WASHINGTON -- It is a trap.

Republicans are now poised to oppose an accomplished Latina federal judge for the Supreme Court, further alienating Hispanic voters the GOP has recently driven away in droves. The main line of Republican criticism is likely to concern affirmative action -- which might provoke conservative extremists to predictable extremes and confirm an image of Republicans as the party of the male and pale.

President Obama's choice of Judge Sotomayor was not cynical; she exactly mirrors his judicial philosophy of "empathy." But it is still a trap.

Some traps should be avoided completely -- and there is a case for avoiding this one. The Constitution gives the president a decisive role in the nomination process. He deserves broad deference to his judicial choices. Sotomayor's story is inspiring; she is experienced and qualified. She has demonstrated a capacity to fairly apply the law -- for example, in upholding the rights of anti-abortion protesters. And, for goodness sake, she ended the baseball strike in 1995. Barring unforeseen ethical revelations, opposition to Sotomayor seems both politically risky and ultimately futile.

Yet Republicans must still enter the trap -- with open eyes and no expectation of gain -- not to defeat a nominee, but to maintain a principle.

The principle is simple: A court should be a place where all are judged impartially, as individuals. The Obama/Sotomayor doctrine of empathy challenges this long-established belief. It is not a minor matter.

As a young senator involved in judicial nomination debates, Obama showed no deference to presidential choices. Instead, he developed a theory that Supreme Court justices should favor socially unfavored groups. He opposed John Roberts for using his skills "on behalf of the strong in opposition to the weak." He criticized Samuel Alito for siding with "the powerful against the powerless." Obama made these distinguished judges sound monstrous because they stood for the impartial application of the law.

By Obama's empathy standard, Sotomayor is a natural choice. She has argued: "The aspiration to impartiality is just that -- it's an aspiration because it denies the fact that we are by our experiences making different choices than others." And these culturally conditioned choices are not just "different." She contends that a "wise Latina woman" will "more often than not reach a better conclusion than a white male who hasn't lived that life."

None of this is particularly controversial at Obama's University of Chicago or Sotomayor's Princeton. In elite academic settings, it is commonly asserted that impartiality is not only a myth, but also a fraud perpetuated by the privileged. Since all legal standards, in this view, are subjective and culturally determined, the defenders of objectivity are merely disguising their exercise of power. And so the scales of justice -- really the scales of power -- need to be weighted by judges to favor the "weak" and the "powerless."

Sotomayor's decision in the case of Ricci v. DeStefano is disturbing because it seems to affirm this judicial philosophy. The New Haven, Conn., firefighters who studied for and passed a promotion examination (including a Hispanic) were denied a benefit they had earned, entirely because of their skin color. Because they were not part of a group deemed "powerless," they were rendered powerless as individuals. Empathy turns out to be selective empathy -- not for human beings, but for social groups. Just imagine the frustration and anger of standing before a federal judge who is predisposed against your claims for racial reasons of any sort. A federal court should be one place where every individual -- black or white, pauper or Rockefeller -- is exactly equal in rights and dignity.

Racial injustice against African-Americans is still alive in America, and the wounds and disadvantages of slavery and segregation linger. The vision of an entirely colorblind society can itself be a kind of blindness, ignoring continuing struggles and continuing bigotry. Institutions should be able to address past and present injustice through some forms of affirmative action, including the aggressive recruitment of minorities and the use of race as one factor among many in subjective admissions and hiring decisions. But denying earned benefits because of race alone is an injustice that will never solve an injustice.

Concerns about the doctrine of empathy will not defeat Sotomayor -- and perhaps they should not defeat her. Obama democratically earned his choice, as other presidents have done. But the problems raised by selective empathy require a substantive (not harsh or personal) national debate -- and this requires Republicans to carefully, warily, enter Obama's trap.

Sonia Sotomayor’s sense of a personal privilege to insert her personal biases into making new policy or changing law from the bench couldn’t be any clearer. Her stated intent makes her suspect and is ample proof of her unsuitability to be given a seat on the United States Supreme Court.

Sotomayar made clear in a speech at the Judge Mario G. Olmos Memorial Lecture in 2001, delivered at the University of California, Berkeley, School of Law that racial and sexual bias will be a part of her decision-making:

“I willingly accept that we who judge must not deny the differences resulting from experience and heritage but attempt, as the Supreme Court suggests, continuously to judge when those opinions, sympathies and prejudices are appropriate.”

“Personal experiences affect the facts that judges choose to see. My hope is that I will take the good from my experiences and extrapolate them further into areas with which I am unfamiliar. I simply do not know exactly what that difference will be in my judging. But I accept there will be some based on my gender and my Latina heritage.”

To read other law review articles written by Judge Sotomayor, as well as reviewed her other speeches, it is clear and unequivocal that Judge Sotomayor has a long track record of advocating for using courts to make policy and laws. It is obvious that the reason the White House has churned up its spin machine [CBS, ABC, NBC, and CNN news] on this is because countless polls consistently show that the American people to do not support judges making policy or law from the bench.

The American people have spoken loudly and often on this subject, they want judges who interpret law as made through the people and their elected representatives, not through judges imposing their personal political views from the bench as Judge Sotomayor has consistently advocated.

But as we see with TARP, Bailouts, Stealfromus Packages, and government takeovers, what the American people say falls on deaf ears in the White House and Congress.

According to Wendy E. Long, counsel to the Judicial Confirmation Network, Sotomayor is "a liberal judicial activist of the first order."

Long described Sotomayor as thinking "her own personal political agenda is more important tha[n] the law as written," and a Fox News commentator said she is neither a consensus-builder nor well-liked by her appellate panel co-workers.

In a forum at the Duke University

School of Law in 2005, Sonia Sotomayor said, "Court of appeals is where policy is made. And I know – and I know this is on tape and I should never say that because we don't make law, I know. OK, I know. I'm not promoting it, and I'm not advocating it, I'm – you know. OK. Having said that, the court of appeals is where, before the Supreme Court makes the final decision, the law is percolating – its interpretation, its application."

Although she catches herself and tries to dissemble her obvious legal foopah, none of the other panelists seemed to be willing to join her in her nervous laughter or to offer any other form of support for her in her letting of her activist “policy making from the bench” cat out of the bag.

Supreme Court Justice is a lifetime appointment.

At 54 yrs of age, this “policy-maker” has the potential for making LAW from the bench for the next 25-30 years in direct subversion of the limits on the Judiciary written into the Constitution. A violation of the Separation of Powers.

Article I Section I of the Constitution states: “All legislative powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives."

What we have with Obama’s appointment of Sotomayor is an attempt by Obama to further undermine the Constitution by adding a legislative influence on the Supreme Court, while he himself subverts the same Constitution with impunity from the White House; in effect, circumventing the people’s representatives in the Legislative branch which the Constitution put into place specifically to allow the people the right to control their own destiny through their elected Representatives.

Republican legislators showing that they are afraid to ask penetrating and studied questions regarding the suitability of this Latina will not gain them any friends with those who are predisposed to vote with the Democrats who offer them entitlements and Obama-Sotomayor style "empathy."

The only advantage they can hope to gain is one that displays they have the courage to do so, regardless of "political correctness" and kowtowing to Democrat voters.

Why is it that you and other "Republicans" can't get it through your heads the notion that perhaps it is precisely that approach (appealing to everyone but the Republican base) is the reason you are losing elections? Duh.

Perhaps Hugo Black said it best:

"Our Constitution was not written in the sands to be washed away by each wave of new judges blown in by each successive political wind.”

Sotomayor:

“Whether born from experience or inherent physiological or cultural differences, a possibility I abhor less or discount less than my colleague Judge Cedarbaum, our gender and national origins may and will make a difference in our judging. Justice O'Connor has often been cited as saying that a wise old man and wise old woman will reach the same conclusion in deciding cases. I am not so sure Justice O'Connor is the author of that line since Professor Resnik attributes that line to Supreme Court Justice Coyle.

I am also not so sure that I agree with the statement.

First, as Professor Martha Minnow has noted, there can never be a universal definition of wise.

Second, I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn't lived that life.”

Can you imagine if Clarence Thomas had made such a statement? What if Sandra Day O’Connor had said this about black men?

Picture it: “I would hope that a wise white woman with the richness of her experiences would more often than not reach a better conclusion than a black male who hasn’t lived that life.”

Barack Hussein Obama learned well from his masters how to play the politics of racial division and polarization. More of the same with his nomination of Sotomayor. Reparations and redistribution of wealth in the guise of “empathy.”

Gerson goes further to postulate:

“The main line of Republican criticism is likely to concern affirmative action -- which might provoke conservative extremists to predictable extremes and confirm an image of Republicans as the party of the male and pale.”

For Republicans to be more concerned with image than they are with standing on the principles that serve to uphold, protect and defend the Constitution, which is by law their ONLY responsibility, is just as likely to confirm an image of Republicans as spineless cowards who, regardless of their attempts to appease the base racists attitudes of Latinas, will find that because of and in spite of their ridiculous and unseemly attempt at pandering to Latinas, they will neither gain their support nor retain the support of the “conservative extremists” who confirm them. Notwithstanding the image continuously being portrayed of them as being “male and pale” from the lying lips of the Obama media.

Republicans have never won an election by being Democrats; or is that reality being somehow overlooked.

Republican Senators and Congressmen will indeed be entering the trap if they allow themselves to be cowed into silence because this woman is a Latina.

Being silenced by their own fears of being perceived of stepping on Latina toes —that IS the trap! Allowing themselves to be trapped by fear and ethical cowardice!

There will be no victory in Republican weakness and moral and ethical surrender in the face of political risk.

Nothing to fear but fear itself!!
Republicans need to step up and fear nothing!! If there is one thing I have learned from this past election, it is that candidates need to be thoroughly and completely vetted. The Narcississy in the WH is a case in point!!

Sotomayor is a member of La Raza, appears to support illegal immigration and reverse discrimination. It is reported that she once filed a discrimination suit against a colleague who asked her questions she didn't like. She will be on the highest court of the land for life!! She already appears to be a dubious choice, IMO, given some of her quoted statements.

She should be asked hard questions and given as little wiggle room as possible when she answers them.

Republicans do your duty. Fear only those who can kill the body and soul of this great nation. Then act with courage, damn the torpedoes and charge full steam ahead!! Get some guts, PLEASE!

And btw ...
a Republican filibuster is not necessarily futile. Given her antipathy to gun rights at the State level, there are a number of deeply Red State Dems (in Montana, Nebraska, Wyoming, North and South Dakota) who may not be disposed to vote for her confirmation!

Losing 15% or more of the Hispanic vote does hurt your candidates. So to turn your back on their concerns and issues, and to attack their first female SCOTUS nominee is to alienate their voting block further.

Gerson continually tells us that the only way to win is to become like Democrats, and that never works. Telling the GOP here to basically give up is exactly what Gerson is advocating in this article; his basic message is that since it may drive the Hispanics to vote for the Democrats (as if they already weren't a Democratic constituency) the GOP should soft peddle any resistance to Sotomayor. The fact of the matter is that the GOP has every right and reason to oppose Sotomayor and to not do so is to abdicate their advise and consent role.

Besides, why do you care as you are obviously a liberal Democrat? Losing the Hispanic vote should not be some huge concern for the GOP, epsecially if getting that vote means adopting the Democratic paradigm of pandering to them. No one wants to lose elections, but no one can win elections consistently if they have no unifying principles that define the Party.

This woman is mediocre -
period. There is nothing brilliant in her record. She is truly mediocre and for that reason should be opposed. BTW - where was the support for Miguel Estrada, a truly talented Latino? Oh, I forgot: he doesn't count!

Republicans Should Heed

the lesson of Clarence Thomas. We all remember the tremendous inroads the Republican Party made with African Americans after the Democratic Party engaged in the brutal mugging of Justice Thomas. If we don’t handle Judge Sotomayer with kid gloves how will we ever get Hispanics to stop voting their self interest and become Republicans.

Republicans must fight the good fight, not to garner more votes, but to provide the greatest amount of blind justice to the greatest number of people. Appointing a liberal racist to the Supreme Court will serve only to provide further division and injustice between the classes which will result in chaos. Trap or sacrificial anode?

Just by making it, he's sent flowers and candy to Hispanic voters.

If she's confirmed without Republican resistance, he'll seat a hard leftist on the Supreme Court. As such, she may prove useful to him as legal challenges to his policies multiply.

If she's confirmed despite Republican resistance, he'll be able to denounce her opponents as racists and sexists right through the off-year elections, and he'll still get a hard leftist on the Court.

If she's not confirmed, he'll beat up on her opponents for years. Further, his next nominee, who may be the person he _really_ wants on the court, will probably be confirmed without a peep.

In any event, we're screwed.

Obama and the race card
This woman is likely a ( would a white candidate be given the doubt if he/she had made a similiar statement) racists and should be opposed because it's the proper course of action, irrespective of whether she is a latina or not!

In addition, i'm getting really of tired of being expected to kowtow to hispanics while politicians attempt to hijack the political process playing the race card( obama is a master at this).

This pick is designed to placate hispanics,and is just in time for obama's attempt to shove amnesty down our throats. Like Sotomayer, anyone who opposes amnesty will be labbeled a racists and anti-hispanic.

Hispanics have never voted Republican as a voting block and likely never will. Threats of leaving the GOP( when they were never there to begin with) unless we roll over to their race-based demands amounts to political blackmail.

Ignoring the rule of law( amnesty for illegals), or opposing someone who has made racists statements - in order to supposedly placate hispanics is asinine!

Also, we have plenty of people celebrating hispanics and their so called "emerging dominance" on the political landscape. What they do not talk about is the role illegal immigration( and the complete disregard for the rule of law) has played in pushing this trend along. That's intellectually dishonest!

If hispanics( or anyone else for that matter) cannot see that this woman has made some serious comments( comments which would have ended the nomination of any white nominee)then perhaps it is they who should take a look in the mirror and ask themselves what this is all about.


PAY ATTENTION
Gerson isn't saying to roll over, he's saying that it's a trap and rather than avoiding it, the Republicans need to walk into it because there's an important principle at stake.

Every Lib in the country has been spouting off for days about how the Republicans would be foolish to dissent this choice... CLUE #1 - Whenever the Libs try to make your choices for you, trust that their choice is not in your best interest. BELIEVE THIS.

Sotomayor needs to be refuted, rebutted, and ultimately withdrawn. Sure it's a trap but that doesn't mean Republican's can't beat this trap. Obama thinks he's smarter than everyone else, but he isn't, and 'traps' like this prove how inept he really is.

All the Republicans have to do is hang this issue around Obama's neck like a rotting corpse. "Obama's Agenda is Racial Discrimination against Whites". And Sotomayor is the smoking gun. She's the evidence, not the focal point. Do it that way, and this is an easy win.

Most Hispanics don't care...plus she is from Porto Rico. I don't think there is much love between Mexicans and Porto Ricans.

Latinos
The Republicans need not fear losing Latino votes by opposing Sotomayor. Those types of racist liberals would never vote for any Republican. The Latino who is about to lose his car dealership for contributing to the Republican party is not going to ever switch to being a democrat. The Latino firefighters who were denied promotions by Sotomayor's opinion denying Latinos and whites got higher scores promotions to positions of command should also consider which political party is really on their side.

The real Republican "Trap"
If I hear one more time that if Republicans oppose Sotomayor, it will drive a wedge between them and the Hispanics I am going to flip out. This contention is a scare tactic to prevent any tough questioning during Judge Sotomayor's confirmation hearings. By so doing, they eliminate any controversy surrounding Sotomayor as well as once again playing the race card.

Republicans need to destroy this race baiting trap that the Democrats place before them on every issue. They used race as a significant intimidator during the last presidential elections and the result was Barack Obama.

Now the government is spending us in to debt from which we will never recover, annexing the financial, business, health and education sectors and fostering a serious national security threat. All this because Republicans listen to politically correct garbage such as this column.

Memo to Republicans, learn to lead or WE the people will drag you kicking and screaming from your cushy jobs in 2010.

Some of us are paying attention. But a little clarification.

You are spot on - Sonia Sotomayor is indeed the smoking gun. And being so, a much easier target than most suspect.

And even though she, barring something unforseen, will still be confirmed... we conservatives need to, and most certainly MUST go after her.

And Gerson is also right, that this is a trap... and a really ugly one.

But as we proceed, we need to exercise caution, and to the extreme. Because if we even remotely go after her like the left did with Clarence Thomas - on a personal basis, the trap slams shut... and we loose big.

The key is that most of main-stream America is still fair-minded and will react accordingly. And calling anyone a racist up front, even if it's true... has never, and will not sit well.

Main-stream America simply needs to come to its own conclusions.

And you do that by exposing another ugly truth -that the term "reverse racism" is both offensive and insulting beyond words... because it blatantly implies that only whites are capable of something that repugnant.

And trust me... nobody, and I mean NOBODY, likes to be called a racist.

And exposing the truth behind that term, in turn, exposes the people who practice it.

Then let America come to its own conclusions, about Obama, about Sotomayor... and their ilk.

It may not matter in this confirmation... but it will, in the next elections.

She is a ethnacist and ethnacism has no place in this country anymore, no more affirmative action, no more racial set-asides, no more quotas of any kind. When the Repubics ran the kind of RINO Gerson favors (McCain), their share of the Hispanic vote plummeted. Gerson apparently didn't notice that Hispanics didn't desert the Dims in droves when they opposed Bush nominees Miguel Estrada and Alberto Gonzales.

Did anyone else notice Gerson's unwitting racist presumption that "of course" most Hispanics will always vote along racial lines? Almost all racism today is practiced by the left and squishy "me-too" types like Gerson, and most of the rest is predictable backlash by those being victimized by the left's racial politics.

In addition to his implied racism, note also Gerson's explicit support for the racist spoils system euphemistically called "affirmative action." In poll after poll, regardless of race, people believe that the most qualified person should get the position. The type of person who craves racial spoils systems and reflexively votes along racial lines will never support a "me-too" Repubic when they can vote for a genuine Dim.

When Republicans run on core principles, they usually win; when they listen to RINOs like Gerson and run as watered-down Dims, they lose.

Why do race and heritage enter into every discussion? We're all Americans, and we should all be looking to do what's best for America. Blacks are always wanting what's best for blacks, Hispanics want what serves them best. We should all focus on what is best for everyone. Supreme Court Justices are lifetime appointments. Should there be blame for investigating whether this person best suits her position? Sounds like smart business to me. The politicians have divided us every day Americans into two different teams, and we spend every waking moment making sure that the other team has zero success. We're not two teams, we're one big huge team! How about we all calm down and discuss things civilly?

If she is deemed to be eligible for SCOTUS appointment, then any member of the KKK is also eligible. It is time for this gross hypocrisy and double standard to be stopped. Since Hillary didn't win, they get this idea that they would get their own woman, and she would pull all the Hillary votes away from the DNC.
They didn't count on the women of the Democratic party having a brain and, they thought these women would just follow them like little ducks. This didn't happen.

Let us take a step back and look at this for a moment.

The "BS" Bush put the country through, The picking of Sarah Palin to be Vice President,
McCain running an eractic campaign, The GOP was bound to lose.
The brand is tarnished, the DNC has been on the defensive for 8 years, the cycle has changed. 1 out of every 10 people say they are a Republican. We all know there are more than that, they are just ashamed to let anyone know they are apart of the party.
Look at it this way, The GOP had it's run for 8 years, if Obama fails to produce while during his Presidentcy, he'll be voted out in 4 years.
If the economy is still in bad shape but, the people are doing well, he may stay for 8 years.

The GOP needs to come up with new ideas.
Not just following after the Democrats.
