Specter's Switch Could Impact the Supreme Court

Arlen Specter’s switch to the Democratic Party is a political earthquake that will have far-reaching consequences for a host of policy and political issues. Of all these, none is more significant than the potential consequences for the United States Supreme Court. As a result of this decision, the future of the Supreme Court may ironically rest with… the Supreme Court.

Pundits have waxed eloquent on how Senator Arlen Specter’s decision to switch to the Democratic Party going into his 2010 Pennsylvania reelection bid changes the balance of power in Washington, D.C. Many issues were hanging by a single vote in the Senate. One issue that has not received as much attention, but will in the days to come, is the future of our nation’s courts.

Senator Specter has always been a crucial figure in the ongoing struggles over judicial nominations. In 1987, Senator Specter was one of the pivotal votes in denying confirmation to Judge Robert Bork to be a justice on the U.S. Supreme Court. (That seat eventually went to Justice Anthony Kennedy.) On the other side of the issue, Senator Specter was also key in confirming Justice Clarence Thomas in 1991, and as chairman of the Senate Judiciary Committee in 2005 and 2006 he played a central role in the confirmation of Justice Samuel Alito.

Senator Specter has played a similar role in the fights over numerous federal appeals judges and other judicial nominations, with the same unpredictable positioning. Few if any senators have had such a rollercoaster career at the center of judicial confirmation fights. Conservatives have been deeply concerned about what Senator Specter would do in any given situation, and liberals have pleaded with him to repeat his performance with Judge Bork.

Now Arlen Specter will be a Democrat, giving that party fifty-nine votes in the U.S. Senate at a time when a liberal Democrat who was also president of the Harvard Law Review occupies the Oval Office. If Senator Specter chooses to support cloture on the nomination of all of President Barack Obama’s judicial nominees, then the only possible check that Republicans can have will ride on the outcome of another U.S. Senate seat, the open seat in Minnesota.

The outcome of the Minnesota election for the U.S. Senate between Senator Norm Coleman and acidic far-left comedian Al Franken is still being fought in court. Out of nearly 2.9 million votes cast, the candidates are within a few hundred votes of each other. First, Senator Coleman had the lead for reelection. Then recounts and challenges over various ballots ensued, and Al Franken took a razor-thin lead.

The election went to court over the recount procedures. A three-judge Minnesota court found in Mr. Franken’s favor, and in June the Minnesota Supreme Court will hear arguments from Senator Coleman. If Al Fraken prevails there, Senator Coleman’s only chance will be taking the matter into the federal court system.

There is a solid basis for federal litigation. Some of the Minnesota counties are employing differing standards on which ballots to count, and the election outcome could easily switch back to Senator Coleman’s favor if certain standards were applied uniformly statewide.

The use of different standards raises an issue under the Equal Protection Clause of the Fourteenth Amendment to the U.S. Constitution. And because the right to vote is a fundamental right under constitutional law, any equal protection issues subjects the counties’ procedures to what is called “strict scrutiny,” an extremely rigorous and difficult standard for the government to satisfy. If the counties’ decisions do not meet strict scrutiny, they will be struck down as unconstitutional.

Should this case go all the way to the U.S. Supreme Court, the issue in the Coleman-Franken case is very similar to the issue that decided Bush vs. Gore in 2000, and with it the presidential election. It would be up to the Supreme Court as to whether to take the case, where Senator Coleman would then have a good chance of winning.

If Senator Coleman won in the U.S. Supreme Court, two outcomes are possible. First, the Court could order a statewide recount with uniformly consistent standards, which could well give the lead back to Senator Coleman. Or second, if ballots are lost or a perfect recount is otherwise impossible, a new election could be called. Should that happen, Senator Coleman may well prevail again.

So in the end, the decision as to whether there is a filibuster-proof majority in the U.S. Senate for President Obama’s Supreme Court (and lower court) nominees may rest with the Supreme Court. That’s ironic.

It cannot be overemphasized that Arlen Specter has not yet shown how he will respond to Barack Obama’s judicial nominees. He may yet surprise those on both the right and left by asserting a moderate voice, should President Obama nominate a strident liberal as many experts anticipate.

So now all eyes are on both Senator Specter and Minnesota, as the future of the American judiciary hangs in the balance.

How does a states rights supporting party encourage one of its own to take this all the way to the US Supreme Court to invalidate the findings of the state court. Bush V. Gore was a travesty in jurisprudence and repeating it again would do more damage to the Supreme Court than a shaky 60 vote majority for the Dems.

Much ado about nothing
First, Specter was no conservative and is definitely no loss to the republican party. Good riddance!
Next, The only supreme court justices that will retire are already liberals and would side with this socialist in the white house anyway. The only threat is if Nobama wins a third term...
Finally, Coleman was not worth all this fuss. Let the comedian Frankenstein have the seat. He will be a good example to use for the next elections, much like Biden has been.

He's just another RINO ghost who took what he could in deals just to vote the correct way on a few occassions.

McCain, Romney, Huckabee, are also all made from the same idiot cloak of lies.

Qualification Switching to GOP
Mr. Specter's "defection" will not have any great impact on The Court since he has fought putting conservatives on the court his entire career. He should have been investigated and "vetted" and refused admittance to the GOP when he left the demo--statics in 1965. I think the most apt description for his role in the GOP was "mole" for his demo "duds" (excuse me "buds").

Specter, unklike Franken, will not automatically vote for the most liberal of nominees. Equating Franken with Specter is like comparing apples to oranges. He switched parties because he sees it as the only way he might be able to capture another term in the senate, but the switch was physical not mental. He is and always has been nothing more than a moderate, or in other words a RINO. I believe he can be counted on to continue to vote as he has in the past. Like the tail on Abe Lincoln's dog not being a leg, it has always been wrong to call Specter a Republican. Same applies to Olympia Snowe and Susan Collins. If the Republicans had a 60 seat majority with Collins, Snowe and Specter, it would stil not be veto proof. Same applies to the Dem's with or withour Specter.

What Will It Matter?
The truth is that a president who we can't identify because he won't produce a birth certificate is a far left liberal with ideas to change the U.S. Constitution because he believes it is a "charter of negative laws." He has strategically appointed far left persons into his cabinet and the U.S. Congress, even the Republicans, voted for H.R. 1913 the hate crimes bill that targets Christians and God-fearing conservatives, and in my opinion, violates the equal rights protection guaranteed under the U.S. Constitution by providing "special protection" for only one minority group of people and discriminates against all other minority groups and individuals who are not given the same equal protection, but in fact, are made targets for allegations, prosecutions, and arrests. Europe warned America. Europe and South American and Cubans who have immigrated to America are still warning America. A former Nazi man is screaming out and warning America. But, Americans are blind. They say if you oppose anything the left proposes into law that you're a racist or rightwing extremists. We are losing our sovereignty; freedoms; and are headed down a very slippery slope that could "change" America forever. We will be telling future generations, I remember when America was free...and...

One thing for sure
We're going to get a new, far left extremist radical liberal to the USSC that will make Ginsburg look like Rush Limbaugh.

This is what people don't understand.
Most Republicans and people who vote Republican are really just Conservatives who vote according to the issues they care about.

Most democrats and people who vote democrat are almost religiously devoted to a political party and partisanship. All they see or care about is the d next to the person's name. If Obama had run as a Republican then neither Republicans nor democrats would have voted for him. Because to Republicans it is about the issues and democrats are blindly partisan. If Sarah Palin had run as a democrat then both Republicans and democrats would have voted for her. Because the Republicans would be voting for the issues and the democrats would be voting for a party.

This is how and why we are under such liberal tyranny in America where we are suppose to be free.

Most Americans would never want these liberal leftist policies and leftist liberals knew it, they knew that they had to get control by masking themselves in a political party, which people would vote for no matter what, because they are completely partisan.

In other words this is no loss to the Republican or Conservatives because Specter already was a loss to them, regardless of the r next to his name.

BARRY WILL APPOINT AN ACTIVIST JUDGE.
When the Saul Alinsky Wannabe interrupted his Useful Idiot's (Robert Gibbs) Press Conference this morning, he was practically peeing his pants with excitement at the prospect of appointing a new judge to the bench. He openly stated that he would choose an person who would right wrongs and help the poor. He mentioned the rule of law and our constitution as an afterthought and suggested that the person would bring the constitution up to date, (I am paraphrasing.) It is clear that this idiot will search for an activist judge, (one of his Chicago creeps?) I keep thinking whoever it is, he/she can't be any worse than Souter. Hopefully.

Specter back to being a real democrat
Arlen Specter never was a Republican or a conservative. He started his political career as a Dumborat and only jumped onto the Republican boat because it had headway - Specter is a real politician- he sleeps with anyone that will give him a free ride and he is betting on Obama for two terms. I hope he falls flat on his face in 2010 and Obama comes down next.

I am afraid we would be very naive to think that Specter would do anything other than confirm Obama’s nomination of (most likely) Cass Sunstein for SCOTUS’ new Justice. We are witnessing the orchestration of a carefully choreographed drama. The turncoat makes his move, the Justice retires, and Obama appoints the most radical friend available. Hates guns, loves animals, hates hunting, loves being an animal rights activist, hates free speech on the internet, would love a “fairness doctrine for the internet” and voila! We have our next impartial Justice.

But maybe O will appoint Hillary – oh, same difference but worse. Also hates babies, loves abortion up to the moment before birth, loves homosexuals, hates marriage. What an impartial one that would be!

Specter is a true Republican,not a RINO.
The Republican party at the national level has NEVER been conservative. Its first president shredded the constitution to save the union. The difference between Dems and Reps has been big-govt-pro-business vs big-govt-pro-labor. Believers in limited government have rarely had a powerful voice in either party.

Coolidge and Reagan were notable exceptions - both of which met with massive resistance, resulting in only limited progress in shrinking the size, power and budget of the federal government.

Teddy, Hoover, Ike, Nixon, Ford, both Bushes and McCain were certainly not conservative.

The GOP ran a flat-out liberal for POTUS last year, and most conservatives voted for him because he wasn't quite as bad as the other guy. We conservatives / believers in limited government should have vocally rejected McCain, and thus avoided this debate within the GOP on whether to jog right or left.


I'd also like to take this opportunity to once again thank former POTUS Bush-43 for coming out to support Specter when Pat Toomey - a much more conservative candidate - had a real shot at winning the nomination (he lost 49-51). Jerk.


I'm not looking for perfection here - just a step in the right direction.



A few other notes
Rose, get over the Obama birth-certificate thing. It distracts from the real problem, which is the tyranny he wants to enact.


James, Souter is no loss - he's always on the wrong side of every case. It doesn't matter how liberal his replacement is - no case will be decided wrongly that would have been decided rightly with Souter seated.



TNconservative, says "Most Republicans and people who vote Republican..."
That's the real problem here - most elected Republicans DO NOT BELIEVE THE SAME WAY as most people who vote republican.

Spreme Court nominees
Since a through knowledge and understanding of The Constitution doesn't seem to be high on the list of criteria Mr. O is looking for in a SC nominee, how about Rod Blagojevich. Isn't he looking for a job? Ward Churchill (also out of a job, I think) or Bill Ayers would also have loads of empathy for the down-trodden.
The days the Court would be in session would certainly be interesting, to say he least!

O'Vomit picked a far left whackadoo for a Justice. This Sotomayor witch is ANOTHER one who hates the Constitution just as O'Vomit does. She wants to evaluate Constitutional issues in comparison to FOREIGN law!! The FIRST litmus test has to be "Will you confine your opinions to settled AMERICAN law and the limits of our Constitution?" No Surprise
Senator Spector made the move because he decided he could not win in the republican primary in PA. I would guess he will vote, for the most part, as he always has. Whichever way he votes, he may or may not gain votes in the dem primary in PA - that's his gamble. The people voted the dems in because of the out of control spending of the republicans. Now, since 2006, the dems have shown they can outspend what the republicans did. My guess is that Spector will lose his reelection bid and the dem's congressional majority will dissappear. Hopefully we will get enough dems voted out in 2010 to bring the Obama budget to a resounding halt. If not, we may well find out what living in a 3rd world country is like.
