Sampson and the Philistines

Contrary to popular opinion, the case of Keith Sampson at Indiana University – Purdue University Indianapolis (IUPUI) is not over. An article by the Associated Press seemed to imply that the case was resolved. But, having done some thorough research on the case – more thorough than the AP, I believe – I respectfully dissent. And, today, I am calling for an investigation of university Chancellor Charles Bantz as well as university spokesman Rick Schneider.

Keith Sampson is really a rare kind of student. First of all, he was willing to take a job as a janitor to help pay for his college education. But, even more impressive, he spends his break time reading scholarly books on subjects such as American history. But, when he decided to read a book on race relations – one describing how students at Notre Dame defeated the KKK in the 1920s – all hell broke loose.

A black female co-worker at IUPUI decided to charge Sampson with racial harassment. This matter should not have been hard to resolve since the book, which Sampson checked out from the IUPUI library, was objectively anti-Klan and anti-racist. The only difficult part of the case should have been deciding the fate of Sampson’s accuser. Had she intentionally leveled the false claim of racial harassment, she should have been fired. Had it been accidental, she should have been sent to sensitivity training to get over her obvious prejudice against white people.

But, of course, this happened in a university setting, which means that common sense never had a fighting chance. Sampson was told last November that his conduct constituted racial harassment. The affirmative action officer (Lillian Charleston who is now retired) stated “You used extremely poor judgment by insisting on openly reading this book related to a historically and racially abhorrent subject in the presence of your black co-workers.” Such ignorance is by itself a good argument against affirmative action.

In case you didn’t understand it, here’s what she said: Sampson may have been a victim of intellectual rape but he was wearing too short of a skirt.

But, fortunately, the ACLU – like the blind squirrel that occasionally finds a nut – found out about Lillian Charleston who is obviously a nut, and more than a little squirrelly. With pressure from the ACLU, Charleston exuded sheer eloquence in later telling Sampson “There is no university policy that prohibits reading (scholarly books) on break time.” Too bad she’s retired. This woman is obviously brilliant.

But of course this was not good enough. Remember that in November Charleston had said “We conclude that your conduct” – of reading a scholarly book in front of a black woman – “constitutes racial harassment.” But after the ACLU got involved in February the university informed Sampson that no disciplinary action would be taken because they were unable to determine whether Sampson’s conduct was intended to disrupt the work environment.

But, of course, the work environment was disrupted by a hypersensitive black female with a distorted view of the “typical white person” – and what a good thing this bigot isn’t running for President of the United States! So, I took the time to call Rick Schneider to ask him about the uncertainty of the university’s findings.

Regrettably, Rick Schneider was the most evasive, stammering, and uncertain administrator I’ve ever spoken to (in the six years I’ve been investigating university speech codes). For example, I asked him whether the charges leveled against Sampson were objectively false and he could not answer. When I asked him whether he even believed in the existence of objective truth and falsity, he replied “I do not wish to get into a general philosophical discussion with you.” I swear I’m not making this stuff up. And I do believe in objective truth.

But, finally, I did get a direct answer from Rick Schneider. When I asked whether he was aware any other acts of racial harassment by Sampson he stated unequivocally “No.” And this is very important.

A Pulitzer Prize-winning columnist for The Wall Street Journal recently asked someone from media relations at IUPUI the same question. The media relations person replied that Mr. Sampson had engaged in other racially insensitive conduct and that Mr. Sampson was aware that he had. And this is why we need an investigation of Mr. Schneider.

If Rick Schneider was not the person who made those statements to The Wall Street Journal it is very good news for him. But, of course, that only means that someone else should be sued for defaming the character of Mr. Sampson whose personnel file is clean and who has never engaged in any racially harassing behavior (despite the university’s pathetic attempt to smear him).

But the Chancellor must also be investigated in order to explain this statement made in an email sent by Rick Schneider:

“The chancellor has sent letters of apology to Keith Sampson, to the co-worker of Keith Sampson who filed the complaint, and to two co-workers who were interviewed as part of the investigation of the complaint. In these letters, the chancellor said he regrets this situation took place and believes this matter could have and should have been handled differently.”

The public has every right to see that letter in order to ascertain the reason why a university president would apologize to an obviously racist black woman who disrupted the IUPUI work environment with an objectively false accusation of racial harassment.

Keith Sampson has suffered a good deal of grief although not as much as the lacrosse players at Duke University. But at least Duke’s chancellor didn’t apologize to the stripper.

Schneider spread his unsubstantiated charges about Sampson to me as well. In his letter to me he states, "We have not elaborated on the conduct, as perceived by his co-workers, nor do we intend to do so." If your readers would like to read the entire letter Schneider sent to me just google my name and Sampson's and you will find it.

I posted the IUPUI AAO dispute rules on my site and they clearly state that the accused must be given all accusations against him in writing and who is accusing him. So far IUPUI administration is breaking its own rules one after another.

It is very noble of you to come to the aid of Keith Sampson, the white Indiana University student who worked as a campus janitor - to help finance his education - and was wrongly accused, and found guilty, of reading "Notre Dame vs. the Klan" (apparently, a complaint based solely on the book's topic and the picture of burning crosses on the cover...a book, ironically enough, that could be found in the university's own library).


I have no beef at all with your spotlighting this troubling incident, Mike. Here is an interesting paragraph I found yahoo-searching the case:

Mike, why can't you extend the same understanding and empathy to gay students (who you incessantly, and unfairly, characterize as "militant" and "deviant" and "in your face" and all the gratuitous rest) that you wholeheartedly extend to Keith Sampson? In fact, I'd go so far as to say that if Keith Sampson were revealed to be gay, you would not have bothered coming to his defense. Your empathy and outrage would have materially vanished. Your "outrage" would suddenly know boundaries.

That is a false - and learned, and partisan - POLITICAL talking point that says gays and gay issues should be made into political and cultural footballs to banter about during election times.

A person's sexuality has NO BUSINESS being co-opted by a political party to use as a gimmicky hot-button issue to (cynically) drive people to the polls.


Gays should be judged by the content of their character, like anybody else, not by the gender of the consenting adult they fall in love with and possibly marry (yeah, I'm from California; we roll like that now).

Maybe what caused the whole commotion was that no one in the faculty or administration at IUPUI thought they had employees or students who could actually read... especially a janitor! So obviously, to them, a janitor who could read must have something seriously wrong with him!

The janitor in question was given the greased rail treatment by the university. The academic people seem to thrive on inserting both feet between their lips and chewing as hard as they can until someone slaps them upside of their heads.

Thank you Dr. Adams for having the courage to stand with this man.


Learning curve
Cases like this have been turning up for years. They usually result in bad publicity, adverse court decisions or expensive settlements, ferment among alumni, and general ill will. But faculty and administrators continue to try squashing expression that they oppose and and people they don't like -- and to condone the trashing of the Constitution by preferred students. What will it take to convince these people that speech codes and the other mechanisms of intolerance don't work and can't be defended successfully? Sad, isn't it, that many of our institutions of learning are run by people who can't learn?

No Racism Involved
Based on this recounting of the facts, the charge of racial harassment was unwarranted. However, the woman who complained was not racist. She may have been in the wrong, but she certainly wasn't racist.

Black woman has no shame?
In a university setting, wouldn't this woman be ashamed of making such a stupid mistake as to accuse before investigating what the book was all about? What if it were a bio of Dr. King? What if it was Tom Sawyer? What is the matter with the university officials that handled this complaint? Is this woman going to college on a government hand out; my tax dollars?

What do we expect...
... in a nation where a black person getting arrested for a crime he's in the act of committing is a victim of racism? Anyone remember "Tookie" Williams or Mumia Abu Jamal? This is the country that gives credibility to a man who has twice leveled demonstrably false accusations of racially-motivated rape against white men (multiple, both times) in instances where no crime occured.

In a perfect world, those who make accusations of bigotry ought to be forced to prove (a) that the bigotry existed, and (b) that it materially affected them (aside from simple offense). And if not, they should be disciplined harshly (if in the workplace) or fined or jailed (if with the police) for filing a false accusation. (Yes, I think that Crystal Mangum and Tawana Brawley ought to have spent 6 months to a year in jail for what they did).

Curruption and perversion of truth
If the ACLU were really interested in justice, they would sue the University, the IUPUI President, Chancellor, and the reverse discrimination accuser for billions. At an institution where liberals run the place, it is harassment to read a book which was checked out of the Universities Library? The library and librarians should be included in the suit, since they obviously did not screen (censor) this piece of literature and shield the weak minded morons attending their school plus they are joint and severally liable for not protecting the poor false accuser from injuring herself by being confronted with an opinion or lifestyle that is not to her control freak wishes. This clearly shows how perverse the University setting has become. It is OK for leadership to slander and malign an employee and it is permissible for them to accept false allegations of harassment (similar to Duke Universities handling of their false rape accusations but the entire matter should be shoved under the rug and forgotten once they are caught in their stinking stupidity. For educated people they might be a good definition of intolerance and bigotry and idiocy. I say fire them all, sue them all and include every liberal University that plays the game of one-sided tolerance and arrogance.

Where are the really good attorneys when you need one? The employees deserve better management; the school needs better leadership; the students and staff deserve and open minded education not an intolerant left-wing, perverse accepting, truth denying brain-washing, babbling of political correctness without integrity, honesty and fairness.

Alliance Defense Fund
I think the Alliance Defense Fund should be contacted on this. The University and their IGNORANT reps should be sued for having such a racist book in their library. Also, the IGNORANT black woman should also be sued for fostering a HATE crime. I would imagine there are several lawyers in the Alliance Defense Fund staff that would love to "get it on" in the courtroom with an American Criminal Liberties Union facist. Just plain f'in ignorant.

What is the point, you ask? Well, the point is that Doctor Adams is talking about academic freedom for all and not leftist-bashing. Look at the subject of book Mr. Sampson was reading. I find it unlikely that Mr. Sampson is a conservative. Who knows, Will? He may indeed be a homosexual. His political leanings and sexuality are fundamentally unimportant here. The point is that a feckless univerity administration is so wedded to an unconstitutional policy limiting freedom of speech and exchange of ideas and a bizarre concept of "diversity," that it will sacrifice academic freedom to the whims and fiats of certain people. Doctor Adams is not making any conservative v. liberal point here. It is all about common sense and academic freedom.

And the accuser in this case is most definitely racist and prejudiced. She prejudged the content of the book as insulting and harrasing of her racial identity. That is prejucice and racism. I wonder if she has ever read "Soul On Ice" or any of Mumia Abul-Jamal's writings in the University library?

False charges brought against innocent people are not punished when it comes out that they are false.
I'm guessing this woman was hoping to sue the University.
If we do not want this type of behavior taking place then this type of behavior should result in the loss of employment.

In 1973 I taught in a publicly funded jobs training program for dental assistants. The young ladies were of an age to be recent high school graduates for the most part and their ethnicity was mixed between white and black. A good many of them were not high school graduates. I commonly addressed the group as "girls", and this is important, I did this for no purpose other than the descriptive nature of the word "girls." One of the black girls of age twenty something came to me with furrowed brow and much gravity and said that she did not want to be called a girl. Why? Because that is the way that the slave masters referred to Negro women over a hundred years before that. I was dumbfounded. I can only say that it must be great to be a victim in the USA.

I wonder what Chancellor Charles Bantz will do next? Deny everything? Say he was mis-lead by his subordinates? Or say it all depends on your definition of the word "is".

Keep up your investigation of this. I would like to see how this eventually ends.

Now, back to the actual subject: I understand the posters who say Sampson should sue. Speaking as one who has been through the academic wringer myself, though, I can understand why he might not. Kafka would've rejected the modern university hearing system as too over-the-top for one of his books. And even if you win -- which I did -- all you want at the end is OUT OF THERE.

It seems to me that trampling on the rights of students is de facto in academia today. Unless brought to light, the charge is upheld and the student(s) must submit to punishment for no wrong-doing, or quit the univerisity and be trailed by the lies lodged against them. They wear the scarlett "R" for the rest of their academic life.

Until there is a massive litigation inititive against the university presidents and their underlings, things will not change. Since liberals have used the class action lawsuit as a tool against the capitalist economy, I propose that conservatives use it against the facist policies of universities across the country.

There is a problem with this. Student Steve Hinkle of Cal Poly San Luis Obispo sued his university president and several other administrators for violation of his free speech rights, and the FEDERAL court found them personally liable. He won a $40,000 judgment, but the State paid it, letting the guilty off scott free.

TWO SIDED AFFAIR - never
This follows the person who called a problem like a black hole and was forced by a judge to apologize to the person who heard him say that terrible racist comment. We now live a country where a certain group of people seem to have the power to make innocent speech a crime. I want someone to do the same when someone says they white-washed the issue, but that never will.
Schools will always try to look aside those who disrupt school discipline until a parent decides to sue a school for not teaching their child because a failure of the school to remove students who just do not care.
We need to start taking personal responsiblity for what we do and not rely on the government, our strapped parents, or blame everyone else for our problems. Grow up America and stop whiny abot everything.

I'm a victim too
I had no idea that the standard for victimhood is so low. I have had countless co-workers say and do things that I dislike while on the job. Some have read books that I found offensive (Playboy, Hustler, The Audacity of Hope). Others told filthy jokes or espoused liberal political beliefs.

Had I only known that this constituted harassment, I would have sued long ago, then wrote my thesis about my struggles.

Hasn't Mr Sampson been harrassed enough already, without someone jumping into his spotlight in order to parade their obsession around town(hall)? Now we are reduced to arguing about preferences when we outht to be concerned with true freedom. Soon, will it be dictated to us which books we cannot read? And moreso, which ones we MUST read?! Beware of political correctness! It is politcally the most incorrect policy that could be adopted. IT IS A ONE-WAY STREET. And people aren't going in the wrong direction, they are just accustomed to being on a two-way steet. Take Mr Sampson, for instance. His lane was abruptly and advertently pulled from beneath his feet, much like the proverbial rug, and he is left facing oncoming traffic. Damages?!?!
If Mr. Sampson were to sue for monetary damages from the school, where do you brilliant legal scholars think that money will come from? IUPUI is a taxpayer supported institution of 'higher learning' not an income generating private concern. Mr. & Mrs Taxpayer will be the ones who will be asked to foot the bill for the cost of hiring intellectual cripples. Perhaps the judgment should insist that the funds be taken directly out of the operating budget for the school.

He was making racial problems back in the 80's and 90's. He was usually a daily topic on talk radio out there. I read your posts on an almost weekly basis, and I have never found a reason to respond, as they always seem to be rants of some sort or another.

This time, though, I have to call you on your post.

You accuse Professor Adams of always linking everything to homosexuality, yet it is you who bring this topic up time after time. We get it. You are gay. You feel persecuted. What a shame.

I submit that if you stop telling everyone your sexual orientation, you will feel a lot less persecuted. Take your mind off of your pe-is for a while and think about something else.

Important Case Update
Dr. Adams,

I would like to give your readers a case update. Sampson wrote a news editorial in 1999 DEFENDING the NAACP. If anyone wanted proof that Sampson is on the level, this editorial is pretty convincing.

Also it seems that the person who replaced Charleston, has a history of violating due process rules and such. It resulted in a lawsuit against her last employer. I posted the court docs on my web site and I talked to an attorney involved in the case.

Loss of income due to language
Does anyone remember the adminstrator in what was it Baltimore? who when discussing budgets used the word 'niggardly' and was fired because it 'offended' the others on the panel? You may assign skin color as you deem appropriate to the parties involved. Now we have the recent issue of some fellow (associate skin color as you deem appropriate) who is offended by the phrase 'black hole' ... I believe again it is in reference to spending. What is it with accounting and so called 'offensive words'? Wow, never saw this coming.

on topic... i decided to stop attending my local community college after seeing a grand mural covering the wall of the cafeteria which depicted the timeline of america, with the indians being ousted and killed by whitey, all the way up to today's times, which if you go by the mural, depicts us as an entire nation of latinos and blacks. the caption running across the entire top of the mural read "Everything For Others, Nothing For Ourselves." marxism and racism, all at home in the academic setting. this semester i'm going to a tech school. goodbye, academia, goodbye, bigotry, racism, hate and communism under the guise of "diversity", "fairness", and "education". good riddance.

It was DC of course
The term niggardly (which has no connection to the similar sounding word) was used by David Howard who was a white aide to then mayor Anthony Williams. This seemed to upset one Marshall Brown who was too stupid to understand the word and thought it related to the other N-word. Of course David Howard is a winnie too. He is gay and after pressure from the gay community the mayor was forced to offer him his job back. He accepted another job with the mayor and said it taught him (not that some people are idiots--the correct lesson) but went on about how whites are naive to think we can be colorblind and an "African-American" has to live race every day..blah blah blah.

Oter examples was a 4th grade teacher being forced into sensitivty training for using the word in class; a University of Wisconsin student who was an English major complained when her profesor used the word in class and said she was offended by it. The lesson--lots of dumb people out there.

Oh and one more thing
David Howard wasn't fired, he resigned after the hornet nest got stirred up by idiots. His gay pals (he is gay as I said) came to his rescue. He was offered a job again, he refused that one but then later accepted another position with the mayor. He said he didn't feel like a victim.

I would have said "Who knew there were so many stupid people working for the mayor's office."

"Social rights" run rampant
The current idiocy represented by this case is nothing new. Read John Stuart Mill, "On Liberty" Ch. IV. In Mill's day, prohibitionists announced a "social right" not to be offended by the sight of drunks in public, or by the mere existence of a commerce in liquor, a "right" that Mill realized could be extended to a ban on individual liberty, since almost anything someone might do might offend someone, sometime. As Mill puts it, "The doctrine ascribes to all mankind a vested interest in each other's moral, intellectual, and even physical perfection, to be defined by each claimant according to his own standard." Clearly, a no-win situation for individual liberty.

Many people would prefer to ban absolutely the image or mention of anything that might make them uncomfortable, or unhappy, or that might be offensive to them. The Right as wella s the Left provides many examples of this position. Liberty is the loser.

Fascism in Education Administrations
Thank you Dr. Adams for shining a light on the Indiana roaches as they scamper for cover. I'd humbly suggest that Mr. Sampson do what most any good multiculturist would do in his situation ..... sue, sue, and sue some more. As we have our wonderful Pacific Legal Foundation in CA, there must be pro bono attorneys somewhere with enough principles to take this case. At least I hope.

Overly Sensitive Complaintant

It’s an interesting phenomenon. Dr. Adams writes an even keeled report about a true case of ridiculous behavior and even credits the ACLU slightly, and then what happens? Darn little. Mike often generates hundreds of comments. The hits on his page must be great. But that only happens when he plays to the extreme. I guess there really is no profit in being an honest, straight forward columnist.

I Love my school
I just completed my two degrees at IUPUI on in Computer Science from Purdue the other in Informatics from Indiana.

Nothing in this article surprises me. Trying to get the faculty to make a decision is like trying to have someone get a root canal without anesthesia. I had been through a similar problem at the university but it never got to that level. Stupid "Ethics" Professor.

I would still recommend the school thought when you get into the hard science there there are a lot of great professors that don't take any B.S. unfortunately they are all getting old or are being forced out.

As Rush always says... "With Liberals, it's never about the alleged crime..It's the "seriousness of the charge!"

Racism creates racism
A couple of things stand out in this story.

1. A white guy who READS on his breaks.
2. Among a BLACK co-workers who were (?) on their break.

Since he was READING, he obviously was not socializing. Could it POSSIBLY be partially the black co-workers had isolated him? Could it be the black female was looking for "15 minutes of fame", or just looking for an excuse to further ostracize the white guy?

One thing is certain! The racist behavior (and lack of appropriate response by the administration) will have a deleterious effect. Whether or not Sampson admits it (or even is aware of it), he will now look at all black people with a certain amount of suspician and distrust.

I know - I've been "there".

Seriously, I grew up in a time when "a man's word is his bond". Then our litigious society developed. Now, it is trust people, but check the fine print.

I'm a "senior citizen" and could give you hundreds of examples. Did I ever buy a used car from someone I trusted and it was a lemon? You bet! Did I ever buy another used car from that person? No way, Jose! Did that experience effect the way I "deal" with other car salesmen? Heck, yeah!

The point of it all ...
The purpose of terrorism is to terrorize.

The point of the harrassment action against Keith Sampson is to intimidate white males, or anyone who disagrees with the "vision of the annointed".

It doesn't really matter that Mr. Sampson was (or appears) to have been acquitted. What matters is that an atmosphere has been created where someone like the black co worker can accuse someone of "thought crimes" and make life miserable with no consequence. That's the purpose of all of this. Eventually, you get to 1984.


The hypocrisy that is "higher" education
Maybe Brodhead (President of Duke) didn't apologize to the stripper / prostitute that filed false charges against 3 of the Lacrosse team members, but even if he didn't, what he did say was bad enough.

Keith is aTroublemaker and rabble rouser
Having supervised Keith, I am convinced that he did this with the knowledge that he would make trouble. Keith is student, yes but he was working as a janitor before he started taking classes. So the "student" is a misnomer, because he actually an employee.
Regardless, knowing that Keith is a troublemaker and a rabble rouser, I can only guess that he was reading the material, not because he sided with Notre Dame, but because he empathized with the Klan. Keith has tried the "reverse discrimination" thing before and failed. He is surrounded by blacks in his line of work, most are his co-workers and others are his supervisors usually.

This was calculated, but he again failed to get any money, which is his true agenda.
