When I began the process of looking for a plaintiff to sue the Georgia Institute of Technology (Georgia Tech), I had hoped to see the day that a federal court would throw out the university’s unconstitutional speech code. The code went so far as to prohibit any speech that would "malign" another individual -- whatever that means.

Now, three months after a suit has been filed against Georgia Tech, the school has enacted a new speech code. This one prohibits any speech that is threatening, harassing, intimidating, or "otherwise injurious." The new code is entirely too broad. That is why the suit will proceed as planned.

Under their first illegal speech code, Georgia Tech created a remarkably poisonous atmosphere for free expression by punishing two students -- Ruth Malhotra and Orit Sklar, the co-plaintiffs in the case -- for engaging in constitutionally protected political protest. But now Georgia Tech officials are making matters worse by standing aside as their students create entire organizations designed to malign individual students; namely, the two aforementioned co-plaintiffs.

For example, Georgia Tech students have formed “Conservatives and Liberals Against Malhotra (CLAM)” -- a group comprised solely of gays and their allies.

Here’s how they describe themselves:

“This is a group and forum for students in any political sphere who see what Ruth Malhotra is doing on campus as divisive and degrading to our Georgia Tech community.”

And here is a further explanation of the group’s mission:

“It is important that we respond to Malhotra's bigoted blather. This fat ugly b****** is getting so desperate (not to mention the fact that she badly needs plastic surgery). Malhotra has a record of fighting Georgia Tech to advance herself, and this isn't the first time she has taken legal action against the school. Just try googling her name. Everyone knows that Malhotra and her ilk are a complete freak show -- setting up tables on Skiles Walkway and ranting against whatever strawman or other minority they decide to hate today. Even the Republicans on campus are embarassed [sic] by their crap. Malhotra wants the right to follow gay students around campus and yell obscenities at them, and now she is forcing the Institute to spend its money to defend against her bull**** lawsuit. Malhotra needs to shut the f*** up and realize that the point of Georgia Tech is to be the best research and engineering school in the country, not to advance her dead end political ‘career.’"

Of course, CLAM offers no facts to support the contention that Republicans (note: they say “plural” but only one effeminate Republican male seems to be opposed) are embarrassed by Malhotra. They can’t even spell the word “embarrassed” and don’t seem to be embarrassed about it. Furthermore, they believe that they are able to read Ruth’s mind and discern a secret desire to scream obscenities at gay people.

And, of course, members of CLAM were also among those responsible for passing out Hostess Twinkies in the dorms at Georgia Tech. This was accompanied by suggestions that Ruth (a student of Asian descent) is “yellow on the outside, white on the inside” and a “Twinkie b****.”

These liberals are hardly in a position to call anyone a “racist” or “intolerant.” But they can freely express themselves at Georgia Tech -- even holding rallies on campus -- for two reasons:

The constitution allows these gay activists to be intolerant racists even when they are ostensibly fighting for “civil” rights. The constitution does not protect a gay activist from showing his, her, or its ass.

The other reason is that the habitually dishonest and racially insensitive Georgia Tech president applies the speech codes selectively at his school. Despite their valuable contribution to Georgia Tech, Asians are not protected by the speech code until they commit their first act of sodomy.

Nonetheless, some people are confused about Georgia Tech’s rapid decline since Wayne Clough took over in 1994. And they can’t understand why the campus gets more hostile the more they pander to the sodomites.

What I STILL can't understand is the
name calling. The accusations of being an 'uncle tom' or B***H 'twinkie' or 'oreo' seem to always come from the left. Why do they think they (Liberals) can call us (Conservatives) any name their hate-filled minds can think of (and I must say they are somewhat inventive in this area!!)

How can they call themselves "INCLUSIVE" when they spout such HATE?

Here's hoping they keep it up and increase our membership of good people who can't tolerant their brand of intolerance.

As always, thank you for all the hard work you do exposing the incredible stupidity, ignorance and idiocy on college campuses.

I know from previous emails that you tend to have a lot of fun poking these fools right where it hurts but in all seriousness, you provide an invaluable service. Once again, thanks.

Now to the case at hand: Mr Conservative hits the nail right smack dab on the head.

Inclusiveness and freedom of speech exist in a liberals mind ONLY as long as you agree with them. Once you udder even the slightest disagreement, you are immediatly dismissed as a right wing fanatic. Never mind facts, a liberal always has a set view in their head and they will wrap whatever 'facts' they can find around that view, right or wrong, in order to justify it. They NEVER let facts get in the way of their arguments.

I am surrounded, on a daily basis, by a bunch of so called 'liberals'. It never ceases to amaze me how these psuedo-intellectuals can rant and rave and espouse viewpoints, never realizing that they THEMSELVES, just by they're complete unwillingness to listen to 'the other side' are as guilty if not more so of the 'crimes' and offenses that they hurl at others so easily.

But isn't that the way this always goes? For me at least, it's always been a pretty good bet that whenever a liberal is accusing ME of doing or saying something 'devisive' or bigoted, they themselves are guilty of that which they accuse me of, in spades.

Amazing, simply amazing...


Differences of opinion
First off, Georgia Institute of Technology has only become a better university since President Clough has taken over. President George W. Bush even appointed Dr. Clough to the President’s Council of Science and Technology in 2001. Yet this man has led to a “rapid decline” of one the highest ranked universities in the country, I beg to differ, we have only gotten better since Clough became president. Please check your facts before you present them as truth. My 8th grade English teacher taught me that. Do not disgrace the man that has worked very hard to make my university one of the greatest in the nation (we are ranked in the Top 10 for Public Universities) by calling him racist or dishonest; this could be considered libel.

I am not going to respond to the statements about the lawsuit, because I do not have a legal background and do not think that it is my place to try to disregard common sense and present my opinion’s as educated fact in this realm. I can however, comment on the student group “Conservatives and Liberals Against Malhotra (CLAM)”, because I am a member of the group. This group was created on an internet website called ‘thefacebook,’ much like ‘myspace.’ It has never been an official school group, more of a discussion of ideas. We have never met, nor does the group sanction any actions against ANY individual. We are merely there as a discussion of beliefs and how this lawsuit compares to our beliefs (ie. purely discussion). Most of the threads on the group’s pages are links to the actual brief of the lawsuit and articles written about the suit, to educate our group members so that they can make an educated decision for themselves.

I, myself, was brought up in a conservative Christian home, and still hold conservative Christian beliefs. In 5th grade, my teacher required my class to memorize the first part of the Declaration of Independence.
“We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.”
The founding Fathers of this great nation espoused that all men are created equal, yet Malhotra thinks otherwise, that she can berate these “different” people. This is their life, let them live it, you can ignore it, just like I ignore extremists on either side. Even God and Jesus expressed a love for your fellow man. Jesus even said when a woman caught committing adultery, brought before the Pharisees, “If any one of you is without sin, let him be the first to throw a stone at her”. Yet, isn’t that was Malhotra is doing? Judging some different group, while having sin herself? With the accusation that CLAM went around handing out Twinkies saying they were like Malhotra, was nothing the group as a whole decided to do. I had never heard of this action until this article. Furthermore, the “further explanation” of the group’s mission that is presented as fact, I could not find anywhere on the website at all, nor have I seen anything that horrendous on the website at all. If in fact it was posted, that is ONE person’s views, not the groups. Again, we are a discussion group, not all of us are politically like minded. We just believe that this suit is not something that should be happening.

Both Conservatives and Liberals alike are allowed to voice their opinions on campus. It is how each group goes about this expression is in contestation. There have been several religious groups on campus speaking out against gays, and the school allows this to go on. So to say the school is against conservatives is asinine. The school protects all of the students, not just a select few. The school cannot stop every incident of free speech; that would be too hard for a large school. If someone decides to pass out Twinkies in a dorm, the school most likely will never hear about it. However, if these students decided to pass out Twinkies in the center of campus in a public spot, they probably would stop that demonstration, just like they stopped Malhotra.

Please check your facts before starting an article, to give your readers an accurate view of the actual situation.

Quick advice for gpb06
You should follow your own advice when it comes to fact-checking. The Declaration of Independence's "first part" is not "We hold these truths to be self-evident…". Look it up. (Although, at least, you got the document correct. I’ve seen survey results that have high school graduates claiming The Declaration of Independence starts with “We the People…”)

Furthermore, your claims of equal treatment of conservative groups on campuses are themselves asinine. Liberal groups are rewarded with funding paid by student fees, while conservative groups are constantly denied the same funding, and often banned from the campuses altogether. Head over to the FIRE website for dozens of examples of this if you doubt this fact.

But, alas, your admission that Georgia Institute of Technology does, in fact try to "stop ... incident[s] of free speech" is merely proving the case for the legal challenge. The First Amendment doesn't stipulate free speech may be denied if you don't like what is being said, and THAT is EXACTLY what Dr. Adams has written at length about. Dr. Adams doesn't care that liberals are allowed to make fools out of themselves while conservatives are punished for pointing out the silly behavior of liberals. Free speech is being denied, and it would be just as egregious if the violations were happening the other way around.

Advice for beowulfe
Sir, I feel obliged to inform you and two of the other posters have been hoodwinked by Dr. Adams' article. Though your sadly contextual fault with gpb06's mention of the words of the Declaration of Independence is in an incredibly technical reading correct, you've failed to take in his message; I suggest you read his post again without snooping for mistakes.

Gbp06 corrects the misinformation spread by Dr. Adams: CLAM is merely a group on an online communication site called the facebook, made up of members from many colleges across the nation. CLAM is in no way supported by the Georgia Institute of Technology, and it is only affiliated in that the members are students at the school. Literally thousands of groups exist on the facebook, and CLAM stands among others such as the "Really, Really Ridiculously Good Looking Club" and "The Price is Right Fanclub," to give a horribly small representation. Ultimately CLAM is no more or less than a way to passively support the Institute in this ordeal with Malhotra by spreading information on the lawsuit's progression (such as media coverage, like this one).

Additionally, what Dr. Adams presents as "a further explanation of the group's mission" was actually the opinion of one member of the group (as gpb06 noted, the group is for discussion); this person was castigated by multiple members for his harsh and unproductive words. There is no way, when viewing the webpage, to accidentally misconstrue this posting as part of the group's mission.

Also, the alleged twinkie incident was not sponsored by CLAM; besides the fact that (as gbp06 writes) most of the group members have never met in person, this has never been mentioned on the group page. The event itself is also not common knowledge on campus (regardless of who carried it out); it appears Dr. Adams has more information than the students themselves--or perhaps none at all.

These are merely the points in Dr. Adams' article that are the most obviously incorrect and therefore the most easily refuted; I hope I've helped convince you of his duplicity. Dr. Adams is not practicing journalism with this article; he is practicing prevarication and intellectual dishonesty. I suggest finding a different source for your news.

A few questions
1) Where is it that Dr. Adams claimed that CLAM is sponsored officially by the Georgia Institute of Technology? I've read the column several times, and can't seem to detect such a statement. Is that statement hidden somewhere within Justice Breyer's copy of the Constitution that contains the ever-ellusive "abortion rights" clause?

2) Malhotra has been punnished for her exercise of the First Amendment because she said things that offended a few people. I would hazard to guess that at least one person -- namely Malhotra -- was offended by being called a "fat ugly b******" on a public website by a student at the university. When is the university due to punnish that student? Or has the university not only forgot what the First Amendment says, but also seems to have forgotten about what the 14th says as well?

3) Dr. Adams claims that "members of CLAM" were responsible for the Twinkie incident, not CLAM itself. Now unless CLAM is a corporate entity, which, as you seem to ellude to, they are not, how is this the same as saying CLAM was responsible for the incident? Furthermore, the alleged incident involves what is quite obviously intended to be a racial slur, something that the university's anti-constitutional speech code strictly prohibits. When will the offending members of CLAM receive their punnishment?

4) Does not the fact that Malhotra was punnished for saying something that some people found offensive, while members of CLAM who uttered things that were offensive absolutely contradict the assertion that "both Conservatives and Liberals alike are allowed to voice their opinions on campus", which is just one of the many primary sources of contention Dr. Adams has with the university?

An answer
Sir, in each of your four concerns you have made an incorrect assumption about my words. I can reply only with this: if you look hard enough, you will find fault with anything. I suggest you re-read my post, more carefully and with a more open mind. My intention was not to debate the politics of the subject, but merely to give you and other readers the true story of Dr. Adams' source. If you are as averse to differing opinions and perspectives as you seem to be, I apologize for the inconvenience.

One last time
Grendel, your message, as my response pointed out, was filled with one inaccurate statement after another. I haven't misassumed anything about your words, your words about Dr. Adams claims are 100% inaccurate, and that is the bottom line.

You insinuated that Dr. Adams claimed that CLAM was officially sponsored by the university. He did not.

You claimed that Dr. Adams claimed CLAM was itself responsible for the "Twinkie incident". He did not.

Now either it is you who should pay closer attention to what is written, or you are simply trying to spread lies. In either case, it has been clearly demonstrated that it is not Dr. Adams who is the one trying to "hoodwink" anyone here.

But to claim that I don't have an "open mind" simply because I refuse to believe what is demonstrably wrong is beyond ludicrous. Failure to believe in obvious untruths is not a failure to have an open mind, but the purest success of possessing a rational mind.

Suggesting churches friendly to gays
Mr. Adams,
In the amazing speech that you gave on C-SPAN on July 1st of 2006 you mentioned that the Georgia Tech site had a page that suggested religions where homosexuals were welcome. You went further to say that this insulted the religions and that this was a wrongful use of college activity funds.

I loved your speech up to this point. But you lost me when you seemed upset about Georgia Tech having the ability to offend people by putting this page up. You had just finished talking about how universities were limiting the freedom of speech. How students were not allowed to insult people or engage in banter. The position that you take on Tech seems very contradictory to what you're fighting for in an overall effort of achieving true free speech in the world of education.

You claim to be a champion of free speech, but what you really want is to secure your rights to engage in hate-speech. And what's even more revolting is that you want young college students to join you in your campaign for bigotry.

Mike, your seemingly light-hearted presentation and tweed sports coat did not fool me one bit. I saw you for what you really are… Hitler’s “mini me”!

However, I must admit I was sort of impressed with your vile talent for snidely insulting African Americans, Gays, Women, Asians, and Hispanics all in one breath, with a big ole wide grin on your face.
