Abuse in Jails Maks Life a Prison

116. That's about how many prisoners in America's jails are raped every day, according to a new report.

Alarmingly, "More prisoners reported abuse by staff than abuse by other prisoners," says Pat Nolan, vice chairman of Prison Fellowship, an organization that ministers to convicts. Nolan calls it a "total abuse of authority" that's also an indicator of a "breakdown of the system" -- a system that purports to be based on the principle of justice.

This issue won't inspire marches on Washington, and it's not new. But a coordinated effort to change the corrections culture is something novel, and very overdue. A study issued by a bipartisan panel established by the Prison Rape Elimination Act of 2003 aims to do just that, investigating "the prevention, detection, response and monitoring of sexual abuse in correction and detention facilities in the United States."

And why did this need to be done? The results speak for themselves. "Too often in what should be secure environments, men, women and children are raped or abused by other incarcerated individuals and corrections staff," the report found.

Nolan, who served on the commission and has spent time inside prisons providing religious guidance to convicts, calls what happens in the facilities "astounding." He cautions that the report "significantly understates" the problem, because it relied so much on self-policing and recording.

The good news, for the sake of human dignity and the health of society, is that in Nolan's wide experience, Americans are compassionate. The topic is unsavory, which is why it likely won't start a large public groundswell. But, Nolan observes, most people assume that no one gets away with rape, a blatantly illegal act, in the hyper-controlled environment of prison. Once they realize that prison life regularly involves facing the corruption, abuse or wholesale failure of authority, people quickly express outrage. Further, Nolan says, people understand what this has to do with stabilization, rehabilitation and common sense. Having had his dignity debased behind bars, a released inmate is rejoining civil society with all kinds of uncivil thoughts, bitter and angry at the horrors inflicted on him not just by his rapists, but also by the justice system that overlooked the criminal acts happening under its nose.

So what is to be done?

The passage of the prison rape law six years ago provided a catalyst for a change in corrections leadership. The panel formed by that act, having looked at what works and doesn't work, what's going right and devastatingly wrong, came up with standards for detection, prevention, reduction and punishment of rape in our prisons and other corrections and detention facilities. And though there is a federal law on the books, and the study was national in scope, Nolan believes that the prison culture must change on the local level, from the ground up. Ask your local newspaper to look into the conditions in nearby prisons. Urge your state officials to implement the National Prison Rape Elimination Commission standards. Make sure people at your place of worship or in your social circles know this is happening.

Churches have played no small role in the disinfecting process already. These dark crimes came out of the shadows when churches got involved, Nolan emphasizes. "Churches made it a moral issue," Nolan remembers. "In a civilized society we cannot allow this to go on."

No criminal, no matter how heinous his crime, deserves dehumanizing humiliation. Nolan, the commission, and Prison Fellowship are, of course, about law and order. But justice must be just, and there has to be more; society must offer support for its present and former convicts. Prisoners need "hope and a helping hand," Nolan asserts. And the most rewarding aspect of his work, he says, is that despite disappointments, "so many respond" to such "love." "They are eager to change their lives. They are desperate to break out of the cycle that's put them in this shameful place they are in, physically and psychologically." The introduction of love and accountability into prisoners' lives can be a breakthrough, he says.

Violence requires a vigilant response. Whether it's perpetrated against someone who's never jaywalked, a burglar or a homicidal criminal, no one deserves to be raped. And justice requires better guardians than those who would overlook violence against fellow citizens, however unsavory. With "change" as the buzzword du jour, a change geared toward dignity and redemption deserves a fair shake; it's also a worthy investment. As the commission reports, "More than 7.3 million Americans are confined in U.S. correctional facilities or supervised in the community, at a cost of more than $68 billion annually."

Loving your enemies and your neighbor as yourself is pretty audacious, too. Doing anything else would be cruel, if not unusual.

Power corrupts
And nowhere is disparity of power more stark than in a prison. If the staff is fully in control, its power over inmates is nearly absolute. It can commit whatever atrocities it pleases with impunity. If the staff is overwhelmed, indifferent, or on the take, the power of strong inmates over weak is nearly absolute, and problems are equally likely to go unsolved.

Overcrowding, understaffing, and inadequate training and supervision of what staff there is cause a great deal of prison violence. If federal and state governments are determined to spend trillions of dollars on economic stimuli, they could make a good start by expanding and improving existing prisons; building new ones; and hiring and developing sufficient qualified personnel to keep these institutions from returning to barbarism.

The feds are grinding out money as fast as their presses can run. Various governments own enough property to accommodate as many new prisons as we need. For example, several naval and military installations closed by BRAC remain underused. Prices of construction materials are low. There's no shortage of labor. So the climate for physical improvement of the penal system is as close to pefect as it's likely to get.

The bad news is that there's almost no chance for significant progress. Prisons are among the few politically incorrect government expenditures. Even the freest spenders of tax money balk at spending it for anything demonstrably useful. Endive research centers, bridges to nowhere, and other boondoggles are much more to their liking.

The worse news is that physical improvement would be only the first step toward meaningful reform.

As long as prisons are controlled by
law enforcement, there will be no change.

The IQ of the average corrections "officer" is lower than that of an iguana and the job attracts many who should be incarcerated. The system, like most gov't systems, is there to serve itself regardless of what is produced. It doesn't matter who "oversees" things, corrections jobs are now entitlements. The cow is long out of the barn.

We created a business to provide jobs for rural areas. We have more prisoners and police of all types per capita than the old Soviet Union. This is a nasty business and sadly a lot of these jobs are being filled by returning veterans many who are suffering from PTSD etc and prisons are the only decent paying jobs available. Most of these soldiers, indeed most prison guards are strong people who work in a soul sucking environment constantly understaffed and under trained. Taxpayers hate prisons but have created an entire system to keep them supplied with prisoners. I was astonished to hear we turn prisoners loose with no means of support or assistance. What would you do presented with the choice of committing a crime or starving? Few choose starving...

Having worked in the prison system for 5 years (state and county lock-ups) , I can attest that most of the CO's are otherwise unemployable minorities and NOT customarily veterans. Furthermore, inmates are given ample opportunity to make changes (PTI, counseling and employment assistance) but choose not to. Starving? Spare me, Hal. Drive through the crappier parts of Allentown and find I defy you to find anyone "starving"; the same is true in Newark.

State lock ups are boring and corrupt (and have very poor ventilation), but those who want to pursue a college education, an Olympic athlete's physique, or even a law degree, can do so (at taxpayer expense). Check out NJ's parolee support- its formidable. Back in the late 80's, we even had a contract with UPS for parolees to walk into high paying jobs, which failed miserably when it was found that many used the trucks to mule drugs. The poor starving darlings had the chance to make more money than I do, but it wasn't enough.

Also, PTSD does not haunt most vets, and is the exception rather than the rule. This is my turf, and there is no argument you can make. I think you get your info at least third hand. There is NO way you have any first hand experience in social services or corrections.

I often wondered how gang leaders could run their outside criminal operations from the inside of prison.

Are these criminal operations being help by government workers?

It wouldn’t take very many corrupt government workers to pull it off.

The government doesn’t have to smuggle the drugs or sell the drugs just wait until the gangs get fat and bust them and take the money?

These gangs have lawyers on retainer and collect dues to pay for court costs.

It’s all so circular.

These gangs wear occult tattoos and have ceremonies and pledges to the ONE.

Most gang members are not in the inner circle and never know who’s pushing the buttons.

Most gang members are disposable.

While not condoning 'abuse' of any kind....this is part of the inherent 'been happening forever' part of getting yourself thrown in jail. If they'd used their heads for something that wasn't illegal thet would not have to be Big Berts' buddy in the hoosecow.....simple solution, if you care so much put up the money for hemmmroid cream.

However, one thing sticks out--the abuse of veterans by the left-wing elements of this country (remember Vietnam veterans, anyone?).

gang members now work in some schools to recruit from within. In addition, businesses taxed and regulated out of solvency have left commercial properties in some areas; gangs have filled this void because they have the cash to buy up the real estate while the rest of us are being squished by big gov't.

Some still hold to the theory that kids join gangs because of "lack of opportunity". Wrong. They join because of moral bankruptcy, and absorb opportunities into the gang. Astonishingly, there are those who think we need to keep dumping more money into the inner cities.

I Don't accept th report on it's face.
I have spent 25 years in law enforcement both as a police officer working the streets of a large city and as a state corrections officer in a medium security prison. I would love to see th study, including the specifics regarding where these rapes proportedly occured and the instances of abuse.

Now I know I will be viewed by some as biased and therefore unable to render an objective take but anecdotaly I can say without hesitiation that the overwhelming majority of Police Officers and Corrections officers are well trained, professional and beyon reproach.

Of course in every profession there are rogues who fall through the cracks. However, once discovered they are not tolerated in todays climate of extreme sensitivity to every ethnic, gender and religious group(protected classes).

There is annual sensitivity training and directives which must be signed if those precpts are violated. Do rtapes occur on occasion? Sure, as they do on the street.

Consider that most inmates doing lengthy sentences are repeat offenders, many are violent and must be seperated from the general population. When you are dealing with 1600 of societys Drug dealers, Rapists, robbers...
it is a challange to keep the peace and protect each individual. Corrections officers are constantly assaulted and threatened, have feces and urine thrown at them, yet are expected to remain cool and professional.

The prisoners on the other hand have become experts through a lifetime of crime at creating the perception of abuse and rights violations through lies and deception. Most police officers and Corrections officers worked to hard to sacrifice their safety and career by perpetrating abuse. Abuse leads to a charged environment and possible riot.

Oh dear you poor sensitive liar. That is not at all what I said. We veterans are national treasures: most of us come to work on time; think before we act; work extremely well under pressure etc., etc. What I said was:

Heck I wasn't abused by the left it was the American Legion and the VFW's that would not even serve my friends and me a drink even though we were members. For your information the troops returning now about 30% suffer from PTSD or TBI. What are you doing to help them? Oh wait I know buying another round at the AL.

PRISONS SHOULD BE FOREBODING PLACES
Prisons SHOULD be horrible places and should be the most dreaded places on earth...not country houses and suites....They should be places where even the most hardened criminal fear. The "Hug-A-Thug" mentality of our society today puts the criminal ahead of decent citizens who are their victims. And if they get out and want to commit other crimes, then put them back in. And as far as child molesters are concerned, I would prefer to line them up and shoot them, otherwise, lock them away forever in an underground dungeon.

Careful it is only by accident you are not there.

I have worked in two prisons
It is a misnomer to call them "correctional institutions." There is some attempt, yes, to provide activity along the lines of correction, but the focus is certainly on punishment. When one or two prisoners do something wrong, there is a lockdown and the whole prison suffers. All "corrections" activities are suspended and more hostility is created.

Meanwhile, effective programs like those of Chuck Colson are turned away because they are not politically correct.

Just another problem.

Tent city jail is the pinnacle of corrections perfection. The jailhouse is not supposed to be fun, nor is it supposed to be something you want to repeat once you have been there.

Inmates do not deserve free college, cable tv, free food, 5 star gym facilities, free surgery, free abortions, nor air conditioning in the desert. Jail should be unpleasant, and if you see it as punishment, so be it. When you get locked up with a few hundred sexual deviants and violent psycho/sociopaths, don't drop the soap. Nuff said. A sane man would stop doing what got him sent there, don't ya think?

Americans nowadays only seem interested in abuse of criminals from other countries and seem to be disinterested in the plight of their fellow Americans who have been incarceated for whatever reason. This is a sad thing to say but its true.
The fact that the abusers are the staff will probably make most Americans happy. They probably feel that such actions by staff upon inmates is warranted and ok. Funny how they don't feel that way when the individual has bombed, killed and will continue to do so to our fellow Americans and others that live on this planet with us.

Yep, some hero. You know, of course, that a lot of people in his tent city are just waiting for trial and haven't been convicted of anything.

I think if I were locked up for something and subjected to the kind of abuse nitwits on these threads seem to rejoice in, I might try to shoot my way out of being rearrested myself, and I've never been arrested for anything.

You treat your dog brutally, and when he bites someone they come for you. When you allow a prisoner to be treated brutally and he comes out a mean dog, I hope he does come for you and not for me. Prison is punishment, and it should be-- but if you can't protect prisoners from rape and abuse, let them go. Society will be better off than if they are released after five or ten years of abuse.

Nurse in corrections
I worked for the GA. DOC for 4 years. The medical staff was very aware of sexual assault to the inmates and I thought did a good job of taking care of the inmates. If an inmate reported abuse by staff, the policy was for us to contact the duty officer not the supervising officer who was right there as they might be involved. No policy is perfect, training of the staff is crucial.

Punishment is to be carried out by the state, and must not be cruel. Being subjected to rape and assault is not part of anyone's punishment.

Nobody deserves to be raped, and nobody is allowed to commit rape.

Custody is a two-way street. We deprive people of their freedom as punishment, but we also assume responsibility for protecting them from harm while they are in our custody.

Why deterrents are of limited value
While deterrents do work for most people, those most likely to become repeat offenders cannot be corrected using punishment and fear.

Many criminals are impulsive. They do not plan their crimes, they simply act out violently without considering the consequences. They would do what they did even if they knew could face the death penalty for their crime.

While they certainly do deserve punishment, they also need help to change their way of thinking.

Children of alcoholics
An experiment was done on dogs, where a light would go in in their cage, and then a mild electric shock was run through the floor. The dogs learned to jump up onto their bed when they saw the light go on, in order to avoid the shock.

Then, the scientists had the shock go off at times when the light didn't come on. eventually, the dogs would simply stay on the floor and endure the shock. They could not predict the pain, and eventually learned to ignore it.

Many in prison are the children of alcoholics. Their parents punished or praised them, not in relation to the child's behavior, but based on how drunk they were. Eventually such children just do whatever they want, because there is no correlation they can see between their actions and the consequences.

Such people cannot be corrected with mere punishment, since they do not associate it with their actions, and like the dogs will simply endure the pain.

The psychopaths among us
Be aware that those who have no sympathy whatsoever for criminals may score as high on the psychopathy scale as those criminals.

The Attack On Religion
With the Liberal Progressives in power, the American prison population can't rely on the religious consciousness of America to do them any good. Unfortunately, when you don't show compassion for your fellow man or woman, you can't expect any. With the mainstream media fostering hate 24/7, how can anyone behind bars expect this hate to stay outside the walls. There is plenty when they go into prison where it is survival, in itself, that becomes the only goal. When Ms. Lopez mentioned rape, was the survey done in female prisons only? If not, then another survey should be done in male prisons where rape is even more common. Not to be outdone, I would imagine that the guards are busy in male prisons as well. Liberals want religion out of our lives, so let them deal with the consequences. I have not followed any religion since I walked away at the age of seven when I first saw the hypocrisy of religion. That was sixty-eight years ago and I still don't break the law, any law. I didn't need someone to tell me the difference between right and wrong. Obviously, those who break our laws do need to learn the consequences. Watch the soap drop in the shower fellows!

Rape in prison
To Jimmy of NJ. You say that prisons should be terrible places so that people will be motivated to obey the law. There is some truth to that but not concerning rape or physical violence.

No man deserves to be raped by another man, no matter what. It is the worse thing that I can imagine. Also you forget an important issue. Not all people who are found guilty and sent to prison, are in fact, guilty!

For an innocent man to be deprived of his liberty and be put in prison is bad enough. For an innocent man to have to try to defend himself against rape or murder in prison is another thing entirely.

In order to have protection you have to join a prison gang and that gang may order you to murder someone in prison. For an honest man to be faced with the circumstance to either be raped, murdered or to have to murder someone else would be terrible.

Also, if you survive prison and are released, you still belong to the prison gang and have to do what they tell you to do forever.

While it's possible for a guard to rape an inmate I am skeptible. It is too easy for prisoners that are serving a life prison to murder the guard if that happened. There are many guards that are killed in prison for no reason what so ever. I can't imagine that the prisoners would stand for a guard to rape a prisoner. Someone may have watched too many Humphrey Bogart movies where the guards are all bad guys and the inmates are wonderful fellows.

All things being said, I don't see how it is possible to prevent prisoners in the general population from raping other prisoners. The only way would be to keep all prisoners in solitary confinement. Too many people would go crazy in that enviornment and it is too expensive a system.

Being politically incorrect.

Now to put this in context, what I am about to propose below is for the most violent and demented animals our society must deal with. So if you get busted for dealing marijuana I am not talking about you.

But those prisoners who belong to the most violent gangs, those who are serving time for assault, murder, rape, child molestation and other violent crimes need stern justice, period.

I think these people should be put on notice that they have 1 year to revoke their memberships in gangs, renounce their violent ways and rethink their lives. If they refuse they should be aware that any future assaults they are found guilty of will result in the loss of one of their hands. If this doesn't do the trick, well, they have one more hand to lose, don't they. This will set the example necessary to reform our country.

I don't care the least about these criminals. I do care about our children, elderly, and decent ordinary people trying to get on with their lives without being victimized by animals that have no respect for the law, human life, or the "rights" of others. Repeat offenders who will kill or maim again, maybe a loved one of yours or mine.

Fretting over the rights and treatment of vicious criminals and ignoring their present and future victims is just another sign of the sickness of our weak effeminate culture.


Guards
I have been falsly arrested twice in my life and spent a total 15 1/2 days in 2 different county jails. The guards treat everyone in the jail like dirt. They do not take care of there medical needs, (I am a type 1 Diabetic and almost died the second time) I was innocent but was treated like dirt. Men are not the ones being raped by the guards it is the women prisoners who are being raped by the guards. Most of the guards are bigger criminals then most of the people behind bars. I am just now after 2 years finally getting the Police Detective who lied in his report charged with filing a false police report and disposing of evidence that proved I was innocent. And another thing, immigrants have flooded to America for centuries. Jews, Buddhists, Muslims, Christians of every denomination, atheists, and all other manners of faiths and cultures. Coming to America with their hopes and dreams for a new life.

And they streamed to America knowing that WE WERE predominantly a Christian nation. But they knew that America, while being predominantly a Christian nation was and is the most TOLERANT society the world has ever known. They knew that they could come to the shores of America and become new men and women, free to worship as their conscience dictated, free to pursue a new life. They took their vows and oaths and became Americans without demanding first America had to remove God from public life, censor the word Christ out of Christmas, embrace homosexual marriage, and jump through all of the multi-cultural hoops the radical left is so busy implementing. They were just thrilled to come to a Christian nation with a tolerant democratic form of government that they could live and raise their families in. Thrilled to be free.

But now the leftist generalize that all of our forefathers were just a bunch of bigots and racists, that now God and the Christian faith have no part in our new culture, that now there is no room for standards of decency in America, that now the Constitution must be reinterpreted and "while all men might be created equal none are they match of a wise Latina woman", and on and on it goes.

Just remember, America grew, flourished, and was the beacon of justice and freedom for many many years, attracting immigrants by the millions, and growing to the most prosperous and powerful country the world has ever known, long before affluent, spoiled, smug, hateful, ingrates such as you drew your first breath.

And now you have the audacity to hate and want to overthrow everything America has stood for. How sick.

Strange, in my 36 years working in corrections, three people were charged with crimes with/against inmates; ALL social workers taking illegal drugs and alcohol into the prison in their brief cases. They must have had IQ's superior to an iguana. Sure hope that helped them out when they locked in to their cells. Make that four as I almost forgot the mail order certificated sociologist who spent her days fellatiating convicts.

Training is constantly being updated and the Corrections Academy extended(Now 18 weeks live-in). The quality of recruit these days is much higher than it was 25 years ago. The younger recruit is more educated and in most cases doesn't carry the old biases or predjudices that existed in the 50s and 60s. Many are ex-military.

The problems are many and complicated. Most prisons are overcrowded, some extremely so.
With an estimated 12 to 20 million illegal immigrants adding to the situation, the intrusion of latin Drug gangs into the heart of the nation, whom I might add are extremely violent, has contributed to the prison over-population. Politicians cut needed programs to save money, as well as freeze hiring of needed officers. Because of the debasement of the culture, high instances of fatherless kids, especially in the Black community, a life of crime, gang membership and violence are much more common than when I was growing up and it is manifested in our prisons.

The nature of the beast is that when you group 1600-2000 criminals(most repeat offenders), many violent, within one institution, maintaining order becomes a real challange.

The inmates, with few exceptions, thrive on reputation. To those posting claiming that they were arrested falsely and imprisoned, I am not saying that it is not possible, but highly unlikely. Police need probable cause to make an arrest. Then a trail decides innocence or guilt. If you have a criminal past, you are more likely to draw the attention of police for any infraction.

Like most of these "studies" the numbers reflect only the female experience. Problem is that when a female inmate trades sex for privileges, that is defined as rape. The correction officer is defined as the criminal; the reality is he should be charged for -- if anything -- soliciting prostitution, and the imate for being a hooker. This is a far cry from the real problem in our prisons, one so glaring even Dershowitz, that icon of the left, wrote about it in one of his books. Of course, there was no follow up. Still won't be.

Prison Rape Is A Myth And Hoax.
The eyes and ears of any prison are supported by prison snitches. The ratio is usually one snitch for every 25 inmates. Each snitch is recruited from two of the major ethnic prison groups. Snitches are in constant contact with the guards. Even minor unacceptable behavior is quickly reported. Any inmate that attempts to rape another will be immediately arrested. If found guilty he will be given 10 extra years to serve. That time will be spent in solitary confinement. If rape was widespread in prisons, where are the arrest records? If they existed they would be made public. Prison rape is a myth and a hoax.
