The name Paul Jacob is familiar here in Arkansas, where he led the struggle to get term limits adopted in Arkansas. Then he went national as head of U.S. Term Limits and now runs an outfit called Citizens in Charge.

It seems Mr. Jacob has never outgrown his need to put the people, not the politicians, in control of their government. One needn't agree with his ideas to admire his commitment -- or defend his right to express them.

But anyone so interested in reform was bound to rile an establishment with an overweening sense of entitlement. So when Mr. Jacob and his merry band of reformers showed up in Oklahoma, they naturally attracted the attention of Drew Edmondson, that state's attorney (and zealot) general.

This time Paul Jacob and company were gathering signatures for a proposal that would have limited that state's legislators' power to spend, spend, spend. Their reward for this show of civic interest? Mr. Jacob and his fellow signature-gatherers, Rick Carpenter and Susan Johnson, were indicted.

The charge? Being part of a criminal conspiracy, to wit democracy. Or as General Edmondson phrased it, attempting to defraud the state by hiring folks from outside Oklahoma to help them gather signatures.

Even though, according to Paul Jacob, these reformers sought signatures only from duly registered Oklahomans. And had consulted state officials beforehand to make sure that they were following the rules. No matter. They were indicted anyway. Welcome to Oklahoma.

But there is justice after all -- thanks to the 10th Circuit Court of Appeals. That court now has struck down Oklahoma's law forbidding nonresidents from circulating petitions. Its ruling follows similar ones, just as unanimous, in the Sixth and Ninth Circuit Court of Appeals in cases from Ohio and Arizona.

To quote the 10th Circuit, the right to circulate petitions in the United States of America is "core political speech," and so is fully protected by the First Amendment to the Constitution.

Thank you, founding fathers. Thank you, courts that uphold it.

This indictment has been hanging over the heads of Paul Jacob and those helping him garner signatures for a year. If convicted, they would face 10 years in prison for the heinous crime of taking part in American politics. This indictment should be quashed; it should never have been filed in the first place. As the 10th Circuit now has indicated.

But no right is safe unless citizens are willing to exercise and defend it. For there will always be Drew Edmondsons around to challenge rights they don't care for, and not even the Constitution of the United States, for all its virtues, is self-enforcing.

Only citizens willing to fight for their rights, like Paul Jacob, and courts that respect those rights, like the 10th Circuit, can keep the spirit of the Constitution alive.

The bad news is that General Edmondson may pursue his prosecution/persecution of Paul Jacob even after this appellate ruling. His official spokesman says Oklahoma's attorney general will appeal the 10th Circuit's decision. But now he'll have the First Amendment to contend with.

Paul Jacob, who once again has stood up for the rights of all Americans, deserves congratulations. Also, thanks and respect.

The Hon. Drew Edmondson, a bully with considerable power, a high state office and more ambition than respect for the rights of others, deserves something else. The word is he's planning to run for governor in Oklahoma. Which means the best rebuke for his misdirected zeal may yet be delivered by its voters.

The threats to the First Amendment are many and varied, and probably always will be. It may be in the nature of man to seek to suppress opinion we do not approve of; it's so much more direct then answering it and trusting public opinion to decide the issue. The best way to assure freedom of expression, no matter when and where it may be threatened, would be to have an army of utterly determined Paul Jacobs fighting for it.

Let it be noted that Drew Edmondson is a Democrat. This is the party which currently holds political power, but I hope to see it disappear soon and give us a solid choice between Republicans and Libertarians.

Democrats seem to favor compulsion, though they often try to disguise it as compassion. Oklahoma has given the country some very fine leaders in recent years; I am a bit surprised the citizens of that state would vote Mr. Edmondson into office.

Mr. Jacobs does fine work, and I appreciate Mr. Greenberg for shining the light on this situation.

I am afraid the Democrat Party is getting so Mafia-like in some places,the opposition may just get tired of fighting and throw in the towel.

That would make us really be like a Banana Republic. One party rule.

Paul, Susan and Rick deserve our thanks for standing up for their own rights (and ours) with such passion and strength. I've been watching this case since it began, as well as the numerous delays in the trial (which has still not officially begun). Mr. Edmondson is on a quest to diminish the ability of normal people to change the law when their political leaders don't respond to their wishes. It's just another way the people--the bosses of every government in this country--provide their consent to be governed.

Keep on fighting!

We have district attorneys and attorneys general all over the nation doing their best to punish citizens for exercising Constitutional rights. Matter-of-fact, many of these cases remind me of so many "law enforcers" who reacted to Dr. King and his people as outside troublemakers. Yep, that's what these kind of folks do -- cause trouble for overbearing government officials who think they are above the law. Three cheers for appellate judges who obey the Constitution.

Does not Oklahoma have a procedure for impeachment or other removal for such tyrants? I should think that rights violations of such enormity would be grounds enough.

just goes to show
that not everyone who defends our freedoms carries a gun. Paul Jacobs is an American hero. As to Drew Edmonson, should he run for governor, I'd like to put my outside money to work for his opponent. Strike a blow for democracy as it were.

Take Javert's DNA and mix it with Inspector Clouseau's, and you apparently have Drew Edmondson - unfortunately minus the Javert self-ending.

Seems that the Constitution has lots of enemies these days, on both sides of the aisle. It is the only document worth fighting for - and we may well have to physically defend it one day.

ATTACK ON FIRST AMENDMENT

Thank you for pointing out some of today's heroes like Paul Jacob, Susan Johnson, and Rick Carpenter. We need more like them.
Unfortunately, the Gestapo tactics of Edmondson have been effective. Not one petition drive has been successful since the indictment. The fear in Oklahoma is real and will not cease until Edmondson is behind bars where he can't hurt innocent citizens again. Let's work hard so that day comes soon. Impeachement is only the first step. He needs to face his deserved punishment for his crimes against humanity in Oklahoma.

Edmondson has the money ...
Edmondson is doing what many politicians do when confronted by a private citizen who wants to clean up the system. He is using tax money to bankrupt the common citizen. Clinton was correct when he said that the easiest way to silence disagreement was to take all the money away from those who didn't follow what he wanted. Edmondson is simply doing that.

Ben Franklin once said that we needed a revolution every two hundred years to throw out the trash and start over with a clean slate. It is now past two hundred years.

Gov't Tyranny is Wearing VERY Thin
This unfortunate story proves once again the wisdom of Thomas Jefferson: "The strongest reason for the pople to retain the right to keep and bear arms is as a last resort, to protect themselves against tyranny in government." I'd say to keep the powder dry, folks. It won't get any better during the liberal tyranny ahead of us all.

I would just point out...
It isn't only the Democrats who fight term limits, or who use the power of the state to coerce and compel rather than attempting to persuade.

I would also point out that I'm glad the courts are engaging in "judicial activism". Unfortunately, too many conservatives speak out against this activity, when it isn't judicial activism itself that's the problem, it's that the activism is typically used to infringe on liberties rather than uphold and protect them.

Thankfully, in this case, it's the latter rather than the former. Good luck Mr. Jacob.

For the confused left
"judicial activism," means that the courts circuvent the laws and the constitution and create their own "guidelines," first in their minds and then in some manipulative form in writing, desguised as "law" interpretation knowing full well that it is a political agenda being put forth and not the correct interpretation of the law as they are suppose to do. This is a common practice of the lying leftist liberals and their radicals that want to destroy the US from within, desguised as "democrats," fooling those who want to be fooled, (conveniently).
In this particular case the appeal court which cited the first amendment was not engaging in "judicial activism," it simply cited law correctly, for at least another round of appeals, for further consideration of legal and correct application, not political agenda manipulation better known as "judicial activism."

How can we expect today's "democrats," who do not even know or accept the correct definition of what a true democrat is and what true democracy is and instead support socialism that takes from the productive, ignores responsibility, lives off the blood of those who die to keep them free all of the time attacking them and promoting a kumbaya fantasy world that they know does not exist even in their confines, rewards skin color for job promotions "affirmative action," talk bad about their own country while they leach off of it, promote more and more government in everybody's life, are full fledge hypocrites.....how can we expect them to know the definition of "judicial activism" ? We can't, much less accept it, even in Texas.

Actually, "judicial activism" refers to a judiciary that takes an activist role in either striking down legislation or changing it. One can be active in interpreting the law, or passive.

Don't confuse that with "legislating from the bench", which is completely different, and also doesn't necessarily involve a very activist judiciary (although it typically does).

I would actually prefer a VERY activist judiciary -- one that was very active in getting rid of the un-Constitutional government programs and restrictions on liberty.

I'm just kind of wondering if perhaps Edmondson attempted to indict anyone with ACORN?

Anne, you must be kidding! You know the DemoNazi AG wouldn't file charges against ACORN, the voter fraud arm of the Democrat Party. After all, they may have helped him get elected.

The Republican Party has been castrated by the Democrats. The RNC is made up of a bunch of wussies who just want to play nice.

I watched some of the debate between the candidates for leader of the RNC, over the weekend. Sickening. Girly-men. Everyone of them.

The Republicans in congress have totally rolled over for the Democrats and do not even pretend to fight anymore. I see nothing in the future except a party that has lost it's confidence and it's way.

Very Partison. There is a VERY organized national effort to stop ballot initiatives in general. Bet if you did a Freedom of Information Act request in any intiative state you would see some surprising interstate communication. The left has learned to Spin, Spin, Spin this as out of state outsiders. Only voters from that state can vote to change a law or initiate a new one. No outsiders vote. Imagine if in the civil rights movement no outsiders could come and help when asked. Have you SEEN Mississippi Burning? Please educate our base about the initiative process before its too late.

Thanks...I get so frustrated watching the Democrats use every weapon against the Republicans and they just come back for more.

This last few weeks would be enough to destroy a party and Republicans aren't trying to take advantage of it. It is mind-boggling how impotent they are.
