Will Sotomayor's Style Blunt Her Liberal Views?

Barack Obama has named his nominee for the Supreme Court, Judge Sonia Sotomayor of the 2nd Circuit Court of Appeals. What's the likely fallout, politically and judicially?

Politically, Obama gets a plus for naming the first Hispanic justice (unless one counts Benjamin Cardozo, nominated in 1932, a descendant of Portuguese Jews). Sotomayor has an appealing biography: She grew up the daughter of Puerto Rican parents in the Bronx, had a fine academic record at Princeton and Yale Law School, served in the U.S. Attorney's Office in Manhattan and practiced commercial law.

Republicans delayed her confirmation for the appeals court in the 1990s for the same reason that Democrats delayed and prevented the confirmation of Miguel Estrada for a judgeship during the first Bush term: to prevent the other party from promoting a Hispanic who would be a plausible Supreme Court nominee.

Sotomayor is that -- she clearly meets the minimal standards for the job. Republicans are unlikely to prevent her confirmation, and Democrats can tell Hispanic voters they put one of their own on the nation's highest court.

It remains to be seen whether Sotomayor will prove as charming and articulate in her confirmation hearings as Chief Justice John Roberts was in 2005. And she will presumably have to defend some of her public statements. Such as, "I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn't lived that life."

That amounts to an assertion that some Americans are more likely to have the "empathy" that Obama said he sought in a nominee because of their gender and ethnic origin. It's not clear that most Americans agree. Pollster Scott Rasmussen reports that 45 percent of Americans believe that legal background and competence are the most important qualities for a nominee, while only 27 percent believe that diversity is the most important. Independents on this issue, as on several others lately, are more like Republicans than Democrats: Fifty percent say legal background and competence are more important.

Sotomayor is not the first nominee chosen for her personal characteristics. But identity politics is not necessarily a political plus for most voters. All of us have only one gender, and only a limited number of ethnic identities and personal experiences. But we don't like to think we're incapable of entering into a sympathetic understanding of those of different backgrounds.

Which leads to the second question: What would a Justice Sotomayor mean judicially? In a widely noted New Republic article, liberal analyst Jeffrey Rosen quoted former 2nd Circuit law clerks and observers as having reservations. One anonymous source said she was "not that smart and kind of a bully on the bench."

If that's a fair assessment, Justice Sotomayor might not fit in particularly well in a court whose current justices, by all accounts I've heard, have excellent personal relations with and respect for each other despite their sometimes sharp disagreements. Half a century ago, most justices came from political backgrounds -- this court's members brought distinguished records from academic life and appeals courts or have demonstrated similar high abilities in their opinions.

Rosen expresses the fear that in this company Sotomayor may not prove an effective advocate for her liberal views. Which way that cuts presumably depends on what you think of those views.

One case currently before the court may be on point. Several white firefighters and one Hispanic firefighter sued the city of New Haven for setting aside the results of an examination because no black firefighters qualified for promotion. The federal trial court ruled this did not violate civil rights statutes, and a three-judge panel of the 2nd Circuit, including Sotomayor, affirmed, without a written opinion. This looked to many like a stealth strategy to protect racial preferences from legal attack.

In this case, Sotomayor seemed to share the view of legal elites that racial preferences must be defended, even at the sacrifice of candor, against all attacks. But most Americans tend to agree with Martin Luther King that people should be judged by the content of their character rather than the color of their skin. The Supreme Court is expected to rule on this in June, probably just before Sotomayor's confirmation hearing. Is this an issue that Obama and the Democrats want to litigate in the court of public opinion?

Good jusges should be like umpires
She is not a good judge because she doesn't think of the law first but the color or background of the person in court. She has proven to be racist in the case with the firefighters. She is anti-2nd Amendment and guns.

She would be like the umpire in a game only making calls on the visiting team. It would have a big impact on the game because she would give a distinct advantage to the home team who would do things that are not by the rules because they know she would let them get away with it.

That is why Republicans and any Dems with a conscience would oppose this nomination and force 0bama to select somebody else.

Obama did NOT name the first Hispanic
judge - BUSH DID!

Sonia Sotomayor may be the first Hispanic nominee to the U.S. Supreme Court, but it bears remembering that during the tenure of President George W. Bush, controversies swirled around two other potential Hispanic contenders: Miguel Estrada and Alberto Gonzales.

Could we have some facts, please!!!!

Here are the facts about these two men.

Miguel Estrada was nominated by President Bush to the DC Appellate Court, not the US Supreme Court.

Alberto Gonzales was on Bush's short list of potential nominees to the US Supreme Court, but he was never nominated.

Re: the role of judges
Kevinfromchatham13 has a good post. I'd like to add to it.

Judges must not make up or alter the law. Their job is to apply the law. To me this means clarifying what the LEGISLATURE meant in laws as they apply to specific circumstances.

Compare it to the NFL and the pass interference rule. This rule is contentious among fans (when is a player interferred with?). It has also been changed by the league (the legislature in this area) many times as they try to improve it. But everyone understands that it is the league owners, not the referees, who determine what the rule is.

Imagine a ref in a game who sees a player commit pass interference. He reaches for his penalty flag, but then pauses. He EMPATHIZES with the player, who's had a rough go of it in the NFL. His OWN OPINION is that the current rule is wrong. So he doesn't throw the flag and lets the play stand.

The ref clearly has not done his job correctly. If he continues to behave this way, it would be appropriate for the league owners to remove him from his position. Similarly, our Congress is empowered to remove judges, even SCOTUS ones, who do not perform their jobs according to the rule of law. This is part of the "checks and balances" principle enshrined in the Constitution.

Attention ALL U White Obama Voters
It is my hope that all of you self-hating, white, reverse-racists, who voted for Obama because he is BLACK ...

It is my hope that the NEXT time you are up for a job promotion which you have earned - that you will lose out to a black or any other minority - but especially to a racist Latina witch.

Of course most of you white fools who voted for Obama are probably sitting around waiting for a government hand-out like the rest of DUMBOMBA's electorate so you are not going to be up for any promotions anyway.

Sotomayer is Not a Racist
Sotomayer is a bigot. A bigot who has used her positions in the judicial system to advance a political agenda of preferential treatment for minorities in general and Hispanics in particular.

She appears to hold embittered or contemptuous views toward whites and does not miss an opportunity to criticize them or deny their constitutional rights when she gets an opportunity.

Were this woman a white man holding similar views towards minorities as she holds toward whites, she would never have gotten to first base in her politicl career disguised as a judge.

But because she is a liberal minority, she will of course be given a pass - just like every other "G*d D*mn America," "Whites Are Devils" raving minority hate monger. Far from being a career killer, being an out-in-the open race hater actually appears to raise your standing in liberal eyes, so long as you are hating on the "Right" people.

Rule of Law Died Long Ago
Sotomayer's nomination is not a sign of the decline in the rule of law. It is merely another of many current reminders of where we are now.

Liberals do not respect or want Rule By Law. They want people to rule over other people, so long of course as they are the ones doing the ruling. If you ever catch a liberal ruler disguised as jurist actually invoking legal justification for a position, it is either only because it coincidentally supports their desired outcome (i.e. a free speech case involving liberal views), or it has nothing to do with the case at hand (such as invoking the mythical "right" to choose in support of legal infantide)

Liberals want to Rule and Be Ruled
Liberal dogma is undergirded by the unshakeable belief that the average person is incompetent to manage their own life. They must therefore be ruled by their betters.

It is also convenient for them to categorize everyone into one of three groups. #1 Those who are fit to belong to the ruling class (i.e. the liberal governing elite). #2 Those unfit to rule, but know it (minorities, the poor, and anyone else willing to embrace the label of victim-in-need-of-being ruled). #3 Those unfit to rule, but do NOT know it (i.e. Conservatives).


Not The First Hispanic Justice
And, just exactly who was the first Hispanic on the Supreme Court of the United States?

Why, that would be Benjamin Nathan Cardozo.

Benjamin Nathan Cardozo (May 24, 1870–July 9, 1938) was a well-known American lawyer and Supreme Court Justice. Cardozo is remembered for his significant influence on the development of American common law in the 20th century, in addition to his modesty, philosophy, and vivid prose style. Although Cardozo served on the Supreme Court from 1932 (appointed by the Republican, Herbert Hoover) until his death, the majority of his landmark decisions were delivered during his 18-year tenure on the New York Court of Appeals, the highest court of that state.

Cardozo was born in New York City, the son of Rebecca Washington (née Nathan) and Albert Jacob Cardozo. Both Cardozo's maternal grandparents, Sara Seixas and Isaac Mendes Seixas Nathan, and his paternal grandparents, Ellen Hart and Michael H. Cardozo, were Sephardi Jews; their families immigrated from England before the American Revolution, and were descended from Jews who left the Iberian Peninsula for Holland during the Inquisition. Cardozo family tradition held that their ancestors were Marranos from Portugal, although Cardozo's ancestry has not been firmly traced to Portugal. "Cardoso", "Seixas" and "Mendes" are common Portuguese surnames.

Can you be both Hispanic and a Jew?

Of course, just ask Geraldo Rivera (Puerto Rican heritage) and a whole host of other Hispanic Jews.

Sodomator On Socialism
Sodomator has written about Ezra Taft Benson, the famous head of the Democratic Socialists of America, who once claimed that we will keep spooning you socialism until you will beg for communism. Nikita Krushchev, said when he heard what Benson proclaimed, "Oh, no, they will drop right into our laps."

Normally, that would sink her, but it is just par for the course in a White House chock-full of Socialists and Marxists.

Justitia, Lady Justice

The United States Supreme Court is the highest court in the Federal System. When our Founding Fathers created the three branch system, it intentionally placed the Judiciary outside of the election process. Thus, an appointment to the Supreme Court is one for life or until a Justice decides to retire and no sitting Justice ever has to answer to voters.

Why did our Founding Fathers set the Judiciary Branch outside of the election process? They wanted to maintain continuity in the rule of law and respect for our legal process. The tradeoff was that they Supreme Court was to judge a case pursuant to the US Constitution, not act in a political sense, be without bias and to leave one's empathy or sympathy out of the judicial process.

Justitia, Lady Justice:

Is cloaked in a robe, which representing the law.

Is blindfolded so that the court can have blind impartiality.

Is depicted with set weighing scales, which are typically suspended from her left hand, upon which she measures the strengths of a case's support and opposition

Is also often seen carrying a double-edged sword in her right hand, symbolizing the power of Reason and Justice, which may be wielded either for or against any party.

A male or female Justice should be able to arrive at the exact same decision.

The Judiciary Committee in the United States Senate must perform its responsibilities and not try to expedite the confirmation process. It is imperative that the Senators be fully briefed with a nominee's case records, decisions, writings, and the full text of all speeches. This is the responsibility of every member, not just the minority party.

It is a seat for life and the Justice never has to answer to "We the People," but the United State Senate must serve all of us well and fully vet a nominee.
