Will the Dems' health care Christmas Present to America be an improvement or detriment to our health care system?


First came the breaking-news e-mail alert: President Obama would appoint Sonia Sotomayor to the U.S. Supreme Court.

Within minutes, a dozen other e-mails tumbled through the hatch enumerating all the reasons why Sotomayor was a terrible pick: affirmative action, identity politics, the Ricci case, double standards, racism, sexism. Boom shacka-lacka-lacka ...

You could practically hear the clattering of bullet points ricocheting through the blogosphere.

Even without the help of all those foot soldiers who blast out late-night memos, any sentient being could have predicted the reaction. A brilliant white Protestant heterosexual male with one wife, two children and a record so clean he squeaks when he walks would have been viewed with skepticism if Obama had chosen him.

In partisan warfare, it's never too soon to open fire.

Let's give our trigger fingers a rest and clear some underbrush. Yes, of course, Sotomayor is a political pick aimed at consummating the Democratic Party's romance with what has been the largest growing demographic in the country. Unprecedented.

When Republicans appoint justices (seven of the nine currently serving), they're merely brilliant men who happen to be Italian-American or African-American -- without any political-identity considerations whatsoever.

Then again, perhaps Sotomayor is an experienced jurist who happens to be a woman (check) and a Latina (check), who also happens to have the qualities Obama prefers, plus a spiffy resume: Princeton University Pyne Prize winner, Yale Law Journal editor, 17 years on the federal bench. Some call that a trifecta. Yet, you'd think from the onslaught that she runs a chain of abortion clinics.

Although her judicial record has raised some legitimate concerns, Sotomayor isn't so easily characterized as the radical liberal some on the right have suggested. She has ruled favorably toward anti-abortion protesters and unfavorably toward minority plaintiffs.

Nevertheless, most criticism has been aimed at perceived racist-sexist remarks from a 2001 diversity speech in which Sotomayor suggested that she, as a Latina, could be more qualified than a white guy. Pause: Don't most women think they're more qualified than most men when it comes to making wise decisions? Kidding, kidding.

What she said: "I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn't lived that life." Sotomayor may be redundant (a Latina is a woman) and possibly misguided, but she isn't necessarily a sexist-racist. I say this as a mother of white males (perfect in every way) and author of "Save The Males." Notwithstanding the preceding, I see her point.

Could a white male get away with saying something comparable about a Latina? Of course not. After Latinas have run the world for 2,000 years, they won't be able to say it ever again either.

Finally, context. Sotomayor's point was that the ethnicity and sex of a judge "may and will make a difference in our judging." Who doesn't believe that?

Just for fun, I might argue that Sotomayor is a conservative inasmuch as she implicitly recognizes that men and women are different and bring different perspectives to bear. Radical-liberal types tend to fantasize that sex is not a difference that matters. It also can't be denied that one's racial/ethnic background is profoundly significant, though we all pretend otherwise as convenient.

The broader concern, obviously, is that such considerations not interfere with how Lady Justice, her blindfold securely fastened, interprets the law. Hence questions about Sotomayor's role in the now-suddenly famous Ricci v. DeStefano case. To think, a few days ago, only seven people outside of New Haven, Conn., knew the name Frank Ricci. Today, rumor has it that Tom Cruise is considering playing Ricci just as soon as Joe the Plumber writes the script.

Briefly, Ricci is a white firefighter who performed well on a promotion-related exam. But because minorities didn't do as well -- and therefore couldn't be promoted -- the city tossed the test. Ricci and 19 other firefighters sued.

The pinch for Sotomayor is that she and the other two appellate panelists affirmed a lower court ruling favoring the city's decision -- without evidence of having grappled with the legal issues. Thus, a legitimate question for anyone: What was she thinking?

By the time Sotomayor comes up for a vote, we'll know everything but her ring size.

For now, the hot winds of punditry could use a little chill.

Calling Sotomayor a sexist and racist, far from being fair, is an irrational rush to judgment unbecoming ladies, gentlemen, scoundrels and scholars.

I’ve now completed the study of every one of Judge Sotomayor’s race-related cases that I mention in the post below. I’ll write more in the morning about particular cases, but here is what the data shows in sum:

Other than Ricci, Judge Sotomayor has decided 96 race-related cases while on the court of appeals.

Of the 96 cases, Judge Sotomayor and the panel rejected the claim of discrimination roughly 78 times and agreed with the claim of discrimination 10 times; the remaining 8 involved other kinds of claims or dispositions. Of the 10 cases favoring claims of discrimination, 9 were unanimous. (Many, by the way, were procedural victories rather than judgments that discrimination had occurred.) Of those 9, in 7, the unanimous panel included at least one Republican-appointed judge. In the one divided panel opinion, the dissent’s point dealt only with the technical question of whether the criminal defendant in that case had forfeited his challenge to the jury selection in his case. So Judge Sotomayor rejected discrimination-related claims by a margin of roughly 8 to 1.

Only one case (Gant) in that entire eleven years actually involved the question whether race discrimination may have occurred. (In another case (Pappas) she dissented to favor a white bigot.) She participated in two other panels rejecting district court rulings agreeing with race-based jury-selection claims. GIVEN THAT RECORD, IT SEEMS ABSURD TO SAY THAT JUDGE SOTOMAYOR ALLOWS RACE TO INFECT HER DECISIONMAKING.

Isn't what's really happening here.

The first thing Sotomayor apologists decried was that her statement about Latina women judges making better rulings than white men was being taken out of CONTEXT.

Now it seems that, in reading your article, that pesky little fact was...uh..er...overlooked.

Yet that is exactly what you would do to defend her.

Conveniently missing from this gender-race-based excuse piece is the most damning piece of evidence against Sotomayor's being seated on the U.S. Supreme Court:

Her candid, if all-too-revealing remarks concerning her pompous bragging about how Appellate Judges (like herself) use the power of their position to circumvent the Constitutional powers reserved and privileged for the legislative branches of government, to MAKE POLICY from the bench.

Not only has she indicated to her fellow members of LaRaza that she considers her opinions and rulings superior to those of white males, she has also said that the position she holds as an Appellate Court Justice is "where policy is made..." Oh, but of course! We all know that (wink, nod).

And if you examine the CONTEXT in which she said so (there's plenty good video footage of her braggadocious elitist comments to be viewed by all), you will begin to realize that your little attempt to rewrite a pitiful and pious narrative history of the poor little misunderstood minority woman can't be bought or sold here.

I run into that one sometimes also, it's maddening! When it starts doing me like that, I find it sometimes helps to restart my computer. At any rate, make sure you SELECT ALL and COPY the text of your posts before pressing the SUBMIT button. That way at least, you won't lose what you've written when you try to post it!

The Truth Is Never Good
I'll give Sotomayor one thing--she has spoken the truth and in todays society that is always a bad political move.

When she said a person of color and female would decide cases better than a white male and judges make policy...she spoke the truth.

Obama's henchmen are trying to say these Sotomayor statements were a poor choice of words. Translation, she should have lied, she should say things people like and then do the opposite just like Obama says things to please his opponents and then does the exact opposite.

Obama's solution, lie to the people and then after confirmation, legislate and rewrite the Constitution from your judges position.

Lying is good politics...the truth is death to a Democrat.

The two Senate Democrats leading the drive to overhaul health care say they will work together to come up with legislation.

Sens. Max Baucus and Edward Kennedy said in a joint statement Saturday they intend to cooperate so their committees pass similar bills that can be combined into a single piece of legislation before the Senate leaves for its August recess.

The statement appeared aimed at dispelling reports that Baucus and Kennedy were working at cross purposes in crafting legislation.

Baucus, D-Mont., heads the Finance Committee. Kennedy, D-Mass., is chairman of the Health, Education, Labor and Pensions Committee.

Kennedy is expected to release a plan next week requiring all individuals to buy insurance and creating a a public insurance plan that would compete with private insurers.

Ms. Parker reminds me of the innocent little child on a walk in the forest. She hears others tell her the forest is on fire, and she might even pick up a little scent of smoke, but she is determined to go deeper into the forest and find alternative explanations for the smell of smoke. When the fire finally engulfs her, she'll be so far into the forest she won't know the way out.

America is on fire, and the Obama administration is setting the fires and pouring gasoline on them at every opportunity. Whether the subject is national security, spending, taxes, energy, education, the judicial system--right down the list, he is pursuing a socialist, godless, government-instead-of-God agenda that is the antithesis of American ideals. Parker should be scared out of her wits, and probably is, but keeps believing everything will be all right if she just rejects all those stupid religious people and writes to get the approval of the enlightened intellectuals.

The secret is (shhhhh) heat lamps. I have a battery of solar powered heat lamps on the Yankee side of my yard. I have carefully calculated the heat transfer required to melt the advancing face at a nominal rate of 3/4 inch per year, and solar panels over half of my yard should provide adequate power, even at the efficiency of current panels. Of course, this will ruin my lawn underneath, but i'm getting sick and tired of mowing the SOB anyway. As backup, my wife has promised to lend me her hair dryer should my calculations be slightly awry. But what about the bears? I plan to goout on the approaching glacier with another heat lamp and melt a big hole in the ice, which i will surround with black-eyed peas. When a polar bear comes up to take a pea, i will kick him in the ice hole.

These intellectually-challenged TH commenters want you to toss them red meat. They want you to write about how inspiration Dick Cheney is, or what a blowhard Al Gore is. Scrutinizing Obama's birth certificate is a valid topic here. There is no such thing as torture so long as americans do the waterboarding and head-smashing (if the vietnamese or japanese do it, it's a different story). Jesus inspired the U.S. Constitution. -- See? -- Stick to easy, non-controversial topics. TOWNHALL READERSHIP IS NOT UP FOR INTELLECTUAL CHALLENGE. Serve them up the same old warmed-over leftovers in new packages. Do not provoke.

And do NOT bring up the fact that out of 111 Supreme Court Justices so far, 107 of them have been caucasian males. This is okay! This is traditional. There is no discrimination in continuing to select white males over equally qualified minorities. TH is comfortable with white males. TH feels unease with outspoken latin females.

Will, if you think this young lady is rational, then keep on with your outcome-determined, Sotomayer apologia campaign. Statistics are fine for straightforward endeavors like sports. But here we are talking about court cases where a number does not reveal the judicial thought or the motives of the judicial clerks working for the judge, and so on. Is it just a coincidence that your argument is also appearing on huff post and Atlantic Monthly blogs?

We spent $787bn on a stimulus.

We spent another $1.6tn on the budget for the first 6 months of this year.

Our national debt service will be $1tn a year beginning in 2019.

Social Security will be bankrupt in 2016.

Medicare and Medicaid will be bankrupt in 2017.

We are supposed to pay for college tuition and benefits for those 50% of taxpayers that only pay 2.3% in federal taxes.

Tax revenues were down 30% last month alone.

Unemployment is 8.9%.

China has indicated that is does not want to loan us any more money, which will result in debt monetization like the failed Weimar Government and Mugabe's Zimbabwe (a depression with hyperinflation).

Just for the record. The Supreme Court has overturned 40% of her rulings since she became a federal Judge. She does not think white males can make proper decisions which makes her predjudiced. She is far to the left thinking that law should be made from the bench. The courts duty is to enforce and defend the law not make it. There oath is to defend the Constitution not twist it. When they make rulings in violation of the Constitution they have commited treason. This woman should be removed from the federal bench and never be allowed to serve as a Judge in this country

Posters like MahGrandma and Tammy are coming from indignation based on what's going on in their own minds. They attribute to others the same motivation they would have for doing the same thing. They see a hunter shoot a deer and attribute the act to bloodthirsty cruelty. They don't enjoy hunting and can imagine no other reason to shoot a deer than that. Likewise, they come out of no where and vent outrage not based on reality, but on the person they imagine you to be. I can't imagine someone decoding my secret message. I used the usual quota of grumpy grouchy prose, incoherent rambling syntax, and baffling mis-strikes. Then i ran the whole works through my Captain Midnight Decoder Ring, knowing only someone in our age group would recognize the hash. You don't suppose some young whipper snapper has put together software to do the decode job, do you? I wouldn't put it past a couple of my 8th graders.

Why is Kathleen Parker still writing for Townhall? I thought this was a site for conservative opinion. Ever since the candidacy of B. Obama, Ms. Parker has consistently tacked to the left in her columns and has done so again with her defense of Sotomayor. I believe Townhall should seriously consider asking Ms. Parker to move on -- say, to the Huffington site.

Are you so incapable of applying the same standards to every candidate for the Supreme Court across the board that you give this Sotamayor a pass? Last time I checked, words mean things. When appointing one of only nine lifetime appointments to a position on the U.S. Supreme Court, the candidates "words" should weigh more heavily than someone competing in the Miss America contest. Your willingness to accept Sotamaor's racist comments as meaningless is breathtaking. Your article could have been posted in the "Nation" and gotten accolades, but certainly shouldn't be taken seriously by anyone who takes their country's future seriously.

Fight injustice with injustice
If one sees a class of people as being different under the law they do not belong on the court. Unless the purpose of the law is to right the injustices of the past with new injustices.


The representatives of our country being the cowards have passed on making law and leave the courts to decide major issues. Therefore a question of whether a jurist sees their appointment as being one of righting the wrongs of the past and has some preconceived idea of what wrongs need resolution may have a bearing on the candidates fitness.

The idea that empathy has a place in decisions on the court should be a major issue for the pundant class. I feel sorry for the plight of group "A" so I shall make judgements in laws which will apply to an entire population?

To use Mr. Obama's logic wouldn't it be right to overturn Roe V. Wade because doctors are being murdered because others believe strongly that abortion is murder? Have you no empathy Mr. President?

And that's why I went into that in my opening statement. Because when a case comes before me involving, let's say, someone who is an immigrant -- and we get an awful lot of immigration cases and naturalization cases -- I can't help but think of my own ancestors, because it wasn't that long ago when they were in that position.

And so it's my job to apply the law. It's not my job to change the law or to bend the law to achieve any result.

But when I look at those cases, I have to say to myself, and I do say to myself, "You know, this could be your grandfather, this could be your grandmother. They were not citizens at one time, and they were people who came to this country."

When I have cases involving children, I can't help but think of my own children and think about my children being treated in the way that children may be treated in the case that's before me.

And that goes down the line. When I get a case about discrimination, I have to think about people in my own family who suffered discrimination because of their ethnic background or because of religion or because of gender. And I do take that into account. When I have a case involving someone who's been subjected to discrimination because of disability, I have to think of people who I've known and admire very greatly who've had disabilities, and I've watched them struggle to overcome the barriers that society puts up often just because it doesn't think of what it's doing -- the barriers that it puts up to them.

To say an individual will not take empathy into account is to ignore humanity.

To say empathy is NECESSARY because one comes from a particular group is to ignore the personnal bias of that individual based on preceived injustice their class.

Mr. Obama seems to have said he wants people who will right the wrongs towards women and minorities.

I expect you do not see it this way but is there no empathy for those of us who do?

I don't know about you but when a candidate for the Supreme Court is a member of any racist group, that's an automatic disqualifier, regardless of accomplishments, gender, or race they are.

Sotamayor is a member of LA RAZA, the latin equivalent of the White Supremisists. Their motto is "for the race, everything, for the rest, nothing". All members of LA RAZA need is the pointy white (or brown) hats.

John Kerry wants to nationalize the media.

The mega-banks have been, effectively, nationalized.

You will get a choice in healthcare and it will be #1) UK style or #2) Canadian, which is a failure in both. And, it will cost you $10tn over the next 10 years.

The national debt will be $23.9tn in TEN YEARS.

Unemployment will continue to rise.

Hyperinflation will come.

Energy costs will skyrocket.

North Korea moved an ICBM by train to its northeastern area, which would put it in striking distance of Alaska.

You will be denied your choice in cars.


Even Obama has said (a little while ago) that your miserable existence will be a sacrifice for generations to come.

because you are wrong when assessing me. I
grew up in a community where most people owned
a gun and rarely used one. Guns were for
killing the varmits who were raiding the
garden or the occasional attacking dog or
possum. During hunting season, they went
hunting - and the little women back home put
the kill into the freezer after properly
treating it.

This is a very long way from the gun advocates
today. The serious gun lovers today are the
ones who are the most dangerous. They have
these paranoid fantasies that the enemy is at
their door and that enemy is the illegals, or
the Muslims, or our own government, depending
on just how crazy they are. I know crime
exists and I know that I was growing up in my
tiny town the biggest crime was shoplifting
by the teens and hotrodding down the street
after midnight. Life in the big city is tougher. Self-protection can be a necessity
in some neighborhoods. But that simply
does not explain the obsession today. And
that is what scares me. Never have I suggested that we should not be able to own
guns. I have a real big problem, however,
with being allowed to bring them into schools,
grocery stores, and other public places.

I've never been there cause I don't fly, but have always been fascinated with Russia. Modern day crime novels, if well written, have an abundance of info about Moscow and environs. Those who seek to have over-reaching government in the U.S. would do well to read up on what's going on in Russia in recent years. Not a pretty picture. If you have ever read how I got my name, you would know that St. Denis (pronounced san-deni) is a family name. I also have three other French surnames, which were bestowed upon me at birth. Two end in the letter "x".

Further, I was born on Mardi Gras Day. The nurses placed a plastic tiara on my head before presenting me to my mother. Silly nurses! Plastics tiaras serve no purpose when Zulu coconuts are falling.

I read this piece of trash on the airplane Monday and had made a mental note to sign on and add my voice to the chorus urging the Parker Problem finally be removed from Town Hall. The reason? Just read this.

Parker was good (well semi-OK) once but the marriage is over. We want a divorce! Her bags are packed and we changed the locks.

Click! She is out on the curb wondering where she will go now.

The Parker Problem's apparently considers a seat on the Supreme Court of no more consequence than the title of Miss California. Even Miss California holds more defendable views than the Parker Problem.

The rank amateurish unserious nature of this column proves this overrated has-been does not belong among such esteemed, authentic, contemporary conservatives such as Jonah Goldberg Mona Charen, Linda Chavez, Ann Coulter, Thomas Sowell and Michelle Malkin.
