Will the Dems' health care Christmas Present to America be an improvement or detriment to our health care system?


President Obama’s massive mortgage-bailout plan is nothing more than a thinly disguised entitlement program that redistributes income from the responsible 92 percent of home-owning mortgage holders who pay their bills on time to the irresponsible defaulters who bought more than they could ever afford. This is Obama’s spread-the-wealth program in action.

Team Obama is rewarding bad behavior. It is enlarging moral hazard. It is expanding its welfarist approach to economic policy. And with a huge expansion of government-owned zombie lenders Fannie Mae and Freddie Mac, Team Obama is taking a giant step toward nationalizing the mortgage market.

Reporting from the Chicago commodity pits, my CNBC colleague Rick Santelli unleashed a torrent of criticism over this scheme. Santelli said: “Government is promoting bad behavior . . . Do we really want to subsidize the losers’ mortgages? This is America! How many of you people want to pay for your neighbor’s mortgage? President Obama, are you listening? How about we all stop paying our mortgages! It’s a moral hazard.”

All this took place on the air to the cheers of traders. Santelli called for a new tea party in support of capitalism. He’s right.

Obama’s so-called mortgage-rescue plan amounts to $275 billion in new debt that will have little if any lasting impact on deeply corrected housing prices or the mortgage-default problem that stemmed from the insistence of government to throw home loans at lower-income people. A modest reduction in mortgage rates will have little impact on home prices, as Harvard professor Ed Glaser has shown. And by the way, re-default rates on modified mortgages have been running 50 to 60 percent. This is not going to change. So why should we throw more good money after bad?

Meanwhile, Wall Street is awakening to the disappointment that the securitized mortgages behind the toxic assets that have done so much damage to banks and the credit system are not being treated in the Obama program. The oversight is incredible. There are no safe-harbor provisions to protect mortgage servicers against lawsuits if agreements are broken. The ownership of these securitized mortgage pools is wide and far, spanning the globe. Breaking contracts is exceedingly difficult, especially without any legislated legal protection.

Of course, banks that have whole loans can choose to modify them if they want. And in some cases it’s much better to modify than foreclose. But 70 percent of this bank-owned paper is performing. It’s the securitizations that have clogged up the world credit system.

Then there’s the bankruptcy-judge cram-down, which would allow the courts to renegotiate interest rates and loan principal. This would abrogate private contracts and throw out the rule of law. Do we think future investors will put up mortgage capital if they fear judges will overturn the terms of contracts? Home-loan supplies will fall and mortgage rates will rise.

Then there’s Fannie and Freddie, the big winners here. Only their products are eligible for mortgage relief. Jumbo mortgages are not. Neither are private-label mortgages created by various non-bank lenders. Fan and Fred already run 48 percent of the mortgage market. Obama’s proposal would greatly enlarge that and move the mortgage system toward government nationalization.

What’s even more incredible is Team Obama’s stubborn refusal to have any faith in the free market. In some of the hardest hit areas of the country, markets are already solving the housing problem. Writing on his Carpe Diem blog, University of Michigan professor Mark Perry notes that while California home prices dropped 41 percent in 2008, home sales in the state jumped 85 percent. It now looks like 2008 sales for single-family houses will exceed levels reached in 2007.

What’s more, the unsold-inventory index for existing single-family detached homes in December 2008 was 5.6 months compared with 13.4 months for the year-ago period. And the median number of days it took to sell a single-family home dropped to 46.1 in December 2008 compared with 66.7 in December 2007. So inventories are dropping, the number of days to sell a home are falling, and sales are rising in the wake of lower prices.

If the government really wants to help, instead of bailing out irresponsible mortgage holders, it should support new and younger families who want to buy starter homes and begin to climb the ladder of prosperity.

All this is free-market economics 101. And I say, let free-markets work. Let’s remember that most folks -- even those with underwater mortgages, where the loan value is more than the home value -- do not walk away from their obligations. They don’t want to wreck their credit -- and their homes are their castles. That’s the American way.

But if we penalize the good guys and subsidize the bad ones, we are undermining the moral and economic fabric of this country.

The program will adjust the principal and interest of mortgagees and extend the number of years to paydown the mortgage. It will not help those who do not work and those who fraudulently obtained or granted mortgages.

The housing market and peoples lives do have to be stabilized. Government policies and mismanagement by both Republicans and Democrats caused the problem so corrective action has to be initiated by the government. Then there will be a time when markets, free of greed and corruption, can take over again and correct the new problems initiated by government.

The bailout for folks who are underwater on their mortgages can be nothing more than disguised welfare and/or reparations.

Remember, these folks bought more home than they could afford. If they are underwater with their mortgages now, it is likely because the market has dropped their home values below what they owe.

So what? Unless they are intending to sell the house, it is just a paper, unrealized loss. In other words, if those folks intend to LIVE in their home, the market would eventually RECOVER and their market values rise back up to being worth more than they owe.

Being underwater on your mortgage is only a problem if you are intending to sell your house. So, we are REALLY talking about bailing out those folks who are intending to sell their houses in this market.

I'd bet MY house (pun intended) that the folks selling in this market are mainly those who were speculating, house-flipping, second and third home buyers (let's buy a second house and rent it out!), were scamming the system with liar loans, or were subprime borrowers.

This is a

I underwrite loss mitigation efforts for my loan servicing firm, non-FNMA/FHLMC. From my prior extensive experience in risk mgmt and underwriting, I often can intuit from a hardship statement that the whole loan started on a false premise. My adverse selection results in nearly 100% misrepresentation of income or none at all (no doc loans). As a firm, we had stringent guidelines for "reasonableness" of stated income, and I declined many. My challenge now is those loans in our purchased portfolios, and the abuses are manifest and egregious. Now, the same players who lived large placing these fictional loans come back as "faciltators" pursuing modifications of the abhorrent loans into which they placed these folks. Oh, and for a fee.

The free lunches and breakfasts at schools that your 10 kids throw in the trash, the $10,000 per yr per student for 13 yrs {K thru 12}, the food stamps for 80 yrs for each of the 10 kids, the sec 8 housing subsidies for 80 yrs, 10 kids and the 10 kids they also have at age 15 to 29. I was a banker for many years... a simple truth is that some cannot pay and some will not pay. When you violate that reality by demanding that bad loans be made, a debacle is inevitable.

There is evidence that several million "no doc" loans were made to ILLEGAL aliens which became problems-- one of myriad problems caused by those working and living here ILLEGALLY after border crashing or overstaying visas.

It was indeed the left which demanded that home loans be granted to the undeserving... as if it were a constitutional right to have a mortgage. This, in turn, artificially inflated home values causing a bubble economy that had to burst, as it had done in Japan years before and in overheated markets here before. By the way, Japan's govt. tried to spend its way out as the ObaMessiah and the left is doing now-- it DID NOT WORK.

So the left created the crisis and will now make it worse.

Larry is 110% correct, and note that those who did the right thing and invested already got killed by the stock market, and will get no bail-out, while those who took on too much mortgage or debt, or dumbly structured mortages, will get bailed out and rewarded. ACORN - Baltimore
Thought you might be interested in some REAL information related to Acorn Baltimore's "help" with breaking into a foreclosed home (THESE are the people that we will be helping);

Donna Hanks initially purchased her home (315 South Ellwood, Baltimore, MD 21224) on 7/06/2001 for $87,000. At some date between 2001 and 2006 she re-financed the original mortgage for the amount of $270,000 with a mortgage payment of $1,662.00. The FIRST foreclosure on this home was filed 5/31/2006. Donna Hanks filed for bankruptcy 6/16/06 during which a payment plan was approved for the $10,500 she was behind in her payments. This action stopped the original foreclosure. When she did not meet the terms of the bankruptcy re-payment, a second foreclosure action was started in January 2008. At the time she had not made her mortgage payments since September 2007. It should be noted that her salary per the bankruptcy paperwork was $1625 per month and she was working a 2nd and 3rd job (supposedly giving her an additional $1,275 in monthly income - the employers were not listed). Over extended? Also, during 2007 she was renting our her basement illegally (she was taken to court) and receiving rent while she was not making her mortgage payments. The mortgage company "raised" her payment $300 a month - right? Well, not exactly it was $340. The amount that she had agreed to pay back in arrears. Not exactly truthful, but what I would expect from a person with her criminal record (theft and assault 2nd degree and possession of a dangerous weapon with intent to injure). Oh and there is the small matter of breaking and entering. The house at 315 South Ellwood had already been sold at auction on 6/26/08 for $192,000. It just took them until September 2008 to get her out. Nothing like public information - it seems Acorn could have found this same information before they helped this "poor" victimized woman.....................

Barack Obama first said people making over $250k were rich, then $150k, then $100k and NOW you are rich if you make over $75k - soon to be anyone making over minimum wage.

Those making UNDER $75k will get $13 a week to stimulate the economy - everyone else must pay more taxes.

First, it does not help "irresponsible mortgage holders". You have to be current on your payments and it won't help you if you bought more house than you could afford. Read the proposal. Try to find the most outrageous part of it. If you do, you'll be scratching your head wondering why Santelli and Malkin are in such an uproar over an exceedingly sensible plan.

Second: This is TARP money. It was legislation passed by Bush. Sure, conservatives complained about that, but not nearly as much as now, when working class people are being helped out. Now they are ready to go to war.

Third: Can someone please explain this:

Kudlow, Santelli, Rush, Hannity, Malkin et al are TRYING to get you outraged. I suggest you actually read Obama's proposal before falling for their demagogy.

Why keep neighborhood wreckers in houses
they can't afford. I would would rather have an empty house in my neighborhood than a scummy family that runs down the house and the neighborhood. I further think there should be a web site that lists the people who get this bailout deal so we scruntinize the ones that live in our areas. I also think that no one making over $40,000 a year should qualify for this housing welfare. No stealth lonas to rich fatcats with vacation homes, etc.

Barack Obama "I Won"

Remember when Barack Obama showed his derision towards the TARP CEO’s for their private jets and their taxpayer paid Las Vegas trip plans, and saying "the party is over"?

Well Barack Obama has a date with Michelle on Valentines day - certainly nothing wrong with that - in fact that is a good thing.

The date is in Chicago, IL.

Obama flew to Chicago Thursday morning, then back to Washington, DC, Thursday night, presumably for something about the 'Stimulus Bill'.

Obama then flew back to Chicago for his date Friday morning.

Where is his 'Carbon Credits' for his date?

Henry Waxman did a cost analysis on Presidential travel in March of 2006, trying to make then President George Bush reimburse the government, for what Waxman called personal travel.

Using Waxmans figures, Air Force One cost $322,153 and the cargo plane cost $55,494. For a grand total of $377,647 for Mr. Obama’s three round trips, for his date.

Will Waxman demand Barack Obama reimburse the government for the 'Obama Date'?

The Oklahoma City Police Department admits one of its officers made a mistake in pulling over a man last week for carrying an anti-President Obama sign in his car.

According to The Oklahoman newspaper, an officer pulled over Chip Harrison last week because he had in his car a sign that said, "Abort Obama, not the unborn."

The officer confiscated the sign and handed Harrison a slip telling him he was under investigation, even though Harrison argued that the sign only meant he wanted Obama removed from office.

The officer thought Harrison was threatening to kill the president, according to the article. But the department later explained that the officer misinterpreted the sign.

That didn't stop Harrison from getting a visit from the Secret Service. They interviewed him at his house and determined he was not a threat to the president, according to the report.

Residential housing is a benefit in much the same way that food and clothing are benefits.

The federal government began to interfere in the housing market for political reasons, first because it was attractive - "sweet" - for politicians to posture as facilitators of home ownership and, second, because anything that increased individuals' holdings of residential real estate increased local tax revenues.

Big incentive there. An apartment building housing multiple families is a very cost-efficient way of providing living space for people. Being cost-efficient means that said apartment building's assessable value is lower than spreading those same folk out among multiple "little boxes made of ticky-tacky" on postage-stamp subdivision lots.

Less tax revenue for city hall.

So the apartment buildings had to go.

Now we have "McMansion" houses that CANNOT be sold for prices equivalent to the dollar values for which their municipal governments have assessed them.

Will we have apartments into which the former owners of these McMansions can cost-efficiently move after they've succumbed to foreclosure?

Nope.

A community organization breaks into a foreclosed home in what they are calling an act of civil disobedience.

The group wants to train homeowners facing eviction on peaceful ways they can remain in their homes.

Derek Valcourt reports their actions are not without controversy.

Near Patterson Park, suburb of Baltimore, the padlock on the door and the sign in the window tells part of Donna Hanks foreclosure story.
“The mortgage went up $300 in one month,” said Hanks, former homeowner.

She says the bank refused to modify her loan and foreclosed, kicking her out of the house in September.

The community group ACORN calls Hanks a victim of predatory lending.

"THIS IS OUR HOUSE NOW," said Louis Beverly, ACORN.

And on Thursday afternoon, they literally broke the foreclosure padlock right off the front door and then broke into the house, letting Hanks back in for the first time in months.

Why, the cost, sending 500,000 troops to Iraq would imperil their precious tax cut. To the Republican party, the tax cut was more important to them than doing the job right in Iraq. They figured the tax cut would be politically feasible only by sending 150,000 troops to Iraq.

When things went bad in Iraq, they concocted the notion of 'Clinton Administration defense cuts' as the reason why insufficient troops were sent to Iraq. The Republican party LIED while American soldiers died. These odious, godless, unpatriotic Republicans lied twice.

Firstly, as we all true conservatives know, it was the Republican-controlled Congress defense cuts that cut our military to the bone in the 1990's. Secondly, it was the Republican party that cold-heartedly decided that their precious tax cut was more important than doing a competent job in Iraq.

If the Republican party lies about matters of national security, then what can they be trusted for?

Did the people that took the loans not voluntarily apply for and then sign a loan contract.

I've been to settlement a few times and no one forced me to do anything -- I don't remember being physically forced to sign for the loan or being held against my will.

Time to blame the private mortgage lenders and Wall Street investment banks. All those re-fi letters you got in the mail, the past few years(one a day, no?) came from organizations outside the government regulatory process.

Wall Street would accept a mortgage from anyone with a pulse, bundle into a Collateral Mortgage Obligation and sell it for a lot of money. Unfortunately, they saddled these CMO's with credit default swaps and other heavily over-leveraged financial derivatives that they themselves didn't understand. The real estate market sunk which their quant models had NOT predicted. Oops!!

Last October, JP Morgan and Goldman Sachs volunteered to go into the regulatory US banking system. They figured the government could run their business better than their own business plans. It has all been a big disgrace!

It seems that for the past few years, that I had heard a lot about 'Predatory Lending'. A situation where, instead of the government forcing lenders to lend more, that their could have been some rules to slow down too much lending.

According to the WSJ there were many states that wanted to institute their own rules, protecting their state's citizens, but the Bush administration opposed this, due to their core belief in democratic centralism, otherwise known as the Unitary Executive Theory and also known 100 years ago as Bolshevism.

Oh yeah...Christ told us to help the poor and unfortunate. He never said we should be forced to or have our money stolen from us and given to others. Pretty sure he'd frown on that. I am a Christian and I do want to help the needy but I will do it on my terms not yours! I am a historian who has studied revolutions. I urge those who advocate one to study the, They are awful and tend to go on and on over and over. Banks make money by charging interest on their loans. The interest rates are based on the risk of non payment. If a judge can nullify a legally binding mortgage contract, the risk to the bank becomes infinite, because it is out of their control and does not depend on predictable market forces. Banks can't charge an infinite interest rate, so they will simply not write mortgages.

One reason this won't work is that everyone has a narrative that is too simple. Rbt Reich talks about unemployment and mortgages. That is involved somethimes, but not all. We have lots of excess inventory in Florida that doesn't have anything to do with refinancing mortgages. For instance, my ex died a couple of years ago, and his condo is among many for sale. The house across me is empty due to divorce, not foreclosure. If the government insists on putting a floor under price declines, that will keep the market from clearing. Just how much can one collecting unemployment afford, anyway? If they need to adjust, they may decide to move for opp;ortunity. A house may be the lat thing an unemployed person wants or needs.

Relax take a vacation

I think people are over blowing this thing. This is the best news that I have heard in a long time, our family income is currently about $75,000 a year. My wife and I are working 100+ hours a week once you factor in travel time. Our mortgage is $40,000 dollars a year. There is no way we can pay that.

So I;m going to have my wife quit her job, our family income will then go down to $30,000 dollars a year, but under the obama plan my mortgage can only be 31% of my income so my mortgage gets reduced to $9300 a year. With the extra $30,000+ that I am saving, tax free, I think I'm going to take my wife on that vacation that she always wanted to go on.

NOT throwing your vote away.

But it will not work... unless we ALL get in the fight.

could not have happened if not for the democrats in congress. just because repubs voted for it, does not mean that if dems would not have overwhelmingly voted for it it could have passed. The president is asking governors and mayors not to waste the stimulus money granted to them. They will not waste it. Politicians do what is best to get them reelected by splitting it with powerful friends. Hoping those friends will reciprocate at election time. Politicians believe it is throwing good money after bad by giving the money to the poor. Most of the poor do not vote or if they do they vote Democratic anyway.

It was unethical to force banks to give people loans for houses they could not afford. It is unethical to force strapped taxpayers to bail out unethical and irresponsible behavior.

The only thing that differentiates government from any other institution in a free society is the legitimate ability to coerce compliance. Coerced altruism is an oxymoron. Your comment is exactly why many would consider you mentally ill: your mind is an oxymoron.

Everyone assumes that

these people are "losers", "slackers", and so on. This is the typical republican rationalization technique of "blaming the victims".

In many cases, people are losing their homes for reasons beyond their control. They are not all losers or slackers or whatever derogatory term you choose.

Obama is trying to help these people stay in their homes. In itself, is this not the ethical thing to do? One would think that such an effort (to keep people in their homes) would be consistent with the conservative emphasis on "family values".

You will claim that this is unfair to you because you end up paying your neighbor's mortgage. This is just the typical republican sense of victimhood, evident across virtually of these columns. Not only do you want to blame victims, but then you want to endow victimhood on yourselves.

In reality, given a decent humane tax system, this could be handled in such a way that the rich people who can afford to help the less fortunate would do so. In an ethical society, they would be glad to do so. You would complain that it constitutes socialism, but it would simply be a more humane form of capitalism.

Then you claim that this will subsidize "bad behavior" and the unfortunate will take advantage of the system. But there is no evidence that this will happen under these circumstances, and it runs counter to what we know of human psychology - It's just another republican rationalization for hateful, greedy behavior.

It's not likely to be a "spree". Certain individuals around the country will come to the conclusion that where there is no justice, there is no injustice.

They'll be isolated events most likely. Look for attempts to kill IRS agents and Democrat politicians by people who've led otherwise uneventful, law-abiding lives, that's when we'll know that people have finally reached their threshold.

The thought of a mortgage bailout is utterly infuriating and very personal to me.

When my wife and I got married in July 2006, we eached owned our own home. Despite placing both homes on the market in January of that year, it took nearly nearly TWO FULL YEARS for one of them to sell. Many times we struggled and considered letting my home go into foreclosure, but we bit the bullet and did what we needed to do to keep paying. Then, when one of the homes actually sold for a ridiculously low price, we had to borrow money against the other house to pay off the existing mortgage.

So now Obama and his friends are going to take OUR tax dollars and give them to someone else so that THEY can avoid foreclosure?? Where is the fairness in that? I have a much better idea: how about letting my wife and I keep more of what WE make so WE can pay-off what WE had to borrow in order to play by the rules??

I'm absolutely disgusted.

I do think that our bankruptcy law passed under Bush was unduly harsh. People should be able to have a new start -- particularly since many bankruptcies happen due to medical issues or a loss of job (even a loss for several months can be enough).

Nevertheless, I live in a house that I can afford. I have no garage, 3 bedrooms and 2 bathrooms. It is fine -- but it would be nice to live in an nice big 2 car garage house. My wife and I are both college educated professionals who are middle aged. Yet, we live within our limits. After we pay our bills, we have about 200-400 left for vacations, unexpected expenses or new purchases. Had we been stupid enough to buy a $500,000 house with no money down -- and a variable mortgage -- that now is worth $400K we would have benefitted. Thanks to a low mortgage rate guaranteed by the government -- we could make out very well in 5 years. Nobody helps us though -- my student loans have a higher interest rate than my mortgage -- and they cannot be reconsolidated or negotiated (those who lobbied for that industry may even be more clever than the drug lobby). It is pathetic since my loans are backed up by the government if I default (yet my car, house and credit cards are not -- and they all have lower than my 7.25 student loan rate).
