Another Year, Another Hispanic Nominee

Want to read an admirably high-minded statement in all the low, Limbaugh-like clamor over the nomination of Her Honor Sonia Sotomayor to the U.S. Supreme Court?

You're not likely to find a better one than these words from The Hon. Mark Pryor, junior U.S. senator from Arkansas:

"U.S. Supreme Court nominees deserve a high threshold of review. I believe Judge Sotomayor's confirmation hearing should be rigorous, but fair. I am encouraged that her earlier nominations to the bench -- by both a Democratic and Republican president -- have received strong, bipartisan support. It is my hope the Senate can carry out its constitutional duty in a similar fashion with good-faith and civility, and not allow rhetoric to cloud the confirmation process."

Hear, hear. How statesmanlike -- and how Mark Pryor's standards have improved. Because he wasn't quite so high-minded when he was part of the partisan pack that blocked the nomination of another Hispanic nominee to the federal bench not too long ago.

The Democrats in the U.S. Senate managed to hold up the nomination of Miguel Angel Estrada to the U.S. Circuit Court of Appeals for the District of Columbia month after month after month. For more than two years. Until finally the nominee, disgusted with the whole, rigged process, withdrew his name from consideration.

Much like Sonia Sotomayor, Miguel Estrada had a stirring life story. For until he fell into the clutches of partisans like Ted Kennedy, Hillary Clinton, and, yes, Mark Pryor, he'd lived the American dream. Ever since he'd immigrated to the United States at the age of 17 from Honduras, he'd studied hard and worked hard to make something of himself. And succeeded.

He became a successful attorney in private practice, then as a highly effective lawyer with the U.S. solicitor general's office. But he had a crippling political disability. Two of them, actually. It wasn't bad enough that he was a Republican, he was Hispanic, too.

That was a combination Democratic partisans could not abide. Such a two-fer on the federal bench would have shattered their most cherished, most vote-winning stereotypes of the opposition. How demonize Republicans as stupid, xenophobic haters if they're nominating a bright, accomplished immigrant from Latin America to the appellate bench? Can't have that.

If only Miguel Estrada had been just another mediocrity, he might have been acceptable. If only he hadn't done so well at Columbia (Phi Beta Kappa and magnum cum laude) or Harvard Law (magnum cum laude again, having edited the Law Review) or in the U.S. solicitor general's office, or if his name had been Mike Edwards instead of Miguel Estrada ... then he might have been quietly confirmed. He wouldn't have represented such a threat to the Democratic hold on the Hispanic vote.

Here was a promising young man who could have turned out to be a great judge, a light in the law, a natural for the Supreme Court. He had to be stopped. Seven times the Republicans brought up his name, and seven times they fell short of the 60 votes required to close debate and proceed to a vote on the merits of the nominee.

In the past, a nominee to the U.S. Supreme Court might be filibustered, but this was the first time in American history that a filibuster was used to block a nomination to a circuit court of appeals. So clear and present a danger did Miguel Estrada represent to the Democratic hold on the Hispanic vote.

And now Mark Pryor speaks grandly about bipartisanship and good faith and civility and a confirmation process that's rigorous but fair. It's a wonder the words don't choke in his throat. But there are politicians who live and breathe hypocrisy with an ease unimaginable to us ordinary folk.

Some excuse had to be found to deny Miguel Estrada and the country his chance for greatness. So he was asked to reveal confidential memos he'd exchanged with his superiors in the solicitor general's office back in the first Bush administration. Of course he wouldn't. He knew about executive privilege and the attorney-client relationship, and wasn't about to violate either one.

So his critics used Miguel Estrada's principles against him, having so few of their own. All seven living former solicitors general of the United States, including good Democrats like Archibald Cox and Seth Waxman, signed a letter pointing out how outrageous it was to demand that a nominee for the judiciary betray his trust by turning over confidential working papers.

Such a demand, they noted, would inhibit candid exchanges of opinion within government, and cripple its ability to make its case in court. For if confidential memos didn't remain confidential, who would dare confide? But so sensible an argument was ignored. This wasn't about high principle; it was about low politics.

Counselor Estrada's refusal to betray a trust he was duty-bound to keep was portrayed by Democrats as a refusal to cooperate with the nominating process -- a slick but false accusation that was nothing but a cover to hide their own, partisan malice. It would be as if Republicans were to ask Sonia Sotomayor to reveal the confidences she'd been party to during judicial conferences, or maybe some attorney-client memos she'd exchanged in private practice.

But any excuse would do to torpedo a Republican nominee as outstanding as Miguel Estrada.

Conclusion: The next time Senator Pryor tries to get away with all that razzmatazz about fairness and civility and bipartisanship and good faith and the American Way and this being the Land of Opportunity, whether they're talking at a law school or before a Hispanic organization or on the Fourth of July, their listeners should remember just two words:

Miguel Estrada.

What truly baffles me is, why do democrats put so much trust and faith in politicians, lawyers, and government bureaucrats? How much evidence does one need in order to understand the universal government imperative - grow and get more powerful, at any cost? And one of the easiest ways to gain more power is to pit groups of people against each other (just ask Hitler, Lenin, Mao, Castro, Barney Franks, etc.).

And just try and keep up with all the backroom deals in congress. Impossible to track, because there are hundreds done every single day. Just look at the relationships between corporations and special interest groups, and former legislators and legislative assistants.

But it's all for the good of the people, right?

What do you dems have against individual freedom and liberty? Let's keep government power in check. I propose a fifty percent reduction in the federal government budget for starters, given the troubled economic times in which we live.

What would happen to the stock market tomorrow if the government were to announce elimination of the capital gains tax?

Please use the filibuster
to block the nomination of the reverse rascist Sotomayer. Let's keep our principles intact!

It may not be possible to prevent the confirmation of this overreaching racist, but it's also no longer possible to make nice with Senate Democrats. They talk a good line of bipartisan crap when their nominees are up for approval, then Bork every Republican nominee without fail. Take off the gloves, you wimps, and let this nominee experience what Estrada went through. Delay. Impugn. Malign. Filibuster. Make the scumbags fight for every inch of progress.

Every available means
should be used to block Sotomayor’s confirmation by any person in Congress, regardless of their party affiliation, who cares about the integrity of the court.

The pandering to liberals in order to curry favor with the Democrats, which is what Republicans intend to do, is disgusting.

When are these cheese ball wimps going to grow a spine and learn how to fight to win?

Republicans in Congress are NOT REPRESENTING CONSERVATIVES. If they no longer represent us, why should we support them?

Hardly a week goes by that I don’t get something from the GOP asking for contributions. They don’t see any problem with asking for my money, yet they continue to say that they can have a strong party without right-wing conservatives.

If you want my money, gentlemen, you had better start embracing my values. And I mean REALLY embracing them, not just talking about it. I want a party that is not afraid to go up against the fascist Democratic machine and fight to win.

Democrats never minded being tough, even unscrupulous, with you. Why are you SO AFRAID to get tough with them?

I wish I could snap my fingers and send all real Americans of European descent back to where they came from. I would love to see how long the brothers, the hissssssssssspanics, the hormone sexuals, the people of the religion of peace, the illegal invaders, et al. would take to complete the process of turning this once great country into the vile caldron of vomit it has become.

That is SUCH a good question. Democrats are so mistrusting of business. They never met a CEO they didn't hate. Yet they seem to think that (Democrat) politicians can do no wrong. This is SO FOOLISH.

Politicians of all breeds have consistently proven themselves to be the MOST UNTRUSTWORTHY people on the planet.

Politicians have one goal. They want to get elected. They will tell any lie and make any promise to that end. And why wouldn't they? Jobs in government are some of THE MOST cherry positions around. There are endless perks and benefits and ways to dip into public funds for private use and hide it.

They also get a great salary for what is basically a part-time-job, and if they don't show up for work, they don't even have to report to anyone.

Show me ONE EMPLOYER where absinteeism does not matter. Only in government can a person just show up for work when it suites them and not lose their job.

Ronald Reagan said it best. "Government is not the answer. Government is the problem."

I have to admit that until earlier today, at
another site, I had never heard of Miguel
Estrada before. So I did a little bit of
checking up before posting here.

First, as a Democrat of over 30 years standing,
I can state categorically that whatever problem
they (and most particularly Senator Durbin)
had with him, it was not because he was Hispanic.

I did see where Rove decided to "prove" that
to be true, but I went to a copy of the
memo and it simply does not say that. They
had serious problems with his lack of experience, his personality, and his extreme
right wing stance, and they did not want him
in the Supreme Court for these reasons.

But I don't agree with your characterization of Rush Limbaugh as 'low.'

I almost didn't read your article because of it, but perhaps taking a swipe at everybody's favorite punching bag was worth it to make people curious enough to read your article after all.

Politics are low. Politicians are low. Criticism that is undeserved is low. Selling out principles for a vote (or a reader) is low.

I love Rush Limbaugh because he is the same today as he was yesterday. He is more than an entertainer (although he certainly is entertaining), he is a Patriot that refuses to succumb to political correctness (the biggest example of an oxymoron since 'honest politician')

Perhaps if the powers that be in Washington understood how much contempt we feel for them, they'd stop dumping on Rush. The more he is villified, the stronger is the case that he is indeed RIGHT.

All that your 'hear, hear' of praise accomplished is to elevate another lie to some kind of 'plausible' status, when we,in fact, know the truth, and it is not to be found in Washington....on either side of the aisle.

Sotomayor is just another example of hypocricy in action. Set up someone with enough political Teflon (woman, Hispanic, minority, past of poverty or want) and nobody has the moral fortitude to question the RECORD or the AGENDA.

When are the members of the GOP going to grow a set? I want the Party of KNOW.

Well, Tam, I have serious problems with Sotomayor's track record (60% reversals), her personality (as exhibited by some of her statements about legislating from the bench), and her extreme left wing stance, and I don't want her on the Supereme court because of these reasons.

That she's been all but silent on abortion? She even opposed spending public funds to help any organizations that promote abortion abroad? That IS strange for a doctrinaire libtard. Hmmm.

Miguel Angel Estrada
As greatly as I am offended by what the Democrats did to Estrada, it is what they do. It was wrong, it was offensive but it is entirely consistent with their attacks on minority conservatives. As much as I would prefer they not engage in the "politics of personal destruction" I am more concerned that Republicans not fight it to the bitter end, when it happens.

I don't know what, specifically (I don't know the rules of the Senate) could have been done but I know they did not make it a major news story. Could they have called a vote every day, every week, once a month? Could they have called a special session? Couldn't someone come up with a "gang of 14" or some sort of nonsense, anything, everything. This was absolutely outrageous and they just left Estrada hung out to dry for more that 2 years!

There is no better argument, in my opinion, to reject "moderate" Republicans.
