Having lost the Congress in 2006 and the White House in 2008, Republicans are looking to redefine themselves for a nation that still leans conservative but is less Republican that it has been in decades.

The nomination of Judge Sonia Sotomayor to the U.S. Supreme Court presents just such an opportunity. For, even if the party loses the battle and Sotomayor sits on the court, it can win the war, as Ronald Reagan won the Panama Canal debate, even as Senate Republicans committed collective suicide by voting to give away the canal.

What are the grounds for rejecting Sonia Sotomayor?

No one has brought forth the slightest evidence she has the intellectual candlepower to sit on the Roberts court. By her own admission, Sotomayor is an "affirmative action baby."

Though the Obama media have been ballyhooing her brilliance -- No. 1 in high school, No. 1 at Princeton, editor of Yale Law Review -- her academic career appears to have been a fraud from beginning to end, a testament to Ivy League corruption.

Two weeks ago, The New York Times reported that, to get up to speed on her English skills at Princeton, Sotomayor was advised to read children's classics and study basic grammar books during her summers. How do you graduate first in your class at Princeton if your summer reading consists of "Chicken Little" and "The Troll Under the Bridge"?

In video clips dating back 25 years, and now provided to the Senate Judiciary Committee, Sotomayor, according to the Times, even calls herself an "affirmative action product."

"The clips include lengthy remarks about her experiences as an 'affirmative action baby,' whose lower test scores were overlooked by admissions committees at Princeton University and Yale Law School because, she said, she is Hispanic and had grown up in poor circumstance."

"If we had gone through the traditional numbers route of those institutions," says Sotomayor, "it would have been highly questionable if I would have been accepted. ... My test scores were not comparable to that of my classmates."

Thus, Sotomayor got into Princeton, got her No. 1 ranking, was whisked into Yale Law School and made editor of the Yale Law Review -- all because she was a Hispanic woman. And those two Ivy League institutions cheated more deserving students of what they had worked a lifetime to achieve, for reasons of race, gender or ethnicity.

This is bigotry pure and simple. To salve their consciences for past societal sins, the Ivy League is deep into discrimination again, this time with white males as victims rather than as beneficiaries.

One prefers the old bigotry. At least it was honest, and not, as Abraham Lincoln observed, adulterated "with the base alloy of hypocrisy."

As the Times reports, on the tapes, Sotomayor rejects "the proposition that minorities must become advocates of 'selection by merit alone.' She said diversity improved the legal system."

"'Since I have difficultly defining merit and what merit alone means, and ... whether it's judicial or otherwise, I accept that different experiences, in and of itself, bring merit to the system,' she said, adding, 'I think it brings to the system more of a sense of fairness when these litigants see people like myself on the bench."

What does the latest Times revelation tell us?

That were it not for Ivy League dishonesty, Sotomayor would not have gotten into Princeton, would never have been ranked first in her class, would not have gotten into Yale Law, nor been named editor of Yale Law Review, and thus would not be a U.S. appellate court judge today or a nominee to the Supreme Court.

Indeed, the White House itself leaked that the final four court candidates were all women and Sotomayor was picked because she was a Latina. One wonders how many superior students and judges have been passed over to advance Sonia Sotomayor's career?

From college days to court days, that career reflects, in word and deed, a determination to use any power she achieves to create a society where the demands of diversity triumph over the ideal of equal justice under law. For Sotomayor, the advancement of people of color over white males is justice.

Republican senators should use this Sotomayor nomination to put affirmative action in the dock for what it is -- race-based bigotry against white males so that persons of color can receive the rewards of society that they could not win in free and fair competition.

Lay out the Sotomayor record -- SAT scores, LSAT scores, bar exam score, law review articles and her opinions -- so that we can see up close what those who eviscerated Robert Bork regard as academic and judicial excellence.

No need for name-calling.

Just lay out the lady's opinions and record, so that, if she is elevated, Americans can say: Barack Obama voted against Chief Justice Roberts because Roberts could not measure up to Sonia Sotomayor, his ideal of what a justice ought to be.

This woman would have difficulty being seated on an American Jury ,let alone The Supreme Court.

Her 5th Reversal is coming in The Ricci vs.Destefano Case.

This Latina is a bigot,who has a problem with White Men.

She's Unfit To Serve !

Being selected and if given a life time appointment to the Supreme Court, all respect for the Justice System is gone.

Its just that clear.

With this woman on the bench, knowing the Law will do me no good.

My obligation to win my case will rest on her Latina "wisdom" and female "feelings"
of empathy.

Only a person who has scorn for law and order will support this woman.

Only a person who is full of CONTEMPT for the Law would appoint this woman.

Only a racist and a bigot would want this woman on the Court.

Only Cynicism can father such contempt and scorn for the Justice System to choose such a person as this woman.

No one in America believes this woman is the best this nation has to offer, no one and only a liar would say she is.

A nation of latinas, not a nation of law
When Hitler was elected President of Germany, and then consolidated absolute power in that nation, among the first things he did was to make each judge swear allegiance not to German law, but to him personally, as the Fuehrer. The so-called "Fuehrer Prinzip" (leader principle) elevated a mere man to the status of a diety. The law meant only what he said it did. Thereby Germany became a nation not of laws, but of men. We all know the rest of the story.

Our founding fathers, writing more than a century before Hitler, warned of such people who would pervert the law into a tool of ideology.

Sotomayor is no Hitler, but she has the totalitarian impulse within her. Her slip of the tongue betrayed that she is comfortable legislating from the bench, and her "wise Latina" remark shows that she is all-too-happy to elevate some people above the law. That's close enough to Hitler to scare this student of history, thank you. Sotomayor's exclusive Ivy League education apparently did not teach her why justice is shown with a scale in her hand, and is blind-folded.

She, like her boss, is an intellectually dishonest fraud.

What would MLK think?

Ricci vs. DeStefano will be a watershed case when the SCOTUS overturns it...be prepared.

The fact that Sotomayer benefited from Affirmative Action Quotas explains why 60% of her decisions have been reversed.

Liberals support having less qualified people deciding life and death decisions.

May I suggest that YOU lay the scores out in detail. You well know that the rest of the media will not.

Let's see the evidence
Dan and Achilles make an important point. Pat Buchanan has not presented the evidence to support his case. Sotomayor's own statements suggest that at least some of Buchanan's points are well taken, but suggestion is not sufficient. We need to see the facts. If Buchanan's conclusions about Sotomayor's intellectual and career history are supported by the facts, as I suspect at least some are, then indeed the Republicans in the Senate should parade those facts before the public. That the battle is lost is a foregone conclusion, but that the war is lost is not. Buchanan is right on the money, *provided* the facts support his conclusions.

But overlooked because he was Black.But I think all honest people know these things.College admissions are there to see who will be able to grasp the knowledge presented to them.If one is "let" in,well,just hope you have teachers that will,well,cheat for you.Happens everyday.

Affirmative Action
Is racism at it's worst. It tells women and minorities that they are inferior and not capable of competing with white males. Minorities that do make on their own merit are diminished. No matter how successful, it will always be suspected that they didn't really earn it. I don't understand why Obama has chosen to cheapen this woman's accomplishments by stating that she was the best minority avaiable. I thought his election would change all of the dividing people by race/sex/class. So much for hope and change.

Guess who has steadfastly refused to release HIS LSAT and SAT scores? AlGore, Kerry, Dubya, and others published their personal info, but NOT the ObaMessiah. It is KNOWN that Michelle O. benefited from AA, and it seems probable that the Chosen One did as well. I am NOT impressed that he headed the Law Review; Harvard Law grads have noted that his writings in same were few and underwhelming (like an AA product might write).

Truth be told, the Ivy League schools have reveled in PC AA. Pat is right about Sotomayor... the Court is already considering whether promotions based on AA should be allowed... it CERTAINLY seems reasonable that the Senate explore whether Soto should even be a candidate based on academic merit.

A gentlemen's bet-- conservatives will shy away from close analysis of her REAL aptitude... they are running too scared thanks to the idiot RINO Dubya sullying the brand.

Wow. Pat Buchanan is a flat out racist pig. Buchanan states:

Notice Buchanan says “summer” not “summers”. There are many people- both black and white- who start out college slowly and finish strongly. For Buchanan to condense Ms Sotomayor’s entire college career into one summer in order to disparage her intellect is a racist and intellectually dishonest attempt to dismiss her academic accomplishments. What about the other summers? What was she reading during her sophomore, junior and senior years? The truth is like many people of Buchannan’s ilk, he is assuming with little evidence that everything Ms. Sotomayor has accomplished has been given to her, not earned.-an interesting perspective from a wealthy southern white male.

He continues:

Do tell Mr. Buchannan. The truth is colleges admit students for all sorts of reasons. Many Ivy League colleges admit legacy children to maintain financial support from rich elitist aristocratic families. I wonder if Mr. Buchannan had a problem with George Bush getting into the Harvard MBA program with a “C” average? Also, it’s ridiculous to assume that once admitted to Princeton, Ms. Sotomayor didn’t earn every honor she received. Through his own racism, Mr. Buchannan is assuming that Ms. Sotomayor was incapable of accomplishing these things on her own.

Finally it’s interesting that when people like Buchannan criticize Affirmative Action, they only criticize people of color for being beneficiaries- especially considering WHITE WOMEN are the primary beneficiaries. Where is the outrage over that Mr. Buchannan?

107 of the 111 Supreme Court justices have been white males. 43 out 44 presidents have been white males. The United States Congress and Senate have been overwhelmingly and disproportionately filled with white men since our founding. But Buchannan wants to talk about discrimination against white men???? What a joke he is.

Pat is right-- Robert Bork was perhaps the most brilliant SCOTUS nominee ever, but he scared hell out of Teddy and the rest of the Left because they knew he would not let the Court legislate from the bench.

Bork was an originalist/strict constructionalist who believed in following the Constitution and the Rule of Law. If the left wanted a right to abortion, legislatures or the Congress would have to pass it under Bork's philosophy, because there certainly is no "implied right to privacy" to it in the Constitution or in the amendments thereto.

I favor a woman's right to choose for practical reasons, but as a matter of Law (which I now teach in a community college), Roe v. Wade was hideous.

Oracle1 is right.
The Ivy League has engaged in PC AA for decades. And not just the Ivy League. If the colleges and universities had not been so blatant, we would not be engaging in the sad spectacle of wondering whether a member of minority is an AA case.

In Bizzaro World, we now have confidence that a white male law review editor earned the honor, because at this point in history, the deck is stacked AGAINST him. Even though he never owned slaves or massacred any Aztecs, and even if he worked three jobs to pay his tuition, he will have to be undisputedly exceptional to be appointed or chosen for any college honor.

We suspect that a minority law review editor benefitted from professorial deception in amassing a record of straight A's when his/her academic preparation was weak. How shameful that we now have reason to question the authenticity of the glowing resumes of minorities! We should not be blamed; it's the legacy of The Left.

Grading in the Ivy League
Grading in the Ivy League us subjective in the extreme in the most squishy parts of the liberal arts. I recently found out that Barack Obama was an English major with a minor in Political Science. He spent two years at Occidental College and finished with two years at Columbia University. Now as a fellow english major I smiled when I learned that little bit of information. If you can talk in big over riding generalilties as an English major you are almost guaranteed an A in the course. That is assuming you can produce a reasonably competent written paper once or twice a semester. I was excellent at big picture talking and as we all now know Mr. Obama is perhaps one of the world's best. So when people rail against the grade inflation or affirmative action special "help" that is offerred to some articulate, ambitious and agressive students, remember it is much easier to have top grades in certain parts of the Liberal Arts than it is in the sciences.

I wonder if our judical candidate Sonya Sotomayer is another liberal arts major?

And if so that would shed a great deal of light on the Summa distinction from Princeton. Clearly, she worked hard in high school and college but how many of those "Progressive" teachers were helping her with those accomplishments if they saw someone who was potentially going to be able to move up the affirmative action ladder.

All the more important if she wasn't the sharpest knife in the drawer, because then she would need to remember her Progressive handlers all the more.

That this is true of her appointer, Mr. Barack Huesien Obama is obvious.

AA is an elaborate game
When we hired our Management Associates at a major (top 10) bank, we paid the blacks MORE than the whites... this was because we had high standards for perceived aptitude and demeanor, so it was competitive among the employers for the "sharp blacks."

The trouble was, it was mostly an "Ëmperor's New Clothes" game... the blacks ALWAYS disappointed-- we were not shooting baskets and running races at a bank.

One threatened to go to the media as he left "to expose the racism"-- he admitted with a knowing smile that he was just shaking us down for hush $, which the lawyers said to pay-- we did.

And speaking of compensation, look at your myriad guvment jobs. I now teach business in a public community college as a second career. Part of the reason they classify me as "part-time" is to not have to pay me a real salary and benefits. (I get rave reviews as an instructor; the Dean of the division had his daughter take her one business elective from ME.)

We have substantially NO true black faculty, while about half of students are black-- BUT, we have a number of well-paid full-time black "advisers" and "ädministrators." They drive to campus in VERY expensive cars... res ipsa loquitur-- the image speaks for itself.

The MSNBC cabal seem to be following Keith Olbermann's lead in screeching anti-establishment screeds. Olbermann got open lesbian leftist Rachel Madcow her own show, and with the addition of Ed Schultz, they now have have wide left shows on from 5:00 till the first rooster crows.

Funny thing, their ratings are terrible... interesting. O'Reilly outdoes 3 competing cable news shows-- combined.

What's the problem?
Sotomayor fits this administration perfectly. As a Puerto Rican, she hates the USA. As an Kenyan muslim, Hussein hates the USA. His wife has always hated the USA until November. Pelosi and Boxer think the USA should look like California (a broke, socialist states). And the rest of the left feel the same way...USA is to blame for most of the worlds problems.

Somewhat akin to why Charles de-Gaulle stayed in French army after 1934 when he had put out a treatise on modernising tank (and other) warfare to keep the forces up-to-date; his treatise was ignored by the top generals, suppressed so that only 500 copies could be sold--at least a few of which were picked up by the German Embassy, which DIDN't ignore it--and de Gaulle was frozen at his then rank of Colonel (in hopes that he would muster himself out).

I suspect that Buchanan and Scarborough both recognise (as did de Gaulle) that their employer actually is HOPING they will quit--but (again like de Gaulle) are smart enough to deny that employer the satisfaction.

Indeed. To perpetrate their sham, "those two Ivy League institutions" first had to commit to taking what wasn't theirs, and to making false statements in the bargain.

Further, they had to anoint themselves the ultimate arbiters of what is "fair," and then set up their very distortions of fairness as the highest good.

They surely forswore their own mottoes -- "Under God's Power She Flourishes" (Princeton); "Light and Truth" (Yale) -- insulting the noble name of Him in Whom they were established.

They had to dishonor the family of every fully deserving applicant they defrauded. They had to foment bitter envy between the "classes," plus the murderous resentment that inevitably follows.

In the process, of course, these "two Ivy League institutions" prostituted themselves with shameless abandon.

And it's certain they've been committing these iniquities seven days a week for decades.

Thus, through their affirmative-action "policies" alone, the Princeton and Yale Sanhedrin managed to violate every single one of the Ten Commandments.

Impressive.

I have noticed over time that my Jewish friends hate AA because they are significantly overrepresented at places of academic excellence, so if they are pegged either as whites or as Jews they get shafted.

They are less than 2% of the general population, but are (per a Jewish researcher) easily 15% of physicians and 20% of attorneys. And they abound at the Ivy League schools and places like Duke, Rice and Emory. Vandy openly solicited Jewish applicants some years ago because of their clear abilities... hence "Jewish intellectualism."

I think you are right... in fact, I have had a similar surmise... Pat Buchanan knows that when Chris Matthews and some of the other screaming leftists like Lawrence O'Donnell gang up on him that an objective observer is likely to notice their lack of reasonableness and comity AND perhaps how well his profferings hold up in contrast.

WOW, let me get this straight: she finished first in her class at Princeton and was editor of the Yale Law Revied because every single professor conspired both as an undergraduate and at the most prestigious law school in the country to give her an A because of her race?! The only potential worse idea that you have espoused is when you argued that it was a mistake to go to war with Germany in WWII! Of course that idea ignored: (1), that Germany had already declared war on us; (2), Germany was actively lobbying Mexico to declare war on us to "take back the land they had lost"; and, (3), most importantly they were alrready engaged in acts of war against us by sinking our ships.

Speaking as one who went to a so-called "ëlite school," there is NO QUESTION that PC can engineer results... prima facie, it tells me NOTHING that the ObaMessiah and Sotomayor were Law Review at their respective law schools... such things are VERY political, and at such schools, recently very politically correct.

As I noted earlier here, some distinguished Harvard Law grads have looked back at the Chosen One's Law Review writings (which are normally supposed to reflect favorably on the school) and not seen scholarship of note, distinction or erudition.

At most, AA merely gets your foot in the door of the institution. Once you're there, you have to prove yourself.

So the fact that Sotomayor was #1 in Princeton and made Yale Law Review editor does say something about her intellectual candlepower.

If she was as intellectually impoverished as Pat makes her sound she wouldn't have passed her first vote in the Senate and more importantly there would be 100,000,000,000,0,000,00,000,000,000,000,000 challenges to the huge number of court cases she has heard. Yes, I was watching Mr. Turley on KO's show when he said that. The fact that she may not be the brighest log on the fire doesn't take away from the fact that even if this were true, (which I doubt, based on her record) she clearly is head and shoulders above several of the current members. Also, many of our best Supremes didn't distinguish themselves until they were actually sitting on the court. I actually read it in full, and did not find there the statements that you ascribe to Buchanan. Sure, the ideas expressed there by P.Buchanan are not the ones commonly adopted in "polite US society", and I am not ready to subsribe to _all_ of them, but they are not the ones you ascribe to him. He talks there mostly about the Versailles peace treaty, which ended World War I, and about the consequences of that treaty for the future WW II.

Why Supreme Court (SCOTUS) matters.
Repeating: From 14th amendment to US Constitution:

"All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."

I would prefer that SCOTUS did not stop reading this amendment on

"All persons born or naturalized in the United States",

but read all the sentence, including the qualifier

"and subject to the jurisdiction thereof".

It is in this sense it is related to SCOTUS and to potential nominees. I do not keep strong hopes that this full reading by SCOTUS will happen.
Still, I do object strongly to the practice of "anchor babies" and subsequent "family reunification", we know in which direction this "reunification" goes.

In some sense, it is not so much a matter of principle (I am not a constitutional scholar), but it is a matter of numbers. When 10 millions or 20 millions people come from a single (repeat: single) foreign country, the ability of USA society to assimilate them (a.k.a. melting pot) is saturated to zero. We see that ourselves "by our lying eyes", as opposed to politically correct attempts not to talk about it.
Any appeals to previous abilities of USA to assimilate do not make a cut: that were for much smaller numbers (per year), for populations from diverse countries, and for the USA without welfare system.

someone make the case as to why it would be better to have less people from varying backgrounds at a given University (non-AA)..then more (AA). If those accepted on an AA basis don't produce then bye bye. Unless you believe that most teachers across the country grade minority students on a separate scale in their own classroom, why would you not choose students from varying backgrounds????????

Second question, which someone brought up earlier, do Ivy league schools not practice selective screening when it is about getting endowment funds? If your dad went to Yale, and sends Alumni checks, isn't it easier for you to get in there in general? Is this ok?

The difference between these two examples is one promotes diversity, one does not.

One more thing, why do minority conservatives not believe in AA (goal: promote diversity) when other conservatives love to use these minorities as examples of diversity within the party?????? Does Clarence Thomas actually believe he was not an AA pick for conservatives?

I don't think anyone is saying it would be better to have less diversity. What conservatives are saying is promote the most qualified candidate, regardless of race. Let the chips fall where they may.

Many of us are in total agreement with these conservative minorities who have the confidence and know in their hearts they can compete and succeed in any field, without "affirmative action" policies.

These affirmative action programs from the failed 60's and 70's socially engineered "Great Society", sent an implicit message to many in the minority communities that they can't compete without special support from the government.

I'm sure these conservative minorities insist on "equal treatment" under the law, and you will get no argument there from most conservatives, but that is a different matter than insisting on preferred treatment.

I would think the purported purpose of affirmative action was to better assimilate minorities into mainstream
American society and better get the chance attaining a higher standard of living. But we all can see that it not only has led to denying these to better qualified Americans, but it has also enabled and encouraged minorities to represent the distinct interests of their own minority groups over the interests of the majority of Americans.

Use the following analogy for Sotomayor
Assume that Canada follows the presidential election system as found in US (rather than its actual Whitehall-style Parliamentary system inherited from UK) and also that Canadian government has three branches (executive, legislative and judicial) as US with same selection methods and powers; finally assume that you are all Canadians instead of Americans.

Now assume you have Paul Rose as the candidate for newest judge to Supreme Court of Canada.

How many of you would now say that this is an abomination?

i entertained that possibility, for a split microsecond. with deficient reading and a fair grading system, a student would be ineligible after one year to ever be the top graduate, even if given a brain transplant the following summer. its the cumulative grade point. one bad grade, and you are out of contention. btw, if soto could get a brain transplant, she should have asked for a face transplant too.

For both the courts and the law will be the result, as many have already pointed out, but that may be the intended and desired outcome, trash the whole judicial system by nominating enough biased bigots and pinheads that struggle to get into the double digits for IQ, and you will eventually create a crisis, which will require an "overhaul" of the whole legal system. She used them as a crutch to get this far. She has liked the advantage and she is not gonna take that handicapped sticker out of the window as long as she can keep parking at the front.

The Difference Between

Appreciate the response, and I do see your points. I may also agree that AA is much less helpful nowadays then it was say 15-25 years ago and even before. However for positions where it is impossible to find THE most qualified candidate (there are many qualified), I see no problem with purposefully screening selectively if you are seriously lacking in the diversity department.

Clarence Thomas was qualified, but so were plenty of white judges, but because he was one of few black conservative judges, he was chosen, right?? That is an easy one.

As far as your second post on political correctness....I have to say you are very selective in your examples. He wasn't pissed enough to not accept the benefits of it though. The issue is not only AA but in general selective screening, like the selective screening of all of our presidents and almost all justices until now. So it continues, but now with new criteria introduced, like woman, black, latina, etc...now if these people end up being unqualified than that is another story.

All I hear on the media about Sotomayer is how she 'pulled herself up by her bootstraps' etc. She had both parents, was Dad unable to work? How about Mom?She lived in public housing, so I asume that if they qualified for that, they also qualified for a host of other freebees (WIC,food stamps,ect.) She 'affirmative actioned' into collage and (I assume,again) that school was free. It sounds to me like afree ride all the way. Where I come from, pulling YUBTBS means something else entirely. Also, I have heard nothing about any specific incedents of racial prejudice that she experienced. Most 'minority' students are funneled strait into 'ethnic studies' programs. Is that where she learned the bitter hatred that she harbors for the Old White Man?

Now, WE are the societal minority, being SHOVED ASIDE, by the likes of the Obamas and Sotomayor. Neither accepts 'colorblindness' or merit as valid criteria for opportunities. But OUR efforts/SACRIFICES OF OUR OWN INTERESTS are judged insufficient and no credit to us. *People RESENT free handouts or hands-up.* I see MASSIVE CORRUPTION, WASTE, REVERSE DISCRIMINATION everywhere. JUSTICE IS UPSIDE DOWN; TRUTH IS DENIED. WHY MUST I AND MY FAMILY SUFFER AND PRETEND THIS IS RIGHT?! Trillions of dollars have been spent; trillions more go out in federal/foundation grants BASED SOLELY ON COLOR/SPECIAL INTEREST 'ENTITLEMENTS' and WHAT GOOD RESULTS DO WE HAVE?! Now it seems to be the more CLEVER, MANIPULATIVE and COERCIVE you are, the more prosperous and admired! It's despicable!
WHY, in heaven's name, are white people going along with their own downfall? I'll never forget Jesse Jackson saying, "When I hear footsteps behind me on a dark street at night, and turn to see a white person, I breathe a sigh of relief." WHITES ARE NOT THE ENEMY, WE SHOULDN'T ACQUIESCE TO PARASITES! W.E.B. Dubois once said, "What shall we do with the [black]? -[Dubois used a formerly acceptable Spanish word for black which is part of the 'United ___ College Fund' but I was censored as using an 'unacceptable' word so had to replace it] I say, Do Nothing. Let him rise or fall according to his own efforts. Whites have done enough mischief to us 'helping' us." CAN WE ADMIT THE HUGE MISTAKES MADE IN BEING NAIVELY 'HELPFUL' AND HALT OUR IMPENDING DEMISE?!
