatically impair the ability of citizens to associate and to effectively speak out (I have italicized the keywords here; please cross-reference with the First Amendment). This is not likely an unintended consequence, but the very purpose of this legislation, and of other, similar bills so often advanced by politicians elsewhere.

Schimek certainly isn’t new to the game. Last year she introduced legislation to force petitioners to wear large badges in public, displaying personal information. This equivalent of a Yellow Star would have made it easier to harass and intimidate any citizen who dared petition his or her government. Today’s leftist thugs who have embraced street-theater warfare as a legitimate tactic of (or against) democracy must have wetted themselves when they heard of this measure. And wept when it failed.

Little do these legislators care if courts later find they have violated the constitutional rights of their constituents. They don’t pay the wasted legal fees; the taxpayers do. For instance, two years ago when the cities of Lincoln and Omaha, Nebraska, attempted to deny people circulating a Taxpayer Bill of Rights petition access to public property. It took a federal judge to stop them. They not only ran up their own legal tab, but also — because the civil rights abuse was so egregious and purposeful — were required by the judge to pay over $100,000 to cover the challenger’s legal bills.

Apparently, there’s no ignominy in passing unconstitutional restrictions. Legislators deem any law — no matter how short-lived — effective if it silences citizens who cannot afford legal challenges. And while litigation goes on, the law remains law, prohibiting citizens from effectively gathering signatures.

Politicians are at war with their constituents. In war you use short-term counter-measures as well as long-term ones.

Thankfully, a few politicians show a great deal more respect for the state’s citizens and constitution. When Nebraska Governor Dave Heineman vetoed Schimek’s bill, he wrote to legislators:

In my view, the restrictions proposed by LB39, when coupled with the signature threshold requirements that exist in current law, would unfairly inhibit the ability of citizens to petition their government. I do not believe that we should enact additional barriers to the powers that are reserved for the people in Article III of the Nebraska Constitution.

In fact, Nebraska’s supreme court has ruled that Nebraska’s unicameral has no legitimate power to pass such restrictions, ruling many years ago that the constitutional establishment of the process also means that, “Any legislation which would hamper or render ineffective the power reserved to the people would be unconstitutional.”

This Tuesday, however, Nebraska’s legislature will be back at it, attempting to override the Governor’s veto in what, for some like Schimek, will be their last chance to violently slash back at the power of the people, the power that dares set limits on politicians.

Those who care about such issues — you know, freedom, the First Amendment, and all that — might weigh in with their own voices.

The "Money" Vote
So, NAVYWAVE61, are you saying that only the RICH should be allowed to vote? And that the "working poor" should not have the right to vote if they can't afford to buy a house? What about those who don't want to buy a house but prefer, for whatever reason, to rent? What about those senior citizens who sell their house and "go on the road" in their motor homes, for most of the year?

Only the RICH should have a "voice"? Talk about dictatorship!!!!! Try again.

Parting Shots
I'm not from Nebraska, but I am still angry about the attack on the Constitution by their legislators.

Ignoring the "rights of the people" to determine who they want in office, and for how long is NOT American! It is communist,socialist, dictatorship, anything UN American!

I hope and pray that the people of Nebraska VOTE everyone of those who try to suppress their CONSTITUTIONAL RIGHTS out of office! And keep them out of ANY office.

And the courts should make the legislators pay any and all court related costs out of their own pockets.

The PEOPLE need to fight back with letters to the editors, use tv, radio, internet, and maybe even billboards to get their message across.

I will pray for the success of the PEOPLE of Nebraska.

Today's Hero's Part Three
We had better hope, pray, & work VERY hard to keep politicians out of Washington who seek to "harmonize" America, her laws, her customs, etc., w/ the "international community." The United Nations, its affiliated special interest groups, global corporate interests, & an activist select group of supposedly altruistic wealthy financiers, all who support elimination of national sovereignty, a global government (That one REALLY scares me!!!), global courts, & imposition of global taxation, are hard at work pushing their agenda's on us all! In short, these guys want an international socialist state, which "they," of course, would control since they are the enlightened elite classes & we peons are intellectually incapable of dealing with such complex ideals & issues. (Don't the truly pretentious really crack ya up??)
Fascism comes in many forms & those who assert "the debate is over," or we must all act in the best interests of all combined while suppressing the needs (read: rights) of the individual. Fascism always paints a pretty picture of "how it could be," but they also always fail to mention their suppressions of our individual inalienable rights would make almost ANYTHING Bush 43 has done look pathetically childish. And I for one have a number of complaints about how Bush 43 has run his presidency, from conduct of the war to vacillating on immigration policies & seemingly purposely absent immigration law enforcement.
Beware those advocating change w/ little detail or assertions sacrifices by some will be required. Change for change sake alone is not good policy & does not make for a free nation that is governed "of the people, by the people, for the people."
Hopefully, many of us will become the "real hero's" this nation needs today!

Today's Hero's Part Two
Our system has worked just fine, in fact spectacularly, ever since its inception. But over the past 50 or perhaps even more years, the "elite" have been working diligently to dilute, diminish, disparage, & eventually destroy those revolutionary documents that protect our liberty & rights. I shutter when I hear a politician say they would appoint Supreme Court Justices who will rule based on feelings & popular social agenda of the day. "Popular" is just how Hitler & his henchmen purported their agenda was good for the German people. They sold easy solutions over difficult working for solutions idea's & those people bought into it. Easy & currently popular are not necessarily what is good for us! The "populists" are the "living-breathing constitutionalists" we have today. Notice they always want it to "breath" when it suits "their" political agenda. They are adamant sticklers for even the semi-colons when it comes to accommodating others. The typical "do as I say, not as I do" scenario.
Our founders provided the means to change the Constitution. Its just a tough job to do & the special interests & elite class do not want to have to go through such "tedious" processes. Ironically, it is also tough for average citizens to mount such change efforts. Amendments approved "by the people," is always the way to go. (There is that pesky people thingy again, huh?)
Paul Jacob & a small cadre of others are fighting the "good fight" for the rest of us. We owe him & them our support whenever, wherever, & however possible. Paul & two others are currently facing serious prosecution in Oklahoma because the Attorney General & political elite do not want the people (again!!!), to petition their government.

Today's Hero's Part One
When it comes to "real" hero's today, most fail to realize that they are not athlete's, pop stars, & certainly not movie or TV stars.
Real hero's today are those willing to stand up & fight for the constitutional rights of all citizens. Many fail to tackle such projects because they see the horrible attacks mounted against many who dare to challenge the status quo political establishment.
Paul Jacob is such a hero. And he had to make his fight his profession. Paul had to quit whatever job or career he may have pursued, & dedicate himself to the fight to protect citizens rights in America. Then again, perhaps this was his chosen profession (meaning citizen activist)!?
Look at the responses to any who even question one item of Global Warming theory currently pushed. And despite what many say, much of the contentions remains unproved theory.
We do need federal term limits & yes, we also need "citizen" legislators. The "professional politicians" we have are destroying this nation w/ their destructive & oppressive legislative & bureaucratic regulators' maneuvers, & giving us a recipe for destruction of America.
When we look at the effect of all of the legislative actions taken by states & the fed's, & what we have is a deliberate, even openly contemptuous attempt by global socialists & corporatists, to bring the American Constitution to its end. They have been enacting legislation & enabling regulatory oppression for so long in such incremental methods, that they now have significantly more power than was ever intended for politicians to have.
Our founders always wanted "the people" to be in charge and to run the show. I justify that assertion by pointing out that is why that phrase is used in the original document so prominently. Otherwise, we would have had a system similar to that of Great Britain or other existing European nations of the time.

Parting Shots
The fact remains that someone voted these turds and fascists into office, then re-elected them. God, how I hate the nebbish and the Copperheads.

A couple hundred years ago, the colonies declared independence from a smothering british government.
"No Taxation without Representation" was the battle cry. The government put it's tentacles into all aspects of life, right down to the tea they drank. Sound familiar?

The grievances of the colonists bear a striking resemblance to our current situation.
We're being taxed to the poor-house, while government reaches it's tentacles into our daily lives.

I read your comments and sense the disgust with courts and politicians, and can only add my own trepidations about the future.

I see the day when the public voter will finally have enough of the abuse of power of those people elected to office to work for the voters. I see a return of vigilanteeism and judges, at many levels and lawyers fleeing in great fear of their lives. Some will be caught and those who catch them will possibly have sufficient amounts of rope to halt their particular abuse, in about as long as it takes to gain a short access to the local oak tree, or perhaps even an urban lampost. Then, it is too late for them to reconsider retirement and a life where they are honored for their work, instead of being chased and possibly caught.

The people will finally have enough of these miscarriages of justice, and the ones who are going to be surprised, are those who thought that it would never happen to them. I hate to see that day come, but the arrogant will finally learn their lesson that way, but they will only live a short time to experience their regrets for mishandling of the public trust. The power is still in the hands of the people. The judges and politicians just have not learned that yet. They are in for one final surprise. Lawyers, will also be on the lists. No pleading, no dramatics, just a short trial, by the people, and a quick execution of justice. At long last!

I was with Jacobs on this one until he started beechin that they couldn't hire paid by the signature loafers. If the people consider the initiative petition vital enough they will mobilize and get the signatures themselves. that's the way it SHOULD be and ONLY the way it should be. I don't WANT paid trash either sitting in the shade OR faking signatures for money. Sure the beneath contempt commiequeers like ACORN do it most often, but I don't WANT ANY cheating SOMBEECH trashheads working the political system.

Personally I want em either deported, shot or burned alive, but I'll take simply being banned from pan handling and scamming in politics the same way they are on the take in every other area of life.

Cheating me in politics rapes my most Sacred Liberty--people like that need to be killed in the most grusome and horrible way POSSIBLE as a warning to others not even to ATTEMPT it.

it didn't seem to have enough signatures to make the feb. ballot. that would have been too late for fabian nunez and 41 other term limited servants of the public. puke.
a call to several registars in a couple of counties and viva! there were magically enough signatures to qualify the initiative after all.
the federal government should investigate this blatant disregard for the initiative process.

I propose the addition of decimation.

With every general election, the electorate shall be put the question - Yes or No - "Shall there be a decimation of the Legislature?"

If "Yes" is chosen by a simple majority of the voters, then one in every ten legislators, chosen at random (the state lottery authority might handle the process), is taken out behind the state capitol building and shot to death by musketry.

Instead of "term limits," think of it as limited termination.

With extreme prejudice.

If the state legislature so thoroughly pisses off the general public that a majority of voters wants to put them up against a wall and shoot them, let the will of the people be done.

McCain loves this type of regulation!
McCain-Feingold, etc., etc., all of these initiatives are intended to weaken the power of the electorate to speak freely and exercise power.

Never forget McCain is one of the worst offenders. He has done all that he can to make it harder to criticize politicians before elections via his legislation, thumbed his nose at the Supreme Court in doing so, and also would just love to kill talk radio by bringing back the FAIRNESS DOCTRINE.

Folks, the world won't end if RINOS don't get elected in November. But the party might get honest again. So forget the Chicken Little stuff an stay home, vote for Obama/Hillary (if you are truly radical), or write in your own faves.


It seems that
the will of the people is an inconvenience to those in power. When the immigration bill was thwarted last summer the reaction of some senators was not 'the people have spoken', rather it was, 'we must shut them up.'
This mischief that happens at the state level usually finds its way to Washington.

...but our experience with term limits has been mixed. When they were passed in California by the initiative process, the Democrats, with some RINO complicity, immediately took the issue to the courts, ending up eventually in the US Supreme Court. Term limits won. Nevertheless, politicians, in particular the professional ones that populate the Democrat Party, soon learned to game the system by imaginative redistricting. Even old Governor Elbridge Gerry, of "Gerrymander" fame, would be impressed at a state district boundary map of California. Persons subject to seizures by visual stimulus are cautioned not to view a district map of Calif. for fear of triggering an episode.

The fact is, term limits are just not enough. Without accompanying district laws to restrain the Democrats political greed, you will still have to keep an eye on them. Looking back, Willie Brown would have eventually died. With term limits its now musical chairs.

I beg to differ with you, nowhere in scripture does it say God helps those who help themselves.
It does say we are to occupy til He comes and sadly the American church has failed abysmally in that area. I think it can go back to LBJ's sneak attack with his unvetted bill attached to an appropriations bill that uses a McCain Feingold method of silencing the church. Any
pastor/church that dares speak out about candidates or issues vital to this Republics survival will be visited by the IRS. It effectively silenced the church which had historically been involved in the founding of this country and in abolition of slavery. The church didn't make a peep, instead it cowered under it's collective pews in fear of losing it's tax exempt status. It serves two masters and it seems for most, it isn't The Master. If
they had in '54 and later, would we have God removed from the public square pushed by the
ACLU, or abortion or super rights for homosexuals, etc. Because the church would have
used the power of the pulpit to inform their
people who would then have gone out an voted. The
candidates would have needed to be more responsive to the citizens. The action the church needs to do is 2 Chronicles 7:14 and let God do the rest.

How do we do that?
They refused to listen in 2006, and the people who expecte more of the Republicans tossed them out. DemonRats on the other hand don't care as long as the bread and circuses continue. The Republicans took a beating in 2006, but they still aren't listening..do we have the border secured in a time of war when we know the terrorists are sneaking in disguising as hispanics? No. Are we still being taxed into
poverty? Yes Do we have a fiscal hawk appointed to the appropriations committee? No.
Washington isn't broken, it's a corrupt carbuncle upon the nation seeping it's putrid contents across this Republic. The further the American people went from Providence as the Founder referred to Him, the deeper the corruption went. This Republican form of government will only work if the people have a
spiritual, moral foundation such as it was founded upon, Biblical principles. When we elect and re elect people without any moral/spiritual foundation but a greedy frauds,
then we end up in the pickle we find ourselve.
The people have to get their moral compass reset before we see any changes in our government, either locally, statewide or nationwide.

Part of the problem
is that EVERYONE is allowed to vote! People that don't pay property taxes should not be allowed to vote. Think about it! Those that own nothing have nothing to lose. Those that live on the public dole will always vote for more benefits and those running will always promise more to get their votes.
The founding fathers made owning property part of the requirments for the privelege of voting. There was a good reason for it!

One word-Remuneration
If the citizens want any control over the politicians we must end the gravy trian of high salaries and perks that attracts only the worst scoundrels and opportunists to seek elected office. As things stand, there is incentive only to such, because any honest person would be appalled at the cost in terms of privacy and funds required to gain a seat.

However, add to the mix the big dollars from special interests and you have the perfect motivation for the most ruthless and greedy to win the election at all costs. They sell themselves and their votes before they ever get in office. Then they vote themselves ever greater pay and perks.

So if the pay were nominal, who would run?
Only those who genuinely wanted to serve their communities and make a just society. No one is perfect and mistakes will be made, but what we have today is perfect madness at a very high cost to the taxpayer.

I was once
one who firmly believed that "We, the People" set the term limits of politicans at the ballot box, but the election process and the very nature of those elected has been so corrupted the further we have moved from our founding.
The Founders never envisioned PROFESSIONAL POLITICIANS forming the majority of the elected; they saw members of our communities being elected, members from a wide range of occupations, and thought that those elected would always prefer to return to their given occupations and family duties. Now, people profess the occupation of politics; they prepare for a political career, and no other; they are in politics not for the patriotism and service, but for self-interests. The system has failed, and term limits ARE needed.

Term Limits
We live in an age of abundance and even more so in the age of complacency/laziness. I used to be one who didn't understand or inquire about what goes on in Washington or even in my own state legislation. Sad to say, but my eyes were opened WIDE with 9/11. I started to listen to talk radio and started to learn about how career politicians are all about their own job security.
They (in power) truly believe THEY know what's best for us. We the people need to get educated on politics and start to inform those around us on the benefits of not allowing term after term of incompetence in government. Thanks to Townhall, I continue to learn. Thanks for being there for the "Common American"

I don't think "we" will. "We" haven't so far; why contemplate this impossibility. Oh, it feels good to say, yes, I know.

So move on from that since it is a dead end.

Implementing term limits over the heads of the elected has worked in the past. The trick now is to put such in to play at the federal level. No initiative process exists, and two-thirds of Congress isn't going to happen. Constitutional Convention of the States? Might be a cure worse than the ailment.

Sorry to be so bleak. Options run thin. But so does my patience with all this "we" crap. "We" won't, so what's next?

I doubt that prayer, apart from action, will save America. God helps those who help themselves. In other words, He needs your help if he is to help us.

Term limits for all
I believe that most of us have observed that government at all levels is out of control. I believe that term limits is the only way for the people to re-establish some modicum of control over elected officials. I applaud the voters of all states that have enacted term limits. In my opinion additional performance measures for politicians need to be enacted and enforced.

Things such as adherence, in the strictest sense, to the constitution.
Fiscal responsibility. Responsiveness to the constituency. Service to the citizens. Honesty!

I could go on forever. The unfortunate fact about todays politicians is that the majority are dishonest, spineless, flip flopping liars serving their own ambitions. A long time ago there were some politicians that truly believed in service to us. Now most of them simply believe in serving their own interests.

Then consider the other 7 articles and 27 amendments.

Regarding Obama, as a law prof, you might expect he knows the articles and amendments, but as a liberal, he will be prone to reading into them what he wants, even if it isn't there. That's their MO.

provided for the popular election of Senators vs the original design of being appointed by the States usually through some votes by state legislatures though each state had their own particulars.
It was a bulwark of federalism.
What I can't fathom is the people of Nebraska not bringing a couple of their legislators to heel by suing for breach of the oath of office they took to uphold and defend the state constitution of Nebraska by recall or impeachment. It would seem losing 3 times would be prima facie (is that the right term?) evidence of such a breach.

I too favor term limits. I have voted throw the rascals out for years, with a few exceptions, such as Reagan and the odd whistle-blowing non-political politician. It seems hopeless, since the pols continually stack the deck in an incumbent's favor, and ignorant voters continue strolling down the chute to the slaughter. McCain/Feingold is such a blatant unconstitutional example i will NEVER vote for McCain, in fear of his next such move. Presumably Obama at least might observe the constitution, as fragile as that hope might be. At least he has no active record of malfeasance. McCain and Hillary are impossible, based on the record.

Sgt Relic is absolutely correct - we already have term limits every two years except us dummies out here don't exercise them. It's always, "My guy is okay, but your schmo has to go."

I say clean out the whole nest of vipers, even the good guys, who seem to be out numbered 10 to 1 nowadays by the porkers. What a bunch of crooks, nitwits and downright fools, and who in the HECK keeps voting for them? I don't! I'm working hard to shed So. AZ of two "progressive" dhimmicrats, Raul "Gravy Train" Grijalva and Gabby "Gimme, Gimme" Giffords.

Who are YOU trying to unseat? Find out who is contesting your Reps and Sens in their primaries and get busy. It's the only way we're going to build a firewall against whichever liberal gets in the White House.

We will have to demand term limits with organized marches.

There is no other WAY to get it done.

And more than a few lawyers need to be "run out of town".
We simply cannot endure this much longer.

The two year limit you refer to takes a tremendous amount of public will. It can happen. I have seen it happen here. But it seems as if most people want you to vote your congressman out whilst I keep mine.
We will never get the constitutional amendment needed for term limits at the national level, because the fox must pass the law and he does not want to be shut out of the hen house.

Term limits, but revocation of the 17th Amendment too. We certainly don't need two sets of popularly elected officials and none representing the State.

And unbridled ambitions. Thanks for shining a light on these types of rodents who prefer to operate in the dark, behind a wall of "we know best" nanny-state government power and back-room deals.

We desperately need term limits at the federal level, too. I would like to see more citizen legislators, like the farmers, merchants, and entrepreneurs who founded this nation.

And far fewer blood-sucking lawyers, who deliver little real value to society, and seek to use the law as a means for generating personal power and personal gain rather than a means of protecting their fellow citizen's individual rights and liberties.
