Blago Raises the Stakes

On the eve of the New Year, Gov. Rod Blagojevich, charged with conspiring to sell the Senate seat of Barack Obama, put the ball back squarely in the court of a Democratic Party that had disowned him.

Blago named Roland Burris, former attorney general of Illinois and first African-American ever to win statewide office, to fill the vacated seat. National Democrats and their media auxiliaries went berserk.

This governor, thundered The New York Times, "has taken his hubris to new heights and the misery of Illinois citizens to new lows."

This appointment "will not stand," raged Majority Leader Harry Reid.

If the distinguished 71-year-old lawyer arrives to take his seat, Reid threatened, the Senate will slam the door in his face.

But who is truly showing hubris here? And under what authority and with what justification would Reid deny Burris his seat?

There is not the slightest hint Burris did anything unethical or illegal to win this appointment. Nor is there any doubt as to Gov. Blagojevich's right to make the appointment. He is still governor of Illinois. He has not been convicted of anything. And he not only has the right but an obligation to carry out his duties, one of which is to appoint candidates to fill empty seats in the U.S. Senate.

As for Burris, his qualifications are surely superior to those of Caroline Kennedy Schlossberg, whom Democrats have been pounding New York Gov. David Paterson to appoint to Hillary Clinton's seat.

Before now, Kennedy has shown zero interest in public office or a public life. She has been lax in voting and shown nothing in the way of political substance since being hailed as the next senator.

Who is to say Paterson's motives in considering Kennedy are superior to Blagojevich's motives in naming Burris?

Blagojevich must not appoint anyone, we are told, because he is charged with conspiring to sell Barack's seat, and the evidence is on the wiretap tapes cited by U.S. Attorney Patrick Fitzgerald.

But here in America, even a governor is innocent until proven guilty. And what exactly do those tapes show, other than that Blago and his chief of staff engaged in crude and corrupt talk about getting rewarded with campaign contributions or high office for Blago in return for giving someone the Senate appointment?

Using vile language and ruminating on selling a Senate seat may be sins, but they are not necessarily crimes. Moreover, there is evidence Blago may have been engaged in boastful beer talk and little more.

Rep. Jesse Jackson Jr. says he talked to the governor for 90 minutes about the Senate seat but was never solicited. Nor did he offer anything. Obama aides Rahm Emanuel and Valerie Jarrett both talked to Blagojevich about the seat, and Rahm talked to his chief of staff.

Neither claims to have been solicited for any kind of bribe.

Yet, if Blago were going to sell the seat, the obvious party to sell it to is the man with the power to appoint ambassadors and Cabinet officers, or to convince others to hire Blago: President-elect Obama.

Yet, from all we know, nether Barack nor anyone on his staff ever offered anything illicit to the governor, nor were they asked for anything. Where is the body of the crime?

If Blago and Burris hold firm, this is going to get interesting.

Here we have an African-American elder statesman of the Democratic Party, an honorable and distinguished man, appointed by the governor according to law and the Constitution, to fill a Senate seat. There has been no hint of illegal consideration asked or given by either the governor or Burris.

Yet Harry Reid, who presides over a Democratic caucus of some 60 senators, with not a single black member, is going to refuse this black man a seat to which the law entitles him?

One hopes Burris will stay firm and march up to that Senate, and, if nothing else, expose the hypocrisy.

Our president-elect is from a party that champions busing to integrate public schools but bypasses D.C. public schools to send his girls to exclusive private schools in far northwest Washington.

We have a Democratic Senate that champions affirmative action. Yet not one white male Democratic senator, in a caucus that has not a single black member, has ever volunteered to step down and let the governor of their state replace him or her with an African-American.

Not one. That would be liberals leading by example, not exhortation.

If Democrats believe our institutions of power should look like America, why don't they make their Senate caucus look like America? Why do not a dozen Democrat senators resign, to be replaced by 12 appointed black Democrats, giving one-fifth of all Democratic Senate seats to a minority that gave Barack 97 percent of its vote and Barack and Joe Biden one-fourth of all the votes they received?

Why does not Gov. Paterson follow Gov. Blagojevich's lead and name an African-American of Burris' stature to the U.S. Senate?

Fellas, let's start practicing what we preach here.

How funny is this? Blago has outsmarted them all and I love it!! He has backed them all in a corner and called their bluff.

Fitzgerald is trying to protect the 'messiah',so he stopped the investigation before it reached the top,or else he is editing the tapes so it would seem so.

Blago is a common crook,but no worse than the rest of them,especially Obama,so it is poetic justice that he makes him sweat.

No one knows how this will end,but it is a great show. It is all business,as usual in politics in Chicago. Come on..make'em sweat!!

What better way to get even with your party for wanting your head other then to pick a black man. Picking Burris wasn't by accident, it was out of being investigated by the FBI. Who would Blago pick, had he not been investigated by the FBI. Impeachment, sure makes a person pretty angry especially when no one has been convicted of anything yet. How does it go, you ruin my life out of politics, I'll ruin the good old boy Senate with a black man. The Democrats are always preaching to the Republicans about civil rights and diversity. It's time to practice what you preach.

What's the big deal with Burris taking Obama's 'empty seat' ? It's an empty seat filled by an empty suit who is replacing an empty suits' empty seat. Decipher that one.

It sure is reassuring that everyone has rushed to insist that one Illinois Democrat politician had no improper conduct with another Illinois Democrat politician. No connection at all.

How Sweet It Is
There could not be a more appropriate setting for testing justice than the scenario that is unfolding here. We have a President Elect who has been a close confidant, colleague, supporter of a Governor who has, in turn, supported him.

A Governor has been rousted at his home, tried by his peers, his fellow Party members, indeed, his friends in the media but weeks have gone by and no Grand Jury, not even a hint of when any formal charges and/or trial might take place and the only person doing his job is the person who has been charged?

Obama's team has inverestigated, they say their hands are clean. Presumably it would have to be a member of that inner circle who would be in a position to endorse or deliver the list of acceptable candidates and if that's the case does it not follow that if their hands are entirely clean, the how does the Governor have soiled hands?

A MAGNIFICENT IDEA
Pat, this is a wonderful column, the best I have ever read. The Democrats will never abandon their hypocrisy, of course, because they actually have no moral principles, but wouldn't it be a major hoot to watch them slowly turning as they roast on the spit of public disapprobation in '09.

Pat, you should send a copy of this column by special messenger (?fancy printed using colors and gold leaf on vellum paper?) to every Democrat member of Congress yesterday if not sooner. Then inform the Washington Post, the Washington Times and the NY Times. See what happens. What fun!

It is possible the delay of lodging formal charges is due to dickering for the best spill-the-beans deal. With Rezko, Emmanuel and Blagojevich involved, to say nothing of Obama, who knows what who knows? It sure was a surprise that Obama's "internal investigation" found no connection between Obama and Blago. Yeah, riiight. Why not just deny any connection? To claim an impartial investigation took place assumes a level of naiveness beyond even most Obamanites. But it makes an amusing show. The climax will probably just be a bust, though.

Time to repeal the 17th Amendment ...
Pat is absolutely right about Blago's right to appoint a replacement to the US Senate. I doubt if Reid will want to provoke a constitutional confrontation over seating Burris.

Also, maybe it's time to go back to original intent of the Founders: that US Senators be appointed by the State Legislature and not by direct election by the voting public.

There would be much more control over a US Senator. You wouldn't have Lindsey Graham and Joe Lieberman globe-trotting with McCain for example.

OBAMA AND CHICAGO SLEEZE
The ongoing sordid Blago comedy, now a black comedy, reminds us on a daily basis about the political origins of the President-elect and that he is little more than a conventional Chicago politician up to his eyeballs in Chicago sleeze.

Pat is correct,no one has been prosecuted for a crime yet but that does not mean none has been committed.However,what it all shows is that politics is dirty business and that power is money.If Mr. Burris gets the job it might not be for money but for the fact that he is black,either way not for his qualifications.As for Mrs. Kennedy it is even worse because she has no qualifications at all outside her name.This country is going to the dogs and we all know why,the majority of our politicians are weasels and generally unqualified to run our country and who is to blame for this, we are.

More problems for the Dems
Thank you Mr. B for clearly laying out the groundwork for the Democratic Party's greasing the wheels of their own downfall. Blago is no hero by any means, however, he has opened a can of smelly worms that just wont go away. I wish the President elect good luck, but the rumblings within are getting louder as Inauguration Day approaches and some of the dirty little secrets are rising to the top in an abundance that even the admiring media will have a problem covering up.

What the dim-o-crats really want is for Guv. Blago to leave office quietly and walk into the shadows. Then they can say, "We cant talk about that any more because it is under investigation." After some time has passed and major newspapers ("the New York Times and others like them") continue to pontificate on their favorite topics (Republican misdeeds), everybody will forget about the long-standing stink in Illinois politics.

I just finished reading the book "Scandals of our Founding Fathers". It confirms that all politicians' lives are soap opera dramas. The Obama saga and the Blago drama is nothing new during the last 200 years. They are here to keep us entertained. The book helped me to stop being angry at our current politicians and have a good laugh at all of these clowns that think they are so important.

The Burris appointment
Here we go again. Select our members of Congress based on race? The Senate and House have not chosen their members -- these people were voted in. Voters can chose their representative and have not chosen people of color. Back to Rev. King -- he said that people should be judged by their character not the color of their skin. That statement did not call for affirmative action, nor quotas. The people still elect.

Is this news? Contrast between walking Mormon "elder" pairs and Reid is like the contrast between the Iran-born proprietor of Columbia's Halal grocery market and Looie Farakhan (the merchant knows that conduct like that of Farakhan or Reid would zero-out his business).

It doesn't matter what Obama does because he is the favored son. Obama could gang rape a nun on the steps of the capital on national TV and the nun would be arrested.

Nope. The necessary term is ASSUMED innocent. And that is only in a court of law. Impeachment is not a legal proceeding in a court; it is a political action by a legislature. And "we the people" can judge someone guilty or innocent any time we want to. Or does Pat really think that OJ didn't kill Nicole?

If Pat really thinks that Blago wasn't trying to sell the senate seat, then I have some swampland in the middle of Death Valley I want to sell him.

Illinois should impeach this skunk and get rid of him, then hold special elections for the governorship and the senate seat. Don't worry; given the track record down there, they will elect two more skunks.

Innocent until...however...
No one has the right to a position of power. Buchanan suggests that the standard to apply, here, is innocence until guilt is proven. That is the correct standard in any criminal case brought against Hot Rod, but a much lower standard can and should be applied to allowing HR to maintain his office and exercise the powers of that office. There is every indication that he has violated the public trust, and, if so, that is a reason enough to remove him from power and to ignore his actions while still in office.

Common Sense
Blago will have his good name quickly restored when the prosecutors hold a news conference admiting to their mistake. It is not in the interest of Washington to open up the biggest can of worms in political history.

The governor is not doing anything he doesn't have the authority to do and as it has been pointed out to me, nothing has been proven as to what the governor did in the first place. I do find it very interesting as to why the Democrats have turned against Blago so quickly before any facts have been put on the table. You just get the sense that Blago is the smaller part of the picture. This is hysterical! All they can come up with on Roland Burris right now is that he gave a few donations to Blogo's campaign fund. Big deal, that's not illegal. But now Fitzgerald wants more time? The way he was talking at the original press conference they had this in the bag. They had Blogo signed, sealed and delivered. Hmmmm...it can't be the Messiah that's involved because he already did his own internal investigation and they all come out smelling like roses. Oh, that's right I forgot...it must be Bush's fault.

Blagojevich doesn't have the right to a political seat but the state assembly hasn't acted to remove him from the job. He does have an obligation to do the job for which he was elected and paid to do.

The fact is that Illinois has a procedure to remove him from office. Unfortunately, the state Democratic party doesn't have the will to do it's job. And US Senate with with in their rights to refuse to seat Burris but in the Democratically controlled Senate not doing so when the Democrats have played such heavy handed identity politics would be a political disaster. It would make Obama's nomination look like affirmative action and that Obama wasn't qualified for the position. Essentially, Reid will have started the new year by undermining the president elect before the man can even take office.

Democrats are by and large self-serving hypocrites. I believe most of them have no interest in what is good for America, but only in what will keep them in office. Hopefully, there will be a few who will NOT join Harry Reid and his comrades.

One reason the impeachment proceedings
haven't proceeded is that the Illinois House is incapable of finding wrongdoing by a Democrat.

It's kinda like expecting anything substantive to be done to Gorelick, Frank, Dodd, Raines in connection with Fannie and Freddie. Dems, having no shame, simply won't go after their own.

For all of Pat's exhortations about what a fine, upstanding gent Burris is, the guy is a registered Lobbyist, and has contributed to Blago's various campaigns through the years.

So maybe he paid for his seat in advance.

Keep a sharp eye on the Ill. Rep. Party. It will manage no to make any hay whatever, and be completely unprepared to present a viable, electable candidate if the impossible should happen and a special election is called.

They're like the Bob Michel Republicans in the U.S. Congresss prior to 1994: so accustomed to going along to get along, it never occurs to them to mount a campaign based on a righteous beef.


Mr. Buchanan is partly right
What I think is wrong in his logic is the race issue. If this country is trying to become race blind, why talk so much about black and white issues? People elect their representatives, supposedly, based on their qualifications, nor color. It was very unpleasant to watch 95% of blacks voting for Obama based on color, with leading black figures supporting just that. Take Oprah, for example.

As to the hypocrisy of the Democratic Party, it is a known fact that they do the opposite of what they preach (Like Communists all over the world: fight for proletariat in words only, live like kings behind tall secured walls). For example, I cannot imagine liberal socialites somewhere in Manhattan or SF inviting illegal Mexican brothers for a cup of tea or sending their children to public schools or going to work on a factory floor, or even cleaning their own apartments...

Blago is their son, brother and cousin. He has the Democrat DNA and he acts accordingly.

What's at stake here is not the Governor or his appointees, small fish, but the favorite son and world savior who must be purer than the first snow.

Buchanan is right this time
Two days ago I wrote that Buchanan should be removed from the TH roster.

Today I'm applauding his logic.

I particularly like the way he pointed out that for Blago to 'sell' the seat some Democrat would have to be trying to 'buy' it, and no Democrat is going to admit that even if it's true.

The Democrats are true to form. Their victory over the Republicans isn't even cold. Obama hasn't even taken office yet. And already they're squabbling among themselves on how to divvie up the spoils.

Former Senator Barack Obama agrees that the Democrat-controlled U.S. Senate should deny the Illinois senatorial seat to Governor Blagojevich-appointee Roland Burris.

HOW DARES HE? HOW DARE THEY?

The Constitution lists only two entities that select members of the Senate:
The people vote for the candidate in an election.
The Governor of the state selects the candidate for an interim appointment.

The Constitution does not give Senators from one state the right to select the Senator from another state.

If a Senator commits a criminal or treasonous act while a member of the Senate, he can be removed from office through an established process. If his constituents vote him back into office, he cannot be denied the seat.
That does not apply in the case of Roland Burris. He is not in the Senate, so he cannot be penalized for any act in the Senate.

It would be more appropriate for those senators to reject the re-election of “I-found-more-votes-in-the–attic-of-the-strip-club” Franken.

I have been wondering the same thing. Where DID Loyal Democrat go? The Blago situation is well suited for him/her -- also, the auto bail-out would be another good topic. Haven't seen him around for weeks now.

Why are politicians, charged with committing a crime, exempt from being suspended, with or with out pay, until proven innocent or guilty?
As for filling barrys Senate seat, a cardboard clone wearing a sign 'PRESENT' would suffice until the voters have the opportunity to elect his replacement.

Will my Blago Burris solution work? First they show up Tuesday at the Senate in a Big Three Hybrid (any make). Blago pulls the usual political, "I'm sorry if you misunderstood me", mea culpa and gets Burris seated,subject to EEOC approval. Blago then drives on to the Whitehouse for a full pardon from Bush who can't refuse due to his theft of more than enough FICA to fight the war in Iraq.

It's true. Obama is against the appointment of fellow black Democrat Roland Burris. Why?

Here is what the Obama said:

"Roland Burris is a good man and a fine public servant, but the Senate Democrats made it clear weeks ago that they cannot accept an appointment made by a governor who is accused of selling this very Senate seat," Obama said in a statement. "The best resolution would be for the governor to resign his office and allow a lawful and appropriate process of succession."

Doesn't Obama - the constitutional scholar - know that the Senate Democrats have NO say in who the Governeor of the State of Illinois appoints to fill his vacant sea?

Isn't he just about to lay his hand on Abraham Lincoln's Bilbe and SWEAR to DEFEND The U S Constitution?

I guess the US Constitution doesn't really matter to a guy who is not qualifed under Article I Section II OF the constitution to be POTUS!

Obama is a lackey for the same people who put G W Bush in office.

Blago phone and offices had been tapped since 2003 for his "pay to play" schemes in making Illinois appointments to civic offices, contracts for building highways, etc. He has virtually been under investigation for 5 years now. He knew it too and still went ahead and tried to auction Obama's senate seat.

He (Blago) like a lot of other politicians think that the law does not apply to them.

This is just the latest scandal with Blagojevich. He was already on his way to being indicted. But the latest is not just big talk. He will be charged with conspiracy to commit a crime. There will be many,many counts on the indictments.

I agree with Pat, but he left out one point. Blago not only hasn't been convicted of a crime, he hasn't been charged with one either. The prosecutor has just asked for an extension of the time limit to do so.

If they really though Blago was going to sell the seat, why didn't they wait until he did so? Then there would be an actual crime, not just lose talk.

It is a crime
It is a crime to conspire to commit a crime. If law enforcement knew someone was conspiring to blow up a building they would not wait until the crime was committed.
If Fitzgerld had waited until the senate seat was sold it would be almost impossible to unseat that person. They would just lie.
Jesse Jackson Jr. had a million dollar fundraiser for Blogo the Saturday before Blago was arrested. Jesse Jr. had a 90 minute private meeting with Blago the day before Blago's arrest.
Fitzgerald had plenty of evidence Blago was going to appoint Jesse Jr. the same day Blago was arrested.
Jesse's people are cooperating with the feds. No matter what the press,Jesse and the prosecutors say Jesse Jr. is in big trouble.
I sure wish you guys would get your facts straight and stop cheering for these scumbags.

Senate Seat Refusal
The Senate has every right to refuse anyone a seat. The Constitution has a provision that if there is an objection to the seating of a Senator a vote may be taken to refuse the seat. As I recall, if 60 Senators uphold the objection, the Senator will be denied the seat.

This provision is rarely used because frequent use would result in hostility from the public, because there is still a *small* amount of civility in American politics, and because it is very rare for 60 senators to agree on anything other than that they should be paid more and should take the next 4 hours to recess for lunch.

Burris will represent the people of Ill
As long as the voters of Illinois do not call for a recall, his appointment should stand. The election of US Senator is a state issue, not something that can be decided by the Senate. Yes, Congress has censored senators before, but they cannot actually deny the seat; they can simply refuse the senator's right to speak on the Senate floor -- usually making it impossible for him to represent his constituency. They don't actually do that very often because, as Kris explained, they have a hard time agreeing on much. So, likely Reid will blow hard and then let it drop.

I think someone should be doing a thorough check of Burris' finances and recent dealings however, just to be on the safe side. Although, I actually believe that Blago probably made this appointment cleanly just to get everybody's goat.

I answered you above. No such right exists from the Constitution. It is a Senate procedure -- that gentleman's handshake stuff that also includes "pocket" filabusters that allow other bills to be addressed while controversial ones just sort of languish for lack of discussion or vote.

Given Burris' qualifications, however, Reid and the Senate Dems would have a hard time actually censoring him.

The reason Fitzgerald asked for and will get a 90 day extension is. During Fitzgerald's press conference he laid down the law. Anyone having knowledge of these crimes(including pay to play) needs to come forward before the feds come knocking on your door. As a result of that statement hundreds of witness' have come forward to testify against Blago.
Also it seems the feds have thousands of hours of wire tapped conversations yet to be analyzed.
When Fitzgerald brings these indictments down it will be massive.

The Game
All the senate has to do is stall. They will refuse to accept Burris on the grounds Jesse White our Secretary of State will not sign off on this appointment.
Burris has gone to the Illinois Supreme Court to force Jesse's hand. Sorry not enough time.
The Illinois Legislature is moving at lightening speed(for them)on impeachment. We will have a new governor by the end of the month.
The new governor will then appoint a new senator. Burris can go to court and sue but he'll be long dead before it comes in front of a judge.
So sorry guys Blogo and Burris lose.

The Race Card

"Statesman" . . . Where?
The Buchanan suggestion that, “Here we have an African-American elder statesman . . .” is an absurdity. Rarely does one find substantive deficiencies or gross overstatement in most of the pieces posted by Patrick. However, today’s piece captioned “Blago Raises the Stakes” is one of those rare exceptions; an exception manifested through the characterization of Roland Burris as a “statesman”. Merriam-Webster defines “statesman” as “one who exercises political leadership wisely and without narrow partisanship”.

With such characterization, Patrick exposes an egregious paucity and malformed understanding of the nature of that uniquely fetid form of government thriving on the shores of Lake Michigan otherwise known as “the Chicago way”, more simply referenced as “Chicago politics”. The operation of the Chicago Machine (the “keystone” of the Obama cathedral) is the quintessential textbook exemplification of a system of “go-along to get-along” through which all who aspire to any form of political involvement at either an appointed or elected level must, by definition, tradition, custom and usage unwaveringly know and abide his or her place at all times and, without exception, adhere to the partisanship democrat mantra duJour.

The current Secretary of State (for Illinois) has announced that he is refusing to certify any appointment made by Blago. Therefore, any decision by the US Senate with regards to admitting Burris, is moot.

If more black people, wish to be elected to public office, I suggest that they follow Mr. Obama's example, and run for the offices they wish to hold.

Don't be too sure
Several posters have said that Blago is charged ONLY with Federal crimes, but I would behoove you to be cautious...

Given what we have learned about Blago's "alleged" crimes, state violations could have been committed. Bribery IS a State offense. Sort of like accepting a bribe for Blago's hospital deal and who knows what else he has done. Just ask my former dishonorable Gov. Edwin Edwards or Campbell Brown's dad, "All Spin, All Bull" Jim.

The fact is that the state ALWAYS lets the Feds go first.

Mr. Buchanan is right ...
... in that Dingy Harry Reid doesn't have the power, by himself, to deny Mr. Burris the Senate seat. The U.S. Constitution reads (in Article 1, Section 5 referring to both houses of Congress) "Each House may determine the Rules of its Proceedings, punish its Members for disorderly Behaviour, and, with the Concurrence of two thirds, expel a Member." The most he can do is call for a vote and deny the seat IF he can muster 2/3 of the vote. It would be relatively easy for Republicans to get 33 votes and deny Dingy Harry the power. GOTCHA!

Roland Burris
He probably could not be elected in his state,that is if he is the good,admirable citizen folks say he is.Not many honest politicians there,evidently.

Maybe that is why he accepted the appointment from one who is said to be a crook. Who is under a cloud of corruption. Maybe even impeachment.

Mr.Burris would have looked like a better citizen had he refused to be involved in this at all. Just because you can does not always mean you should.

I applaud Reid...for once
Reid is right to uphold the standards of the Senate in defiance of racial identity groups and the fact that seating Burris would be the "easy" thing to do for the party. What would be the consequences if Secretary of State (for Illinois) White defied the courts and refused to certify Burris and if Reid and the Senate Democrats refused to seat him. I hope White and Burris go to that length to enforce the standards of the U.S. Senate. Blagojevich should not be able to get away with this!

Senate Standards
The Senate has no standards. They were thrown under the bus long ago. If you are a Democrat,even murder will not keep you out,if voters in your state select you. Ask Teddy.

There are several senators who strut around like they are somebody special and make laws for the rest of us to follow. They break them every day. Ask Dodd. Reid. Kennedy. Obama. Many others have no integrity and should not be there.

The House is even worse. Many of them are downright street hoodlums and still the people send them to congress. It is no wonder their approval rate is in the teens. It is well deserved.
