Freedom of the press is on trial in Canada.

The trial is before a court with the Orwellian title of the British Columbia Human Rights Tribunal. The accused are Maclean's magazine and author Mark Steyn. The crime: In mocking and biting tones, they wrote that Islam threatens Western values.

Had Steyn written that, given the Crusades, colonial atrocities in Africa and the slave trade, Christianity had been on balance a curse, he would not be in the dock. In the United States, these charges would have been tossed out by any federal judge, who would have admonished the plaintiffs that, here in America, we have a First Amendment.

The United States, however, is an isolated exception, as Western nations seek to impose wider restrictions on what has come to be called "hate speech."

Questioning the Holocaust is a crime in Canada and Europe, as British historian David Irving discovered when he was sentenced to prison in Austria. To say the Armenian massacres of 1915-1924 were an attempt at genocide is a crime in Turkey.

In France, animal rights champion Brigitte Bardot has been fined $23,000 for provoking discrimination and racial hatred by denouncing Muslims who slaughtered a sheep in a religious ceremony. Bardot had been punished five previous times for her statements.

Censorship is making a comeback. Outside the United States, it is considered an acceptable price to pay for the new diversity Western Man seems now to value more than the old liberty.

In 1990, writes Adam Liptak of The New York Times, Chief Justice of the Canadian Supreme Court Brian Dickson wrote, in upholding the conviction of one James Keegstra for anti-Semitic slurs:

"(T)he international commitment to eradicate hate propaganda and, most importantly, the special role given equality and multiculturalism in the Canadian Constitution necessitate a departure from the view ... that the suppression of hate propaganda is incompatible with the guarantee of free expression."

There you have it. Canada's commitment to multiculturalism and the equality of all religions, races and cultures requires the silencing of those who do not believe all races, creeds and cultures are equal.

The dogmas of the Diverse Society dictate that the cherished rights of the Free Society be sacrificed on the altar of social tranquility.

What has caused this reversal of the advance of freedom?

Western Man has come to believe there are more important values than freedom, if men use their freedom in ways our new Lords Temporal find unacceptable.

Nor is this anything new. Censorship has always had powerful patrons and not always benighted backers.

In the Middle Ages, pious men sought to silence heretics because they believed the Faith led to Paradise, while its loss led to Hell for all eternity. The Christian censorship we mock today was born of men's deepest convictions about the most important thing in life: salvation.

Devout Muslims believe heretics and apostates should be put to death. Islam is the most important thing in their lives, and its truths are valued more than any freedom to mock them.

And, indeed, most men accept some form of censorship.

Most of us believe that published or spoken lies that ruin good names should be punished by libel and slander laws. Most of us believe there are military secrets that must be protected. Not a few Americans believe that the moral codes imposed on Hollywood by the Legion of Decency helped protect society from the toxic pollution that poisons our children. Most of us support FCC sanctions against filthy language or racist slurs on the airwaves.

Nor is government censorship unknown to America.

President John Adams signed the Sedition Acts, which called for the incarceration of journalists who wrote insultingly of him. Abraham Lincoln suppressed newspapers that denounced his war. Woodrow Wilson imprisoned the Socialist Eugene Debs for denouncing his war.

A new censorship is now arising. We read of speech codes on campuses, sensitivity training for freshman, and tribunals before which students are made to grovel and recant for joking references that offended some minority or other.

"The best test of truth," said Justice Holmes, "is the power of thought to get itself accepted in the marketplace."

Nonsense. Editor Elijah Lovely was lynched in Alton, Ill., in 1837 for advocating abolition -- against the view of the marketplace. Truth is truth, whether the majority agrees or not.

Yet, one's money ought to be on the new censors, for men who believe deeply in something, even when wrong, usually triumph over men who believe in nothing.

Today, the true believers in Islam and the true believers in diversity uber alles are making common cause against those who believe in freedom of speech and the press. As the former have the convictions and increasingly the power, they may prevail, and not only in Canada and Europe.

A new orthodoxy is arising. Freedom's finest hour may be behind us.

Because even for Pat, his article is more PC than it needs to be, which waters down his argument.

The truth is, people are being censored and prosecuted for speaking their opinions regarding Muslims. Not just your everyday Muslim, but the radicals that are being spoken about are off limits.

Michael Savage is still currently in a law suit against CAIR who tried to silence him by manipulating his words from a broadcast, slandering him, going after and threatening his sponsers in which most complied and dropped from his show, in an attempt to get him off the air.

What did Savage say? The truth. It's his right, he has freedom of speech, and yet the CAIR organization will attempt to dismantle our rights as Americans to suit their agendas.

Remember the Flying Imams? A set up by CAIR. Those passengers who were frightened by seeing Muslims kneel on the floor of the airplane and pray, had every right to report this. Now they are being sued by CAIR for doing so. Why? So that we are forced to look the other way when any potential threats appear and silence us from saying so.

We have other ridiculous suits or arrests of PC BS when you consider Imus, or the woman calling a bunch of kids monkeys who were climbing her trees (and happened to be black) and the Duke false rape.

But we have a serious problem, larger than the other PC nonsense we deal with and most of that is only to get a windfall of You Hurt My Feelings Cash.

It's the radical Muslims who are using our laws and courts against us for one purpose only. To destroy all of us.

Freedom of Press in Canada was butchered as long ago as 1991. That year, on just the RUMOUR of USA Today printing a report about the Carla Homolka trial, Canada's government banned imports of the publication for the duration of the trial.

Ironically, Patrick reflects a spirit found in that publication (which I facetiously term "USA Yesteryear")!

Judicial Tyranny
At a time of cultural decline, judges now generally reflect society's lack of values except they are usually one step ahead of the game, as in the imposition of homosexual marriage by the California Supreme Court. The judiciary has become part of the academic elite. A case could me made that a judge has to know pornography to make a decision about pornography. But why would a federal judge lead a free speech drive to keep software filters away from computers in the judicial administration? Is it any government worker's right to view pornography at work?

Judicial kookiness is a result of the rejection of Christian values in favor of diversity.

Yeah, and Michelle Malkin was successful in having a Dunkin Donuts ad, featuring Rachel Ray, removed under threat because she was wearing a scarf.

Both CAIR and Malkin are within their rights to call for boycotts for frivolous reasons. That's the other side of freedom.


making too much of this
Mr. Buchanan , you are making too much of this, Very much in line with " the threat of Islam" and "attack on our freedom".
In principle you are right, however you picked on the wrong group. The only off-limit and censored subject, which we practically can not talk about, is Isreal. In all other areas we have free speech. In fact, you can open any magazine and turn any TV Channel and see that we are in no shoratge of Anti-Islamic propaganda. So this event is NOT an example of the powerful mainstream trying to suffocate the weak and the free. This is a case of a minority choosing the wrong strategy to counter the relentless propaganda againts them.

the enemy within
This story along with the comments indicate the real enemy is within our land. Foreign enemies are usually quite open about their feelings, most particularly these extremist Moslems. The real enemy is the pc police types who are fixated on gaining control of anything they can; but on these issues they function as children up at night, fiddling with the lock on our back door responding to a killer's glittering entreaties to open our back door in the dead of night.

It is clear that the marxist-led "progressives", the ACLU, my one-time party of JFK, and a panoply of various community organizers and political operatives of the left are our mortal domestic enemies.

Is the California court imposing on you to participate in a homosexual marriage?

The imposition is that in order to receive certain rights and benefits, couples(be they same sex or normal)are required to enter a legal contract called marriage, and they are then obligated to be controlled by the legal system.

If I were gay, the last thing I would want is to have the state stick its business into my personal relationship. But gays are committed to having society recognize their unions as normal. What doesn't seem to register is that some sections of society view homosexuality as normal and some don't, and legal recognition of their unions won't change that.

There is an old adage...something to the effect that you can't beat something with nothing.

And another to the effect that if you believe in nothing, you fall for anything.

Well, there are huge exceptions. Strong belief itself can blind one...make one a fanatic.

But in Western Europe, Christianity has given way to secularism, creating a void which is rapidly being filled by Islam, thanks to the influx of Muslims from North Africa and the Middle East.

To the extent some of the more "internationalist-minded" justices on the USSC incorporate other nation's(or international organization's)laws and procedures in rendering decisions applicable to the people of the United States, we are all at increased risk from this pernicious p.c. and multiculturalist virus.

In those nations WHICH CHOOSE to live under Islam, I have no problem with their system putting to death those deemed to be heretics or infidels.

If that is their mindset, their religion, they have a right to it, I guess.

I find it repulsive, but I cannot tell them how to behave.

Clitorectomy is barbaric, savage, yet is quite popular in some cultures and religions(including Islam).

I think Buchanan may be mistaken in thinking strict Islamists will make common cause with the p.c. multiculturalists, for the former cannot stand the lack of judgment embodied by the latter.

James Keegstra was acquitted several
times, but in Canada there is no "Double Jeopardy" rule. So, a vindictive Crown Attorney (financed by the inexhaustible pocket of the unfortunate taxpayer) can go on and on and on, seeking conviction, until he's got "right".

Another victim of such similarly corrupt police and lawyers was Guy Paul Morin, charged with murder, acquitted, retried, acquitted, retried, finally convicted.

After serving several years for the crime he did not commit, he was exonarated and released based on DNA evidence.

O.J. Simpson must thank his lucky stars he is not Canadian.

Censorship in Europe?
I don't know, Pat.

I can't speak for the folks in Canada. But I live in Europe and I sure don't see it. We got our share of diversity gunghoers and the odd court case or two. But it's all pretty much in the open. As far as some trend as you talk about, my wife's a journalist and not much has changed in the 20 years since I got here.

Could be we're makin' a mountain out of a molehill. Seems to like you good people spend a lot of time giving each other the hebee jeebies with this kind of stuff.

There's censorship...

I agree with Pat's column except for one statement. There's a difference between removing offensive material from public airwaves and public spaces, and blocking material from being published at all, or arresting those that published such material.

While it is generally true that we should not try to force someone to stop speaking, we should not allow these same people to try to force people to listen.

For instance... if you want to view pornography, it ought to be up to you to seek out that material and purchase it. If you do not want to view pornography, you should not have to try to avoid (ie, it should not be displayed on a billboard). The materials are still available to those that want them, but they are not forced on people that want no part of them.

Can The Future Cross The Border?
If anyone thinks that what is occuring in Canada or Europe cannot happen here, think again. What begins in the Universities more often than not creeps into civic society.There are thousands of "experts", lawyers, and "scholars" who believe there is too much freedom of the press here. Just four years ago, the President and Congress signed into law the abridgement of Free Speech during an election cycle - and the High Courts upheld it.

When Obama wins this November look for the floodgates to open.

I agree with Shells to some extent that the Censorship of Michael Savage is idiotic. Personally, I do not agree with everything that Michael Savage says but he is one of the few talk show hosts who has the intestinal fortitude to speak truth to power.

On the other hand, there are a lot of Zionist groups too like the ACLU who wish to shut down dissent or your right to your own opinion about anything if they do not deem them worthy to be in a public forum. The same thing is true for Townhall.com.. to some degree... because they will expunge some of your comments like the ones I recently posted on Diana West column if they do not agree with them. I might add that I didnt believe my comments were any more nauseating than virulent Zionist/Fascism that she spews with regard to Islamo/Fascism. Just to be fair, you will never see any Moslem writers on Townhall.com....but you will find many Jewish, Chrisitan and Others. I am not seeking to be an advocate of Islam but rather an advocate of Free Speech....which appears to be almost extinct.

Re: John in NY: It's Not Propaganda!
Would you state that any commentaries regarding Muslims and their difficulties in the American melting-pot are "propaganda?" Is the mention of "Muslim" or "Islam" code words for, as you state, propaganda? As a Catholic, my religion is in the news quite often, but I'm not ready to cite it all as propaganda, nor am I so sensitive as to run to the court system to seek "justice." I believe too many Muslims exploit every possible situation. It seems to me they suffer a huge inferiority complex. They could have stayed where they were born and not had to endure what they imagine. Case in point, the five imams out of Minnesota. Just five innocent travelers minding their own business, right? Such an obvious set-up!

It seems that practically overnight these Islamists have taken aim at American life and law to twist and shape same to their needs, all else be damned. When they clean up their own act and become as sensitive to the needs and practices of non-Muslims, I think most of their own gripes will disappear.

If they continue to "crowbar" the traditional American way of life to their own purposes, they'll have a tough time here. They wanted to live in the USA, they had to know what was here before them,that it was built by good God-fearing Americans who weren't Muslims, and there is no need for them to receive exceptional consideration simply because they think the rest of us are "unclean."

I'm a third-generation American and we were doing fine without the complaining, paranoid, Muslims before they started to emigrate in numbers. Everyone else seems to assimilate to American life...I think these people have no intention of respecting the history that made this nation great.

I'm fed up with these whiners who go running to the court system at the least minor issue which they're ready to call serious provocation. If they want freedom, let them respect the freedoms of others.

I suggest that there are Muslims participating in Town Hall commentary, but they don't identify themselves specifically as Muslims.
Anyway, what's the issue if a writer slants his/her remarks in favor of Islamic practice or issues, whether he/she is Muslim or not? To my knowledge, Town Hall has never placed barriers against Muslims or anyone else.
In my own opinion, I believe I've read many comments from Muslim commentors or their sympathizers. In any case, openess is beneficial and no harm's been done by people expressing themselves. The less damned PC the better.

Regardless of what you wish to make of the name "Isreal," the correct spelling for the name of that nation is "Israel." I believe it comes from the ancient Hebrew name of that holy land so long ago.

Don't wait for any signal. "Fighting back" is how fervant you feel about your rights as an American. I think it's an individual decision, but that decision is more and more prevalent each day. The choice: Be a lamb led to slaughter, or be a Lion and stand by your American rights...and never surrender them.

As you suggest, it is the ancient name for the nation of Israel. It was given to Jacob and his descendants.

The root meaning might be:
1. combination of sara (he fought) + El (God), 2. derived from the verb sarar (to rule, be strong).

But I think John was tweaking Israel's enemies.
