The Sotomayor Debate Is a Chance to Talk It Out on Race

For decades, America's liberal establishment has been saying that what we need more than anything is a frank conversation about race. Well, here's another chance.

Ever since the Kerner Commission in 1967, we've been hearing how Americans need to air out their racial views. After the L.A. riots, Hurricane Katrina and every other racially loaded event, we heard this refrain. President Clinton launched an official national conversation on race, but he clammed up once conservatives started talking frankly and winning the argument.

During the presidential contest last year, Barack Obama delivered his now-mythic "race speech." It was hailed everywhere as the beginning of that long overdue conversation. Rep. Barbara Lee (D-Calif.), chairwoman of the Congressional Black Caucus, said the address "set forth a road map on how to look at race within the context of public policy." But then Obama tried his best to never mention race again during the campaign.

Attorney General Eric Holder used Black History Month to deliver a racial jeremiad, accusing America of being a "nation of cowards" for not talking more honestly about race.

And now we have Sonia Sotomayor. It's been reported that Obama's Supreme Court pick has long been his first choice for the court. This suggests that the president is well aware of her views and that she personifies his views of how the courts should dispense justice.

Which brings us to Sotomayor's now-infamous line that she would hope a wise Latina would make better decisions than a wise white man. In the same speech, she somewhat favorably considered the possibility that there are "physiological or cultural differences" between races or genders that make some people better at some things (like judging) than others.

What is the president's response? To lead a nation of cowards.

Obama says he's sure Sotomayor would "restate" her views (which technically means she would repeat the same idea in different words). White House allies have carried this further, saying she "misspoke" (in the words of Democratic spinner Lanny Davis). The Washington Post reports her comments were "unscripted."

But this is flatly untrue. Sotomayor's comments were literally scripted -- for a lecture. She then published that speech in a law journal. It's apparent she meant what she said, and if a white judge ever said anything similar, his career would be over. And, as former federal prosecutor Andrew McCarthy notes, any typical citizen who said anything of the sort would be dismissed from a jury pool.

It may go too far to call her a racist -- not necessarily because she doesn't fit the technical definition, but because she doesn't fit the popular, emotional definition of one. She's not an evil bigot, which is what the word "racist" colloquially suggests.

So maybe we can call her a "racialist." She certainly doesn't seem to believe in official colorblindness. Just ask Frank Ricci, the fireman denied a promotion simply because he's white. He sought justice in her court, but Sotomayor couldn't muster the requisite empathy to give him a fair hearing.

There's a lot more to Sotomayor's views on race that seems worth talking about, and her record is far from indefensible. In many ways, she's a perfectly mainstream liberal jurist. All the more reason liberals should defend her positions openly, rather than dismiss or deny them.

Obama and the Democratic Party indisputably share the broad outlines of her approach to racial issues. But rather than calmly defend her, they hide behind the robes of the first Latina Supreme Court pick and shout "bigot" at anyone who fails to throw rose petals at her feet.

And that is pretty much what liberals always do when it comes to race. They invite everyone to a big, open-minded conversation, but the moment anyone disagrees with them, they shout "racist" and force the dissenters to figuratively don dunce caps and renounce their reactionary views. Then, when the furor dies down, they again offer up grave lamentations about the lack of "honest dialogue." It's a mixture of Kabuki dance and whack-a-mole.

The irony of the current brouhaha is that the roles are somewhat reversed. Conservatives are shouting "racist," and liberals are scrambling to explain themselves.

I'm willing to concede, happily, that liberals aren't cartoonish villains for believing that certain preferred minorities deserve special treatment under the law. Unfortunately, too many liberals are unwilling to offer the same courtesy in return.

So here's an idea. Let's assume both sides have a serious and well-intentioned perspective and talk it out. Now.

Judicial Racism
Nice try to soften the blow but a racist is someone who discriminates on the basis of race, which is what Sotomayor does. That she did so with the intention of causing financial harm and retarding the careers of the racial group she despises makes it worse. That she believes in her racial supremacy to the point of publicly boasting about it in print makes her a racist bigot.

That she believes in gender supremacy as well makes her a sexist bigot.

SCOTUS is no place for a racist and sexist bigot.

What's left to discuss? It's clear where Sotomayor stands on this issue - at least it would be if a white male had made similiar remarks.

But with Obama having spiritual advisors / mentors such as the racist Rev.Wright and the anti-semite Louis Farrakhan, a pick like Sotomaoyor makes perfect sense. She is another affirmitive action baby who hates white America and isn't afraid to use her position on the bench to further her agenda.

A racist Judge who believes in judical activism (kind of like a community organizer, except with judical overtones)is exactly the type of Judge Obama would seek on his first appointment.

Of course he gets the added bonus of pandering to hispanics, many of who have gone ga ga over Sotomayor simply because she is a hispanic. This will give obama more time to figure out how he's going to ram amnesty for some 20 million illegal aliens down the throats of hard working Americans, who want no part of such insanity.

In Obama's world, this pick makes perfect sense.

The Left has no interest in serious discussions about race.

Why?

Because negative aspects of minority cultures are always blamed on white people. If minorities couldn't charge white people with racism they would have to look in the mirror.

We might as well assume the earth is flat and the Sun revolves around us. We know that the leftists have no well-intentioned perspective! They need to be racists and to use racism to bash conservatives falsely in order to keep them (minorities) in their flock as if only the leftists care about them. All the while, their programs do nothing but perpetuate the rut the minorities are in.

The Right Has No Credibility on Race
This is really comical, the right with a history of racism has now found religion on racial equality.

The Republican party grew out of a backlash of the civil rights act which casued racists Democrates to go to the Republican Party (Jesse helms is one example). Remember Reagan's welfare queen or GH Bush and Willie Horton adds. Where was the outrage then?

A majority of Republicans voted for the Civil Rights Act of 1964. Southern democrats filibustered against it, and voted against it. If you saw the Willie Horton ad, there was no mention of his race. Most people didn't know he was black until Jesse Jackson told us so. The outrage should have been at JJ. What have the democrats done for blacks lately? They still have 60 percent illegitimate births. They still have higher unemployment than blacks. They are still forced (Except BHO's kids) to go to substandard schools. They still have all kinds of problems (I'm with Dr. Cosby, some of them are self-inflicted), and the Democrats have been in total power since January, and where has the money gone? Banks, Unions, Auto companies. Have your taxes been dropped? Mine hasn't. Have your children's debt been lowered? Hmmm? BTW, look at all the places where democrats are in total charge. Detroit, California (Schwartzenegger is a RINO),Washington DC, Michigan. All economic basket cases where whites and blacks are in a quagmire.
Don't tell me republicans and conservatives are to blame. We still want a color blind society. Do you? Or do you want to perpetuate through "affirmative action" the myth that you can't make it without being propped up by somebody else?

At least, now...
we old white guys know how to get out of jury duty. Just paraphrase Sotomayor: "I like to think an old white guy can make a better decision than someone who has not lived that life." Poof, you are outta there.

The left
doesn't want an honest discussion of race. They would lose...everything! They would lose at the ballot box. They would lose monetarily. They would not be allowed to exploit people for personal and political gain.

The left screams so loudly about racism and bigotry, because they are guilty of what they accuse.

We've got to stop changing the meaning..

Let's go back to the clear meaning of the language! Here's a perfect template of a racist belief:

An individual member of group A (regardless of victim status, by liberal definitions) suggests that she, based entirely on her membership in group A, will do better at task X than a corresponding member of group B. It matters not at all which specific group is represented by A or B, or what task X might be. This is an example of blatant racism/sexism!

We cannot shrink from identifying evil as evil.

You are a history revisionist. You simply rework "facts" to fit your perspective. It is dishonest, and it is unbecoming. Why can't you realize that neither side is perfect, and it is high time we have an honest dialogue?

Or is that not what you really want? I am tired of the left. They do not want a dialogue; they want to shriek out their beliefs and that is it. They want to throw the word racist around like a hand grenade. They do not want an honest discussion because then something would be expected from them, and that is not what they want.

The left reminds me of my own children (one pre-teen and three teen-agers). To them, honest discussion means telling them what they want to hear. I am yelling (even if I do not raise my voice) if I tell them anything they do not want to hear. I am a mean mother if they do not get the results they want....

It is the same with the left only much more shrill, and the language is more incindiary.

In favor of partial birth abortion being legal.

The rich are not taxed enough.

Tax cuts will not stimulate the economy.

Racial quotas in hiring and college admissions.

We should take waterboarding off table as an option for interrogation.

A bigger gov't is a great thing.

We should take the nuclear threat off the table as an option for defending ourselves.

We can talk Iran into peace w/Israel.

That health care is a right and the gov't will do a much better job of providing access to health care for everyone.

Man made global warming is destroying the Earth.

He believes all of these things BUT Conservatives voted against him because he's black......OKAY!

You should have ample reading-- enough to see you through to Labor Day, if not Thanksgiving. The MSM indulged in an orgy of lies, calumnies and character assasination. You will probably feel that you need a shower after reading some of these disgusting diatribes!

Being a racist doesn't mean Judge Sotomayer is a bad person. It just means she is a racist.

Its how she acts on her racists beliefs that we should give us concern.

FRANK DISCUSSION ON RACE
Impossible to have these days. Any truths spoken result in hysterical, angry responses. Which one of the famous Crick/Watson DNA duo commented upon IQ differences in different groups, and was fired in England fairly recently? Double standard??? All the time. But the pendulum having swung too far to the left, will always swing back. It's basic physics...and human nature.

Does she really believe she is better than a white man? What makes her to say that?

Is it because she thinks Puerto Ricans have brought the mankind a lot of wisdom through their philosophers? Famous scientists, medical doctors, engineers, artists and writers?

Does she really want to compare her race to the race of white people with the richest culture in the history of the world?

We can examine 2000 years starting with ancient Rome and move through middle ages, Renaissance and industrial Revolution, to developed capitalism of our time. Can anyone name a famous Puerto Rican on the same scale as Archimedes, Leonardo, Copernicus, Dante, Goethe, Pasteur or Tolstoy?

The point is that all these people above belong to all of us, Puerto Ricans included. And justice should be equal to all of us, again Puerto Ricans included.

Then and only then our justice system will be respected and trusted. Otherwise, how a white man can trust Puerto Rican judge and vice versa?

Justice Clarence Thomas was treated just as badly or worse. I watched the hearings every day on C-Span.Thomas and Bork. The Democrats verbally crucified them both.

I never heard anyone say the Democrats would alienate minorities if they turned on Thomas and it never hurt them,because Thomas was conservative.

Double standards,bias and hypocrisy...that is the Democrat trademarks.

Too bloody right! The Thomas confirmation hearings were every bit as nasty, if not moreso because of the racial element, as the Bork ones, although, thank goodness, the outcome was diferent.

I must confess to being of two minds about "Borking" Sotomayor. On the one hand I find the practice of "Borking" absolutely repugnant. On the other hand, the woman MUST BE STOPPED, regardless of any personal qualms on my part!

Liberal Disenchantment
As usual, Jonah is on the mark with his assessment. It becomes incredibly more frustrating to deal with a group of people that either do not think that you are paying attention or who are so blinded by there own ambition, that they do not realize they contradict themselves constantly. The whole process of vetting and interrogating the possible justices has been more of a circus for as far back as I can remember (okay, maybe not that far). Joe Biden, and so many other liberals, like Teddy Kennedy, display their irreverence and ignorance almost every time we go through this process. They demand to answers to questions that they themselves would deem unfair, and then jump around interrupting the nominee as if they were on trial for pedophilia. " He without sin cast the first stone", is a thought that comes to mind when this occurs. The bottom line here is that the Democrats do not respect anyone, including themselves. Their whole platform is based on an ideology that preys on young adults, minorities, the fearful elderly, and all of those who favor voter fraud. I have never heard them stand up once with a logical argument as to why they believe what they do, and why it will work. The discussion always ends up that the questioner must not know the facts. Democrats think that they cannot be wrong ,only misunderstood. Thats just fine, the future Justice Sotomayor will be very understanding should they ever have to come before court...God help us.

Sotomayor simply stated the obvious.
Judges render judgements.

Faced with issues that involve racial conflicts, a judge needs to resolve those conflicts. That's what happened in the Firefighter case. Actually, the lower court resolved the conflict and she merely upheld their decision along with the other appellate judges. If this was racism, she's certainly not alone.

It is also true that, faced with a conflict that involved alleged mistreatment of minorities, including 'mistreated' minority women, it is entirely plausible that a wise latina woman could reach a better conclusion than a wise white male, just as the white male might reach a better conclusion in other cases.

If all legal issues could be resolved entirely by 'the book', without the need for judges rendering judgement, we could replace the supreme court with a fairly simple computer program.

Baloney!!! And the sad thing is
you don't believe that it will get talked out at all. It never does and never will because it takes two sides with open minds to talk it out. Worthless column.
